CALL TO ORDER: Chairman Rosemary Smedile called the meeting to order at 7:00 PM at Town Hall
Meeting Room.
ATTENDANCE: The following were present: Rosemary Smedile, Chairman; Richard Vaillancourt, Clerk;
William Gordon, Donald Stewart and Andrew Maylor, Town Manager and Ray Santilli, Assistant Town
Manager.
Note: Selectman Tracy Watson was absent.
PLEDGE OF ALLEGIANCE
COMMUNICATIONS, ANNOUNCEMENTS,AND PUBLIC COMMENT:
New Business Recognition
The Board of Selectmen presented TITLE Boxing Club, 137 Turnpike Street a Certificate of Appreciation
for locating their business in North Andover.
The Board of Selectmen presented Pazzo Gelato Cafe, 99 Turnpike Street a Certificate of Appreciation
for locating their business in North Andover.
Ian Burns, Eagle Scout Service Project
Ian Burns presented his Eagle Scout Service Project which is building bog bridges (pedestrian
boarkwalks)on the Osgood Hill Trail. Ian Burns received permission and a formal enforcement order
from the Conservation Commission in August. Ian had fundraisers to help with supplies to build the
bridges and he completed 70 feet of bog bridges on Columbus Day weekend. Ian said that he would be
willing to build additional bridges if he had additional funds from the town of other sources.
The owner of Pazzo Gelato offered to donate funds through his charity giving program for the month of
November.
Municipal Election Calendar for March 2014
Town Clerk Joyce Bradshaw provided an update regarding the March 2014 municipal election.
Rabbi Zalman Borenstein of Chabad of North Andover changing the use of the Town Common for a
Chanukah Menorah Ceremony from December 3 ra to December 2 na from 5:30—7:00 p.m.
This was previously approved at the Board's September 23rd meeting. Due to a conflict, Rabbi
Borenstein is changing the date of the Chanukah Menorah Ceremony to December 2, 2013.
CONSENT ITEMS:
Dog License Fees
Chapter 193 of the Acts of 2012, an Act further regulating Animal Control, has as one of its requirements
that"the license fee for a spayed or neutered dog shall be less than the license fee for an intact dog."
The Act also specifies that fees cannot be increased without Town Meeting approval. The Town's current
dog license fee is $20. In order to comply with the statutory requirements, Town Clerk Joyce Bradshaw is
recommending a license fee of$19 for spayed or neutered dogs and $20 for intact dogs.
William Gordon made a MOTION, seconded by Donald Stewart, that the Board of Selectmen approves
2014 dog license fees of$19 for spayed or neutered dogs and $20 for intact dogs. Vote approved 4-0.
North Andover Fields Committee recommends the transfer of$20,000 from New Fields Account to
Kittredge School Gym Addition project.
For the past three calendar years, the various youth sports organizations, as members of the North
Andover Fields Committee, have donated approximately$156,000 to the New Fields Account. With the

additional work being contemplated as part of the Kittredge School Gym Addition project, the Fields
Committee is requesting the Board of Selectmen approve transferring $20,000 previously accepted for
the New Fields Account to the gym addition project.
Richard Vaillancourt made a MOTION, seconded by Donald Stewart, that the Board of Selectmen
approves the recommendations of the North Andover Fields Committee to transfer$20,000 from the New
Fields Account to the Kittredge School Gym Addition project. Vote approved 4-0.
Petition to enforce the State Sanitary Code and for Appointment of a Receiver for 88-90 Saunders Street
The Board is asked to approve the filing of a court petition,jointly by the Massachusetts Attorney General
and the Town of North Andover, to enforce the State Sanitary Code and for the appointment of a
Receiver for the property located at 88-90 Saunders Street. This residential property is abandoned, has
numerous long-standing code violations, has been deemed unfit for human habitation, and poses a threat
of harm to the general public. Peter Moses is the owner of record of this property and has been
unresponsive to any and all formal communications.
William Gordon made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen approve
the filling of a petition,jointly with the Attorney General of the Commonwealth of Massachusetts, to
enforce the State Sanitary Code and for the appointment of a Receiver for the property located at 88-90
Saunders Street. Vote approved 4-0.
LICENSING COMMISSIONERS:
Donald Stewart made a MOTION, seconded by Richard Vallaincourt, to open a meeting of the North
Andover Licensing Commission. Vote approved 4-0.
Chairman Rosemary Smedile is stepping in as Licensing Chairman in Tracy Watson absence.
Greg Nolan of Joshua Donuts, LLC requests a Common Victualler License at 1018 Osgood Street
Donald Stewart made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen acting
as the Licensing Commissioners approves the application contingent of Fire Department approval of
Joshua Donuts, LLC at 1018 Osgood Street. Vote approved 4-0.
Kevin Jacques of Events Partners, LLC requests a One Day Wine & Malt License for a `Black Light Run'
Event on October 26, 2013 from 4:00 p.m. to 11:30 p.m. at 1600 Osgood Street
Donald Stewart made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen acting
as the Licensing Commissioners, hereby grant a one day wine and malt license to Events Partners, LLC
for a `Black Light Run' Event on October 26, 2013 from 4:00 p.m. to 11:30 p.m. at 1600 Osgood Street.
Vote approved 4-0.
Jennifer Konopisos of Merrimack College requests a One Day Wine & Malt License for a Homecoming
Cookout on October 26, 2013 from 11:30 a.m. to 5:00 p.m.
Donald Stewart made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen acting
as the Licensing Commissioners, hereby grant a one day wine and malt license to Jennifer Konopisos of
Merrimack College for a Homecoming Cookout on October 26, 2013 from 11:30 a.m. to 5:00 p.m. Vote
approved 4-0.
Michael of Smolak Farms requests a One Day Wine & Malt License for a Pumpkin Smashing Festival of
November 2, 2013 from 10:00 a.m. to 4:00 p.m. (with a rain date of November 3, 2013.
Donald Stewart made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen acting
as the Licensing Commissioners, hereby grant a one day wine and malt license to Smolak Farms for a
Pumpkin Smashing Festival of November 2, 2013 from 10:00 a.m. to 4:00 p.m. (with a rain date of
November 3, 2013. Vote approved 5-0.

Donald Stewart made a MOTION, seconded by William Gordon, to close a meeting of the North Andover
Licensing Commission. Vote approved 5-0.
TOWN MANAGER'S REPORT:
Capital Projects Status Report
The Town Manager provided s status summary of the on-going capital projects as well as a milestone
timeline through the end of January 2014. These status summaries will be provide on a monthly basis.
Report of Financial Conditions
The Town Manager briefed the Board of the financial status of the Town.
Police Department—September Crime Status
Police Chief Gallagher provided a Police Report and Crime Statistics for the month of September.
Fire Department—Activity Log
Fire Chief Melnikas provided a Fire Log Report for the month of September.
