BOARD OF SELECTMEN MINUTES NOVEMBER 19, 2012
CALL TO ORDER: Chairman William Gordon called the meeting to order at 6:30 PM at Town Hall
Meeting Room.
ATTENDANCE: The following were present: William F. Gordon Chairman; Richard Vaillancourt, Clerk;
Rosemary Smedile, Licensing Chairman; Donald Stewart, Tracy M. Watson, and Andrew Maylor, Town
Manager and Ray Santilli, Assistant Town Manager.
EXECUTIVE SESSION:.
Richard Vaillancourt made a MOTION, seconded by Tracy Watson, to move into Executive Session to
discuss: Collective Bargaining Strategy. Roll Call vote: William Gordon yes, Donald Stewart yes,
Rosemary Smedile yes, Richard Vaillancourt, and Tracy Watson yes. Vote approved 5-0.
Richard Vaillancourt declared that an open meeting may have;a detrimental effect on the bargaining
position of the Selectmen.

COMMUNICATIONS ANNOUNCEMENTS AND PUBLIC COMMENT:
New Business Recognition`
A certificate of appreciation was presented to"Allstate Insurance"for locating their first office in
Massachusetts in the town of North Andover.
The Board of Selectmen wished everyone.a"Happy Thanksgiving" and a reminder that the annual
Holiday Parade would be held on Saturday, November 24, 2012, starting at 12:00 noon and this year's
Grand Marshall is Selectman Donald Stewart.
Change in Selectmen's Meeting Schedule
Due to conflicts in Selectmen's personal schedules, the meeting on Monday, December 3rd is being
moved to Monday, November 26, At the November 26th meeting, the annual Tax Classification Hearing
will be held.
Five Year Financial Forecast Presentation
Town Manager Andrew Maylor presented his 5-year financial forecast. He started with an overview of the
Budget Development Process. He then went over the General Fund Revenues such as new growth from
new homes and businesses, local receipts which include auto excise payments, state aid will depend on
the fluctuation of state revenue.
The Town's general expenses will be focused on controlling the cost of health insurance and other
employee benefits, building financial reserves, developing strategic partnerships, maintaining the town's
infrastructure, reducing energy costs, controlling debt service costs, and using technology to lower the
cost of providing services.

CONSENT ITEMS:
Waiver of Building Fees for two (2) Stevens Estate Projects
CPA funding was approved for two projects at the Stevens Estate; masonry repairs to the exterior of the
building, and window replacements. Both of these projects were bid and recently rewarded.
Richard Vaillancourt made a MOTION, seconded by Tracy Watson, that the Board of Selectmen waives
the building permit fees for the masonry repair project and the window replacement project at the Stevens
Estate. Vote approved 5-0.
Modify Parking in Front of 25 High Street
A request was received from Jaime's Restaurant, located at 25 High Street, to change three of the two-
hour parking spaces in front of the restaurant. Two of the spaces will be converted to 15-minute parking
and one converted to a handicap accessible space. The management of the East Mill complex and the
Police Department concur with the request.
Richard Vaillancourt made a MOTION, seconded by Tracy Watson that the North Andover Board of
Selectmen votes to approve changing three two-hour parking spaces in front of 25 High Street to two 15-
minute parking spaces and one handicap accessible space. Vote approved 5-0.
Appointment to the Festival Committee
The Selectmen sub-committee has recommended appointing Dorothy Nolan to the Festival Committee.
Richard Vaillancourt made a MOTION, seconded by Tracy Watson that the North Andover Board of
Selectmen votes to appoint Dorothy Nolan to the Festival Committee for a term ending June 30, 2013.
Vote approved 5-0.
TOWN MANAGER'S REPORT:
Capital Project Status Report
The Town Manager Andrew Maylor gave the Board an updated report of Capital Projects including the
Stevens Estate Masonry Repairs, Stevens Estate Windows Replacement, Raleigh Tavern Lane Water
Main Replacement, Sutton Street Sewer Line, School Street and Bunker Hill Street Sewer Line, School
Department Administration Building and the Kittredge School Gym.
Position/Vacancy Log
The Town Manager Andrew Maylor provided a report outlining the status of various recruitments that are
ongoing or recently completed.
Request for Proposals— Purchase and Development of Former Bradstreet School Property
Due to requests from additional interested parties, an addendum was issued moving the submission date
for proposals to January 9, 2013.

Selectmen Meeting Schedule for First-Half of 2013
The Town Manager's office provided various dates for the Board of Selectmen to meet for calendar year
2013 from January through June for the Selectmen to review. Jan. 7;&28, Feb. 11 & 25, Mar. 11 &25,
Apr. 8 & 22, May 6, May 21, Town Meeting, June 3 &24, 2013. Meeting dates may be added, deleted,
and/or changed as needed or as circumstances dictate.
Selectmen praised the work of all the members of the Festival Committee and E.J. Foulds of the Police
Department for a very successful Holiday Parade and kudos to all involved.
LICENSING COMMISSIONERS:
Richard Vaillancourt made a MOTION, seconded by Tracy Watson, to open a meeting of the North
Andover Licensing Commission. Vote approved 5-0.
Zinga Frozen Yogurt, 560 Turnpike Street—'Common Victualler and Entertainment License
The Licensing Chairman Rosemary Smedile said that she heard that this establishment was already
opened before the licenses were approved and this could be a problem and set a bad precedent. The
Licensing Commissioners would have to decide how to handle this situation since the applicant was not
present at the meeting. After a;discussion the Board decided to approve on a contingency.
Donald Stewart made a MOTION, seconded by William Gordon, the Board of Selectmen acting as
Licensing Commissioners,approve the licenses contingent on the Town Manager contacting the applicant
and getting a reasonable explanation as to why he opened the establishment before receiving license
approval and to attend the Board's next meeting in December. Vote approved 4-0-1. Tracy Watson
abstained.
Pazzo Gelato Company, 99 Turnpike Street—Common Victualler and Entertainment License
Donald Stewart made a MOTION, seconded by Tracy Watson, that the Board of Selectmen acting as
Licensing Commissioners approves the common victualler license and entertainment license for Pazzo
Gelato Company, 99 Turnpike Street. Vote approved 5-0.
Tracy Watson made a MOTION, seconded by Richard Vaillancourt, to close a meeting of the North
Andover Licensing Commission. Vote approved 5-0.
PUBLIC HEARING:
Property Tax Classification Hearing
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile, to enter a Public Hearing for the
purpose of Property Tax Classification Hearing.

Selectmen moved back into Licensing to discuss Common Victualler and Entertainment License.

Zinga Frozen Yogurt, 560 Turnpike Street—Common Victualler and Entertainment License
Selectmen questioned Mr. Dell Isola as to why he opened his food establishment without acquiring the
proper licenses.
Mr. Dell Isola said that he had attended a technical review committee meeting back in August and
received all his occupancy permits from the various departments and thought he was approved for
opening. He stated that he did not receive a letter saying that he had to apply for a common victualler
license. After he opened on November 9th, he received a call from the Town Clerk's office informing him
that he needed to apply for the common victualler and entertainment licenses and he thought he was all
set to go. He did not know that he had to appear before the License Commissioners at their meeting.
He apologized and takes full blame for not fully understanding the process.
The License Commissioners said that this is the first time that anything like this has happened and then
decided to take another vote on this establishment.
Donald Stewart made a MOTION, seconded by William Gordon, that the Board of Selectmen, acting as
Licensing Commissioners, approves a common victualler license and an entertainment license for Zinga
Frozen Yogurt, 560 Turnpike Street. Vote approved 5-0.
PUBLIC HEARING:
Property Tax Classification Hearing
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile, to enter a Public Hearing for the
purpose of Property Tax Classification Hearing.
Roll Call vote: William Gordon yes, Donald Stewart yes, Rosemary Smedile yes, Richard Vaillancourt,
and Tracy Watson yes. Vote approved 5-0.
Chief Assessor Garrett Boles informed the Board that he sent all of his reports to the MA Department of
Revenue and received a verbal approval but the DOR has a backlog of paperwork and did not approved
North Andover's preliminary certifications. After the written approval there is a statutory notice that has to
be advertized for public disclosure for five business days before officially filing the evaluation report. As a
result this will delay the official vote of the Selectmen on setting the Tax Rate at tonight's meeting.
Assessor Boles provided the Board with spreadsheets calculating preliminary information regarding tax
values, tax levy and estimated FY2013 tax rate for residential and commercial properties. If the
Selectmen choose to keep the same shift percentage as last year, at a shift of 1.31%, it would create a
slight change in property taxes.
On behalf of the Merrimack Valley Chamber of Commerce Vice President Will Carpenter requested that
the Board consider not raising the tax rate of local businesses.
Richard Vaillancourt made a MOTION, seconded by Tracy Watson, to close the Public Hearing regarding
the Tax Classification Hearing.
Roll Call vote: William Gordon yes, Donald Stewart yes, Rosemary Smedile yes, Richard Vaillancourt,
and Tracy Watson yes. Vote approved 5-0.
TOWN MANAGER'S REPORT:
Town Manager Andrew Maylor announced that the Town is exploring ways to service calls from the public
whether it be a complaint or an issue. The town has applied for a grant for software that would be no cost
to the town to deal with public communication. He will update the Board in the future.

FY13 Tax Classification—Final Vote
The Board decided to keep the shift percentage at 1.31% with an estimated residential tax rate at$11
and an estimated CIP tax rate at$18.85. This is approximately a$3.00 increase in a residential bill and a
$72.00 decrease in the business bill
Richard Vaillancourt stated that a legal notice was published on November 12, 2012, for the purpose of
holding a Public Hearing for Property Classification on Monday, November 26, 2012, in accordance with
Chapter 40, Section 56, and other applicable provisions of the Massachusetts General Laws.
Richard Vaillancourt made a MOTION, seconded by Tracy Watson that the North Andover Board of
Selectmen hereby votes to adopt a Residential Factor of.953535 for the purpose of classifying the
FY2013 North Andover Tax Rates. The resulting estimated property tax rates will be$13.73 per
thousand for residential property and $18.85 per thousand for commercial, industrial and personal
property. Vote approved 5-0.
The Board was asked to sign the Classification Tax Allocation for submission to the Department of
Revenue.

As previously discussed with the Board of Selectmen,the Town sought `sponsors' for the six (6)
new 5' teak benches recently placed in the Town Common. The cost of a sponsorship was $500.
A small plaque will be placed on each bench indicating the respective sponsor.
Interested parties were asked to submit a letter of interest by close of business on Monday,
October 1, 2012. In the event more than six letters of interest were received, a drawing would be
held. A total of 16 letters of interest were received so a drawing was held and six sponsors were
selected.

The Route 125 Corridor Study
An Economic and Land Use Analysis

Understanding of the Project
The University of Massachusetts Center for Economic Development understands that the Town
of North Andover wishes to undertake an economic impact of the possible transformation of the State
Route 125 Corridor. As part of the project it wishes to determine the benefits of extending water,sewer
and fibre optic lines from Sutton Street to the City of Haverhill line. Moreover,the project should
examine the potential benefits from re-zoning and the re-parcelization of properties.
Protect Goals
• To provide examples where investment in infrastructure has stimulated economic
development.
• To determine the economic state of the Route 125 Corridor as it exists today by examining
assessor's data, land use and business data.
• To examine the town and regional master plans to determine how the corridor fits with the
stated objectives.
• To determine the economic benefits of extending utilities along the State Route 125
Corridor.
• To determine the economic benefits that could occur from re-zoning the corridor.
• To determine the economic benefits that could occur from re-parcelization.
• To prepare a report for the Town that would present alternatives to the present situation.
This report will focus upon the economic potential of the corridor.
• To present the findings before the Selectboard/Planning Board.
• Determine any quantified increases in property taxes with future build-out.
The Process
• The CED will start work as soon as the Community Development Director approves this
agreement.
• This fall, CED will research and analyze examples where communities have invested funds
for infrastructure for the purpose of economic development. The examples will have as
many characteristics of North Andover as possible.
• This fall, Dr. John R. Mullin will meet with the Selectboard in order to inform them of the
purpose, process and end product of the study.
• This fall,the Town Planner will form an advisory committee to provide insights into the
project. Beginning in January, this committee will meet monthly through May, 2013.
• Beginning in January a team of three professors will oversee the project. The work will be
undertaken by 3-5 graduate students who are pursuing master's degrees in Regional
Planning and/or Landscape Architecture.
• The Project will be presented to the planner in draft form in April. After his review, it will be
presented to three planners and/or three town managers to obtain their comments, insights
and possible revisions.
• The Project will be presented to the Selectboard/Planning Board in early May for comments,
insights and possible revisions.
• The Project will be completed by May 15, 2013.
The End Product/Deliverables
• The Final Report of the Project will include the inventory, analysis and a set of
recommendations concerning the future development of the Route 125 Corridor.
• The Final Report will include recommendations that focus upon infrastructure investment,
re-parcelization and future zoning recommendations and master plan goals.
• The Final Report will include text, photographs, design scenarios and maps and will be
presented in both hard copy and PDF formats. The number of hard copies will be no greater
than 10.
The Protect Team
• Dr.John R. Mullin will serve as project director. He will also oversee the collection of case
studies, the re-parcelization analysis and the zoning analysis. He will be the Team
Representative at all meetings of the Advisory Board,the Selectboard and the Planning
Board.
• Dr. Henry Renski, Director of CED will oversee the determination of economic impacts.
• Professor Mark Lindhult will oversee the preparation of all landscape architecture elements,
maps and graphic materials.
• There will be a minimum of three graduate students who will be assigned to the project.
They will be selected by December 1, 2012.
Time Commitment/Costs

Frequently Asked Questions
What is the University of Massachusetts Center for Economic Development(CED)?
CED consists of faculty, staff and graduate students who focus on local economic development
issues. The products range from formal research work to applied planning projects at all levels of
government. It is located in the Department of Landscape Architecture and Regional Planning.
Where has the Center Worked?
We have worked in more than 130 cities and towns across the Commonwealth on projects
ranging from comprehensive master plans and economic development strategies to technical assistance
on regulations. We have worked for state agencies (i.e.: Mass Development, Massachusetts
Department of Transportation), regional agencies (i.e.: Metropolitan Area Planning Council, Central
Massachusetts Regional Planning Commission) and cities and towns (i.e.: Northfield, Hartwick).
Who is Involved in the Center for Economic Development?
The Director is Henry Renski, Ph.D., a professor of Urban Planning with a research emphasis on
economic research methods. The Associate Director is John R. Mullin, Ph.D., FAICP, professor of Urban
Planning. Dr. Mullin's research focuses on Industrial Development. Faculty from the School of
Architecture, School of Management, College of Engineering, and Department of Landscape
Architecture regularly participate on a project by project basis.
How are Proiects Undertaken?
Most of the projects are undertaken on a semester by semester basis (approximately fourteen
weeks). They are directed by at least two faculty members. Typically 3-5 students are involved per
project.
What is the Process?
Typically,the faculty will work with the community to define the issues, prepare the scope and
develop a memo of understanding with local officials. They will then offer the opportunity for students
to participate (The students usually gain graduate credit and/or a paid assistantship for their
participation). The students then work as a team(s)on the critical issues. Most projects consist of three
phases: the inventory phase, analysis phase and the implementation phase. The students are overseen
by the faculty. They are required to create a finished product by the end of the semester.
What are the Work Expectations?
The faculty member in charge of the project will work at least 80 hours on the project. The
faculty advisors will each work at least 40 hours on the assignment (a total of 120 hours). Each of the
enrolled students will work 140 hours on the project (approximately 420 hours in total). In addition,
research assistants (2)will dedicate approximately 140 hours each to the project (280 hours in total).
Do the Faculty Members Get Paid?
No. The assignments for the Center are part of each professor's normal workload. The one
exception is if the project requires summer work. All funds received are intended for student
assistantships, student expenses or CED research requirements.

Re: Finance Director
Many years ago the Town had the position of Finance Director. That position served as the division
director for the finance division and the Town Clerk. Several individuals served in that role over several
years (a true revolving door). The Finance Director in those cases was also the Treasurer/Collector. Due
to the constant transition,the budget development and bond issuance sections of the positions job
description were assigned to the Town Accountant and the Town hired a Treasurer/Collector(non-
Finance Director).
After a one year review of the finance departments, including a dozen or so meetings with the
department heads, I have determined that the those functions could benefit from improved
coordination.
Therefore, I have crafted and attached a job description for a Finance Director position. It is my
intention to appoint Town Accountant Lyne Savage to this position effective January 1, 2013. Lyne will
continue in her role as Town Accountant(as appointed by the Board) and not unlike when the Budget
Director role was added to her responsibilities, she will take on the additional coordination and
management responsibilities outlined in the job description. Lyne and I are both comfortable that this
will not prevent her from continuing her exemplary work in her current role.
Lyne is a tried and true professional that has demonstrated the skills necessary to take on this important
role. .
Job Description
Finance Director
The Finance Director is appointed by, and reports to, the Town Manager and serves as the Division
Director of the Finance Division. Work includes planning, organizing, supervising and coordinating the
financial activities for the town. Specific activities include establishing policies and procedures to ensure

the financial systems for the town in conjunction with the Town's Information Technology Director and
makes recommendations to the Town Manager regarding upgrades and replacements of said systems.
The Finance Director advises the Town Manager on all financial matters; and coordinates and supervises
the activities of the Town Accountant's, Assessing, and Treasurer/Collector's departments.

nonprofit 501(c)(3) organization. Founded in 1986, our mission is to support,
strengthen and enrich the North Andover school curriculum by providing in-school
cultural and educational programs in the Sciences and Humanities.
The North Andover Schools Enrichment Council(NASEC)is comprised of representatives from
each of the five elementary schools and the middle school. Currently the Enrichment Council is

I am pleased to inform you that the Joseph N. Hermann Youth Center,Inc. has approved a
contribution to North Andover Youth and Recreation Services in the amount of$9,180.
Our organization conducts various fundraising activities to support the youth of our Town.
Certain donors have contributed funds to provide scholarships to members who cannot afford the
annual fee. As of the end of our last fiscal year, we have collected $9,180 in Scholarship
donations. Our Board believes that the intent of our donors would be best served by transferring
these funds to the North Andover Youth and Recreation Services revolving account. Our
expectation is that these funds will be used to subsidize the cost of providing scholarships to
deserving members.

Andover Youth and Recreation Services funding request in the amount of$11,400.00. Our
Board's approval of this request stipulates that the donation will be made to the Town of North
Andover Youth and Recreation Services revolving fund and that the proceeds will be used
exclusively to fund a part-time Administrative Assistant. It is our intention and understanding
that this Administrative Assistant will provide support services to Rick Gorman and his staff.
Our Board supports the continued funding of this position in order to minimise the
administrative burden on the Youth Services staff. This administrative support will enable the
staff to continue their focus on providing services to the youth,of North Andover.

I respectfully submit the attached list of establishments for your review in approving their
license renewals for the calendar year 2013. There are several exceptions when compared with
the 2012 approvals:
• With regards to their Common Victualler license, Yente LLC d/b/a Solo Cafe (1503
Osgood Street) has not returned the renewal package. I have been contacted by an
individual stating that he is the new owner of the business. He has been sent an
application for a Common Victualler License, but as of this date has not returned it
completed. Yente, LLC, "aka Raceway"was also sent a renewal package for their wine
&malt license, which they have not responded to.
• One Stop Transportation is not renewing their Livery License.
In regards to the Section 12 (alcohol licenses),the Building Inspector and Fire Chief have
signed off on most of the establishments regarding the Certificate of Inspections. Valid copies
of the signed certificates are in the Town Clerk's Office files. All appropriate paperwork
regarding Worker's Compensation Insurance and Alcohol Liability Insurance is likewise in the
office files. As of this date, the businesses without signed Certificates of Inspection are Rolf s
(39-41 Main Street) and The Stevens Estate (723 Osgood Street). I have been assured by the
Building Inspector's Office that the outstanding issues are being addressed and they will soon
be in compliance.

Capital Project Status Report
December 17, 2012
Stevens Estate Masonry Repairs—contract was awarded to Patriot Restoration. Company has
been work on the building for the past few weeks and will continue as long as the weather holds.
The work should take about 2'/2 months to complete. After work is suspended due to winter
weather conditions, the company expects to complete the project by mid-April at the latest.
Stevens Estate Windows Replacement—Contract was awarded to Vareika Construction.
Company is working on a sample window to be presented for approval by architect and Board of
Trustees. Work is expected to take place in Spring 2013.
Raleigh Tavern Lane Water Main Replacement—project is underway and approximately
67% complete. This project is expected to be mostly complete by the end of calendar year 2012,
with the exception of surface restoration and paving, which will be completed in spring 2013.
Sutton Street Sewer Line—the design of this project is 85% complete. Funding is already
appropriated for this project with bids to be solicited in the winter and construction scheduled for
spring 2013.
School Street and Bunker Hill Street Sewer Line—the design of this project is 75% complete.
The intent is to put the project out to bid in early 2013, complete pipeline installation in 2013,
with final paving in 2014.
School Department Administration Building—Kang Associates was selected as the architect
for the project this past week. A contract is currently being negotiated. Previously, a contract
with Municipal Building Consultants to serve as Owner's Project Manager was executed.
Kittredge School Gym—Peterman Architects, Inc. was selected for the design services for this
project. Peterman has presented the School Building Committee with three possible locations for
the gym, with very rough estimates of what a gym in each location might cost. The purpose of
the estimates was to show how each location compared to the others based on cost. The School
Building Committee has instructed Peterman to prepare a design for location 91 (attached to the
modular classrooms). This is the location with the lowest estimated cost, and the one Peterman
believes gives us the best chance of staying within our budget. The next meeting of the School
Building Committee is scheduled for December 20. Peterman will present an initial design plan
for the gym at this time.

RE: Status Report—Steven's Pond Study
We recently met with both our consultants who are performing the two components of the study. Aquatic
Control Technologies (ACT) is performing the assessment of water quality and management techniques to
control the nuisance algae in Steven's Pond. Weston& Sampson Engineers (W&S)is doing the hydraulic
evaluation associate with the Lake and the Pond. Both have completed their initial data collection,
assessment of existing conditions;and have some preliminary findings but have not prepared their final.
recommendations as yet. The work they have done to date will be presented in the public meeting that has
been requested to receive public comments on.the study. We have scheduled the meeting for January 30,
2013 at 7:00 PM in the Selectmen's Meeting Room.at Town Hall. Once we have received input the study
will be finalized and the management techniques recommended to be most effective to control the algae
outbreak will be implemented. The implementation will include permitting and scheduled in-pond
monitoring;to detect the increase of algae early on, so that management techniques can be implemented as
needed to control outbreaks.
