ATTENDANCE: The following were present: William F. Gordon Chairman; Richard Vaillancourt, Clerk; Rosemary Smedile, Licensing Chairman; Donald Stewart, Tracy M. Watson, and Andrew Maylor, Town Manager and Ray Santilli, Assistant Town Manager. I PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES: Richard Vaillancourt made a MOTION, seconded by Donald Stewart, to approve the Open Session Minutes of January 07, 2013, as written. Vote approved 5-0. COMMUNICATIONS ANNOUNCEMENTS: Note: Take Out of Order IVB FY12 Audit Report Richard Sullivan from the Town's outside auditing firm of Powers and Sullivan gave the Board an overview and analysis of the town's financial activities of FY12. The overall financial picture is good with no serious internal problems; the auditors said they have an unqualified opinion meaning an accurate report. The Management Letter was short with a few comments and recommendations; seven out of ten prior year recommendations were resolved and three will be in the near future. There are only four comments and recommendations for the current year; Library Trust Fund Bank Accounts; Segregation of Duties—Ability to Add, Delete or Modify Payroll and Vendor Master Files; Consider Centralizing the Collection of Permits, Fees and Other Receipts; Enhance controls for Over-the-Counter Collections. Mr. Sullivan commended the work of the Finance Director Lyne Savage for her work on the Comprehensive Annual Financial Report, Mr. Sullivan also commented that it was a pleasure working with the Town's financial team and thanked them for their assistance. This was a very good report and the Board should be proud of the work. Note: Take Out of Order VG Request to Research Tap & Harvest Sap from Maple Trees Paul Boulanger and Kathleen Gallagher owners of Turtle Lane Maple Farm are requesting approval to research, tap and harvest maple sap from maple trees located on town property. Donald Stewart made a MOTION, seconded by Rosemary Smedile that the North Andover Board of Selectmen hereby votes to authorize Paul Boulanger and Kathleen Gallagher to harvest sap from maple trees located on town property from February 2013 through May 2017. Vote approved 5-0. Legislative Priorities Senator Tarr, Senator O'Connor Ives, Representative Lyons and Representative DiZoglio were present and discussed the Town's priorities for fiscal year 2014. Each of them gave their support in advocating for the Town's most important projects and funding requests which would benefit the residents and businesses of North Andover. They all spoke briefly about the bills that were filed on behalf of towns such as North Andover. There was discussions regarding Chapter 70 funds, state mandated programs, prevailing wage law, pension reform, development on route 125 and Osgood Landing, signage on route 495 and safety on route 114. i Board of Selectmen Minutes January 28, 2013 2 I The Town Manager Andrew Maylor thanked them for the Health Insurance Reform Act that significantly reduces the cost of health care for employees of cities and towns. This was a fantastic example of how the legislature can provide municipalities with the tools needed to become sustainable. We encourage the same leadership in the area of pension reform. The Senators and Representatives said they would work with Town officials to work on some of their requests and revisit in about six months. 2nd Quarter Financial Report Finance Director Lyne Savage Finance Director Lyne Savage gave a budget status report for FY13 for revenue and expenses for the 2nd quarter ending December 31, 2012. Tax Revenue collections are at 49% which is slightly up from this same time last year which was 48.3%. Motor Vehicle Excise Taxes collected at this point are 12.2% which is up 1%from this same time last year. Ambulance Services collections are still running on track although slightly down from this same time last year. Building Inspection Fees are up substantially from this same time last year. This is largely due to an anomaly that is being driven from several large development projects in Town. Board of Appeals receipts are up from last year also due to an anomaly where filing fees received for a 40B project generated the one time increase. Interest Income is continuing to track on target and projections indicate that we should have a small surplus in this line item. Collections at this point are 62.4% which is up 3% compared to last year's 59.4%. When Motor Vehicle Excise Tax is factored out of Local Receipts it is tracking at 56% of budget. Expenses are running at approximately 50% of target at this point which is right on track. There will be several retirements within the Police Department that will occur this fiscal year. There are some other surpluses that will be able to absorb the related buyout costs within the General Fund budget. Due to the changes in health insurance more work needs to be completed to confirm the full impact on the FY13 budget. The Water collections are at 59% which is up 5% with expenditures at 47%. Sewer collections are at 49.2% up 7% and expenditures at 39.5%. The Stevens Estate collections are at 80.8%which is up 28.4%with expenditures running at 64.8%. The Estate continues to show monthly profits with an accumulative profit to date. Bradstreet School Property Proposal Town Manager Andrew Maylor announced that"A Coalition for a Better Acre (CBA) submitted a proposal to acquire the former Bradstreet School property at 70 Main Street. Following an inspection of the building they concluded that the optimal reuse of the site involves demolition of the current building and the new construction of a mixed used building that offers commercial retail storefronts on the first floor and 24 residential affordable housing rental units. The Board suggested that the Town Manager contact the developer to attend a future meeting and give a brief presentation on their plans. Stevens Pond Public Input Meeting Announcement: The Stevens Pond Input Meeting will be held on Wednesday, January 30'", at 7:00 PM at Town Hall. The Public is invited and participation is important. Note: Take Out of Order VIIA FY2014-2018 CAPITAL IMPROVEMENT PLAN The Town Manager said the CIP requests funding for annual building maintenance, roadway improvements, an adopted Facilities Master Plan. The 2010 Town Meeting approved funding the Facilities Master Plan. The first phase of the plan is well under way with the construction of a Kittredge school gymnasium, the construction of a new school administration central office and the design of a new central fire station. Chief Board of Selectmen Minutes January 28, 2013 3 Melnikas was present and emphasized that the new central fire station should be kept in the downtown area at two possible sites. Note: ESCO was TABLED COMMUNICATIONS AND ANNOUNCEMENTS Selectman Smedile announced that residents had a deadline for Tax Abatements. All Tax Abatements must be filed by Friday, February 1, 2013 at noon. Selectman Gordon announced that the Finance Committee voted in favor of the ESCO Project. Selectman Gordon announced that he read an article about an upscale Hotel to be built near Northern Essex Community College and the developer will be extending sewer lines and the neighboring businesses would be able to tie into it. Selectman Gordon said the Board should plan and discuss the new Medical Marijuana Law that was passed in November. Cities and Towns are already taking action and drafting different options. There will be thirty- eight dispensaries throughout the state. CONSENT ITEMS: Acceptance of Donation to Police Department Tracy Watson made a MOTION, seconded by Rosemary Smedile that the North Andover Board of Selectmen hereby votes to accept a donation from Stella McClintock in the amount of$50 to the North Andover Police Department for general use. Vote approved 5-0. Request to Surplus Fire Department 14' Mirro Craft Aluminum Boat Tracy Watson made a MOTION, seconded by Richard Vaillancourt that the North Andover Board of Selectmen hereby votes to approve the request of the Fire Chief to surplus the 14' Mirro Craft Aluminum Boat per his memo dated January 11, 2013. Vote approved 5-0. Information Technology Request to Surplus Equipment Richard Vaillancourt made a MOTION, seconded by Tracy Watson that the North Andover Board of Selectmen hereby votes to surplus equipment determined to be of no value per his memo dated January 18, 2013. Vote approved 5-0. Affordable Housing Unit Resale— 1 Harvest Drive Unit 307 Oakridge-Maplewood Reserve (CHAPA) has notified the Town that the affordable housing unit is up for sale. It is recommended that the Board not exercise its right of first refusal. Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the North Andover Board of Selectmen hereby votes to decline the right of first refusal to purchase the affordable housing unit at 1 Harvest Drive, Unit 307, Oakridge-Maplewood Reserve. Vote approved 4-0-1. Tracy Watson abstained. Appointment to Affordable Housing Trust Fund—Stephen L. Bernard Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the North Andover Board of Selectmen hereby votes to appoint Stephen L. Bernard to the Affordable Housing Trust Fund, Board of Trustees for a term ending June 30, 2013. Vote approved 4-0-1. Tracy Watson abstained. Johnson Administrative Secretary Richard Vaillancourt, Clerk of the Board Communications And Announcements F„ n January 31°2013 r Selectmen Town of North Andover CKA RE: Offer to Purchase Bradstreet School Dear Selectmen: i We are writing to express opposition to the buyers proposal to purchase Bradstreet for 300,000 and develop it for housing. This is not an appealing alternative to an historical and long standing building in North Andover. Could it not be renovated to house Administrative Offices for the town.......or attract a small upscale grocery store to the site such as Hannafords or Whole Foods or Wild Harvest? When the supermarket closed at Messina's plaza.....that took away the option for many people of walking to the grocery store to get necessities. The many elderly housing tenants, Sutton Pond residents etc. now need to use a car when a quick walk would suffice. In the future, due to energy conservation, physical benefits, and just the ability to have the necessary living staples within town such as bank,post office,town offices etc. and groceries would be an asset to the Town of North Andover. I know CVS carries some of those things, but without vegetables, fruit or meat products.... selection is sorely lacking for residents. Can we not try to market this spot for something to bring residents into town? Making sidewalks better for walking and encouraging people to "leave the car at home" once in a while by bringing in a reason to come to downtown would better serve our needs as we move forward. Green - Clean Sustainable Executive summary The Merrimack Valley Planning Commission (MVI'C) issued a Request for Qualifications (RFQ) to Energy aG 4 Service Companies (ESCos) to provide for Comprehensive Energy Management Services for its member communities. Ameresco submitted a proposal and was subsequentlyy awarded the contract. The program utilizes a multiple step design/development process beginning with a preliminary energy assessment _t s (PEA) and followed by a refined and detailed Investment Grade Audit(IGA). This IGA is a key step in developing a successful energy savings and infrastructure improvement project focusing on the exact needs and desires of the Town. The purpose of the IGA is to analyze and quantify the feasibility of installing certain improvements or energy conservation measures (ECMs) throughout the Town. The IGA will form the basis for the subsequent Energy Services Agreement(ESA)which will enable the design and construction phase. The IGA quantifies how the Town will be able to reduce utility costs nearly$400,000 annually,through the acquisition of just over$4 million dollars in capital improvements,net of projected utility company rebates. This investment however,will not require any up-front capital by the Town. The Town will achieve these improvements via a Performance Contact designed to extract energy inefficiencies in the current utility operating budgets to self-fund the project from future energy savings. Payment will be made over time utilizing Ameresco's guaranteed annual energy savings for security. The Town's total utility cost for FY 2011 was $2,288,893. After review of the facilities with Town personnel,the Town narrowed down the list to sixteen (16) facilities to focus on in the IGA. The list consists of eight(8) school buildings and eight(8)Town facilities. The baseline developed for each building is based on fiscal year FY 2011 utility data. The total utility usage was 6,241,761 kWh of electricity,455,420 Therms of natural gas and 9,745 CCF of water and sewer. The total utility cost for these buildings was$1,671,279. A wide-range of energy conservation measures (ECIVIs)were identified,evaluated,and presented for consideration in the PEA. The comprehensive development process of the IGA included input from Town personnel in order to refine the ECVis and overall scope of the project to match the infrastructure need of the facilities. Green - Crean - Sustainable I Energy Conservation Measures The following ECM descriptions are intended to provide a high level overview. In general the ECMs are designed to deliver many technical,financial,and environmental benefits to the Town that include: • Better learning and working environment for students and staff; • Improved energy efficiency and operation of existing systems; • New energy efficient equipment and systems; • Performance Guarantee of energy savings;and • Reduction of Greenhouse gasses and emissions. ECM 1: Lighting System Improvements Ameresco's in-house lighting experts completed a detailed survey of all the Town's facilities. Ameresco proposes to replace or upgrade 5,311 existing fixtures with state-of-the-art lighting systems which will enhance the quality,consistency,and color rendering of the lighting throu g hout the Town,while meeting all g applicable codes and standards. Ameresco standardized the lighting system where practical, reducing the number of different products that must be purchased, stocked and maintained. Most fixtures replaced or retrofitted with 4'T8 lamps will receive 28-watt"energy- n Y=.ae l.t;Nle-kv ightil-i,?-i ff istanrove efficient"lamps and ballasts. This premium combination yields aesthetics xactsave operati$29 coSts� maximum energy savings without sacrificing light output or quality. These 28-watt lamps use a superior mix of phosphors that allow them to consume less energy while matching the light output of standard T8's. The 28-watt lamp also maintains light output better than T12 and typical T8 lamps. Many retrofits will include new reflectors designed to improve fixture efficiency. Some will also receive new acrylic lenses. Certain fixtures that have reached the end of their service life will be replaced. Several hundred Compact Fluorescent Lamps and LED retrofit lamps will be installed in recessed cans,as well as,exit signs not containing LED technology will be replaced with new LED signs with battery backup, thereby ensuring the sign will illuminate in the event of a power outage and/or generator failure. We selected appropriate areas that contain several controllable fixtures,which have intermittent occupancy,and where a safety hazard will not be created if the sensor inadvertently turns the lights off. Applicable areas include classrooms,offices,baths, the cafeteria,and the library. ECM 3: Domestic Water Conservation Amexesco proposes to replace existing standard flow water fixtures at Fire Station 2,Atkinson Elementary School,Franklin Elementary, 1 School,and Kittredge Elementary School with low-flow water fixtures. The open protocol specification will allow the Town to connect products from almost any LonWorksTM or BACnet vendor to the proposed system.Future upgrades and expansions can be competitively bid and will not be limited to the products of any one manufacturer.Ameresco has no commercial alliance with any EMS vendor and considers all applicable products. Ameresco believes the Town's interests would be best served with open-protocol EMS architecture. ECM 5: Boiler Replacement Ameresco proposes to replace the 42-year-old boiler and appurtenances at Fire Station 2 with a high efficiency boiler. Since the apparatus floor was disconnected from the boiler,the boiler became more than twice as large as needed to heat just the living ' quarters. That made the modular design a liability,since the boiler's cast iron construction requires continuous flow through both modules to avoid the thermal shock that would result from intermittent flow. In effect,the idle module becomes a radiator to the outdoors. Another contributor to the inefficiency of the ig existing system is the simplicity of the controls. When the arc s. : "ride boiler at 'i e Station I thermostat in the living quarters starts the boiler,the boiler runs at full fire until the supply temperature reaches its operating limit,then stops until the supply temperature drops or the thermostat stops calling for heat. ECM 7: Variable Frequency Drives 3 This measure installs variable frequency drives (VFDs) to improve , F performance and save energy in the Police Station ventilation w system and for the heating systems at the Franklin,Thomson,and Middle Schools. The installation of VFDs and controls on these systems will allow them to modulate with varying load more efficiently than the existing methods of control,which will reduce electrical energy and to improve system efficiency. Authorization for funding of an Energy Services Contract is anticipated by vote at the Town's Annual Town Meeting scheduled for May 21, 2013. • Why an owner's agent is critical for your municipality to implement this project In order to ensure the proper design and construction of the (81) energy conservation measures it is imperative that the necessary expertise be engaged to serve as the town's advocate. The owner's agent would perform a role similar to that of an Owner's Project Manager (OPM). The agent shall serve as a consultant during the implementation of the performance contract providing guidance concerning compliance with Ch 25a requirements. In order to ensure the savings under the ESCo agreement the owners' agent will provide oversight of the Commissioning of all energy conservation measures and monitoring of the Measurement &Verification phases of the contract. • A discussion of the specific tasks you expect the owner's agent to perform once services are awarded. Gallagher, Chief of Police DATE: February 1, 2013 RE: January 2013 Crime Statistics The New Year started at midnight and the North Andover Police had their first arrest at 12:30 AM after a short pursuit. There were no incidents at any of the establishments given permission to stay open later on New Year's Eve. Officers made frequent checks of all liquor establishments during the evening and reported no unusual activity. Throughout the month,and coordinating with the school principals,North Andover police officers have continued to conduct school familiarization training with the elementary,middle and high school on off hours. The off hours is being done so as to not worry student or parents and to keep the press away in hopes of not drawing unwanted attention. Our officers have made very positive comments about learning the layouts of the buildings and are keeping their skills sharp. We also issued police portable radios to all schools in the district including St. Michaels and the Early Childhood School. These radios allow for direct communication to our dispatch center,as well as cruisers on the road,should a critical incident occur.All principals were trained in police protocol and radio checks with our communication center This year Officer William Lynch and Detective Barter were nominated as our 2012 Officers of the year. Staff,families and Selectmen attended this annual event.Officer Lynch is a 30 year veteran of the North Andover Police and was involved in a number of critical incidents over his career. Most recently,on June 19th 2012,when the TD Bank on Andover Street was robbed by a serial bank robber,Officer Lynch observed the vehicle fleeing the area of the robbery and initiated a pursuit. Officer Lynch,assisted by Deflective Barter,pursued the vehicle to the New Hampshire boarder where the vehicle was immobilized and the suspect taken into custody. While pursuits are one of the most dangerous aspects of police work,Officer Lynch and Detective Barter showed that experience and training keeping skills sharp are important not only for the safety of the public,but also police officers who find themselves in high risk incidents. There was another stabbing incident,this time at the Harvest Drive complex. Officers responded initially to a call of a man who was robbed and stabbed. Primary officers took immediate action by securing the scene and making the building safe,they performed first aid until the paramedics and eventually Med Flight,landed. The incident is still under investigation by the North Andover Police,State Police and the Essex County District Attorney's office. There appears no foul play. New cruiser laptops were programmed and installed. These new laptops replaced the 10 year old computers that were hardwired to the cruisers and allow for real time interface between the cruiser,our records management system,and the registry of motor vehicles. These computers were part of our Capital Improvement and are working extremely well with the assistance of our towns IT staff. This month our traffic unit took aggressive steps to recover unpaid parking fines for those who had a violation in town. By utilizing our automated license plate reader (ALPR),we recovered $5300.00 in unpaid parking fines. Another project of the ALPR is the investigation of over 300 vehicles that are registered out of state,yet appear to be garaged in North Andover. These vehicles, and its owners,may be scofflaws of excise tax evasion and insurance violations.We will be watching these vehicles and following up with the owners and the insurance companies. As the month of February approaches,one of our focuses will be to onsite realistic training inside the schools during the scheduled vacation. We will conduct active shooter scenarios inside one of the schools. We hope to involve the staff of the school in one of the future trainings as well and at their request. The school department has initiated a school safety committee that is chaired by the high school principal.Our department will be actively involved. The GIC. provides health insurance to more than 350,000 employees and retirees statewide and offers many different plans_ Although the benefit design of these plans will be different than what the Town currently offers,premiums will be dramatically lower. In addition,the agreement includes substantial funding to cover certain out of pocket costs and provides a subsidy for Medicare eligible retirees. There will be an open enrollment for all ernployees and retirees later this year for the GIC. Between now and December 31, 2013,the'1"own will continue to offer the sarne Blue Gross Blue Shield products that we have historically provided. As part of our agreement to join the GIC:the Town offered to not increase health insurance premiums through the end of the calendar year. After careful consideration the Town has decided to go one step further, The rates for Network Blue,the plan with the most subscribers,will be reduced by 3%,while the rates for all other plans will remain the same. Since the new monthly health insurance rates effective March 1,2013 have been established,an open enrollment period for any changes to your health insurance coverage is now in effect. This is the only time in the following 10 month period that changes can be made(a separate open enrollment will take place with the transfer to the GIC). These changes can be new coverage, changing from single to family coverage(or vice-versa), or changing plans entirely. Blue Cross Blue Shield does not allow the Town to add or change coverage"off anniversary"unless there is a"qualifying event".
