ADJOURNMENT i it Approval of Minutes BOARD OF SELECTMEN MINUTES MAY 6, 2013 CALL TO ORDER: Chairman William Gordon called the meeting to order at 7:00 PM at Town Hall Meeting Room. ATTENDANCE: The following were present: William F. Gordon Chairman; Richard Vaillancourt, Clerk; Rosemary Smedile, Licensing Chairman; Donald Stewart, Tracy M. Watson, and Andrew Maylor, Town Manager and Ray Santilli, Assistant Town Manager. PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES: No Action COMMUNICATIONS ANNOUNCEMENTS AND PUBLIC COMMENT: The Friends of Patriots Memorial Park are in need of donations. The Friends have placed a granite marker to honor Chief Harold Dushame and commemorate his service to the community. They have received donations from the Garden Club and the North Andover Improvement Society, but still need additional funds. Please send your donations to P.O. Box 212, North Andover, MA. Healthy Communities Tobacco Control Ron Beauregard of the Healthy Communities tobacco Control Program was present and gave a brief description of the North Andover Board of Health's tobacco control program. Certificate of Appreciation — Philip and Judith Rohn Philip and Judith Rohn were recognized for their community service and financial support of the successful `Gun Buyback Program' held on March 19, 2013. North Andover residents were given American Express gift cards in the total amount of$1,360 for turning in 27 weapons. The Board announced several successful events that were held such as the Booster Club Parade, the Sustanability Committee Clean Up Day and announced upcoming events such as the Sheep Shearing Festival, and fundraisers run by North Andover Merchants Association "Cow Pie Bingo"which raises funds toward the Annual Holiday Parade'. CONSENT ITEMS: Appointments to the Cultural Council Richard Vaillancourt made a MOTION, seconded by Tracy Watson to appoint Karin Valliere-Moschetto to the Cultural Council for a term ending June 30, 2015. Vote approved 5-0. Richard Vaillancourt made a MOTION, seconded by Tracy Watson to appoint Julie Faro to the Cultural Council for a term ending June 30 2015. Vote approved 5-0. Acceptance of Donation ($50) from Lafond Insurance to Fire Department for SAFE Program Lafond Insurance has made a donation to the Fire Department to purchase supplies to educate students for the SAFE Program. Richard Vaillancourt made a MOTION, seconded by Tracy Watson that the Board of Selectmen accepts the donation from Lafond Insurance in the amount of$50 to the Fire Department for the SAFE Program. Vote approved 5-0. Acceptance of Donation ($5,000) from TD Bank to Youth & Recreation Services to Sponsor 2013 Summer Band Concerts TD Bank representatives Jerry Copsinis and Tracy Beaudoin presented a donation of$5,000 to Youth & Recreation Services to sponsor all eight(8) 2013 Summer Band Concerts. Richard Vaillancourt made a MOTION, seconded by Tracy Watson that the Board of Selectmen accepts the donation from TD Bank in the amount of$5,000 to Youth & Recreation Services to sponsor the 2013 Summer Band Concerts. Vote approved 5-0. Board of Selectmen Minutes May 6, 2013 2 Request from Lions' Club to waive Building Permit Fee to erect Circus Tent Ray Sirois of the Lions Club was present on behalf of the Lions' Club and requested the Board to waive the Building Permit fee to erect the circus tent. The Lions' Club will hold this annual fundraiser at the rear of the Middle School on July 1-2, 2013. Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen waives the Building Permit fee for the Lions' Club to erect the circus tent for their annual fundraiser. Vote approved 5-0. Request from Brooks School for use of the Town Common on May 23, 2013 for Annual Class Picture Per their tradition, Brooks School requested to use the Town Common on May 23, 2013 to take the annual photograph of the senior class in front of the Phillips Brooks statue. Tracy Watson made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen approves the request of Brooks School for use of the Town Common on May 23, 2013 for the annual class picture. Vote approved 5-0. Board of Selectmen Schedule of Meetings Rosemary Smedile made a MOTION, seconded by Tracy Watson that the Board of Selectmen approves the schedule of meetings by adding a meeting on May 13, 2013; change the June 3, 2013 meeting to June 10, 2013 and approves the meeting schedule for the balance of calendar year 2013, reserving the ability to modify the schedule as the need arises. Vote approved 5-0. PUBLIC HEARING: Road Layout Hearing—Red Gate Lane Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile, to enter.a Public Hearing regarding the layout of Red Gate Lane as a public way. Roll Call vote: William Gordon yes, Donald Stewart yes, Rosemary Smedile yes, Richard Vaillancourt, and Tracy Watson yes. Vote approved 5-0. The Planning Board voted unanimously in recommending Red Gate Lane accepted as a public way. The vote was taken on the condition that the Town Planner performs an inspection of the Red Gate Subdivision. This inspection has taken place and the Subdivision has been found to be in satisfactory and acceptable condition. Rosemary Smedile made a MOTION, seconded by Tracy Watson, to close the Public Hearing regarding the layout of Red Gate Lane as a public way. Richard Vaillancourt made a MOTION, seconded by Tracy Watson that the Board of Selectmen accepts Red Gate Lane as a public way and declare that public necessity and convenience require the aforesaid way to be laid out and do hereby order and direct that said way be laid out as shown on a Plan of Land entitled "Layout Plan of Re Gate Lane located in North Andover, MA"; prepared for the Town of North Andover, MA, by Waypoint Surveying Services; scale 1 inch = 40 feet; dated March 25, 2013; to which plan reference may be made for a more particular description of the way as so laid out, a copy of which plan is filed herewith in the Office of the Town Clerk, North Andover, Massachusetts." Vote approved 5-0. OLD BUSINESS: Review of Former Bradstreet School Property Proposals Representatives from Hearthstone Realty Corporation presented three (3) of their proposals previously reviewed by the Board: Scheme 2, Scheme 3, and Scheme 4. The company was asked to elaborate on their written proposals and the firm's background on similar projects. Board of Selectmen Minutes May 6, 2013 4 Merrimack College requests 8 One-Day Licenses for Graduation Weekend, May 15-17 &20, 2013 Jennifer Konopisos on behalf of Merrimack College requests 7 One-Day Wine & Malt Licenses and 1 All Alcohol License for Merrimack's commencement week beginning May 15, through and including May 20, 2013. OLD BUSINESS: Review of Former Bradstreet School PropertV Proposals Representatives from RCG LLC, Oakgrove Residential, Inc., and Water Street Retail, LLC. presented proposals for the Bradstreet School Property. Each of the developers elaborated on their proposals and gave details of their particular plans for enhancing the downtown property. Selectmen thanked all the developers for bringing forth great ideas and commented about the pros and cons of the plans. Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt,that the Board designate Oakgrove Residential, Inc. as its first'choice. Vote failed 3-2:` Richard Vaillancourt, Tracy Watson and Donald Stewart opposed. Tracy Watson made a MOTION, seconded by Richard Vaillancourt, that the Board designate Hearthstone Realty Corp. Scheme 3 as its first choice. Vote approved 4-1. Rosemary Smedile opposed. Note: Tracy Watson arrived OLD BUSINESS: Town Meeting Warrant Article 10 Citizens Petition Mr. Nothnagal of 92 Surrey Drive, North Andover came before the Board to speak on behalf of his citizens petition,Warrant Article 10. Article 10: citizen's.petition, A resolution to suppod passage of a constitutional amendment providing that only human beings are people. Mr. Nothnagal gave explanations and reasons why he proposed his citizen petition. He also proposed to Amend his original article. After a discussion the Board decided to take No Action on Article 10. TOWN MANAGER'S REPORT: The Board briefly discussed planting trees on various streets in downtown. The Town Manager would follow-up with the Board and let the Board give specific locations of where the trees should be planted. You exemplified leadership working with the Trustees of the Reservation and the Conservation Commission, leading your team in removing an old 65 foot wooden boardwalk in the Weir Hill Reservation in North Andover and replacing it with a sturdy structure which hikers will enjoy for many years. You lead your team to build a small retaining wall and a patio area, moved the flag pole holding the American flag, Added an additional pole for the USMC flag, relocated granite benches and landscaped the entire area with grass and shrubs. You exemplified leadership working with your team constructing eight two-foot tall PVC monofilament recycling bins. The bins are fishing line receptacles that were placed along the shores of the Merrimack River at eight different locations where fishing is most abundant and have a threaded adapter on the bottom to empty them which will result in less fishing line litter on the shores of the Merrimack River. Savage Budget Director/Town Accountant Town of North Andover 120 Main Street North Andover MA01845 Dear Ms. Savage: We are pleased to notify you that your comprehensive annual financial report(CAFR)for the fiscal year ended June 30, 2012, qualifies for a Certificate of Achievement for Excellence in Financial Reporting. The Certificate of Achievement is the highest form of recognition in governmental accounting and financial reporting, and its attainment represents a significant accomplishment by a government and its management. Each entity submitting a report to the Certificate of Achievement review process is provided with a "Summary of Grading" form and a confidential list of comments and suggestions for possible improvements in its financial reporting techniques. Your list has been enclosed. You are strongly encouraged to implement the recommended improvements into the next report and submit it to the.program. If it is unclear what must be done to implement a comment or if there appears to be a discrepancy between the comment and the information in the CAFR, please contact the Technical Services Center (312) 977-9700 and ask to speak with a Certificate of Achievement Program in-house reviewer. Certificate of Achievement program policy requires that written responses to the comments and suggestions for improvement accompany the next fiscal year's submission. Your written responses should provide detail about how you choose to address each item that is contained within this report. These responses will be provided to those Special Review Committee members participating in the review. When a Certificate of Achievement is awarded to a government, an Award of Financial Reporting Achievement (AFRA) is also presented to the individual(s) or department designated by the government as primarily responsible for its having earned the Certificate. As the designated individual we have enclosed your AFRA. Your Certificate of Achievement plaque will be shipped to you under separate cover in about eight weeks. We hope that you will arrange for a formal presentation of the Certificate and Award of Financial Reporting Achievement, and that appropriate publicity will be given to this notable achievement. A sample news release has been enclosed. We suggest that you provide copies of it to local newspapers,radio stations and television stations. Parish Church for the use of the Common on 6-16-2013. If they are using propane grills in excess of 20 Ibs they will need a permit from the Fire Department. A fire extinguisher shall be present for all cooking purposes. Is it possible to add a line or 2 on the application asking if propane gas will be used for cooking or any other purpose. BEB REMOTE PARTICIPATION AT SCHOOL COMMITTEE MEETINGS The North Andover School Committee shall conduct all its meetings pursuant Massachusetts General Law Chapter 30A and 940 CMR 29(the Open Meeting Law and regulations). It is understood that, under certain circumstances (as outlined in 940 CMR 29.10) it may be unreasonably difficult for a member of the board to be physically present at the meeting location The following are School Committee conditions for the remote participation: 1) The chair or, in the chair's absence,the vice chair must be physically present at the meeting. 2) If chair is to participate remotely,the vice chair will run the meeting pursuant to the agenda. 3) There must be a physical quorum at the meeting location. 4) All reasonable efforts to reschedule around the committee's availability will be done prior to considering remote participation. 5) Only one member of the board may participate remotely at any meeting. 6) All reasonable efforts will be made to provide maximal advance notice of the need for remote participation,so a technical solution can be provided. 7) The remote participant is expected to be presented visually in the meeting room and on any recordings. (2)Adoption of Remote Participation. Remote participation in meetings of public bodies is not permitted unless the practice has been adopted as follows: (a) Local Public Bodies.The Chief Executive Officer,as defined in M.G.L. c.4, sec.7, must authorize or, by a simple majority,vote to allow remote participation in accordance with the requirements of these regulations,with that authorization or vote applying to all subsequent meetings of all local public bodies in that municipality. (b) Regional or District Public Bodies.The regional or district public body must, by a simple majority,vote to allow remote participation in accordance with the requirements of these regulations,with that vote applying to all subsequent meetings of that public body and its committees. (c) Regional School Districts. The regional school district committee must, by a simple majority,vote to allow remote participation in accordance with the requirements of these regulations,with that vote applying to all subsequent meetings of that public body and its committees. (d)County Public Bodies.The county commissioners must, by a simple majority,vote to allow remote participation in accordance with the requirements of these regulations,with that vote applying to all subsequent meetings of all county public bodies in that county. (e)State Public Bodies.The state public body must, by a simple majority,vote to allow remote participation in accordance with the requirements of these regulations,with that vote applying to all subsequent meetings of that public body and its committees. (f) Retirement Boards.A retirement board created pursuant to M.G.L. c. 32 sec. 20 or M.G.L. c.34B, §19, must, by a simple majority,vote to allow remote participation in accordance with the requirements of these regulations,with that vote applying to all subsequent meetings of that public body and its committees. (3) Revocation of Remote Participation.Any person or entity with the authority to adopt remote participation pursuant to 940 CMR 29.10(2) may revoke that adoption in the same manner. (4) Minimum Requirements for Remote Participation. (a) Members of a public body who participate remotely and all persons present at the meeting location shall be clearly audible to each other; (b)A quorum of the body, including the chair or, in the chair's absence,the person authorized to chair the meeting,shall be physically present at the meeting location, as required by M.G.L. c.30A sec 20 d ; (c) Members of public bodies who participate remotely may vote and shall not be deemed absent for the purposes of M.G.L. c.39 sec. 23D. (5) Permissible Reasons for Remote Participation. If remote participation has been adopted in accordance with 940 CMR 29.10(2),a member of a public body shall be permitted to participate remotely in a meeting, in accordance with the procedures described in 940 CMR 29.10(7), if the chair or, in the chair's absence,the person chairing the meeting, determines that one or more of the following factors makes the member's physical attendance unreasonably difficult: (a) Personal illness; (b) Personal disability; (c) Emergency; (d) Military service;or (e)Geographic distance. (6)Technology. (a)The following media are acceptable methods for remote participation. Remote participation by any other means is not permitted. Accommodations shall be made for any public body member who requires TTY service,video relay service,or other form of adaptive telecommunications. (i)telephone, internet,or satellite enabled audio or video conferencing; (ii)any other technology that enables the remote participant and all persons present at the meeting location to be clearly audible to one another. (b)When video technology is in use,the remote participant shall be clearly visible to all persons present in the meeting location. (c)The public body shall determine which of the acceptable methods may be used by its members. (d)The chair or, in the chair's absence,the person chairing the meeting, may decide how to address technical difficulties that arise as a result of utilizing remote participation, but is encouraged,wherever possible,to suspend discussion while reasonable efforts are made to correct any problem that interferes with a remote participant's ability to hear or be heard clearly by all persons present at the meeting location. If technical difficulties result in a remote participant being disconnected from the meeting,that fact and the time at which the disconnection occurred shall be noted in the meeting minutes. (e)The amount and source of payment for any costs associated with remote participation shall be determined by the applicable adopting entity identified in 940 CMR 29.10(2). (7) Procedures for Remote Participation. (a)Any member of a public body who wishes to participate remotely shall,as soon as reasonably possible prior to a meeting, notify the chair or, in the chair's absence,the person chairing the meeting,of his or her desire to do so and the reason for and facts supporting his or her request. (b)At the start of the meeting,the chair shall announce the name of any member who will be participating remotely and the reason under 940 CMR 29.10(5)for his or her remote participation.This information shall also be recorded in the meeting minutes. (c)All votes taken during any meeting in which a member participates remotely shall be by roll call vote. (d)A member participating remotely may participate in an executive session, but shall state at the start of any such session that no other person is present and/or able to hear the discussion at the remote location, unless presence of that person is approved by a simple majority vote of the public body. (e)When feasible,the chair or, in the chair's absence,the person chairing the meeting, shall distribute to remote participants, in advance of the meeting, copies of any documents or exhibits that he or she reasonably anticipates will be used during the meeting. If used during the meeting,such documents shall be part of the official record of the meeting, and shall be listed in the meeting minutes and retained in accordance with M.G.L. c.30A sec. 22. (8) Further Restriction by Adopting Authority.These regulations do not prohibit any person or entity with the authority to adopt remote participation pursuant to 940 CMR 29.10(2)from enacting policies, laws, rules or regulations that prohibit or further restrict the use of remote participation by public bodies within that person or entity's jurisdiction, provided those policies, laws, rules or regulations do not violate state or federal law. (9) Remedy for Violation. If the Attorney General determines, after investigation,that 940 CMR 29.10 has been violated,the Attorney General may resolve the investigation by ordering the public body to temporarily or permanently discontinue its use of remote participation. This amendment says in part: "Any city or town receiving street lighting service from an electric company pursuant to a tariff which provides for the use by such municipality of lighting equipment owned by the electric company, ...may: (i) convert its street of lighting service from the subject tariff to an alternative tariff approved by the department providing for delivery service by the electric company electric energy,whether supplied by the electric company or any other person, over distribution facilities and wires owned by the electric company to lighting equipment owned or leased by the municipality, and further providing for the use by such municipality of the space on any pole, lamp post, or other mounting surface previously used by the electric company for the mounting of the lighting equipment of the electric company;" (The entire text is at Appendix A.) Communities now have the right to acquire the streetlights from their utility or Local Distribution Company(LDC), for their depreciated value. The method for calculating this value has been addressed in a number of Department of Telecommunications and Energy (DTE) rulings: 98-89, reaffirmed in DTE 01-25 in 2001, and most recently in regards to the Massachusetts Electric Company(NGRID) in 03-98. The DTE is now called the Department of Public Utilities(DPU). Each utility uses a different approach to these calculations depending on the data they have available in their records. The Legislation also provides for Communities acquiring some or all of their fixtures. The cost to a City or Town that owns and maintains its own streetlights is from 20% to 40% cheaper per year than the utility owned and maintained cost. The amount of savings depends on which utility serves the community and the type of fixtures in the community. Objective The objective of this financial analysis is to provide the Town of North Andover with the information necessary to determine whether to proceed with the acquisition of their streetlights as provided for in the Legislation. This report reviews the various financial considerations associated with the acquisition, ownership and maintenance of some or all of the streetlights as provided for in the Legislation. These include the applicable utility tariff costs,maintenance costs, property taxes, insurance, purchase price and other factors pertinent to the decision making process. Information was gathered from various Town Departments,the Massachusetts Electric Company (MECO/NGRID) approved tariffs (as published by MECO), financial organizations that provide tax-exempt municipal financing, and streetlight equipment manufacturers and suppliers. Note:through previous Prepared by Siemens Industry Inc,June 2013 2 For the Town of North Andover consolidation in the utility industry,NGRID now owns MECO, and the terms"NGRID" and "utility" are used interchangeably hereafter in this report. Process The usual steps to acquiring the streetlights are as follows, 1. Request purchase price information from the utility. 2. Economic analysis to determine benefit and payback of acquisition. 3. Notification of intent to purchase,triggering the sixty-day(60) clock. 4. Determination of the desired approach to maintenance and issuance of RFP as applicable. 5. Negotiation of the Purchase& Sale and License Agreements as required. 6. Completion of transaction and notification of citizens of the change. Update of any Town publications to reflect reporting procedures for outages. The Legislation provides the utilities must sell their lights for the net book value at the time they receive notification from the community of their intent to purchase. The terms of the sale will be covered in a Purchase and Sale Agreement negotiated with the utility. The community will acquire all assets associated with the streetlights including: underground feeds and conduits to the point of connection to the utility distribution system, any poles that are dedicated to streetlights and have no telephone or electric distribution lines on them, and all streetlight brackets and fixtures. All joint-use poles(those with either telephone or electric distribution wires)will be subject to a Joint Use License Agreement governing the responsibilities of each of the joint users of the pole. These Agreements are based on the standard agreements the utilities have with other joint users. Two years ago, NGRID added a requirement that all customer lights be fused. We were able to negotiate that that work would be done in conjunction with any ordinary repair and that the community would have up to ten years to complete the work. Negotiations with NGRID on the terms of the two Agreements should be minimal. Once the lights are acquired, the community becomes responsible for their maintenance as well as any dedicated poles and underground feeds. NGRID will reserve the right to make and break the electrical connection to their distribution system and for any work in their manholes. As such, the utility may perform any work necessary between their manhole and the streetlights for underground fed lights, make or break any secondary overhead connection, and bill the Town for this work. The details for this division of responsibility will be spelled out in the Joint Use Agreement. The addition of any new fixtures or the conversion of fixtures to alternative lighting sources requires the prior approval of the utility. The maintenance can be performed by contract, in-house or a combination of both. These options will be discussed in detail later in this report. Prepared by Siemens Industry Inc,June 2013 3 For the Town of North Andover Pole Attachment Fees The Legislation provides sixty—days (60) to resolve any issues with the utility in regards to the Purchase and Sale Agreement and the Joint Use License Agreement. Thereafter, any unresolved issues may be taken to the DPU for resolution and they in turn have sixty-days to resolve any disputes. A pole attachment fee for each streetlight was one of the unresolved issues remaining when the Towns of Lexington and Acton filed with the DPU (DPU 98-89) for resolution of the terms of purchase and sale and the purchase price calculations. The utilities currently receive a pole attachment fee from other non-utility users of the pole such as the cable television companies. The DPU ruled there would be no pole attachment fees for the time being but it was left as an open issue the utilities could address at a future rate filing. Communities already have the right to attach fire alarm wires to the poles without charge and as a part of the Grant of Location process could provide for the attachment of streetlights as a condition of approval for any future Grants of Location applications. Additionally, if the utilities were to charge the community a pole attachment fee,the community would be within its rights to charge the utility a pole site rental fee in recognition of the additional expenses the community incurs as a result of poles placed in the public way.t This issue has not been revisited since 1998 and remains an open issue. The utilities have thus far not addressed this issue in any subsequent rate filings and it appears unlikely they will do so in the future. Applicable Tariffs NGRID currently has five tariffs that apply to unmetered street lights: S-1, S-2, S-3, S-5 and S-20. The S-1 tariff applies to utility-owned and maintained streetlights and is the current applicable tariff for most streetlights in the Town. It consists of 1) a fixed charge based on the size, type, and class of the luminaire (Luminaire Charge), 2) an energy charge (Transmission, Transition, Default Service Adjustment, Demand Side Management and Renewable Energy and a Generation Charge) based on the energy consumption of the fixture, and 3) Pole charges for non-standard poles. Included in the fixed monthly luminaire charge are distribution, depreciation and maintenance costs. The fixed luminaire charges are divided into three lamp types: Mercury Vapor, High Pressure Sodium, and Incandescent. Unfortunately, as of this report NGRID has not adopted any provisions for any alternative light sources such as induction or LED. The S-5 Tariff applies to municipally owned and maintained streetlights and is the tariff which would apply to the Town if they acquired their streetlights. This tariff is based on an energy charge for each type of lamp and the operating hours during each month. There are no pole charges under this tariff and it does not provide for maintenance. Therefore, communities under this tariff must provide their own maintenance either through contract services, in-house work force, or a combination of both. I There is one community in Eastern Massachusetts that currently charges such a fee.To date this fee remains unchallenged. Appendix C contains spreadsheets based on these tariffs used to calculate the annual costs of North Andover's particular inventory of streetlights. The other tariffs, S-2, S-3 and 5-20, are special tariffs for unique circumstances. Gross Savings Table 1 below summarizes the projected costs and includes the cost of a typical full service maintenance contract derived from current bid prices in other communities. Table 1. The energy costs were calculated using$.0750 supply costs. This is based on typical supply contracts. The current fixed rate from NGRID for street lighting is $.0700 but it was over eight cents. Supply costs do not affect the savings except when considering alternative light sources as the supply costs remain the same regardless of ownership. Table 1 illustrates the gross potential annual savings,which must be adjusted by amortization of the purchase price, loss of tax revenue, and other factors outlined later in this analysis. It provides the gross savings from which these other expenses are deducted and provides the basis for later calculations. It also assumes a commercial contract for maintenance. Should the Town elect to enter into an intermunicipal agreement with a municipal power company these savings will be somewhat lower but so will the risks of unexpected costs and/or contractor default. The projected CY 2013 bill under both scenarios was calculated using the January 1, 2013 approved S-I and S-5 tariffs for NGRID and applying North Andover's specific inventory. Maintenance is estimated at $12.60 per fixture per year plus a contingency to cover Prepared by Siemens Industry Inc,June 2013 5 For the Town of North Andover relocations, knockdowns or other unexpected repairs. Recent bids in other communities have been somewhat lower; however, it is important that the estimates are conservative. Based on the current tariff rates,the estimated contract maintenance costs, and assuming acquisition of only the overhead fed streetlights,the gross annual savings would be $52,193.34. Other miscellaneous expenses outlined below will further adjust these savings. Purchase Price NGRID's stated purchase price for all fixtures is $145,098.46. Of this price, $43,418.70 is allocable to the 7 underground serviced streetlights and the balance to the overhead serviced fixtures, $101,679.76. This includes all of the lights currently paid for by the Town covering 4 different accounts and including the School Department. North Andover's system is predominately newer high-pressure sodium fixtures installed by NGRID in the early 1990's. There are still two mercury vapor lights listed on the inventory which may or may not exist. It is more likely they were changed and the inventory was not updated. The inventory indicates that one is on Osgood Street pole#1970 and the other on North Main Street on pole#228. Included in Appendix B is the purchase price information supplied by NGRID and the breakout by account number and department. Partial or Full Acquisition The Legislation provides for the acquisition of some or all of the streetlights. This section will examine the economics associated with partial acquisition. The most logical division is the overhead and underground fixtures. The underground fixtures are the most expensive to purchase and potentially the most expensive to maintain if the underground service needs repair. The purchase of the underground serviced fixtures includes the light, bracket, pole, underground conduit, and wires. Refer to Appendix B and C for the purchase price and detailed spreadsheets used to determine the costs associated with this section. The purchase price of the overhead serviced system is $101,679.76. The cost of the seven underground fixtures is $43,418.70; they represent .0054%of the total fixtures but almost 30%of the cost. Not purchasing the underground fed fixtures will decrease the savings by only about $1,000 per year as the increased NGRID costs are partially offset by maintaining higher property taxes. These fixtures are post top decorative fixtures located on two neighborhood streets: Foxwood Drive and 1 st Street. The routine maintenance contract price for the streetlights is independent of whether they are overhead or underground fed. Consequently, the expected fixed maintenance costs are unaffected by a partial purchase. However, most of the potential for greater unexpected costs is associated with the underground fixtures. Under the S-5 tariff, the energy cost for each type fixture is the same as it is based solely on energy use. Repairs to the poles or the underground wiring would be an extra cost paid on an as required basis if the Town acquired all of its lights. The frequency of failure of an underground feed is very small. However,these repairs can be expensive and must be accounted for under any purchase scenario. If the Town purchased the underground fed fixtures only, the contingency Prepared by Siemens industry Inc,June 2013 6 For the Town of North Andover allowance would have to be proportionately larger to account for the potential underground feed problems and the occasional knockdown. This was done in the above analysis Acquiring only the overhead fixtures may create the requirement to label every streetlight to identify ownership and educating the public as to who to call in the event of an outage. If the utility responds to a light that is owned by the Town,they will not complete the repair and will bill the Town for the erroneous service call. The utility will oppose only a partial acquisition, but experience from previous acquisitions provides sufficient precedent for partial acquisitions such as the one (i.e., overhead fed system only) proposed here. It is quite evident that the Town should not purchase the seven underground fed fixtures. Notifying the residents on those two streets will be relatively simple and there will be little complication from excluding them from any service contract. There are four other overhead fed lights on 1 st Street which would be part of the purchase. Property Taxes The street lighting equipment subject to purchase is part of the basis for the taxes paid by the utility to the Town. Subsequent to the purchase, the purchase price will be deducted from that basis resulting in the loss of revenues from property taxes paid by the utility. The Town receives a property valuation statement from the State each year in regards to the tax basis of the utility and this should be closely monitored if the Town chooses to acquire the streetlights. Street lighting is included on that statement in the Distribution Plant 373 account with some portions also included in the 364, 365, 366 and 367 accounts. These should be closely monitored for change. The Town's current tax rate(FY2013) is $18.85, which if the entire system is purchased will result in a loss of$2,735.11 in tax revenue assuming no change to the purchase price. If the Town only purchased the overhead system,then the lost tax revenue would be $1,916.67. Contract Maintenance The Attorney General's Office has issued an opinion that affects the maintenance of streetlights. Qualified personnel must perform the work, prevailing wage laws do apply, and public works statutes govern portions of the maintenance work. This is work other than routine maintenance. As a result, maintenance contracts including this other work are best bid under MGL 30-39m of Chapter 30. Alternatively if the Town is contemplating a conversion to LED or some other technology they may also bid the project under MGL 25A § 1 I or an RFP which would provide the advantage of a single vendor supplying the materials doing the install and warranting the savings. This can come with a ten year warranty and all other minor maintenance the Town might require, saving the Town having to reissue bids for non-covered services every three years and the complications resulting from having one company for warranty repairs and another for maintenance. Once the Town owns the lights, it is responsible for the fixture and bracket on all joint use poles, and the fixture, bracket, and pole for any dedicated poles-that is, poles that serve no other purpose except streetlights. North Andover has nine(9) dedicated poles. In the case of a pole that has no utility lines, electric or telephone, but may have cable television, then Prepared by Siemens Industry Inc,June 2013 7 For the Town of North Andover the fees currently paid to the utility by that entity would be paid to the Town. It is recommended the Town not purchase the seven underground fed fixtures leaving only two dedicated wood poles to be part of the purchase. If a joint use pole (utility owned)needed replacement, the Town would be responsible for reattaching the streetlight to the new pole. Pole replacement of the joint use poles remains the responsibility of the utility. In the case of the two dedicated poles, the Town would be responsible for the pole replacement as well as the fixture and bracket. Maintenance services should include a call center, seven-day maximum repair time (five working days), quarterly outage inspections of every lamp, a fixed price for services, and contractor coordination with the utility whenever required. The Town would receive monthly detailed reports of all services rendered. The contractor would also be responsible to contact the reporting party if the repair cannot be completed within the prescribed seven days. Bids for this level of service have ranged from$1.00 to $3.00 per lamp per month. The majority of these bids, where the bid was designed for maximum bidder participation, have been below$1.30 per lamp per month. I have selected $1.05 as a base price for estimating the cost of the contract services plus a$5,000 contingency for any unexpected decorative fixture replacements and/or underground repairs. In Massachusetts,the rates have dropped over time as the work has been very competitive and the experienced contractors have continued to refine their operations. If an intermunicipal agreement with a municipal light company is selected, theses costs could be as high as $2.00 per light per month but would include a broader range of services. Clearly the installation of LED streetlights would have a dramatic impact on the required maintenance due to the typical seven to ten year warranties on LED lighting from high quality manufacturers. This will be discussed in more detail later in this report. In-house Maintenance MGL 141 Section 7 exempts the maintenance of street lighting in the public way from the supervision of electricians;therefore, Town DPW personnel with some minimum level of safety training can perform it. The National Electric Code also exempts street lighting in Section 70-90-2. However, all reasonable aspects of the electric codes should be adhered to as a matter of good practice and safety. The final authority is the Town's Wires/Electrical Inspector. Maintenance of the bulbs and photocells, general cleaning, and tree trimming can be performed by any employee licensed to operate a bucket truck. Town employees should receive additional safety training for working in proximity to high voltage lines, working on ungrounded fixtures, hazardous material disposal, CPR, and rescue from high voltage lines. Changing of bulbs and photocells is quite simple and represents over 85%of the failures. Repairs of ballasts, starters, igniters, and fixture replacements would require additional training in electrical skills and safety. The Town could use an in-house electrician for this work or contract for on call services. The Town of Lexington has followed this approach. They use their Tree Department personnel on an overtime basis to do all non-electrical repairs and have a standing contract with an electrical contractor for all other work on a time and materials basis. Most contractors will use only one employee per vehicle for routine streetlight repairs. Most Cities and Towns will typically use at least two Prepared by Siemens Industry Inc,June 2013 8 For the Town of North Andover employees per vehicle citing safety reasons. Maintaining 1,308 streetlights would not be a full time job for one person(less than 250 man hours per year exclusive of knockdowns and new installations) so unless that person's time is allocated against other cost factors, contract maintenance would be cheaper than performing some of the work in-house and contracting the rest. The Towns of Amherst, Lexington, Maynard and Milton are performing work in-house. Amherst is also serving the Town of Erving. Both Amherst and Milton use qualified electricians and manage all aspects of their maintenance in-house. Amherst saw an opportunity to use the streetlight savings to hire a full time electrician to do both their streetlights and other electrical work that they previously contracted. This has proven to be cheaper and more responsive to their needs. Amherst is also providing maintenance to the Town of Erving on a time and materials basis. Maintenance of streetlights requires an insulated bucket truck with the capability to reach at least 35 feet. These trucks cost upwards of$100,000. Before deciding on the maintenance approach, the Town should carefully consider the importance of the public's perception and the political aspects of the decision. Taking over the lights needs to be a smooth transition and the public needs to see that responsiveness is improved. The advantage of a contract company initially is that they can be held to a standard and the Town can gather information over the contract period to see in detail what it will take to maintain the lights in house. As a general rule, it is a good idea to start with a contract service and transition later. When evaluating the costs, keep in mind the true cost of a public employee is much more than their salary and benefits. Intermunicipal Agreements Towns can also enter into service agreements with neighboring communities that have a municipal utility. Currently Wellesley, Littleton, Reading, Paxton, and Wakefield Municipal Light Companies have provided this service to neighboring communities. Today only Paxton continues to provide service to Spencer. All other communities who had used neighboring Muni's have gone to contract maintenance. Generally the municipal light companies do not want to go beyond their abutting towns. Costs for these services range from$2.00 to $3.00 but generally provide for more comprehensive services and less unexpected costs. Wellesley Municipal Light Company was providing these services to Newton for $2.03 per light per month from 2000 to 2005. Subsequently Newton brought these services in house and used the fire department alarm technicians to do the work. Today they contract for these services. Communities must examine their expectations and judge the trade-offs between risks and costs they are willing to bear in selecting a maintenance service approach. A properly written maintenance contract with a municipal utility company can provide an excellent level of service with minimal risk to the Town, however to date all but one of these has not continued beyond three to six years. Entering into intermunicipal agreements requires specific approvals and processes in accordance with Massachusetts Laws and Town requirements. These requirements can introduce some delays in finalizing an Agreement but should not be a hindrance. Prepared by Siemens Industry Inc,June 2013 9 For the Town of North Andover Extra Costs A typical service contract will include routine maintenance for component failure due to normal age and or deterioration, a call center, outage inspections, general cleaning, and tree trimming within three feet of the lamp in conjunction with any repair. The community would be charged separately for new installations, replacements, removals, repair to underground service,transfer of a light from an old pole to a new pole, and knockdowns. In general, the knockdown rate is less than 0.4% of which less than 10%of those involve a hit and run. The likelihood of a knockdown with only two poles is fairly remote. However, in those instances, the Town would bear the full cost of any dedicated poles and the cost of the fixture or in the event of a joint use pole, the cost of attaching a new fixture to the utility pole and the reconnect fee. A new fixture with a standard six-foot bracket is approximately$500-600 installed and a new fixture is $175-225 installed without the bracket. Acquisition of the system would include two poles. In the event of a knockdown of one of those poles from an unknown cause, the Town will bear the full cost. The contingency of$5,000 will cover the typical extra cost expenses. Alternatively, some allowance can be included in the Town's reserve account. These funds would be available if needed;otherwise they could be used for other purposes at the end of the fiscal year or become part of free cash. The Town could also include them in their insurance policies. The Town has direct control over the addition of new lights. The included contingency in the estimates should cover the addition of a limited number of new lights. Insurance The main risk the Town accepts with ownership of their lights is the risk of a major storm damaging a large number of streetlights. To cover this possibility, the Town may wish to consider adding streetlights to their current insurance plan. The cost for such insurance is minimal since the risk is relatively small. Typically after such an occurrence both State and Federal aid (FEMA and MEMA) is available. You may also wish to include in the policy provisions for the occasional knockdowns. The likelihood of one of the dedicated poles being struck by an uninsured motorist or of a hit and run is small. In the case of an insured motorist, their insurance would reimburse the Town. There are a number of firms who specialize in seeking reimbursement for Cities and Towns. Additionally, should the Town use a contractor for maintenance, the contractor will typically request that they be allowed to deal directly with the insurance carrier as they can collect a larger sum. The Town should plan for one knockdown every two years and some reinstallation of brackets and fixtures associated with the utility replacing poles as part of their routine operations. The Town of Lexington's 3,500 streetlights (roughly two and half the number in North Andover) increased liability insurance costs were approximately$150 with the Town doing the work. The City of Lynn's policy for 7,000 lights was just under $10,000 annually. The Massachusetts Municipal Association's insurance program(MIIA) has indicated they would include street lighting at no additional cost. This, of course, is entirely dependent of the level of coverage the Town seeks. The more urban nature of North Andover would likely increase these costs slightly but the experience thus far has been these costs are quite low. The level of savings would pay to replace the entire system every six years. Included Prepared by Siemens Industry Inc,June 2013 10 For the Town of North Andover in a contract maintenance service is the requirement that the contractor provide liability insurance for their equipment and personnel as part of their costs and both the Town and utility are named as additional insured. If the Town chose to enter into an intermunicipal agreement,then the serving entity should be required to provide liability insurance. This would reduce the Town's exposure and costs. Paxton Municipal Light Company provides this insurance coverage for Spencer. Note: expected insurance costs are of minimal value in the overall analysis, therefore,they can be included within contingency estimates. Police Details As a rule, communities do not supply or require police details for streetlight repairs. The work is usually accomplished quickly with minimal interruption of traffic. The contractor is required to provide appropriate traffic warning devices as well as completing work on any main thoroughfares outside of normal peak traffic periods. Police details would be required for new installations and during knockdown repairs. The cost of police details for knockdowns would be paid by the utility company in the event of a joint use pole. New installations can be scheduled at night to minimize these costs. The Town is typically responsible for the cost of police details and this was a consideration in the contingency. Miscellaneous Utility Costs The License Agreement with the utility for joint use poles provides certain services in conjunction with streetlights that must be performed by the utility(NGRID) personnel on a reimbursable basis. Only the utility can make or break the connection to their secondary lines. The typically fee for this service should be approximately$127 (based on their most recent Agreement). However, the wires between the lamp and the secondary connection can be cut without the involvement of the utility. This is common practice and can be performed by any qualified person. Therefore, these costs are easily avoided in most circumstances. Connections in manholes will have to be performed by NGRID, as they will be reluctant to allow any outside personnel not under their direct supervision into their manholes. The maintenance contractor can break the connection inside the hand hole in the pole. The Agreement requires the Town have the utility's approval before installing a new light on any existing joint use utility pole. The utility would conduct a survey to determine if a streetlight can be safely attached to the pole and bill the Town for the inspection service. Fees will be quoted at the time of the request. The contingency maintenance costs will cover general expenses in this category. The routine maintenance contract price for the streetlights is independent of whether they are overhead or underground fed and under the customer owned S-5 tariff, the energy cost for each is the same as it is based solely on energy use. Repairs to the poles or the underground wiring would be an extra cost paid on an as required basis if the Town acquired all of its lights. The frequency of failure of an underground feed is very small. However,these repairs can be expensive. The recommendation is not to purchase the underground fed lights so this should not be an issue. Where the underground feed serves more than just the lights,the utility will retain responsibility for those repairs. Prepared by Siemens Industry Inc,June 2013 1 1 For the Town of North Andover Lighting Levels There are no State or Federal laws requiring streetlights. The historical trend in street lighting has been to increase lighting levels. There are some areas of Europe already experimenting with this paradigm shift in lighting philosophy and quite interestingly is this approach was used long before its time on Main Street in Fall River in the City Hall Plaza area (see photo below). e r �r � ,2W Communities may adopt a street lighting ordinance but this seems to be an uncommon practice in Massachusetts. There is also a risk associated with adopting standards in that once you adopt a standard, you are then bound by the standard and face liability risk if you do not ensure it is continuously met. The Illuminating Engineering Society of North America(IESNA) does publish guide lines in their RP-8 Roadway Lighting Design Handbook. These guidelines divide roadways into four classes: Expressway or Major Arterial, Arterial, Collector and Residential. Each of these is further broken down based on pedestrian conflict levels: low, medium and high. Recommended lighting levels are published for each roadway class and pedestrian conflict level. Most community street lights were not installed using these guidelines but rather their locations were more likely based on the utility pole location. What we frequently find is a mix of wattages and light levels on each class of roadway. Communities that take ownership of their lights will have to deal with citizen requests for more or less light, different style lights etc. It becomes important to develop some form of lighting guidelines to make addressing these requests easier but we strongly recommend against adopting standard or an ordinance because of the potential liability risk it introduces. North Andover's streetlights are almost all high-pressure sodium lamps except the 2 mercury vapor lamps. There are 209 streets in the Town and 60 of these streets have lights of multiple wattage on them(see Appendix C). Normally a street would have only one assigned wattage based on its classification with exceptions only where the pedestrian conflicts were higher or there were special considerations. All of these streets should be Prepared by Siemens Industry Inc,June 2013 12 For the Town of North Andover reviewed for the appropriate wattage. Two thirds of the lights are on those 60 streets. The Town also has 13 400 watt lights. The 400 watt lights are much brighter than the IESNA (Illuminating Engineering Society of North America) recommended levels in most typical municipal applications and also create significant glare at standard street light mounting heights. These can typically be replaced with 250 watt or lower wattage lights and still provide more than adequate light levels. Consideration of wattage changes must take into account current lighting levels, route classification, pedestrian activity levels, pole spacing, uniformity, utility tariffs, and the IESNA RP-8 Guidelines. The Town's streetlights are predominately high-pressure sodium lamps. The two (2)mercury vapor lights should be replaced with more energy efficient fixtures. It is also very likely these do not exist and the Town is being improperly billed for them. They should be checked. The photo below illustrates the affect of glare and how it can wash out the details behind the light. Excessive glare can obscure details causing decreased visibility especially in the elderly. Many Cities and Towns that have taken over their lights have also implemented system changes that made the lighting more uniform and energy efficient. These changes also brought their system into closer compliance with some form of guideline that could be used when evaluating citizen lighting requests. gli rvr )Ifl Yellow fixture is a 400 watt/50,000 Lumen HPS In order to determine what wattage reductions are possible, a detailed review of lamp wattages and locations would have to be conducted. Clearly some areas would require the existing illumination levels be maintained. However,the current budget challenges offer the Town a window of opportunity where the political climate of the voters would permit some such reductions. A careful review of each area and its associated factors should be done prior to any recommendation for lumen level reductions. The reductions in lumen levels from 50,000 to 27,500 would likely be seen as an improvement due to the glare reduction and from 27,500 to 16,000 would still keep lighting generally within the IESNA recommendations, depending on spacing and mounting height. Conversion to LED lighting would also be an opportunity to make the lighting levels more uniform throughout the Town. Prepared by Siemens Industry Inc,June 2013 13 For the Town of North Andover The amount of savings realized through the use of lower lumen fixtures and or more energy efficient fixtures is increased if energy rates increase. The next section deals with the latest in street lighting technology. Energy Efficiency Improvements-Light Emitting Diode(LED) Technology LED technology has progressed to the point where it is a very cost effective alternative to the widely used high-pressure sodium (HPS) and metal halide (MH)technology. Today there are fixtures available that are nearly twice as energy efficient as the current family of High Intensity Discharge (HID) streetlights (e.g. high-pressure sodium, metal halide, multi- vapor, halogen, and mercury vapor) and have life expectancies 16 times greater than HID lights. The performance combined with falling prices have led to major conversions such as Boston and Los Angeles. Arlington and Watertown as well as Fairhaven have completed partial conversions and are moving to full conversions this year. As of this report, however,NGRID has still not yet embraced LED technology but they are in the process of evaluating it and do intend to provide a tariff supporting LED technology in the future. We also anticipate they will provide incentives for the conversion. Currently NSTAR is supporting LED technology and provides a 25 to 30 cent per kWh saved incentive for them. NGRID is not likely to be as generous but their minimum incentives have been between 15 and 18 cents per kWh saved. LED technology, in addition to its long life, also provides a white light source which has been shown to enhance nighttime visibility and there is some anecdotal information showing a reduction in crime associated with its implementation. The white light source does improve nighttime visual clarity and the ability to distinguish colors both of which assist the police with identification of suspects. Based on price quotes seen in other Cities such a project to convert the entire system to LED technology would cost roughly$490,000 dollars but result in annual savings of over $100,000 annually when combined with the acquisition savings. This project would have a simple payback of under four and a half years not counting financing costs and assuming a utility incentive based on $.18/kWh saved. Financed over ten years,the Town's net savings after all costs would still be roughly$35,000 annually increasing to $116,000 once the conversion project and purchase costs are paid off. This compares to a savings of$33,000 annually assuming the purchase were financed over the same period. Conversion to the LED technology would result in an annual energy savings of 57.1% or 290,000 kWh per year. Additionally, maintenance costs would be reduced by 50%to 70%. This would greatly assist with meeting Green Community energy goals. Conversion to LED lighting has proven to be very well received in other communities. Politically the combination of the takeover of the system with an LED conversion provides the public with a dramatic improvement in their lighting and at a significantly reduced cost providing wide public support and a very positive accomplishment for the Town leadership. Prepared by Siemens Industry Inc,June 2013 14 For the Town of North Andover Alternative Conservation Option An option which could produce a small additional savings that NGRID would support immediately would be the reduction of the 400 watt flood lights to 250 watts or lower. This has been done routinely in many Cities and Towns and the light level reductions are seldom noticed. There are 9 each 400 watt flood lights and four 400 watt roadway lights in the Town and replacing them with 250 watt lights would save 12,500 kWh per year or $1,589 at today's energy rates. Such a project would cost about $4,000 and qualify for a minimum grant of$1,900 for a net cost of$2,100 and a payback of under two years. This could be easily covered by the first year's savings from the acquisition. Replacement of some or all of the 400 watt fixtures with new fixtures lower than 250 watts would further decrease project costs and payback time, and further increase the NGRID grant amount. Financing Options Clearly there are more than sufficient savings to cover financing acquisition costs out of the current budget. Once the Town decides to move forward, it would take at least sixty days to complete the acquisition process based on the law. Hopefully NGRID will adopt an LED program by the summer in which case the Town could include the conversion as part of the financing. The Town can finance the acquisition and conversion project using a variety of means. 1. Appropriation 2. Bonding 3. Lease 4. Cash Reserves Appropriation: Appropriation offers the lowest cost of money. If the Town opted to appropriate the purchase price, it would see the $52,000.00 in savings immediately, which translates to about $4,300 per month. Bonding: Bonding offers the lowest cost of borrowing with rates today at approximately 1.5% or lower. There are a number of up front costs associated with bonding that must be considered when comparing this method to other options. These costs include underwriter fees, legal fees, paper fees, insurance, etc. These costs can significantly affect the cost of borrowing particularly with small amounts (<$400k). In the case of a$101,679 bond,the issuance costs combined with the time delay to issue a bond would more than offset the savings associated with lower interest rates of a bond. It simply does not make sense to bond such a shall amount unless it is part of a much larger bond issuance. The Town could use a lease option as a temporary bridge to bond financing and mitigate the time delay. If the Town is contemplating a larger bond issue for some other purpose,this could be rolled into that bond spreading the issuance costs over the larger amount. The streetlights have a relatively quick payback compared to typical bond periods so the streetlight purchase would provide positive cash flow to help pay the larger bond issue. Prepared by Siemens Industry Inc,June 2013 15 For the Town of North Andover Leasing: Lease arrangements using tax exempt municipal financing can provide an excellent alternative to borrowing. These contracts are year-to-year leases subject to annual appropriation. As such, they are not a borrowing. They can be structured to allow the full cost of the streetlight program to be within existing appropriations and provide some annual savings depending on the term of the lease. Current representative lease rates for a$100,000 lease range from 2.6%to 4.5%. Actual rates will vary from these depending on the Town's bond rating treasury rates at the time the contract is signed, the amount financed,the term of the lease and whether or not the lease payments are made monthly in arrears or annually in advance. There are no lease initiation fees or costs except for the Town's legal review of the lease document. These leases can be set up to have no or minimal prepayment penalty. Should the Town at some time during the term of the lease,wish to pay it off with money from another source (e.g., a bond issue for other capital needs) they could do so. Consequently, the lease option can provide a"bridge"to other financing. The shorter the term of the lease,the greater the long-term payback. More companies will be willing to finance the shorter term and interest rates are lower. However,the longer-term leases provide a greater immediate savings and if the Town would plan to retire the lease early, the effective interest rate is reduced and the long-term savings can be maximized. Cash Reserves: Those communities that have sufficient reserves and believe this would be an appropriate use of these funds can use cash reserves. The cash reserves could be replenished over time from the savings in the street light account. This approach provides a viable alternative to the appropriation approach and avoids the cost of borrowing. However,the interest earnings of the cash reserves must be considered, as those revenues would be lost. Most communities, due to restrictions on investments, earn only 5-6% on their cash reserves and currently even less. The lease option and bonding can be break- even or even slightly cheaper than using cash reserves at the current interest rates. The payback is less than three years for the acquisition of the entire system in its current configuration or the overhead system only using the lease option. There is no question the future of street lighting will be in light emitting diodes(LED's). These are exceptionally energy efficient light sources with up to 100,000 hours mean time to failure. The efficiency of the LED is improving very rapidly and the costs are coming down. A common question is: why not wait when they will be even more efficient and less expensive? The answer is relatively simple. The vast majority of the savings will be from the conversion to the technology and the technology improvements are measured against the installed LED. If we look at North Andover, we see a savings of over $62,000 of the total$116,000 potential associated with the LED conversion today. Waiting will be measured against the remaining 57% of the energy savings today. So if there is an improvement of say 20% over what we could achieve today it would be worth another $7,147 a year in savings2 but the one year delay in the project would have cost the Town over $62,000 in savings So given the current pricing and efficiencies it does not make 2 Conversion today would reduce the annual kWh from 506,603 to 217,448.A 20%increase in LED efficiency would be 57,831 kWh which at$.12358 per kWh is worth$7,147 in annual energy savings. Prepared by Siemens Industry Inc,June 2013 16 For the Town of North Andover economic sense to wait. It would take over 8.6 years to make up for what was lost due to waiting. Table 2 below illustrates the savings associated with acquisition(overhead system only) and conversion under several lease terms of varying length. Lease terms of 7-10 years create a positive cash flow. The increased interest payments associated with changing the lease terin from 3 years to 10 years is approximately$53,000 over the 10-year period as shown in the bottom row of Table 2. Table 2. Street Lighting Policy Once the Town owns the streetlights, requests for additional lighting, light removals, dark sky issues and so forth will become the Town's issues. The Town should develop a policy as to how they plan to deal with requests for changes in the lighting levels and other related issues. Existing lighting levels should be reviewed and a policy established that would over time align the existing lighting to be consistent with the developed policy. Thus, whenever a light fails and the lamp head must be replaced it would be replaced with the appropriate type fixture for that location. Such a policy should be based on a lighting philosophy that addresses the purposes of street lighting and provide a basic guideline for decision making. Included should be: Prepared by Siemens Industry Inc,June 2013 17 For the Town ofNorth Andover 1. Requests for new lights or increased wattages, 2. Requests for removals, 3. Types of fixtures permitted, 4. Light trespass and light pollution, 5. Permissible lighting levels for various applications, and 6. Process for application and decision. Typically an application is made to the Town Board of Selectmen who in turn would give the request to a committee for review and recommendation. Represented on the committee are the Police, Fire, DPW and Planning Board. They would review the request against the established criteria and make a recommendation to the Board. It may need to be reviewed by the budget committee, as changes will impact on the current and future budgets. There is a-legislative effort to implement a policy directing any newly installed fixtures be full cut-off fixtures to reduce light pollution and spillover light. Any policy should take this legislation into account, as it will very likely become a matter of law. Finally, the Town may wish to address outdoor lighting in general as a part of their policy. There are a number of example policies available, which the Town could use as a basis. Summary This analysis demonstrates the potential value of acquiring the streetlights and especially combining it with a conversion to the LED technology. This would be both a financial and political win for the Town with the risk taken on by the selected vendor who completes the install and provides the full term warranty service. The Town saves money, gets better lit streets and minimal risk. Ownership of the lights will provide the Town the ability to take advantage of technological advances and to choose the type of lighting they desire without reliance on the utility for cooperation. It was this very issue that led to the writing of the legislation that gives Cities and Towns the right to take over their lights in Massachusetts. Issues such as light pollution, color quality, life cycle costs, lighting levels, and lamp styles become a matter of choice for the Town. Gallagher, Chief of Police DATE: June 1, 2013 RE: May 2013 Crime Statistics Throughout the month of May the North Andover Police have been busy with the arrival of the spring and summer weather and outdoor activities. This month the police assisted with Walk to School Day, Earth Day,North Andover Little League opening day parade, Memorial Day parade, Walk for Youth, Cystic Fibrosis walk and the Sheep Shearing festival. All of these events went off without incident. We have reports that the sheep shearing was the biggest event in recent years. The officers on shift, volunteer officers and Special Officers did an excellent job keeping the events safe for pedestrians and motor vehicle traffic at no cost to the organizers. On May 2nd the North Andover Police Department received it official accreditation certification from the Massachusetts Police Accreditation Commission. The police accreditation team, town manager and members of the Board of Selectmen attended this distinguished ceremony. During the month of May the Police Department held an awards ceremony in recognition of local students and the Take 25 Program, The Take 25 program is a preventive child safety campaign created by the National Center for Missing &Exploited Children(NCMEC) in honor of National Missing Children's Day. Annually honored on May 25th,this day serves as a reminder to the nation to make child safety a national priority. Designed to raise awareness of the issues surrounding missing and exploited children,the Take 25 campaign encourages parents, guardians, educators, and others to take 25 minutes to talk to children about safety. With a focus on prevention,Take 25 provides communities with free safety resources including safety tips, conversation starters, and engaging activities. The awards were presented in the Community Room of the North Andover Police Station. Special Guests included representatives from State Senators Bruce Tarr and Kathleen O'Connor- Ives offices, State Representatives Jim Lyons and Diana Dizoglio,District Attorney Jonathan Blodgett and North Andover Assistant Superintendent Greg Gilligan. 1475 Osgood Street, North Andover, Massachusetts 01845 Telephone: 978-683-3168 Fax: 978-685-0249 The North Andover Police saw the retirement of many senior officers during the month of May. Sergeant. Thomas J. McEvoy, Officer John McEvoy, Officer David Patnaude, and Officer Thomas.Donovan, with after over 130 combined years of service to the people of North Andover, retired. I wish these fine officers the best in their future endeavors. We hope to fill these openings with some new reserve officers. As you are aware, we have had a surge of motor vehicle breaks over the past month. Almost all of the breaks were overnight and the victims had left their vehicles unlocked. Our Criminal Investigation Division worked with the town G.I.S. division to have pin point maps drawn up of the neighborhoods victimized and used them to anticipate when the next attempt would be. This focus on the breaks yielded one arrest for receiving stolen property. The subject was observed early one morning and once stopped and questioned by officers, it was discovered that he had property that was taken from a vehicle that evening. Officers have even engaged in foot patrols in the late night shift in an attempt to apprehend these culprits. We believe that this is a group of individuals who may or may not know each other and target an area for quick thefts in order to sell the items to buy drugs. We are working closely with area police departments who are also experiencing this crime. One housebreak this month was interrupted by the homeowners returning back from a walk to see a suspect exiting their house. When the homeowner confronted the suspect, the suspect jumped into a waiting vehicle and struck the homeowner with the car while fleeing. A BOLO was put out(Be On the Look Out) and an officer working a detail on the other side of town spotted the suspects. The detail officer assisted in following the suspects until marked cars arrived and made the arrest. I mention this to you because I cannot stress enough how important having officers on the street is. Details allow the police department to have extra officers to assist with just such an event. This sort of incident happens on a regular basis and it is a great benefit to the Town to have the extra manpower on the street armed and with radios to hear calls for service and BOLO's such as this incident. Late in May, detectives and investigators with the Massachusetts Department of Industrial Accidents set up a sting operation on two massage parlors in town. These parlors had advertised on the internet as well as other means about possible criminal activity. Undercover officers went in and confirmed the suspicions and arrested two suspects for solicitation of a sexual act. Detectives then worked with the North Andover Building Inspector, Gerry Brown,to close the parlors and notify the landlords of the activity taking place so that eviction processes can be initiated. One final notable event this month was two incidents in which incident command training with the Fire Department last month paid off. One instance was a suicidal male who fled into the woods by the Shawsheen River late at night and another involved a seriously injured cyclist in the State Forest. In both instances, both departments utilized their training together last month to set up a command post, organize communications and locate both subjects. Incidents such as this are a clear demonstration as to the benefits of training together as a team. We hope to continue training over the summer and are confident that the benefits will be positive for both departments. The month ended with the annual Memorial Day service at the police station.Last year the engraved memorial stone was moved to the new location on Osgood Street, Active and retired officers, with their families, attended to honor the deceased members of the department.
