Bahrawy Attorney At Law P. O. Box 455 55 Main St. North Andover, MA 01845 Dear Attorney Bahrawy: 27 Charles Street North Andover, Massachusetts 01845 2000 Fax(978)688-9542 Upon review of your letter dated June 22,2000 and speed note dated July 6,2000 the following items have been observed. 1) The lots in question are under sized. The R-4 District requires 12,500 square feet of area and 100 feet of frontage. 2) The plot plans should be submitted with proposed structures and show 2 parking spaces per dwelling unit. 3) Be advised that the R4 District also requires 30 foot front and rear setbacks and 15 foot side setbacks. Upon receipt of the proposed plot plans showing the above information a zoning denial form can be written so as to expedite the process to get the applicant to the Board of Appeals for the hearing. If I may be of further assistance please do not hesitate to contact me between the hours of 8:30 — 10:00 AM and 1:00 — 2:00 PM at 688-9545. Andover, MA 01845 Dear Sir/Madam: (' OCT 10 2000 IROARD OF _k PEALS Enclosed is a copy of a notice I recently received pertaining to proposed land use in North Adams, MA. Please be advised that Guilford Transportation Industries, Inc. manages real estate matters for several corporations. This response is sent on behalf of the following corporations in reply to your notice which was received on October 4, 2000: ° Boston and Maine Corporation; ° Maine Central Railroad Company; ° Portland Terminal Company; ° Springfield Terminal Railway Company; ° Hudson River Estates, Inc.; ° Delaware River Estates, Inc.; or ° DH Estates, Inc. (formerly Delaware and Hudson Railroad). As you may well be aware, the railroads listed above receive numerous notices on a daily basis. Based upon the limited time frame existing between the date on which the notice is received and the scheduled hearing date, I respectfully request your cooperation regarding this matter. Although the railroads are concerned with each and every notice, there are certain instances which are of particular concern to the railroads. You may be able to advise me if the petition involves land plans showing a crossing of railroad property. Specifically the railroads' concern exists even in the event that your petitioner indicates that it is the holder of a valid railroad crossing. Also, the railroads must be advised if the petition proposes any development within 25't from the centerline of an existing railroad track, even if such development occurs on non -railroad property. As such, petitions for variances from set back requirements can be particularly troublesome. City of North Andover, MA Planning Board October 4, 2000 Page Two Please be advised that this letter should not be construed as a waiver of any other objections which the railroads may have to a proponent's plan. However, the railroads respectfully request your assistance in bringing their attention to any such matters. Thank you for your anticipated cooperation in this regard. Sincerely, Roland L.
