ADJOURNMENT Communications And Announcements Approval of Minutes BOARD OF SELECTMEN MINUTES JULY 21, 2014 CALL TO ORDER: Chairman Richard Vaillancourt called the meeting to order at 7:00 PM at Town Hall Meeting Room. ATTENDANCE: The following were present: Chairman Richard Vaillancourt, Clerk William Gordon, Rosemary Smedile, Donald Stewart, Town Manager Andrew Maylor, and Assistant Town Manager Ray Santilli. Please note: Licensing Chairman Tracy Watson was absent. PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES: William Gordon made a MOTION, seconded by Tracy Watson, to approve the Open Session Minutes of June 9, 2014 as written and June 23, 2014 as written. Vote approved 4-0_; COMMUNICATIONS ANNOUNCEMENTS AND PUBLIC COMMENT: Certificate of Appreciation— Martha Larson The Board recognized Martha Larson for her 17 years of service as a member of the Stevens Estate Board of Trustees. Signing of September Primary Election Warrant and Election Update-Town Clerk Joyce Bradshaw Town Clerk Joyce Bradshaw asked the Board of sign the September Primary Election Warrant. The last day to register for the primary is August 20, 2014; Chris Marshall, Borderline Running Club—Summary of 4'h of July Road Race Chris Marshall gave the Board a'summary of the race 1200 runners signed up but because of the inclement weather 800 runners actually participated. The net proceeds will go directly to the "Friends of the North Andover Senior Center" which was about$20,000. Borderline Running Club is looking forward to next year. Announcement from the Chair Congratulations to the director and staff of the Stevens Estate for another profitable year. This is the third year in a row that the Estate is shown a profit. An update on the Water and Sewer Enterprise,Funds that the Water rates would remain unchanged for another year. Congratulations to Public Works Director Bruce Thibodeau and Finance Director Lyne Savage. Thank you to the Lowell Five Bank and'Pentucket Bank for sponsoring the Fireworks that were displayed on July 12th. CONSENT ITEMS: Taking out of order Item J under consent items Request by Patriotic Observance Committee to install granite benches at Patriots Memorial Park Ted Tripp of the Patriotic Observance Committee asked the Board to approve the installation of two matching granite benches in Patriots Memorial Park, one on each side of the World War I Memorial. One of the benches will be dedicated in memory of Lieutenant Colonel Harold A. Dushame, Jr. The second bench will be engraved at a later date if or when the Town decides to dedicate it to a deserving individual. William Gordon made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen approves the request of the Patriotic Observance Committee to install two granite benches at Patriots Memorial Park. Vote approved 4-0. Board of Selectmen Minutes 2014 2 Acceptance of Donations for Summer Fun scholarships ($5,400) and for Summer Fun activities ($7,792.70) from Joseph N. Hermann Youth Center, Inc. to the Youth & Recreation Services The Joseph N. Hermann Youth Center, Inc. has for many years supported the activities and services provided by the Youth & Recreation Services Department. This donation totaling $13,192 is designated for Summer Fun scholarships and activities. William Gordon made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen accept the donations from the Joseph N. Hermann Youth Center, Inc. in the amount of$5,400 for Summer Fun scholarships and $7.792.70 for Summer Fun activities to the Youth & Recreation Services. Vote approved 4-0. Approximately 100-150 walkers are anticipated. All relevant Town Departments recommend approval. Request from Cynthia Lauwers to use Town Common on Sunday, August 17, 2014 from 8:00 p.m. to 9:00 p.m. for a candlelight memorial service Cynthia Lauwers is requesting to use the Town Common for a candlelight memorial service on Sunday, August 17, 2014 from 8:00 p.m. to 9:00 p.m. The candlelight memorial service is in honor of a former resident, Flo Tissandier. All relevant Town Departments recommend approval. Board of Selectmen Minutes 2014 3 Request to Dispose of Surplus Vehicles— Public Works Department Per the Town Policy regarding surplus vehicles, please see the memorandum in your packets from Public Works Director Bruce Thibodeau. Rosemary Smedile mad a MOTION, seconded by William Gordon that the Board of Selectmen approves the request of Public Works Director Bruce Thibodeau to dispose of surplus vehicles per his memo to the Town Manager dated July 7, 2014. Vote approved 4-0. Affordable Unit Resale 178 Cortland Drive, Unit 34 (Meetinghouse Commons) & 64 Ciderpress Way (Meetinghouse Commons) The Citizens' Housing and Planning Association (CHAPA) has notified the Town that the affordable housing units at 178 Cortland Drive, Unit 34 (Meetinghouse Commons) and 64 Ciderpress Way (Meetinghouse Commons) are up for sale. It is recommended the Board not exercise its right of first refusal. William Gordon made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen declines the right of first refusal to purchase the affordable housing unit at 178 Cortland Drive, Unit 34 and decline the right of first refusal to purchase the affordable housing unit at 64 Ciderpress Way (Meetinghouse Commons). Vote approved 4-0. Appointments to Cultural Council—Carmen Santiago and Helena Minton The Board's Appointments Subcommittee is recommending the appointments of Carmen Santiago and Helena Minton to the Cultural Council. William Gordon made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen appoints Carmen Santiago and Helena Minton to the Cultural Council for terms ending June 30, 2017. Vote approved 4-0. Approval of 5-year lease, with additional 5-year extension option, for 170-172 Sutton Street with North Andover Thrift Shop In May, the Town issued a Request for Proposals for 'Lease of Property' at 170-172 Sutton Street for the purposes of a non-profit thrift shop. Only one proposal from the North Andover Thrift Shop was received and evaluated. Per Town Meeting vote, any contract(or in this case, a lease) with a term exceeding three years requires the vote of at least four(4) members of the Board. Rosemary Smedile made a MOTION, seconded by William Gordon that the Board of Selectmen approves a 5- year lease, with an additional 5-year extension option, for 170-172 Sutton Street with North Andover Thrift Shop. Vote approved 4-0. Granting of Easement to Massachusetts Electric Company at 566 Main Street, North Andover As part of the construction of the new School Department Administration Building, Massachusetts Electric Company (d/b/a National Grid) is seeking an easement from the Town for the right to install, own, operate, and properly maintain equipment on the property in order to provide electrical service to the building. Rosemary Smedile made a MOTION, seconded by William Gordon that the Board of Selectmen approves the granting of an easement to Massachusetts Electric Company at 566 Main Street, North Andover. LICENSING COMMISSIONERS: Rosemary Smedile made a MOTION, seconded by William Gordon, to open a meeting of the North Andover Licensing Commission and appoint Donald Stewart as acting Licensing Chairman in the absence of Tracy Watson. OLD BUSINESS: Signing testament of Approval of Preservation Restriction Agreement for the Captain Nathaniel Stevens House, 140 Academy Road, North Andover The Board signed the legal document as a result of their vote at their June 23rd meeting. NEW BUSINESS: Proposed Dog Park Locations For discussion purposes a preliminary analysis was prepared by the Engineering staff at Public Works for six (6) potential sites for a dog park. Five of the sites are as follows: Cyr 1, Cyr 2, Reynolds 1, Reynolds 2, and Stevens Estate 1, are adjacent to active playgrounds and athletic fields. The last one is located along the access road from Charles Street to the Greater Lawrence Sanitary District which is closer to the downtown area. After a discussion of the various sites, the Town Manager asked the Board if they wanted to pursue this and focus on a site. The Board indicated that they would like more information on the Charles Street site. The Town Manager will proceed with the Department of Public Works and the GLSD to move forward with this proposed site and provide an update at the Board's next meeting. Board of Selectmen Minutes 2014 5 Banners— Main Street There has been some initial discussion regarding hanging banners across Main Street at#136 and #133 in order to be able to announce various Town events. There was a discussion about installing anchors on poles that would anticipate the banners, an application form and permitting process for Town groups to advertise Town events. Selectmen spoke about problems that were experienced in the past. Selectmen directed the Town Manager to reach out to other cities and towns on how they install banners across busy streets and also get an idea of the application process and policies. No Action was taken. TOWN MANAGER'S REPORT: Appointment of Town Planner Town Manager Andrew Maylor announced the appointment of Matthew Egge as the Town Planner. Mr. Egge has a Bachelor's Degree in Urban Studies and Planning, and a Master's Degree of Planning. He will begin his employment with the Town on Monday, August 18th and be present at the Board's next meeting on August 20, 2014. Capital Protect Status Report Assistant Town Manager Ray Santilli gave a status summary of on-going capital projects such as the School Department Administration Building, Redevelopment of McEvoy Field, Stevens Estate, Water Treatment Plant HVAC/Roof Replacement, Schofield Mill Renovations, and Central Fire Station. Position/Vacancy Log Human Resources Director Cathy Darby provided a Job Posting/Vacancy Log Police Department Report A summary of June 2014 crime statistics was provided by Police Chief Paul Gallagher Fire Department Report A summary of June 2014 Activity Report was provided by Fire Chief Andrew Melnikas. Great Strides is a circular walk, which will be held throughout the United States on the week-end of Mayl6-17. In 2014, the Massachusetts/Rhode Island Chapter of the Cystic Fibrosis Foundation raised $1.8 million for CF research and patient care. The North Andover walk raised $107,000. We expect approximately 300 walkers. The registration, walk and clean-up will take place between 9 AM and 3 PM. The walk committee, headed by Kim and Joel Myerson and Kim and Rob Cheevers, handles logistics and will assure that the park is left in impeccable condition. Thank you for considering our request. Just a few notes where I'm at on some issues in North Andover. #1. I've some investigation into the Andover Street Speed Regulation #281 trying to figure out why none of the distances jived, and I've solved the mystery. After sifting through our archives of Survey and Layouts, I found out Mass.Ave., Osgood Street and a portion of Andover Street were all State Highways at one time, (pre-Route 125) and have since been "discontinued" and turned over to the Town of North Andover.So the portion of Andover Street from Route 125 heading eastbound for about 1400 feet(0.26 miles)is essentially"unzoned" and the Town Regulation (#281)takes over from there for the remainder to the junction of Johnson Street. (you can note the change in the composition of the pavement where these two sections meet). So I've rescinded Andover Street from Regulation 281 and produced the attached Regulation,which will be mailed to the Town Clerk for B.O.S. signatures,for the entire stretch of Andover Street under Town jurisdiction. I've also elongated the 25 MPH zone to begin prior to the curve just west of the Common area and intersection of Oak Avenue (limited sight distance)and Osgood Street, so the existing 25 MPH sign will need to be moved farther west. I would also recommend the Town consider replacing the sign reading"REDUCED SPEED AHEAD" (we don't use these any longer)with a W3-5 (25)sign which is in conformance with current standards (I think they are more effective in capturing the motorists' attention). SPEED LIMIT On to issue#2: I'm in the process of re-writing the Route 114 Regulation and correcting the errors contained in the original,so you may notice the signs/zones being adjusted in the near future (extending 40MPH zone through signals at Stop and Shop & Mill Road, & moving 30 MPH sign closer to Andover Street intersection). After meeting with DPW on Main Street we came up with two options: using existing utility poles or erecting a new pole just for banners (Memo attached). The use of existing utility poles is the most cost effective. In order to use existing utility poles our office contacted both National Grid (NGrid) and Verizon, co- owners of the utility poles on Main Street, for their approval. Each company stated that they have a policy when an organization is seeking to hang a banner from one of their poles. NGrid requires the applicant to sign a contract (attached) when a banner is proposed. The contract has certain requirements, including insurance and waivers of indemnity. NGrid also maintains certain restrictions when installing a banner. NGrid also requires applicants to seek permission from Verizon (pole co-owner). Verizon has an application (attached) process that is required to be completed in order to receive approval. Two alternatives were discussed: installing new poles and utilizing existing connections the Town has on utility poles. Only the engineering design and installation costs were discussed. Legal liability and authorization was to be researched by Curt. Alternative 1: new poles The installation of new stand-alone poles to support banners would be very costly and time consuming. A structural engineering firm would need to be retained to design poles and footings to withstand wind loads etc. and put together a bid package. Installing poles would be costly and problematic due to overhead wires and unknown buried obstructions. The work would need to be done by outside contractors. Alternative 2: use of existing utility poles This is the preferred alternative due to ease of implementation, less time delay, and cost to accomplish. The Town already has brackets for attachments to poles and they could be easily modified to accommodate cables across Main St. A structural engineering firm would still need to be retained but analysis and design would be limited to the review of the connections to poles, the cable materials, and height. Gallagher,Chief of Police DATE: August 4,2014 RE: July 2014 Crime Statistics Several Police Officers, including Bicycle Patrol Unit and Special Police Officers assisted with the 4th of July Road Race and July 3rd activities on the Common. The organizers of the road race, Borderline Running Club, reported a larger turnout than last year's race and there were no incidents. Storms forced the cancellation of the fireworks and 4th of July events on the Common. This information was conveyed to the public through Blackboard Connect,sign boards and social media. Collaboration between all of the departments and organizations involved in these events was integral to the success of the events. Due to heavy rains,the Lion's Club Circus had to change locations from the North Andover Middle School to Lawrence Airport, with little notice. The Police Department worked together with Lawrence Municipal Airport management, NAFD, NADPW and Lion's Club personnel to coordinate the change. Special Police Officers and Bicycle Patrol Officers were on hand for all four shows to assist with pedestrian and motor vehicle traffic safety. Lion's Club personnel reported a better than expected turnout for the event. The Bicycle Patrol Unit was assigned to additional patrols in the Weir Hill area,several strip mall locations and the downtown area.These Officers are able to cover a lot of area swiftly and can access areas not accessible by cruiser.The Officers were tasked with educating the public regarding several animal laws and drinking water supply regulations in the Weir Hill area,and enforcing these when necessary. Officers were dispatched to this location per department policy. Communications Officers confirmed with bank personnel that this was a robbery in progress and updated the responding Officers. The responding Officers took up tactical positions,according to department policy and recently completed roll call training. The suspect was quickly apprehended and all monies recovered. The successful conclusion to this incident was a direct result of good communication between dispatch,responding Officers and bank personnel and the training given to all Communication Officers, Police Officers and educating bank personnel on department policy and procedure regarding bank alarms. All involved officers were presented a letter of commendation for a job well done. During the month of July,we all experienced the Market Basket work stoppage in some way.I dealt with both sides of the dispute concerning the store in the North Andover Mall. Our concern was to keep the peace and protect citizens and assets,which we did without incident. All concerned acted in a professional manner. Our Officers,both in cruisers and bicycles,made their presence known. As you are aware,this month we had a situation at the Royal Crest Apartments. Officers and supervisors quickly responded to the scene to investigate what occurred. Initial responding Patrol Officers quickly secured the scene for Detectives who spent the entire day processing the scene and gathering witness j statements. Detectives also faced non-cooperation from both the victim and the involved party. Royal Crest responded by seeking an immediate eviction of the suspect. Our Officers assisted and testified in Housing court,in which the judge promptly issued an Immediate eviction. I spoke to Royal Crest management and arranged for an increase in police presence at the complex and stressed the cooperation aspect of our residents. We also utilized police details for two weekends. Austin Green is not the only area of property owned by the college that is available for construction.
