CALL TO ORDER: Chairman William Gordon called the meeting to order at 7:00 PM at Town Hall
Meeting Room.
ATTENDANCE: The following were present: William F. Gordon Chairman; Richard Vaillancourt, Clerk;
Rosemary Smedile, Licensing Chairman; Donald Stewart, Tracy M.Watson, and Andrew Maylor, Town
Manager and Ray Santilli, Assistant Town Manager.
PLEDGE OF ALLEGIANCE
APPROVAL OF MINUTES:
Richard Valliancourt made a MOTION, seconded by Tracy Watson, to approve the Open Session Minutes
of October 1, 2012, as written. Vote approved 5-0.
Richard Valliancourt made a MOTION, seconded by Tracy Watson, to approve the Executive Session
Minutes of October 1, 2012 as written. Vote approved 5-0.
COMMUNICATIONS ANNOUNCEMENTS AND PUBLIC COMMENT:
New Business Recognition
The Board presented a Certificate of Appreciation to Thomas Licciardello and Crissy Licciardello Lippman
for relocating their business Licciardello Financial Services/Compass Capital'Corporation in the Town of
North Andover.
The Merrimack Valley Chamber of Commerce is hosting a debate for the 6th congressional District
Candidates Congressman John Tierney, former state Senate Minority Leader Richard Tisei and
Libertarian Daniel Fishman at North Andover High School on Wednesday, October 17, 2012.
In the honor of founding of the Andover's on October 24, 1645, the public is invited to explore the town's
most important historic site, the First Burying Ground, where the first church was located. Heritage
Sunday at the First Burying Ground, October 21;2012, from 1 PM,—3PM
The 2nd Annual 5K Knights Run will be held on Saturday, October 20, 2012, for all ages.
PUBLIC HEARING:
Personnel Policy Amendments
Tracy Watson made a MOTION, seconded by Richard Vaillancourt, to enter a Public Hearing to receive
comments on proposed amendments to the Personnel Policy affecting non-union personnel. Vote
approved 5-0.
The Town Manager Andrew Maylor and Human Resources Director Cathy Darby are recommending
proposed changes to the Personnel Policy effective October 15, 2012. This draft policy was circulated to
all non-union employees as part of an information communication process and to receive input of these
employees incorporated into the policy.
Some modifications fall into`two categories, substantive and grammatical/corrective. Substantive
changes relate to a change in benefits (non-economic) including the Termination Process and Additional
Hours. Grammatical/corrective changes include: Work schedule to reflect new hours of operation; all
references to Assistant Town Manager as Human Resources Director have been eliminated; all
references to MIS have been replaced with IT(Information Technology); all references to"handicap" have
been replaced with "disability"; the workers compensation language has been modified to reflect current
industry practices; "Department Director" has been replaced with "Department Head"; Eliminated
references to the Deputy Fire Chief.
None of these changes effect monetary compensation in any way.
The Board asked various questions on additional hours and compensatory time.

Rosemary Smedile made a MOTION, seconded by Tracy Watson, to close the Public Hearing to receive
comments on proposed amendments to the Personnel Policy affecting non-union personnel. Vote
approved 5-0.
Tracy Watson made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen approve
and accept the proposed amendments to the Personnel Policy affecting non-union personnel. Vote
approved 5-0.
CONSENT ITEMS:
Pay and Classification Plan for Exempt Employees
The Town Manager Andrew Maylor presented a new classification scale that allows one to see the
relative worth of non-union positions without specific regard to salary. The proposed scale incorporates
the more commonly used 'Min' to 'Max' range of 20%with 10% between grades. These proposed
changes would not result in any pay increases or decreases for any employee since they are simply
policy documents.
Richard Vaillancourt made a MOTION, seconded by Tracy Watson, that the North Andover Board of
Selectmen hereby approves the proposed pay and classification plan for all non-union employees
effective October 15, 2012. Vote approved 5-0.
Notice of Intention to Sell MGL. C61A Land— Map 62, Lot 160
This parcel of land is currently used for agricultural purposes and taxed under MGL c61 A. Per the
statute, the town "shall have, in the case of intended sale, a first refusal option to meet a bona fide offer to
purchase the land." It is recommended that the Board not exercise its right of first refusal.
Tracy Watson made a MOTION, seconded by Donald Stewart, that the North Andover Board of
Selectmen declines a first refusal option to purchase the parcel of land identified as Map 62, Lot 160.
Vote approved 5-0.
Affordable Housing Unit Resale—4 Harvest Drive, Unit 206
The Citizens' Housing and Planning Association (CHAPA) has notified the Town that the affordable
housing unit at 4 Harvest Drive, Unit 206 is up for sale. It is recommended the Board not exercise its right
of first refusal.
Tracy Watson made a MOTION, seconded by Donald Stewart, that the North Andover Board of
Selectmen declines the right of first refusal to purchase the affordable housing unit at 4 Harvest Drive,
Unit 206. Vote approved 5-0.
School Committee Remote Participation for November 1, 2012
This item was withdrawn from the agenda as it is no longer needed.
Appointments by the Board of Selectmen
Tracy Watson made a MOTION, seconded by Rosemary Smedile that the North Andover Board of
Selectmen appoints Denny Morganthal to the Zoning Board of Appeals as a full/associate member for a
term ending June 30, 2014. Vote approved 5-0.
Tracy Watson made a MOTION, seconded by Donald Stewart that the North Andover Board of Selectmen
appoints Kristen Hollenbeck to the Poet Laureate Committee for a term ending June 30, 2015. Vote
approved 5-0.
Tracy Watson made a MOTION, seconded by Donald Stewart that the Board of Selectmen appoints
Town Manager Andrew Maylor to the Greater Lawrence Sanitary District for a term ending June 30, 2015.
Vote approved 5-0.
FY14 Budget Policy Statement
In accordance with the Town Charter, Chapter 9-2-3, `on or before the first day of November of each year,
the Board of Selectmen, after consulting with the Town Manager, shall issue a policy statement relating to
the budget for the ensuing fiscal year. The statement shall establish the outer limits of possible budget
growth for the town.'

Town Manager Andrew Maylor said that the Board sets the objectives and strategic goals of the Policy
Statement, but the Fixed Cost Committee establishes the outer limits of the possible budget growth for
the town. Mr. Maylor suggested that the Board amend the last sentence in the future. The statement
shall establish the outer limits of possible budget growth for the town.' This can be amended on a warrant
article at town meeting with Charter change by a Home rule petition
The Budget Policy Statement Objectives and Strategic Goals include: Financial, Economic Development,
Neighborhood Enhancement, Community Development, Public Safety, and Governmental Philosophy.
Tracy Watson made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen
approves the FY14 Budget Policy Statement as presented. Vote approved 5-0.
FY14 Budget Calendar
The FY14 Budget Calendar presents the specific milestones in the FY14 budget process leading to the
2013 Annual Town Meeting. Depending on future developments, some of the dates may be modified.
Tracy Watson made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen
approves the FY14 Budget Calendar as presented. Vote approved 5-0.
2013 Annual Town Meeting
The Town Bylaws, §59-6 states, "Annual Town Meeting shall be held on the first Monday in May at 7:00
PM." MGL c39, §9 allows the Board to postpone an Annual Town Meeting to any weekday evening
Monday through Thursday at 7:00 PM until all articles in the warrant have been acted upon.
Tracy Watson made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen set the
date of 2013 Annual Town Meeting as Monday, May 6, 2013 at 7:00 PM. Vote approved 5-0.
Tracy Watson made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen, in j
accordance with MGL c39 §9, postpone the 2013 Annual Town Meeting to Tuesday, May 21, 2013 at
7:00 PM. Vote approved 5-0.
Installation of a Stop Sign on Saltonstall Road at Herrick Road
In an effort to further enhance the safety of the area behind the Thomson School the Police Department is
recommending installing a stop sign on Saltonstall Road at the intersection of Herrick Road.
Tracy Watson made a MOTION, seconded by Donald Stewart, that the Board of Selectmen approves the
installation of a stop sign on Saltonstall Road at the intersection of Herrick Road. Vote approved 5-0.
Request to Conduct Ceremony & Parade on Veteran's Day, November 11 2012
The North Andover Patriotic Observation Committee is requesting to conduct a ceremony and parade on
Veterans Day, November 11, 2012.
Richard Vaillancourt made a MOTION, seconded by Donald Stewart, that the Board of Selectmen
approves the request from the North Andover Patriotic Observation Committee to.conduct a ceremony
and parade on Veterans' Day, November 11, 2012. Vote approved 5-0.

Tracy Watson made a MOTION, seconded by Donald Stewart, to open a meeting of the North Andover
Licensing Commission. Vote approved 5-0.

Donald Stewart made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen acting
as the Licensing Commissioners, hereby approve the four one-day wine and malt and one-day all alcohol
licenses per M.G.L. chap. 138 sec. 14 to Merrimack College. Vote approved 5-0.
Donald Stewart made a MOTION, seconded by William Gordon, to close a meeting of the North Andover
Licensing Commission. Vote approved 5-0.
PUBLIC COMMENT:
School Committee members Brian Gross of 45 Settlers Ridge Road and Andrew McDevitt of 266 Barker
Street asked the Board to explain their position of remote participation in a Board meeting. Both men
sometimes cannot be at a School Committee meeting because they are traveling for their companies and
are seeking to attend a School Committee by remote technology.
The Board was not in favor of approving a request for remote participation because this would open the
door for all boards to continue in this practice. These requests would be taken on a case by case basis
and it would depend on the circumstances or if this was truly an emergency. There is a rule that states if
you participate remotely, it does not count as a quorum and you can note participate in a vote.
Town Manager Andrew Maylor suggested that they take this matter first before their School Committee
Board for discussion and work out a solution. Then come back to the Board of Selectmen at a future
meeting.
TOWN MANAGER'S REPORT:
Five-Year Financial Forecast Presentation
The Town Manager Andrew Maylor will be presenting a five-year financial forecast power point
presentation at the Board's meeting on November 19, 2012.
Route 125 Economic Development Study
The Town will be engaging the services of the University of Massachusetts—Amherst to conduct an
economic development study of Route 125. John Mullin, Dean of the Graduate School, will attend a
future meeting to discuss this project in more detail.
Job Posting/Vacancy Log
The Town Manager provided an updated job posting/vacancy log for the Board's review.
There were two employees who received promotions: James Halchak was promoted to IT Systems
Analyst and Donna Delaney was promoted to Outreach Worker/Assistant Director.

Understanding of the Project
The University of Massachusetts Center for Economic Development understands that the Town
of North Andover wishes to undertake an economic impact of the possible transformation of the State
Route 125 Corridor. As part of the project it wishes to determine the benefits of extending water,
sewer and fibre optic lines from Sutton Street to the City of Haverhill line. Moreover, the project
should examine the potential benefits from rezoning and the re-parcelization of properties.
Project Goals
• To provide examples where investment in infrastructure has stimulated economic
development.
• To determine the economic state of the Route 125 Corridor as it exists today by examining
assessor's data, land use and business data.
• To examine the town and regional master plans to determine how the corridor fits with the
stated objectives.
• To determine the economic benefits of extending utilities along the State Route 125
Corridor.
• To determine the economic benefits that could occur from re-zoning the corridor.
• To determine the economic benefits that could occur from re-parcelization.
• To prepare a report for the Town that would present alternatives to the present situation.
This report will focus upon the economic potential of the corridor.
• To present the findings before the Selectboard/Planning Board,
The Process
• The CED will start work as soon as the Planner approves this agreement.
• This fall, CED will research and analyze examples where communities have invested funds
for infrastructure for the purpose of economic development. The examples will have as
many characteristics of North Andover as possible.
• This fall, Dr.John R. Mullin will meet with the Selectboard in order to inform them of the
purpose, process and end product of the study.
• This fall, the Town Planner will form an advisory committee to provide insights into the
project. Beginning in January, this committee will meet monthly through May, 2013.
• Beginning in January a team of three professors will oversee the project. The work will be
undertaken by 3-5 graduate students who are pursuing master's degrees in Regional
Planning and/or Landscape Architecture.
• The Project will be presented to the planner in draft form in April. After his review, it will
be presented to three planners and/or three town managers to obtain their comments,
insights and possible revisions.
• The Project will be presented to the Selectboard/Planning Board in early May for comments,
insights and possible revisions.
• The Project will be completed by May 15, 2013.
The End Product
• The Final Report of the Project will include the inventory, analysis and a set of
recommendations concerning the future development of the Route 125 Corridor.
• The Final Report will include recommendations that focus upon infrastructure investment,
re-parcelization and future zoning options.
• The Final Report will include text, photographs, and maps and will be presented in both hard
copy and PDF formats.

The Project Team
• Dr.John R. Mullin will serve as project director. He will also oversee the collection of case
studies, the re-parcelization analysis and the zoning analysis. He will be the Team
Representative at all meetings of the Advisory Board, the Selectboard and the Planning
Board.
• Dr. Henry Renski, Director of CED will oversee the determination of economic impacts.
• Dr. Jack Ahern will oversee the preparation of all landscape architecture elements, maps
and graphic materials.

• There will be a minimum of three graduate students who will be assigned to the project.
They will be selected by December 1, 2012.

On behalf of the North Andover Festival Committee and the North Andover Police Association I am
requesting the Board of Selectmen to approve our request to use Main St., Elm St., Water St. and Sutton
St. on Saturday Nov. 24th for the annual Santa Parade. I would also request permission to limit parking
in certain areas along the parade route due to safety concerns. This would include temporary"No
Parking" areas on one side of Water St.from Elm St.to Main St. as well as Main St. from Water St.to
Waverley Rd..These areas would be posted at 8:00 am the day of the parade and removed at the finish.
The parade will start at 12:00 pm at the North Andover Middle School and should finish the route by
2:00 pm. We will utilize sign boards and local media to notify the public about road closures prior to the
date of the parade and during the parade.
I am also requesting that the Board of Selectmen limit the distribution of candy.The only method of
distribution of candy will be by hand. No candy will be thrown from vehicles or by persons on foot. 1 am
also requesting that the Board of Selectmen require participants younger than age 15 who are riding on
a float or trailer to be properly seated and secure without having legs or arms extended over the sides of
the float or trailer.These requests are due to safety concerns for viewers and participants.
The parade will form at 11:00 AM at the Middle School and proceed down Main St. to Elm St. From Elm
St.the parade will turn left on to Water St. and then merge back on to Main St. and continue until
Sutton St.where it will disband. If there are any questions please contact me.
As in years past all Town Officials are invited and welcomed to march in the parade. I expect this year's
parade to meet or exceed the participation we had last year and continue our goal of growing so that
this parade becomes a signature event not only in North Andover but in the entire Merrimack Valley.

NOTICE TO MOTORISTS
ALL NIGHT WINTER PARKING BAN
WILL GO INTO EFFECT ON DECEMBER 1,2012,AT 12:01 AM
In accordance with Chapter 40, Section 22,of the General Laws,the following parking regulation shall go into
effect on December 1,2012,
1. On or after the effective date of this ORDER,no person, except in the event of an emergency, shall park or
permit any vehicle to remain unattended on any street or way in the Town of North Andover between the
hours of 12:00 o'clock midnight and 6:00 o'clock AM, during the months of DECEMBER, JANUARY,
FEBRUARY,AND MARCH. Parking on sidewalks at any time during the year, including the period of
this ORDER is not permitted, except as noted below in section 2b.
2a, During the period of this ORDER,parking is allowed so that two tires are within 12 inches of the curb or
sidewalk and a minimum of twenty feet away from an intersection or ten feet from fire hydrant, on the
following streets, as indicated below.
Stonington Street: Parking on even side only
Saunders Street: Parking on odd side only
Lincoln Street: Parking on even side only
Perry Street: Parking on even side only
Church Street: Parking on odd side only
Ashland Street: Parking on odd side only
Annis Street: Parking on even side only
Thorndike Road
(from Sutton Street to Troy Road): Parking on odd side only
Marblehead Street
(from Union Street to Middlesex Street): Parking on odd side only
Union Street
(from Beverly Street to Marblehead Street): Parking on even side only
Norman Road: Parking-on even side only
2b. During the period of the ORDER parking is allowed so that two tires are within 12 inches of the curb or
sidewalk and a minimum of twenty feet away from an intersection or ten feet from a fire hydrant on the
even side of Beverly Street from Middlesex to Union and on the odd side from Union Street to the Dead
End. (No parking on either side of Beverly from Dana Street to Middlesex Street.) The sidewalk on the
odd side of Beverly Street from Middlesex to Union Street is closed during the period of this ORDER.
Residents may park on this sidewalk so long as no part of the vehicle is on the roadway.
3. Any violation of this ORDER shall be punished by a fine of$25.00.
4. EXCEPTION: If there is not a snowstorm,the above parking ban does not have to be observed on
Christmas Eve December 24 2012 and New Year's Eve December 31 2012.
5. No parking will be allowed in municipal parking lots for more than 48 hours. Vehicles in violation will be
towed at the owner's expense.
6. No snow or ice shall be deposited upon any portion of a way open to public travel.

I recommend no changes to the parking ban. However, after discussion with Chief Gallagher, we will, at the
beginning of December and again at the end of February, review the projected weather forecast. At that time
if we jointly believe an adjustment to the beginning or end dates need to be made based on these projections
we will make a formal recommendation to you. If adjustments to the dates are approved then notification can
easily be communicated to the public through the Blackboard Connect system, the web site, and NACAM.

After speaking to DPW Director Thibodeau and Karen Robertson of your office i
recommend the town approve the draft policy without any changes. The police
department issues orange warning notices to vehicles that are in violation of the winter
ban for the first ten days. This allows the residents to be aware the ban is in place
before a parking ticket is issued, A Blackboard Connect message will also be announced
townwide before the effective date. Both the town and police websites will post the
notice.
During the winter we will evaluate the duration of the ban due to weather conditions and
make a recommendation to your office.

Capital Project Status Report
November 5, 2012
Stevens Estate Masonry Repairs—contract was awarded to Patriot Restoration. Company is
scheduled to begin work on the back fagade of the building on Monday,November 5th. The
work should take about 21/2 months to complete. If work is suspended due to winter weather
conditions, the company expects to complete the project by mid-April at the latest.
Stevens Estate Windows Replacement—there were no bids submitted when the initial
Invitation for Bids (IFB) was issued. The IFB was re-issued and bids are due on Monday,
November 5th at 2:00 p.m.
Raleigh Tavern Lane Water Main Replacement—project is underway and approximately
33%complete. This project is expected to be completed by the end of calendar year 2012.
Sutton Street Sewer Line—the design of this project is 85% complete. Funding is already
appropriated for this project with bids to be solicited in the winter and construction scheduled for
spring 2013.
School Street and Bunker Hill Street Sewer Line—the design of this project is 50% complete.
The intent is to request full funding of this project at the 2013 Annual Town Meeting.
School Department Administration Building—a contract with Municipal Building Consultants
to serve as Owner's Project Manager was executed. The Request for Qualifications for an
Architect/Designer is scheduled to be issued on November 7t with proposals to be submitted no
later than November 28th.
Kittredge School Gym—the Request for Qualifications for Design Services was issued on
September 27'h. Only one proposal was received by the October 18th deadline. The firm is
being interviewed on November 1St by the School Building Committee. If the firm is approved,
the fee will be negotiated and a contract executed.

The Police Department requests that the following vehicle be declared a surplus item.

Reason for Request: This vehicle has passed its useful life cycle as a police K-9 service
vehicle. The vehicle is in need of engine and other serious repairs. The
vehicle mileage is 99,059 as of June 11,2012.
The department currently has two K-9 units,one in use for a
drug(search/patrol K-9 and one explosive K-9. Local agencies such as
NEMLEC and the Sheriff's Department have increased the number of
K-9 units in the area. It is the intent of the department to reduce our K-
9 units from two to one and utilize the other K-9 resources in the area
that are now available to our department taking advantage of the
reduction in operating expenses. This change will reduce our
requirement from two to one for our K-9 vehicle needs.
