This meeting was attended by you, Ms. Michele Grant, Health Inspector and Susan Sawyer, Health Director. The meeting was held in response to food safety issues of concern resulting from a complaint received at the Health Office and the conditions found on site. You are the current owner or operator and are responsible for attention to these matters. The Administrative Hearing process is an informal meeting where we sit down and discuss the problems identified and work towards compliance. The hearing is held when conditions are such that the health and safety of the public are endangered, or when violations are of a repeated nature. This hearing is the last stop before future violations are brought directly to the Board of Health. Discussion items: 1. Violations to the Food Service Permit. a. Did not notify the Health Dept. when change in service was considered b. Did not comply with direction from the Health Dept. regarding adding Food Safety Certified Food Handlers 2. Violations to the food code regarding food handling. a. Did not remove potentially hazardous foods from a unit that was not holding temperature properly. b. Did not demonstrate adequate knowledge.on safe food handling. 3. Violation to the direct request for training and certification Outcome: 1. Permit holder must submit missing specification sheets for additional equipment proposed 3. Submit new menu 4. Complete food safety training and allergen training 5. Comply with allergen requirements on signage 6. Utilize equipment temperature logs provided or create a log for your establishment. Keep 30 days on site for review by Health Inspector 7. Keep temperature logs for potentially hazardous foods. Keep minimum of 30 days of logs for review by Health Inspector. Please submit all requested information by Tuesday, November 12, 2013 or the issue will be placed on the agenda for the next Board of Health meeting for discussion. At the Board meeting, the members would consider whether a suspension of the permit to operate a food establishment is warranted and if so, for what period of time. Thank you for your effort and cooperation. Your establishment will continue to be monitored and inspected twice annually in compliance with the MA Food Code. In addition, for year 2014, you will be scheduled for a third inspection in response to the concerns. It was determined that the food items where running in the danger zone, at temperatures of approx. 70 degrees. The North Andover Health Department did a walkthrough of the establishment on November 1, 2013 in an effort to assist the owner of corrective action items as well as items that may need to be brought up to code. At that time, Imad Massabni and Samer Biloune were verbally issued a "Stop Order" on prepared foods until further notice, and to throw away all food that was in the danger zone from the previous day. The walkthrough determined the overall condition of the establishment to be in good condition; however it was found that your establishment was selling food items that require proper equipment to be within the kitchen. It was found that the previous layout of the establishment had been changed and equipment was removed that is needed to sell these prepared foods. Back in December 2012, the Health Department was made aware that Raceway had changed ownership (formerly Race Way Gas Station) and you were now the new owners. At that time, you were in violation since you did not submit a Food Plan Review application for a new business and you were running the establishment without the proper permits. The Health Department worked with you and had you submit the proper applications and fees (received on 12/6/12). It was only at that time that you were issued a dumpster and food permit. Since the Food Plan Review was not submitted, the Health Department was not aware that the layout of the establishment had changed along with sinks being removed. You have stated that the establishment was that way when you took over. Since there are major changes, the Health Department requested that you submit a Food Plan Review application. The Health Department received your Food Plan Review application on November 12, 2013. Unfortunately, we are unable to approve the application until further questions are answered (see attached list). A simple response of how you will address each item along with any missing information needs to be completed. Until this issue has been rectified, we will continue to ask that no food will be sold in that area. It is important that the health office ensure compliance to the food code and provide safe food to the public.
