HomeMy WebLinkAbout1975-03-10Monday - March ~0, 1975 Regular Meeting The Board of Appeals held its regular monthly meeting c~ M~nday evening, March ~0, ~975, at 7:30 P.M. in the Town Office Meeting Room. ~he following members were present and voting: Alfred E. Frizelle, Acting Chairman; William N. Salemme, Dr. Eugene A. ~eliveau, Clerk; and Asso. Member, James D. Noble, ART~R S. FUNDE~IAN: Petition to permit a garage and enclosed porch on ~he kitchen siAe of the house. Mr. Salemme made a motien to accept the petition and gr~nt the Yar~ance as recfaested. Mr. Noble seconded the motion. Dr. ~eliveau stated that he didtt see a~y gre~t harm in granting this V~riance but it is n~t a good precedent to set. He said he would vote for it inasmuch as it is located out in the country, but this could create a problem if it happened in town due to the buildings being located so much to one corner. Mr. Frizelle noted that there ~as considerable distance from ~tudeklia~'s house to the next lot line. Mr. Frizelle stated tha-~, for the record, the four members who s~t c~ the publi~ tiearing are present ~nd the vote must be unanimous. The vote w~s then taken and all members voted unanimously. Arty. John J. Willis, Jr. w~e present representing Robert ~tson. Mr. Watson was also present. Mr. Willis described what is being done to date on the site and noted the operating section' of the pit on the plan. Some rough grading has been started, the front are~ has been leveled and some loam has been spread. Mr. Wa%sen has dug and is in the process of enlarging a stump hole to bury boulders and stumps. He is alee in the process of negotiating with Lynnfield Because they want rip rap material for a reservoir and, therefore, would like to leave the boulders where they are right now until such time as ~ymnfield comes up with a decision. By July ~s~ he is to grade and seed the ~-k area and put in some trees. He will seed and put pine trees in %he front area and the stumps will be clea~ed up and in stump hole by I~bor Day. He ~ants to keep the rest of the area open as of now Because it is either being worked on or has not be touched. Mr. ~izelle asked about Mr. ~tson's financial status ihasmuch as there h~i been ~ome question about this in the recent past. Mr. Watson said that has been cleared up and that the property is owned by his wife. The application should be made out in her name. The fact that the permit expired in February was an oversight on their p~rt, said Mr. Willis, and ~ant to thank the B0_A~D for estending them the 30 days. Mr. ~rizelle mentioned that the origir~l permit was ussued in ~96~ and Watson requests a renewal of an existing permit. The conditions of the original permit were read which states that it is renewable without a public hearing upon submission of a report from the ~uilding Inspector. The Building Inspector said th&t he feels the operation is proceeding smoothly and is not offensive to ~he eye. Member Frizelle cfue~ied how ~ acrea were presently being operated and Mr. Watson answered, in the vicinity of 20 acres including the poud. S~narles Foster asked how ma~y acres will be restored this s,,mmer and Mr. ~tson replie~, ~0. He has to keep 50 f~. away from the access road and 75 ft- away from the brook and the three ponds are eventually going to Be all one. One pond is 22 ft. deep at its deepest point. ~is plans are to build up the road between the ponds and Boston Brook. Mr. Foster reported that he h~d been out there ~wice within the last two weeks. He would like to see %he plan governing %his permit made more explicit so that the areas that Mr. Watson has to Nmrch 1~ 1975 - cont. improve are sho~n on the map with their boundmrieso Now is the time to ~et mo~e definite inform~tion~ because if there was ever to be development there in the f~ture we would want to pinpoint everything e~actly. Mr. Watson should be made aware ttmt we are going to m~_ke more inspections and probably will be more problems with this 'wi'th the implementa- tion 'of the new by-law. We need to h~ve some parts of the site definitely restored as quickly as possible. Mr. ~rizelle asked to have something %o indicate what has been done and what is planned to be done and also some sort of time Sable as to when the operation will be completed. Mr. Watson said it would Be 2 years. Mr. Foster recommende~d that they hold the lo~m there until it is restored. Mr. Foster said, als6, there would be problems applying the new by-law to mn existing permit. Mr. Watson said the boulders would be con- rained in one specific ~rea. Mr. Frizelle preferred going to view the area and asked if there was any objection to continuing the permit until the ne~ hearing? It was felt that it would be a hard~hip at this time if they could not continue to haul out. There was no objection by the BOARD to allow them to have an operation until the next meeti~ date of April 14, 1975. It was decided that the BOARD Would view the site on Saturday, April l~h, at 9 A.N. Dr. Beliveau stated that they ought to have the map ready for that morning in order that the BOARD members could see e~ctly what is going to be done. It was stated by Hr. Wa%eon that, in the end, the only access will be ~he A~ Site Rd. and Mr. Willis ,added that these are not really ro~ds, But paths. The secretary was dire=ted to send Mr. Willis a letter advising of the cont'inuance until April 14th. The BOARD consensus was to officially advise the 0on. 0°m' of ~heir decision and attach a copy of the brief. The BOARD will mttend the hearing. The Em~h Remora/ By-Law proposal contains a provision that attempts to apply it to existing permits. Mr. ~rizelle~s 'opinion was that you cannot impose the new conditions on an em/sting permit. The BOARD should not be faced with making these decisiens and perhaps we should advise the Planning Bomrd of our concern.
