The following non-voting members were present: Thomas D. Ippolito, Daniel S. Braese, and Michael P. Liporto. Upon a motion by Joseph D. LaGrasse and 2nd by Richard J. Byers, the Board voted to GRANT the applicant's request to WITHDRAW WITHOUT PREJUDICE the Special Permit from Section 4, Paragraphs 4.122.14.A.b, 4.122.14.D, and Section 10, Paragraph 10.31 in order to construct a new two family dwelling on the proposed Lot C2. The proposed single family dwelling's footprint shall be constructed per the revised Plan of Land showing the proposed driveway on the left side of the single-family dwelling as viewed from the street and to the west of the Green Hill Avenue intersection with Great Oak Street. 5. The approved single-family structure shall be the design and scale as submitted at the April 14, 2009 meeting, which the Board finds said petition is substantially similar and an appropriate fit within the neighborhood of said petition. To the extent the applicant modifies or alters the aforementioned design referenced as above Building Plans, then the applicant shall and must resubmit new design plans to the Board for approval prior to the issuance of a building permit. 6. Prior to the issuance of any Certificate of Occupancy, the applicant shall demonstrate to the Board and or its designee that it has mitigated any and all water drainage and or run off flowing on or to abutting properties. Applicants duty to mitigate may include but is not limited to: preparing and supplying engineered drainage plans as determined by the Board and or its designee, to the extent required, thereby demonstrating to the Board and or its designee compliance as to this condition. 7. Prior to the issuance of a Certificate of Occupancy applicant shall demonstrate to the Board or its Designee, it has provided appropriate landscaping to delineate and screen abutting properties as required by the Board and or its Designee thereby ensuring said petition is in keeping with the substantially similar and an appropriate fit of the neighborhood of said petition. Voting in favor of the Variance request: Joseph D. LaGrasse, Richard J. Byers, Albert P. Manzi, III, and Richard M. Vaillancourt. Voting against the Variance request: Ellen P. McIntyre. The Board finds that owing to circumstances relating to the shape and location of the existing 254 Greene Street dwelling, which is listed in the 2007 North Andover Historical Commission's List of 100 Year-old Structures, on the existing lot especially affects 254 Greene Street (Map 22, Parcel 51) and the existing structure but does not affect generally the Residential 4 zoning district in which it is located. The Board finds that a literal enforcement of the provisions of Paragraph 7.1 & Table 2 and Section 10, paragraph 10.4 would involve substantial hardship, financial or otherwise, to the petitioner. The Board finds that Fredrick Soucy, 6 Green Hill Avenue, stated he had seen the proposed revised Plan of Land and proposed single family dwelling and had no objections to the revisions. There were no written or spoken opposition to the revised lot lines for proposed construction of a single family dwelling on the revised Lot C2 Great Oak Street. The Board finds that lots in the Waverley Road, Massachusetts Avenue, Greene Street, Linden Avenue, Great Oak Street and Green Hill Avenue area vary between 6,000 and 24,000 square feet with most lots less than the required 12,500 per North Andover Tax Maps 22 and 22.
