ADJOURNMENT ill BOARD OF SELECTMEN MINUTES DECEMBER 17, 2012 CALL TO ORDER: Chairman William Gordon called the meeting to order at 6:45 PM at Town Hall Meeting Room. ATTENDANCE: The following were present: William F. Gordon Chairman; Richard Vaillancourt, Clerk; Rosemary Smedile, Licensing Chairman; Donald Stewart, Tracy M. Watson, and Andrew Maylor, Town Manager and Ray Santilli, Assistant Town Manager, EXECUTIVE SESSION: Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile, to move into Executive Session to discuss: Purchase or Sale of Real Property. Roll Call vote: William Gordon yes, Donald Stewart yes, Rosemary Smedile yes, Richard Vaillancourt, and Tracy Watson yes. Vote approved 5-0. Richard Vaillancourt declared that an open meeting may have a detrimental effect on the bargaining position of the Selectmen. - PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES: Richard Vaillancourt made a MOTION, seconded by Tracy Watson, to approve the Executive Session Minutes of November 19, 2012 as written. COMMUNICATIONS ANNOUNCEMENTS:AND PUBLIC COMMENT: New Business Recognition —Doctors Express 129 Turnpike Street The Board presented Doctors Express with a Certificate of Appreciation for locating their business in North Andover. Sponsorships for Town Common Benches Six new 5' teak benches were recently placed in the Town Common. These benches were sponsored by interested parties for a cost of$500. A small plaque will be placed on each bench indicating the respective donor. Route 125 Corridor Study-Center for Economic Development UMass John R. Mullin, Associate Director for the Center of Economic Development was present to provide information relating to a project that the town wishes to undertake and the impact of the possible transformation of the State Route 125 Corridor. Part of the project is to determine the benefits of extending water, sewer, and fiber optic lines from Sutton Street to the City of Haverhill line. Mr. Mullin spoke about the Project Goals, the Process, the End Product/Deliverables, the Project Team, Time Commitment and Costs. A preliminary information report would be available in March/April with a completion date of May, 2013. Board of Selectmen Minutes December 17, 2012 2 Appointment by the Town Manager of Town Accountant Lyne Savage as Finance Director The Town Manager announced that it is his intention to appoint Town Accountant Lyne Savage to Finance Director as of January 1, 2013. Lyne will take on additional coordination and management responsibilities outlined in the job description as she continues her work in her current role. North Andover Enrichment Council Selectman William Gordon announced that the North Andover Enrichment Council is selling Note cards with images of North Andover memorialized in the note cards. Proceeds benefit the North Andover Schools Enrichment Council bringing enrichment programs to elementary and middle school students. Order information at www.naenrichmentcouncil.org CONSENT ITEMS: Acceptance of Donations from Joseph N. Herman Youth Center, Inc. The organization conducts various fundraising activities to support the youth of the Town. The group has raised funds to provide scholarships to members who cannot afford the annual fee and also to fund a part-time Administrative Assistant for the Youth Center. Richard Vaillancourt made a MOTION, seconded by Tracy Watson that the North Andover Board of Selectmen hereby votes to accept the donation from the Joseph N. Herman Youth Center, Inc in the amount of$9,180 to provide scholarships to Youth Center members who cannot afford the annual fee. Vote approved 5-0. Richard Vaillancourt made a MOTION, seconded by Tracy Watson that the North Andover Board of Selectmen hereby votes to accept the donation from m the Joseph N. Herman Youth Center, Inc in the amount of$11,400 to fund a part-time Administrative Assistant at the Youth Center. Vote approved 5-0. Town Manager's Recommended FY2014-2018 Capital Improvement Plan The Town Manager's Recommended FY2014-2018 Capital Improvement Plan was provided for the Board's review. Per Chapter 9, Section 5-1 of the Town Charter, the Board of Selectmen has 30 days to act on the CIP and forward to the Finance Committee once approved. It is recommended that the Board accept the CIP as submitted reserving the right to make any changes at future meetings. The was a discussion on several points of the Town Manager's recommendations. Richard Vaillancourt made a MOTION, seconded by Tracy Watson that the North Andover Board of Selectmen accepts the FY2014-2018 Capital Improvement Plan reserving the right to make changes as additional information becomes available and forwarding the document to the Finance Committee for their review. Vote approved 5-0. Town Manager's One-Year Performance Evaluation The Selectmen discussed the Town Manager's evaluation and read the goals and accomplishments of the Town Manager Andrew Maylor. Richard Vaillancourt made a MOTION, seconded by Tracy Watson that the North Andover Board of Selectmen hereby votes to approve the Town Manager's One-Year Performance Evaluation as presented. Vote approved 5-0. "TABLED" Authorization to Purchase Land at 623 Osgood Street(CPA funded) Richard Vailiancourt made a MOTION, seconded by Rosemary Smedile, to TABLE Item D, "Authorization to Purchase Land at 623 Osgood Street(CPA funded)"until Friday, December 21, 2012 at 4:00 PM. Vote approved 5-0. LICENSING COMMISSIONERS: Richard Vaillancourt made a MOTION, seconded by Donald Stewart, to open a meeting of the North Andover Licensing Commission. Vote approved 5-0. Change of Pledge of License—Wine & Beer at the andovers (dba Liquor Wine & Beer at the Andovers), 352 Winthrop Street Board of Selectmen Minutes December 17, 2012 3 Tracy Watson made a MOTION, seconded by William Gordon, that the Board of Selectmen acting as the Licensing Commissioners, approve the change of Pledge of License for Wine & Beer at the Andovers (dba Liquor, Wine & Beer at the Andovers), 352 Winthrop Street, North Andover." Vote approved 5-0. Extended Hours for New Year's Eve The following establishments Orzo Restaurant, China Blossom, Chama Grill, and Camelot are requesting to remain open until 2 AM, with service of alcohol to end at 1 AM on New Year's Eve. Tracy Watson made a MOTION, seconded by William Gordon, that the Board of Selectmen acting as the Licensing Commissioners, approves the following license holders to stay open until 2:00 AM on New Year's Eve: Orzo Restaurant, (1170 Osgood Street), China Blossom (946 Osgood Street), Chama Grill (115 Main Street), and Camelot(505 Sutton Street). Vote approved 5-0. License Renewals for Calendar Year 2013 An extensive list of establishments was presented by the Assistant Town Clerk Karen Fitzgibbons for renewals for various licenses. I respectfully submit the attached list of establishments for your review in approving their license renewals for the calendar year 2013. There are several exceptions when compared with the 2012 approvals: • With regards to their Common Victualler license, Yente LLC d/b/a Solo Cafe (1503 Osgood Street) has not returned the renewal package. I have been contacted by an individual stating that he is the new owner of the business. He has been sent an application for a Common Victualler License, but as of this date has not returned it completed. Yente, LLC, "aka Raceway" was also sent a renewal package for their wine & malt license, which they have not responded to. • One Stop Transportation is not renewing their Livery License. In regards to the Section 12 (alcohol licenses), the Building Inspector and Fire Chief have signed off on most of the establishments regarding the Certificate of Inspections. Valid copies of the signed certificates are in the Town Clerk's Office files. All appropriate paperwork regarding Worker's Compensation Insurance and Alcohol Liability Insurance is likewise in the office files. As of this date, the businesses without signed Certificates of Inspection are Rolf's (39-41 Main Street) and The Stevens Estate (723 Osgood Street). I have been assured by the Building Inspector's Office that the outstanding issues are being addressed and they will soon be in compliance. Update Regarding Stevens Pond Public Works Director Bruce Thibodeau provided a status report on the Stevens Pond study. A public meeting to receive comments has been scheduled for Wednesday, January 30, 2013 at 7:00 PM I the Town Hall Meeting Room, Citizen Connect Grant Award The town received notice of Grant award to partner with the city of Boston to track service calls from the public whether it be a complaint or an issue and deal with public communication with software, which will be implemented through the town's information technology department. This would be at no cost to the town. At a future meeting the IT Director Matt Killen will explain in detail how the system works. i Distinguished Budget Award The Town of North Andover received notice from the Government Finance Officers Association that town of North Andover was awarded the Distinguished Budget Presentation Award for the current fiscal period. This award is the highest form of recognition in governmental budgeting. There are only a number of Towns that have received this award. The Town and PEC will take all necessary and reasonable actions to effectuate the transfer of subscribers to the GIC effective January 1,2014 and to maintain coverage thereafter for the duration of this Agreement. For the duration of this Agreement,premium contributions under the GIC for active subscribers hired on or prior to December 31,2012 shall be as follows: Indemnity or POS Plans (Non-Medicare Plans) 50%Town/50%subscriber i PPO Plans(Non-Medicare Plans) 75%Town/25%subscriber HMO Plans(Non-Medicare Plans) 75% Town/25% Subscriber 8. All Medicare eligible Retired Municipal Teachers receiving health insurance through the GIC as of December 31, 2013 shall be grandfathered at their December 31, 2013 contribution rates up to and including December 31, 2014. Effective January 1, 2015, for Indemnity plans the Town will contribute seventy-five percent(75%) of premium contributions for all Medicare eligible Retired Municipal Teachers who were receiving health insurance through the GIC as of December 31, 2013. i I I i 11. For the period of January 1, 2014 through the end of this Agreement, all non-Medicare retiree subscribers receiving health insurance as of December 31, 2012 shall be grandfathered at their December 31, 2012 contribution rates for Indemnity,PPO or HMO plans offered by the GIC upon transfer, except for Retired Municipal Teachers who were receiving health insurance through the GIC as of December 31, 2013. 12. For the entire period of this Agreement, all non-Medicare Retired Municipal Teachers receiving insurance through the GIC as of December 31, 2013 shall be grandfathered at their December 31, 2013 contribution rates for PPO and HMO plans. 13. For the period of January 1, 2014 through December 31, 2014, all non-Medicare Retired Municipal Teachers receiving insurance through the GIC as of December 31, 2013 shall be grandfathered at their December 31, 2013 contribution rates for Indemnity plans. Effective January 1, 2015, for Indemnity plans the Town will contribute seventy-five percent (75%) of premium contributions for all non-Medicare eligible Retired Municipal Teachers who were receiving health insurance through the GIC as of December 31, 2013. 14. If the GIC offers any new or additional HMO, PPO, or Indemnity plans during the life of this Agreement, the same contribution percentages as described above will apply. However it is agreed that only plans offered by the GIC will be available to subscribers. Mitigation Plan 15. The Town agrees to establish an"Employee Health Care Mitigation Fund"(EHMF),to be administered through a Health Reimbursement Account(HRA), of a sum equal to twenty-five percent(25%) of the actual first year's total savings which is representative of the transfer to the GIC. 16. From the EHMF referenced in paragraph 15 the Town and the PEC shall establish a Health Reimbursement Arrangement. The HRA shall be administered by a third-parry administrator jointly chosen by the Town and PEC. The Town and the PEC will jointly fund the 3rd party administrative fee for each year the HRA is in existence by each party paying 50%of the administrative fee. The total cost of the HRA administrative fee shall not exceed$45,000 annually without the mutual consent of the parties. It is understood that the PEC portion of the administrative fee shall be taken from the EHMF. 17. From the EHMF referenced above in paragraph 15 the Town shall provide a Medicare retiree subsidy in the amount of$25 per month for each Medicare eligible retiree for the first 12 months upon transfer to the GIC. Prior to December 31, 2014 the PEC will meet to reevaluate this provision. Eligible members will be based on enrollment as of December 31, 2013. Payment will be made as a premium reduction. 18. The established Health Reimbursement Arrangement(HRA) will be available to all subscribers for the purpose of; (1) reimbursing subscribers for their actual out of pocket costs; and (2)to assist those subscribers who have extraordinary out-of-pocket co pays. The conditions and eligibility for this reimbursement are as follows: A. `HRA-Part 1' Employee Reimbursement Both parties agree to adhere with the HRA Provider's rules and procedures to implement and distribute reimbursements in accordance with IRS regulations and applicable laws of the Commonwealth. The HRA shall reimburse actual out-of-pocket costs, based on actual GIC plan design, for the following: • Outpatient Surgery Copayments—Based on actual GIC plan design • Inpatient Hospital Admission Copayments—Based on actual GIC plan design • High Tech Imaging Copayments—Based on actual GIC plan design B. `HRA-Part 2' High Out-of-Pocket Costs This account will assist those subscribers who have extraordinary out-of-pocket copayments. In the event that any one member or family has out-of-pocket costs, exclusive of deductible costs (as specified in the plan design) for covered services in a plan year, that are not reimbursed by the HRA, that exceed $1,000 per individual and $2,000 per family,the HRA will provide reimbursement of 100% of the costs over $1,000 / $2,000 per plan year up to a maximum of$5,000 for an individual and $10,000 for a family plan per plan year. Both parties agree to adhere with the HRA provider's rules and procedures established by the HRA provider for reimbursements. Balance in HRA-Part 2 will be carried forward into next plan year. The Town and PEC agree to meet semi-annually with the HRA administrator to discuss ongoing usage, remaining funds, and to review ongoing status of the HRA. Waiting/Hiatus Period 19.New employees of the Town are eligible to enroll in health insurance offered by the GIC in accordance 805 CMR 9.01. Therefore, in accordance with 805 CMR 9.01(3),new employees of the Town are eligible to enroll in health insurance offered through the GIC within ten(10) calendar days of the first date of employment with the Town. GIC health insurance benefits begin on the first day of the month following sixty(60) days or two (2) full calendar months of employment, whichever is less. The period between the date of employment and the effective date of coverage pursuant to 805 CMR 9.01(3)is hereinafter referred to as the "Waiting/Hiatus Period." Eligibility for insurance coverage will be determined in accordance with II Massachusetts General Laws and applicable regulations, including but not limited to, 805 CMR 9.01. 20. During the "Waiting/Hiatus Period, the Town shall pay a Waiting/Hiatus Period Stipend' (Stipend)to those newly hired employees who have notified the Town within ten(10)calendar days of employment that they have chosen to enroll in one of the health insurance plans through the GIC. The amount of the Stipend will be equal to the employee's portion,up to a maximum of 80%,of the premium or cost for whichever plan the employee has chosen to enroll. To receive the Stipend,the employee must show proof of other health insurance coverage during the "Waiting/Hiatus Period," (e.g., COBRA or other alternative health insurance plan). Newly enrolled employees/subscribers who cancel their GIC coverage within sixty(60) days of the effective date of the GIC coverage shall return the Stipend in its entirety to the Town. 21. GIC Retroactive Effective Date of Coverage: Subscribers may request retroactive coverage from the GIC in accordance with 805 CMR 9.01(4). Therefore, if a subscriber incurs an unplanned or urgent medical expense(s) during the "Waiting/Hiatus Period"that in sum exceeds the full-cost health insurance premium of the GIC's elected plan for the "Waiting/Hiatus Period",the subscriber may file a written request to the GIC for approval of health coverage to become effective on the first day of employment. Upon approval by the GIC, coverage shall take effect as of the first day of employment. In this event,the Town shall submit the full-cost health insurance premium for the "Waiting/Hiatus Period"to the GIC in a timely manner. The employee shall reimburse the Town for the premium and any Stipend amount already received through normal payroll deductions. 22. The provisions of subparagraphs 14, 15 and 16 shall expire if and when the GIC eliminates the Waiting/Hiatus Period as set forth in 805 CMR 9.01. Health Coverage after June 30, 2019 23. The transfer of subscribers to the GIC shall remain in effect after June 30,2019,unless,pursuant to a successor Agreement executed by the parties,notice is provided to the GIC no later than December 1,2018,that the Town will terminate its coverage with the GIC. 24. The Town Manager, or his designee, and the PEC shall commence negotiations for a successor agreement no later than July 1,2018. To facilitate negotiations,the Town shall request specific utilization and claims data from the GIC pursuant to GIC CMR 8.05,Paragraph(29), §§a-b which shall be made available for examination by the PEC. Severability Clause 25. If any provision or portion of this Agreement is found to be unenforceable or unlawful, the remaining provisions or portions shall remain binding. Scope&Modification 26. This "Memorandum of Agreement" shall constitute the whole of the Agreement between the I I i Town and the PEC.The Agreement may y be modified only by a written agreement approved in the same manner as the original Agreement. i Authorization to Sign Agreement 27. Each signatory to this Agreement is authorized to bind the entity he/she represents. Work will resume in late winter/early spring and the company expects to complete the project by mid-April. I Stevens Estate Windows Replacement—Contract was awarded to Vareika Construction. Company is working on a sample window to be presented for approval by architect and Board of Trustees. Work is expected to take place in Spring 2013. Raleigh Tavern Lane Water Main Replacement—project is underway and approximately 67% complete. This project is expected to be mostly complete by the end of calendar year 2012, � with the exception of surface restoration and paving, which will be completed in spring 2013. Sutton Street Sewer Line—the design of this project is 85% complete. Funding is already appropriated for this project with bids to be solicited in the winter and construction scheduled for spring 2013. School Street and Bunker Hill Street Sewer Line—the design of this project is 75% complete. The intent is to put the project out to bid in early 2013, complete pipeline installation in 2013, with final paving in 2014. I School Department Administration Building—Kang Associates was selected as the architect for the project this past week. A contract has been negotiated and an initial meeting with all parties is scheduled for this week. i Kittredge School Gym—Peterman Architects, Inc. was selected for the design services for this project. Gallagher From: Lieutenant Charles Gray Re: Possible Liquor Violation—Raceway Gas Station DBA Osgood Convenience On Thursday, October 25,2012 at approximately 3:30 p.m.,Detectives from the Criminal Investigation Division received information that the Raceway gas station was selling beer that had no bottle deposit on them. The information also claimed that the Raceway was selling cigarettes with a New Hampshire tax stamp on them. Detective Cronin and I went to the raceway and observed numerous cans of beer to have no bottle deposit stamped on the can and bottle. Detective Cronin and I identified ourselves to the manager,David Erazo, and asked for the most recent copy of the wholesale distributor invoice. Erazo produced an invoice dated 5 September, 2012 which showed purchases of Budweiser products. Erazo stated that they have been purchasing items from BJ's and selling them at the store. David also stated that the owners would have other employees stock the alcohol bought in New Hampshire on the shelves at the Raceway. Detective Cronin observed numerous Newport cigarette products to have a New Hampshire tax stamp on them as well. We informed Erazo of the violations,photographed the violations,and had the items removed from view or sale. Possible violation follows; 204 CMR 2.05 (2)allowing an illegality on a licensed premises to wit: MGL c. 138 s.23 No license issued under section twelve,fourteen or fifteen, and no certificate of fitness issued under section thirty shall authorize the sale of any alcoholic beverages other than those purchased from a licensee under section eighteen,nineteen or 19F or nineteen C or from a holder of a special permit to sell issued under section twenty-two A; provided,that the holder of a license under section twelve or fifteen may sell alcoholic beverages acquired as the result of the purchase of a warehouse receipt for such beverages if the said receipt was purchased from the holder of a license under section eighteen,nineteen, 19F or nineteen C or from a broker registered under chapter one hundred and ten A who is authorized thereunder to deal in warehouse receipts for alcoholic beverages; and provided,further,that nothing contained in this section shall be construed to authorize a licensee under section twelve or fifteen to import alcoholic beverages into the commonwealth except through the holder of a license issued under section eighteen or 19F. MGL c. 138 s. Section 2E. (a)Any manufacturer,wholesale dealer,agent or any other person or entity who knowingly sells cigarettes,other than through retail sale,in violation of section 2B.
