MassDEP's approval is a formal permit, based on review of an Application for Non -Traditional Asbestos Abatement Work Practice Approval (BWP AQ 36). DLS's approval is obtained by contacting that agency (see end of the Permit Fact Sheet for contact information). The situations for which MassDEP may issue a Non -Traditional Asbestos Abatement Work Practice Approval are: ■ When demolition of a facility is done under an order issued by a state or local government agency because the facility is structurally unsound and in danger of imminent collapse; ■ Where Asbestos -Containing Material (ACM) or Asbestos -Containing Waste Material (ACWM) was not accessible for testing and was, therefore, not discovered until after demolition began and, as a result of the demolition, the material cannot be safely removed; ■ Where asbestos abatement activity is conducted as part of an emergency renovation operation; ■ Where asbestos abatement activity is conducted to clean up and decontaminate a facility or portion of a facility as a result of: o asbestos abatement activities not conducted in compliance with 310 CMR 7.15, or o ACM deterioration that, if not immediately attended to, presents a safety or public health hazard; ■ For a facility that is being renovated, where wetting would unavoidably damage equipment or present a safety hazard; or ■ For bulk loading of ACM and/or ACWM. The MassDEP Application for Non -Traditional Asbestos Abatement Work Practice Approval Form (BWP AQ 36) must be submitted to the appropriate MassDEP regional office (see page 9 for contact information). MassDEP's Asbestos Regulation (310 CMR 7.15) defines key terms: "Asbestos" means all asbestiform varieties of serpentinite (chrysotile), riebeckite (crocidolite), cummingtonite-grunerite (amosite), anthophyllite, actinolite, and tremolite, and any other asbestiform minerals designated as asbestos by the U.S. Environmental Protection Agency (EPA) in 40 CFR 61.141. "Asbestos Abatement Activity" means the removal, encapsulation, demolition, renovation, enclosure, repair, disturbance, handling, transportation, storage or disposal of asbestos - containing material or asbestos -containing waste material, or any other activity involving asbestos -containing material or asbestos -containing waste material that has the potential to result in a condition of air pollution. This definition does not include survey, sampling, analysis, monitoring, or visual inspection activities. "Asbestos -Containing Material" (ACM) means any material containing 1 % or more asbestos as determined by a laboratory using protocols set forth in the "Method for the Determination of Asbestos in Bulk Building Materials" found in EPA report EPA/600/R-93/116, or another method as directed by the Department. This term includes, but is not limited to, sprayed -on and troweled -on materials applied to ceilings, walls, and other surfaces; insulation on pipes, boilers, tanks, ducts, and other equipment, structural and non-structural members; tiles; asphalt roofing or siding materials; or asbestos -containing paper. "Asbestos -Containing Waste Material" (ACWM) means any ACM removed during a demolition or renovation project and anything contaminated with asbestos in the course of a demolition or renovation project including, but not limited to, asbestos waste from control devices, bags, or containers that previously contained asbestos, contaminated clothing, materials used to enclose the work area during the demolition or renovation operation, and demolition or renovation debris. This definition also includes ACM on and/or in facility components that are inoperable or have been taken out of service and any ACM that is damaged or deteriorated to the point where it is no longer attached as originally applied or is no longer serving the intended purpose for which it was originally installed. "Facility" means any dumping ground, or any installation, structure, building establishment or ship, and associated equipment. 2. What are "prescribed work practices"? The "Specific Asbestos Abatement Work Practice Standards" section of the MassDEP's Asbestos Regulation (310 CMR 7.15 (7)) prescribes work practices that must be implemented when conducting an asbestos abatement project to prevent the release of asbestos fibers that could cause or contribute to a condition of air pollution. These include requirements for preparing and isolating the work area; covering floor, ceiling and wall surfaces as well as objects that cannot be moved away; decontaminating equipment that is used during the abatement; ventilating the work area so as to prevent fibers from migrating outside of this area; and specific requirements for 11/14 • Instructions for Non -Traditional Asbestos Abatement Work Practice Approval • Page 3 of 12 Massachusetts Department of Environmental Protection Application for a Non -Traditional Asbestos Abatement Work Practice Approval, BWP AQ 36 Instructions and Supporting Materials removal and cleanup. 3. What are "Non -Traditional Asbestos Abatement Work Practices"? These are practices that are different from the specific work practices prescribed in the Asbestos Regulation and that are needed to address situations in which the prescribed practices cannot be implemented safely (e.g., before demolition of a fire -damaged building; or in areas near high- voltage electrical equipment and other situations where wetting would be dangerous). Before these Non -Traditional Asbestos Abatement Work Practices are implemented, MassDEP must be persuaded that they will: • Not result in the discharge of visible emissions of asbestos to the outside air, Keep ACM and ACWM adequately wet (where appropriate) until it is placed and sealed into containers for transport to a disposal facility, Comply with all other applicable requirements of 310 CMR 7.15, and Be consistent with the requirements of applicable federal, state, and local laws and regulations. 4. Who may apply for a Non -Traditional Asbestos Abatement Work Practice Approval? Applications may be submitted by the owner, operator (e.g., property manager), DLS-licensed asbestos abatement contractor, or DLS-certified project designer for a specific facility or facility component. An Approval will be issued to the person who filed the application and that person must provide copies to all parties involved. Please note that a Non -Traditional Asbestos Abatement Work Practice Approval is a permit that applies to a specific facility or facility component, and cannot be transferred to other parties. 5. Is there a specific Application form? Yes. The application must be submitted using MassDEP's "Application for Non -Traditional Asbestos Abatement Work Practice Approval" form (BWP AQ 36), and it must be accompanied by a written proposal for specific non-traditional asbestos abatement work practices prepared by a DLS- certified Asbestos Abatement Project Designer. All sections of the application form must be completed (incomplete forms will be returned by MassDEP). The proposal must include the following information: • A description of the need and justification for each requirement of 310 CMR 7.15 for which a deviation is sought, • A description of each non-traditional work practice proposed, and • A demonstration that the deviation(s) from 310 CMR 7.15 and the proposed non-traditional work practice(s) will not cause any visible emissions of asbestos to the outside air, and will not pose significant risk to public health, safety, or the environment, and • Any additional information requested by the MassDEP Attachment 1 to this Permit Fact Sheet contains a list of specific information that must be submitted with each Application for Non -Traditional Asbestos Abatement Work Practice Approval. 11/14 • Instructions for Non -Traditional Asbestos Abatement Work Practice Approval • Page 4 of 12 Massachusetts Department of Environmental Protection Application for a Non -Traditional Asbestos Abatement Work Practice Approval, BWP AQ 36 Instructions and Supporting Materials The Application for Non -Traditional Asbestos Abatement Work Practice Approval Form and Instructions are available on MassDEP's website at http://www. mass.gov/eea/agencies/massdep/air/programs/asbestos. htmI 6. How do I submit the Application for Non -Traditional Asbestos Abatement Work Practice Approval Form? Two steps are required to submit your Application for Non -Traditional Asbestos Abatement Work Practice Form: 1. Send the original Form and proposal to the Asbestos Program in the appropriate MassDEP regional office (see contact information at the end of this fact sheet for email and postal addresses). This submittal may be made by regular, certified or U.S. Postal Service Express mail. If you are seeking approval for non-traditional asbestos abatement work practices to address an emergency or time -sensitive situation, you may email a scanned version of the BWP AQ 36 Form and the accompanying proposal to the appropriate MassDEP regional office. Emailed submittals will need to be followed by mailing a paper copy of the signed BWP AQ 36 form to the MassDEP regional office, so that MassDEP has the original signature of the project proponent on file. 2. You must also send a copy of the BWP AQ 36 application form and a $600 check for the filing fee (if the fee is applicable) to: MassDEP P.O. Box 4062 Boston, MA 02211 Checks are picked up from this P.O. box every working day and entries are made in MassDEP's data management system when each check is cleared by the bank. Please note: Private delivery services cannot deliver to the P.O. Box. If you are sending the BWP AQ 36 Application for a Non -Traditional Asbestos Abatement Work Practice Approval Form via private or overnight delivery service, please send it and the associated fee (via check or money order made out to the "Commonwealth of Massachusetts") for $600.00 to: Massachusetts Department of Environmental Protection One Winter Street Boston, MA 02108-4747 Please be aware that MassDEP will return your submittal it if it is found to be incomplete. What is the permit application fee for a Non -Traditional Asbestos Abatement Work Practice Approval? The permit application fee required by MassDEP regulation (310 CMR 4.00, Timely Action and Fee Provisions) for a Non -Traditional Asbestos Abatement Work Practice Approval is $600. However, cities, towns, counties, districts of the Commonwealth, federally recognized Indian tribe housing authorities, the Massachusetts Bay Transportation Authority (MBTA), and municipal housing authorities are not subject to permit application fees. 8. What are MassDEP's timelines for reviewing applications for Non -Traditional Asbestos Abatement Work Practice Approvals? Once the BWP AQ 36 Form and proposal are received by the MassDEP regional office, it will be reviewed to determine whether it is administratively and technically complete. If the application is complete, MassDEP will issue an approval or denial within 10 working days of receipt of the application (and will strive to issue approvals or denials for emergency situations within two business days of receipt). If additional information is required, the applicant will be notified and will be asked to submit the missing information within 30 calendar days. Where the applicant responds to the deficiencies in the original application within 30 calendar days of being notified of deficiencies, MassDEP will conduct a second review, and will issue an approval or denial to the submitter within 10 calendar days of receiving the additional information. 9. Is the permit application fee refundable? If MassDEP does not complete its review of your Application for Non -Traditional Asbestos Abatement Work Practice Approval within 10 calendar days of receipt of a complete application, MassDEP will return your fee and issue an approval or denial of your application. Your fee will not be refunded if MassDEP denies the application within the 10 -day review window, or if you decide not to implement the proposed non-traditional asbestos abatement work practice. 10. Do I need to file a notification for my asbestos abatement once I have a Non -Traditional Asbestos Abatement Work Practice Approval? If you have obtained a Non -Traditional Asbestos Abatement Work Practice Approval from MassDEP, you must file an ANF -001 form for the abatement work to be undertaken (this filing can be done by using a -DEP). When you complete the ANF -001 form, please put the MassDEP approval number for your Non -Traditional Asbestos Abatement Work Practice Approval and the date on which the approval was obtained in the ANF Pre -form if filing through eDEP, or in response to Question 5 in Section A if filing by paper. 11/14 • Instructions for Non -Traditional Asbestos Abatement Work Practice Approval • Page 6 of 12 Massachusetts Department of Environmental Protection Application for a Non -Traditional Asbestos Abatement Work Practice Approval, BWP AQ 36 Instructions and Supporting Materials 11. Where can I find DLS License and Certification Numbers for my asbestos abatement Project Designer/Contractor? The DLS License Number for your Asbestos Contractor and the Certification Number for your Project Designer need to be typed into your answers to Section B of the BWP AQ 36 Form. Your Asbestos Contractor and Project Designer should supply this information to you. DLS publishes a list of licensed asbestos abatement contractors and their license numbers on the DLS website. (See contact information below.) 12. When can I start work? Work cannot begin until you have received MassDEP's approval of your Application for Non - Traditional Asbestos Abatement Work Practice Approval, and you have filed a notification (via an ANF -001 Form at least 10 calendar days in advance of the scheduled start of your abatement). If your Non -Traditional Asbestos Abatement Work Practice Approval will address emergency conditions, you may obtain an emergency waiver of the 10 -day notification period from the appropriate MassDEP regional office (this may be issued by phone at the same time you receive a conditional authorization to proceed with the Non -Traditional Asbestos Abatement Work Practices). See Question #16 in the Permit Fact Sheet for the ANF -001 for more information about emergency waivers: http://www.mass.gov/eea/agencies/massdep/service/approvals/bwp-ag-04-anf-001.html . Please note that you must start work on the "start date" you indicate on the ANF -001. If you are not going to start on that date, you must revise your notification prior to the original start date indicated, and pay a $35 fee for filing the revision if your project is subject to this fee. 13. Can I file an Application for Non -Traditional Asbestos Abatement Work Practice Approval for a facility other than a building? An Application for Non -Traditional Asbestos Abatement Work Practice Approval must specify the facility and location where the asbestos abatement work will be done. However, the definition of "facility" in 310 CMR 7.15(1) includes "any installation" or "associated equipment", not just buildings. For example, in the case of an electric utility, the "facility" might be identified as a specific set of interconnected structures (e.g. manholes, utility poles, etc.) and equipment (e.g. substations) within a contiguous service area network. 14. Can I revise my Non -Traditional Asbestos Abatement Work Practice Approval? It is possible that unforeseen conditions may result in the need to modify approved Non -Traditional Work Practices. If modifications are needed, you will need to submit a written modification request to the appropriate MassDEP regional office. The revised Non -Traditional Work Practices cannot be used at the facility until your request has been approved by MassDEP. 11114 • Instructions for Non -Traditional Asbestos Abatement Work Practice Approval • Page 7 of 12 Massachusetts Department of Environmental Protection Application for a Non -Traditional Asbestos Abatement Work Practice Approval, BWP AQ 36 Instructions and Supporting Materials 15. How long does a Non -Traditional Asbestos Abatement Work Practice Approval remain in effect? Your proposal should indicate the time period in which you will implement your non-traditional asbestos abatement work practices, and the approval will cover this time period. Your approval will be valid for the time period you specify in your application, but in no case will it run for more than one calendar year. 16. What can I do to avoid the most common mistakes in submitting an Application for Non - Traditional Asbestos Abatement Work Practice Approval? a. Fill in all information required on the BWP AQ 36 Form accurately and completely, and have the form signed by an authorized person. This signed form needs to be submitted to the appropriate MassDEP regional office (see question #6). b. Make sure that the accompanying written proposal has been developed by a DLS-certified Asbestos Abatement Project Designer, and includes all of the applicable information listed in Attachment 1. c. Make sure that you send a check for the fee (as applicable) with a copy of the BWP AQ 36 Form to MassDEP Boston office (see Question # 7 above). d. If you have any questions completing the form, call MassDEP (see contact information at the end of this Permit Fact Sheet). 17. Where can I get copies of the regulations that apply to the Commonwealth's asbestos program? These regulations include, but are not limited to: a. MassDEP: • Asbestos Regulations, 310 CMR 7.00, including 7.09 and 7.15. • Asbestos Disposal Regulations, 310 CMR 19.061 • Massachusetts Contingency Plan waste site cleanup regulations, 310 CMR 40.0000. • Timely Action and Fee Provisions, 310 CMR 4.00. • Administrative Penalties Regulations, 310 CMR 5.00. Polito Martin Suuberg Lieutenant Governor Commissioner PERMIT FACT SHEET: ASBESTOS BLANKET NOTIFICATION APPLICATION Introduction The Massachusetts Department of Environmental Protection (MassDEP) approves two types of Asbestos Blanket Notifications on a case-by-case basis: An Incidental Maintenance Blanket Notification Approval is designed for facilities that contain significant amount of asbestos containing material and routinely encounter situations where asbestos must be abated immediately without being able to wait for the 10 day advance notification period required by the MassDEP asbestos regulations (310 CMR 7.15). Please note that incidental maintenance projects involving the removal or disturbance of 100 square feet or less of asbestos -containing floor tile and related asbestos - containing mastics and/or 32 square feet or less of asbestos -containing gypsum wallboard and or joint compound are exempt from notification as per amendments of 310 CMR 7.15 that were promulgated on June 20, 2014, but in these cases, specific work practices must be implemented to keep non -friable material from becoming friable and to prevent releases of asbestos fibers to the environment. • A Large Scale Asbestos Abatement Project (LSAAP) Approval is designed for planned abatement projects that involve the removal of significant quantities of asbestos containing materials over an extended period of time and can provide more flexibility in scheduling and sequencing of the work. Both types of Asbestos Blanket Notification Approvals are facility -specific, and can be issued for time periods of up tol2 months. They can be renewed by submitting a new application. Approvals are issued by the MassDEP region that covers the municipality in which the facility is located, and are frequently issued for a calendar year. If your Blanket Notification Permit Application is approved, you will receive a Blanket Notification Permit Project Approval number from the MassDEP Regional Office. You will need this number for each Asbestos Notification Form that you will submit for each job conducted under the blanket. D. You will need to submit an ANF 001 form for each job completed under the Blanket Notification Approval. ANF 001 forms should be submitted online via eDEP, where the $100.00 notification fee can be paid by credit card. ANF 001 forms may also be downloaded from MassDEP's web site and submitted on paper. If you submit your ANF 001 form online via eDEP, check the second box on the ANF 001 "pre -form" and enter the Blanket Permit Project Approval number in the associated box. This number will then automatically appear to answer question 4 in Section A of the ANF 001 form. If you submit your ANF 001 form on paper, you will need to enter your Blanket Permit Project Approval number to respond to question 4 in section A of the form. Negative air pressure was established in the work area relative to adjacent spaces using High Efficiency Particulate Air (HEPA) filter equipped air filtration devices (AFDs). During abatement activities, access to the work area was limited to authorized personnel only, who entered the containment area utilizing appropriate personal protective equipment (PPE) and, before exiting, followed the required decontamination procedures. Removal of asbestos -containing materials (ACM) was performed using wet methods. This involved spraying ACM with water or a solution of water and wetting agent that assisted in penetrating and saturating the ACM. After all ACM were removed, complete cleaning of the abatement area was accomplished. This included scrubbing abated surfaces with brushes or abrasive pads, wet washing all substrates and other surfaces, and wet vacuuming accumulated debris and contaminated water. The cassettes were tilted downward at a 45° angle and placed between three and four feet above the floor. Air was drawn through the cassettes via the use of high-volume sampling pumps. Immediately before and after the sampling periods, the sampling flow rates were calibrated using a precision rotameter. The samples were analyzed on-site by phase contrast microscopy (PCM) in accordance with National Institute of Occupational Safety and Health (NIOSH) 7400 Method, A counting rules. SWA utilized the Olympus optical microscope at 400x magnification to analyze the samples. What is the notification fee for asbestos removal? The notification fee required by MassDEP regulations (310 CMR 4.00, Timely Action and Fee Provisions) for asbestos removal is $100 per notification. However, owner -occupied residential properties with four or fewer units, cities, towns, counties, districts of the Commonwealth, federally recognized Indian tribe housing authorities or municipal housing authorities or other state agencies are not subject to asbestos notification fees. 6. Is the asbestos notification fee refundable? No. In the event that an asbestos notification is withdrawn, the notification fee will not be refunded. 7. Where can I find DLS License and Certification Numbers for my asbestos contractor, on-site supervisor/foreman, project monitor, and asbestos analytical lab? These DLS License and Certification numbers need to be typed into your answers to Questions 6-9 in Section A of the ANF -001. Your Asbestos Contractor (who must be identified in your answer to Question 6 in Section A) should supply this information to you. DLS publishes lists of licensed asbestos contractors and Asbestos Analytical Service Providers/Labs at: http://www.mass.gov/lwd/labor-standards/asbestos-safety/license-lists/ (please note that these lists are updated approximately every month and may not contain recently issued license or certification numbers, and also may not reflect recent renewals of licenses and certifications). 8. What are MassDEP's and DLS's timelines for reviewing notifications? After the Asbestos Notification Form ANF -001 is recorded in the eDEP notification system, the form can be reviewed by both the MassDEP and DLS. The notifier will be contacted only when the submitted notification form is found to be deficient. When either MassDEP or DLS informs the notifier of deficiencies in the notification form, the notifier may not proceed with the asbestos work for which notification was made and will have 30 calendar days from the date of being informed of the deficiencies in which to respond. Where the notifier responds to the deficiencies in the original notification form within the 30 -day period, a second administrative/technical completeness review may be conducted by either agency within the respective 10 working day notification period. The result of the second review will.be: • a determination that the notification is administratively and technically complete, or • an order to not proceed with the job. The notifier will be contacted only in the case in which an order is issued to not proceed with the job. Should the notifier wish to pursue asbestos removal on the same site after a stop order has been issued, a new Asbestos Notification Form ANF -001 and new notification fee for the job must be submitted to MassDEP. 9. When can I start work? Work cannot begin until the 10 working days waiting period specified by MassDEP's regulation has elapsed. Starting an asbestos abatement project before the end of the 10 -working day waiting period is a violation of the asbestos regulations and may result in enforcement action, including a civil administrative penalty. If you cannot wait 10 working days before starting an asbestos project, you must obtain an emergency waiver of the 10 -day notification requirement from MassDEP and DLS before starting work (see Question #12 below). MassDEP's eDEP system uploads each electronic notification to an "Asbestos Project Lookup" at http://public.dei3.state.ma.us/Asbestos/asbestos.aspx, which is refreshed every 15 minutes. When you use the Asbestos Project Lookup to check the status of your notification, please search for it based on the project's municipality and street address. LlMassachusetts Department of Environmental Protection ll� Asbestos Notification Form ANF -001 Instructions and Supporting Materials When completing the ANF -001 it is important to identify the date on which you plan to start the asbestos removal project. Please note that you must start work on the "start date" you indicate on the ANF -001. If you are not going to start on that date, you must revise your notification prior to the original start date indicated. 10. Can I revise my Asbestos Notification Form? Yes. If you plan to change the original start date or completion date indicated in the ANF -001 you have filed, you MUST file a notification revision. There is a $35 fee for each notification revision. You must ensure that your notification revision is received by MassDEP at least one working day prior to the original start date or completion date being changed. Failure to revise your notification should your start date or completion date change is a violation of MassDEP's asbestos regulations and may result in enforcement actions, including a civil administrative penalty. If you are revising your ANF -001 Form to correct deficiencies that MassDEP has identified, please note that your corrected form must be received by MassDEP no later than 30 days after you were notified of the deficiencies. If you want to submit a corrected form more than 30 days after you were notified of deficiencies, you will need to submit a new ANF -001 form and pay a new notification fee. Note: Some project changes cannot be made using this revision procedure and require the submission of a new notification and fee. See Question #11 below. 11. What project changes require a new asbestos notification and new notification fee? A new Asbestos Notification Form and payment of a new notification fee is required when any amount of asbestos -containing material above the estimate on the original notification form is planned, and when there is a change in location from that indicated on the original notification form. A new notification is also required when an asbestos removal project is postponed more than 30 days from the start date or end date appearing on the original notification form. Finally, a separate notification is required when asbestos removals are scheduled for a single facility but are separated by more than 1 week (e.g., phased implementation with more than 1 week between phases). 12. What if I need an emergency waiver from the 10 working -day notification requirement? Both MassDEP and DLS may jointly provide authorization for an emergency waiver of the 10 working -day notification requirement. To obtain an emergency waiver, you will need to first contact the MassDEP regional office that covers the municipality in which an asbestos abatement project is located to determine whether an emergency waiver is warranted (see contact information at the end of these Instructions). Where deemed appropriate, MassDEP will issue an emergency waiver number, which can then be used to notify DLS using their online electronic emergency waiver system. Once a MassDEP emergency waiver number has been assigned, an asbestos contractor can request a waiver of the DLS requirement for a 10 -day notification period for EMERGENCY PROJECTS by filling out the online request form located on the DLS home page at http://www.mass.gov/lwd/labor-standards/ or click directly on http://ewr.detma.org/. All requests must be submitted no later than within one working day after the project start date. Fill in all required information and click on SUBMIT. You will instantly receive a confirmation number, followed by an email which contains a printable version of the form. If both MassDEP and DLS grant an emergency waiver, the contractor or other entity may proceed with the work. Please recall however that notification on Form ANF -001 and the fee still must be submitted for the specific project (as described in Question #'s 4 and 5) within one working day of beginning the asbestos abatement activity for which the emergency waiver was granted. When completing the ANF -001, please supply the emergency waiver numbers given by each agency in Section A, Part 17 of the Form. Failure to file the notification with fee payment in a timely manner may result in enforcement actions. An asbestos notification remains in effect only until the project end date specified in the Asbestos Notification Form ANF -001 or in a revised ANF -001. 14. Do I have to notify other governmental agencies? You may be required to notify the city or town in which the asbestos abatement project is located. Contact local officials (Board of Health and/or Building Department) to determine what notification they require for asbestos removal. Submitting a complete ANF -001 satisfies notification requirements for state and federal agencies. MassDEP has been delegated by the U.S. Environmental Protection Agency (EPA) to receive notifications required under Federal regulations (NESHAP, 40 CFR Subpart M). Submission of the ANF -001 to MassDEP satisfies EPA asbestos demolition or renovation activity notification requirements. 15. What is a Blanket Notification Approval? The Blanket Notification Approval provides flexibility in the 10 -working day wait period when multiple ANF -001 Notifications are anticipated on a project. A Blanket Notification Approval may be considered under two scenarios: 1) an "Incidental Maintenance Blanket Notification" is designed for facilities where ACM is routinely encountered and where it must be abated immediately without being able to wait for the 10 working -day advance notification period; or 2) a Large Scale Asbestos Abatement Project for planned abatement projects that involve the removal of significant quantities of ACM over an extended period of time, and can provide more flexibility in scheduling and sequencing of the work. What is a Traditional Asbestos Abatement Work Practice Approval? Both MassDEP and DLS issue case-by-case approvals for deviations from the prescribed work practices in their regulations to address situations in which the traditional practices cannot be safely implemented or are significantly impractical (e.g., emergencies involving structurally unsound buildings, fire -damaged structures, and some non -emergency situations such as abatements in areas in close proximity to high voltage electrical equipment and bulk loading of asbestos -contaminated debris). Work done under an NTWP approval must still be accompanied by an ANF -001 Notification for each abatement activity with referencing the relevant NTWP approval number. PERMIT FACT SHEET 1. What is an "asbestos abatement" and what rules govern this work? An asbestos abatement includes all the activities associated with the removal, encapsulation, demolition, renovation, enclosure, repair, disturbance, handling, transportation, storage, or disposal of asbestos - containing material or asbestos -containing waste material or any other activity involving asbestos -containing material or asbestos -containing waste material that has the potential to result in a condition of air pollution. This definition does not include survey, sampling, analysis, monitoring, or visual inspection activities. The Massachusetts Department of Environmental Protection (MassDEP) Asbestos Regulation at 310 CMR 7.15 governs asbestos abatement activities and defines the following key terms: • "Asbestos" means all asbestiform varieties of serpentinite (chrysotile), riebeckite (crocidolite), cummingtonite-grunerite (amosite), anthophyllite, actinolite and tremolite, and any other asbestiform minerals designated as asbestos by EPA in 40 CFR 61.141. "Asbestos -Containing Material" (ACM) means any material containing 1% or more asbestos.as determined by a laboratory using protocols set forth in the "Method for the Determination of Asbestos in Bulk Building Materials" found in EPA report EPA/600/R-93/116, or another method as directed by the Department. This term includes, but is not limited to, sprayed -on and troweled -on materials applied to ceilings, walls, and other surfaces; insulation on pipes, boilers, tanks, ducts, and other equipment, structural and non-structural members; tiles; asphalt roofing or siding materials; or asbestos -containing paper. "Asbestos -Containing Waste Material" means any ACM removed during a demolition or renovation project and anything contaminated with asbestos in the course of a demolition or renovation project including, but not limited to, asbestos waste from control devices, bags or containers that previously contained asbestos, contaminated clothing, materials used to enclose the work area during the demolition or renovation operation, and demolition or renovation debris. This definition shall also include ACM on and/or in facility components that are inoperable or have been taken out of service and any ACM that is damaged or deteriorated to the point where it is no longer attached as originally applied or is no longer serving the intended purpose for which it was. originally installed. In addition to MassDEP's regulation at 310 CMR 7.15, the Department of Labor Standards (DLS) also establishes notification requirements and work practice standards at 453 CMR 6.00. The MassDEP and DLS regulations are designed to protect public health, worker safety, and the environment, by ensuring that asbestos will not be released to indoor and outdoor air during demolition or renovation work. The MassDEP also regulates the disposal of asbestos -containing waste material (ACWM). 2. What are the Commonwealth's notification requirements for asbestos removal? Submitting a notification form for asbestos abatement work is required by both MassDEP and DLS. Under 310 CMR 7.15, MassDEP requires notification 10 working days (working days do not include Saturdays, Sundays or holidays) before the start of work involving the removal of any amount of asbestos -containing material. Under 453 CMR 6.12, DLS requires notification 10 calendar days before any work involving the abatement (removal, encapsulation or enclosure) of asbestos in amounts greater than three square feet or three linear feet. Who must notify? A notification form must be filed for each asbestos abatement activity in Massachusetts. MassDEP allows the notification to be filed by the property owner or operator, the licensed asbestos abatement contractor, or another entity performing the asbestos abatement. For DLS notification purposes, the licensed asbestos abatement contractor is required to notify. 4. How do I submit the ANF -001 notification form and fee? Notification must be made on a current version of MassDEP's Asbestos Notification Form (ANF -001), which satisfies the requirements of both MassDEP and DLS regulations. Step 1 If you have not already done so, register online with eDEP at https://edep.dep.mass.gov/DEPLogin.asox. Select "New User" and complete the required steps. It should take no more than five minutes to complete the registration process, and you can begin online filing of your notifications right away. Step 2 The eDEP Asbestos Notification Form and Instructions are available on MassDEP's website at http://www.mass.gov/eea/agencies/massdep/air/programs/asbestos.html. Step 3 When filing via eDEP, you will pay the fee online using a credit card. Please note that "fee decals" will no longer be sold and cannot be used with online filing through eDEP. Step 4 When filing electronically through eDEP, your 10 -working day waiting period will start when you submit your form, and you will receive an automatic notification that the submittal was recorded. Troubleshooting If you get an error message after you click "Error Check & Next" at the end of the form that says "License # is not recognized", please check to make sure you typed the DLS License and Certification Numbers for the asbestos contractor, on-site supervisor/foreman, project monitor, and asbestos analytical lab number correctly. (Please note: Only fill-in the fields for the DLS license/certification #'s for questions 6 — 9 in Section A of the form. The fields with the corresponding names and addresses will be pre -populated when you click "Error Check & Next".) If the project does not require the use of a DLS-licensed asbestos contractor, then simply check off the appropriate boxes on the BWP AQ04 (ANF -001) PreForm and when you click "Error Check & Next", it will automatically pre -populate the asbestos contractor and asbestos supervisor fields (i.e. questions 6 and 7) to reflect work by a "Non Licensed Removal".
