BOARD OF SELECTMEN MINUTES SEPTEMBER 9, 2013
CALL TO ORDER: Chairman Rosemary Smedile called the meeting to order at 6:40 PM at Town Hall
Meeting Room.
ATTENDANCE: The following were present: Rosemary Smedile Chairman; Richard Vaillancourt, Clerk;
Tracy Watson, Licensing Chairman; Donald Stewart, William Gordon, and Andrew Maylor, Town Manager
and Ray Santilli, Assistant Town Manager.
EXECUTIVE SESSION
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile, to enter into Executive Session
for the purpose of strategy session for negotiations, collective bargaining sessions declaring that an open
meeting may have a detrimental effect on the Boards position.
Roll Call Vote: Donald Stewart yes, Rosemary Connelly Smedile yes, Tracy Watson yes, Richard
Vaillancourt yes, and William Gordon yes. Vote approved 570

Richard Vaillancourt made a MOTION, seconded by Tracy Watson, to approve the Open Session Minutes
of as written. Vote approved 5-0.
COMMUNICATIONS, ANNOUNCEMENTS,,AND PUBLIC COMMENT:
Recognition of Individuals and Businesses for Work on Business and Community Guide
The Board recognized the generosity of a number of businesses and organizations which allowed for the
publication and printing of the North Andover Business and Community,Guide and the outstanding work-
effort from a number of individuals; Millie Matasso, Brenda Tomasz, Linda McHugh, Bernadette Curran,
Curt Bellavance and Rosemary,Connelly Smedile,
Route 125 Corridor Study-John Mullin, UMass Center for Economic Development
John Mullin of UMass Center for Economic Development said the study was conducted by Practicum
students Kristen Bryan, Toro Gehring, Ivette Banoub, Anita Lockesmith, Jennifer Stronisten and Jonathan
Cooper. He introduced student Jonathan Cooper to present the findings of their study on the Route 125
Corridor,
Mr. Cooper'gave an overview of the Project Objectives, Methods& Resources and Boundaries. He
discussed the fourcomponents as the Cornerstone, 1600 Osgood Street; Regional Asset, Lawrence
Municipal Airport; Agriculture, Barker Farm and Smaller Parcels, residential and small businesses. He
discussed the five characteristics of the area and then went into the Five Assessment Issues, Vision,
Aesthetics, Consistency, Connectivity and Partnerships. The Vision and Next Steps is to Reshape,
Reconnect and to Restructure. It is important for the Town to communicate with the Lawrence Municipal
Airport; continue dialogue with 1600 Osgood Street about Sewer system; and discuss protections for
Barker Farm. In the future the Town should form a Redevelopment Authority, Promote renewable waste
cluster and to pursue transit-oriented development.
Mr. Mullin answered questions from the Board and finalized with saying that the students enjoyed their
work in the Town of North Andover and all the help they received from Community Development Director
Curt Bellavance and Town Manager Andrew Maylor.

Announcements
There will be a Ceremony on Patriot's Day September 11, 2013 in front of Town Hall starting at 8:30 a.m.
in remembrance of the thousands of lives lost on that day in 2001.
There will be a perambulate at the border of Andover and North Andover on Saturday, September 14,
2013 at 9:00 a.m. at the town line marker.
On September 29, 2013, the Merchants Association will hold their Annual Fundraiser Festival for
Handicap Children at the Knights of Columbus from 10:00 a.m. to 4:00 p.m.
The Merchants Association will be holding Restaurant Week from September 20 through October 5,
2013. Many restaurants will hold specials during the week. Check the website for updates.
The Cultural Council will be having an event at the Rogers Center at Merrimack College to present Grants
on October 14, 2013 starting at 7:00 p.m.
Susan Sawyer as a member of the Rotary Club announced that they will hold CPA training at$25.00 per
person.
CONSENT ITEMS:
Extend Service Agreement between the Town of North Andover and Wheelabrator North Andover, Inc. for
July 1, 2013 through June 30, 2018.
The Town's current agreement with Wheelabrator North Andover, Inc. for the disposal of solid waste was
through June 30, 2015 with tipping fees of$72.00 for FY14 and $74.00 for FY15.
Wheelabrator proposed a new five-year extension of the original Service Agreement for the period of July
1, 2013 through June 30, 2018. The new extension includes tipping fees of$60.00 per ton for FY14 and
$61.50 per ton for FY15. For these two fiscal years alone, the Town projects savings totaling
approximately$200,000. In addition, by agreeing to the new five-year extension Wheelabrator will pay
the Town a cash incentive of$39,000.
Note: (per Annual Town Meeting vote, the motion will require a minimum of four votes in the
affirmative.)
Tracy Watson made a MOTION, seconded by Donald Stewart that the Board of Selectmen approves the
five-year extension to the Service Agreement for the disposal of solid waste between the Town of North
Andover and Wheelabrator North Andover, Inc. for the period of July 1, 2013 through June 30, 2018.
Vote approved 5-0.
Request to Surplus and Trade-in Vehicles
Per the Town Policy regarding surplus vehicles and equipment, Public Work Director Bruce Thibodeau is
requesting approval to surplus and trade-in 6 vehicles that are beyond their useful life.
William Gordon made a MOTION, seconded by Tracy Watson that the Board of Selectmen approves the
request of Public Works Director Bruce Thibodeau to surplus and trade-in six (6)vehicles per his memo to
the Town Manager dated August 30, 2013. Vote approved 5-0.
Waiver of Building Fees for Kittredge School Gym project
Jim Mealey, Chief Operations Officer of the North Andover School Department, is requesting the Board's
approval to waive any and all building fees for the Kittredge School Gym project.
Donald Stewart made a MOTION, seconded by Tracy Watson, that the Board of Selectmen waives any
and all building fees for the Kittredge School Gym project. Vote approved 5-0.

Waiver of building Fees for Water Treatment Plant HVAC/Roof Replacement Project
Stephen Foster, Facilities Management Director, is requesting the Board's approval to waive any and all
building fees for the Water Treatment Plant HVAC/Roof Replacement project.
Tracy Watson made a MOTION, seconded by Donald Stewart, that the Board of Selectmen waives any
and all building fees for the Water Treatment Plant HVAC/Roof Replacement project. Vote approved 5-0.
North Andover Rotary Club— Upgrades at Aplin Playground
Barbara McGovern representing the North Andover Rotary Club briefed the Board about the work done
by the Club to upgrade the Aplin Playground for the past few years. As the next phase, they are
requesting to lay a brick walkway and patio with inscribed bricks purchase by individuals and/or groups.
They also wish to add a couple of benches, to light the flagpole, install a Rotary plaque on the benches,
and a Rotary sign in the front of the park.
Tracy Watson made a MOTION, seconded by Donald Stewart that the Board of Selectmen approves the
request of the North Andover Rotary Club to proceed with the upgrades to Aplin Playground as proposed.
Vote approved 5-0.
Stefanie Lewendon of Girl Scout Troop#85376 requests the use of Town Common
Stefanie Lewendon of Girl Scout Troop#85376 requests the use of Town Common for a Girl Scout
Ceremony on Sunday, September 15, 2013 from 1:00 p.m. —2:00 p.m. All relevant Town Departments
recommend approval.
Tracy Watson made a MOTION, seconded by Donald Stewart that the Board of Selectmen approves the
request from Stefanie Lewendon of Girl Scout Troop#85376 for the use of Town Common for a Girl
Scout Ceremony on Sunday, September 15, 2013 from 1:00 p.m. —2:00 p.m. Vote approved 5-0.
Approve Employment Contract for Town Manager, term of December 16, 2013- December 15, 2018.
The Board held an Executive Session and came to terms for an Employment Contract with the Town
Manager Andrew Maylor for the term of December 16, 2013 through December 15, 2018.
Richard Vaillancourt made a MOTION, seconded by Tracy Watson that the Board of Selectmen approves
the Employment Contract for Town Manger Andrew Maylor with a term of December 16, 2013 through
December 15, 2018. Vote approved 5-0.
The new contract will be posted on the Town's website.
LICENSING COMMISSIONERS:
Donald Stewart made a MOTION, seconded by Richard Vaillancourt, to open a meeting of the North
Andover Licensing Commission. Vote approved 5-0.

Camelot Sports Pub requests a One-Day Wine & Malt License on September 29, 2013 from 11:00 a.m. to
9:00 p.m.
Camelot Sports Pub submitted an application for the North Andover Merchants Association Annual Fall
Festival to be held on the grounds of Camelot Sports Pub, 505 Sutton Street, in a tented, roped off area
between the hours of 11:00 am to 9:00 pm on Saturday, September 29, 2013. The applicant is
respectfully requesting a waiver of the fee.
Donald Stewart made a MOTION, seconded by William Gordon that the Board of Selectmen acting as the
Licensing Commissioners approves the One-Day Wine and Malt License for the Camelot Sports Pub on
September 29, 2013 from 11:00 a.m. to 9:00 p.m. and to waive the fee. Vote approved 3-0.
William Gordon made a MOTION, seconded by Donald Stewart, to close a meeting of the North Andover
Licensing Commission. Vote approved 5-0.

PUBLIC HEARING:
Richard Vaillancourt made a MOTION, seconded by William Gordon, to enter a Public Hearing regarding
the Removal of Public Shade Trees on Osgood and Bradford Streets per MGL c87, §3—Michael Green,
1769 Osgood Street.
Roll Call vote: William Gordon yes, Donald Stewart yes, Rosemary Smedile yes, Richard Vaillancourt,
and Tracy Watson yes. Vote approved 5-0.
Michael Green of 1769 Osgood Street requested to remove fifteen (15) public shade trees from the
Town's right-of-way at the intersection of Osgood and Bradford Streets, on either side of the entrance to
the new Saracusa Way subdivision. Mr. Green will assume the cost of removal of the trees.
Bruce Thibodeau, Public Works Director concurs with the removal of the trees due to sight lines.
However, he recommends the developer provide 5 to 10 replacement trees to be used on his site or to be
provided to the DPW to be planted around Town.
Tracy Watson made a MOTION, seconded by Donald Stewart, to close the Public Hearing per MGL c87,
§3 for the Removal of Public Shade Trees on Osgood and Bradford Streets.

and Tracy Watson yes. Vote approved 5-0.
Tracy Watson made a MOTION, seconded by Donald Stewart, that the Board of Selectmen approves the
request of Michael Green to remove fifteen (15) PUBLIC SHADE TREES ON Osgood and Bradford
Streets. Vote approved 5-0.
The Town Manager suggested that in the future there a level of coordination for a requirement between
the Planning Board and a Public Hearing for Tree Removal.
TOWN MANAGER'S REPORT:
Police Department Log Report
Police Chief Paul Gallagher provided a Police Report and Crime Statistics for the month of August and an
overview of a successful National Night Out held on August 7, 2013.

COMMUNICATIONS ANNOUNCEMENTS AND PUBLIC COMMENT:
Thank you to the North Andover Garden Club
The North Andover Senior Center would like to thank the-members of'N.orth Andover Garden Club for the
work they did weeding and cleaning out the planting beds at the Main Street entrance and the parking lot
entrance of the Senior Center. The Board of Selectmen thanked the members;who contributed their time
and effort and send a letter of thanks from the Town.
Update of Facilities Master Plan Implementation
The Town Manager Andrew Maylor provided an update of the Facilities Master Plan including the
following projects: Kittredge Elementary School'gym addition, School,Department Administration Building
and the New Fire Station 1. The Kittredge Elementaryy School gym addition will be completed and ready
for occupancy in the spring,of 2014. The School Department Administration Building project bids should
go out in December 2013 and signed by January/February 2014 witha start construction date of spring of
2014.
Stan Limpert School Committee Chairman thanked the Town Manager for his support and working with
the School Committee on this school project.
Announcements
William Gordon announced that there will be a fundraiser at Stachey's Pizza on October 2, 2013 for
Corks for Courts to raise additional funds for Kittredge School.
Richard Vaillancourtlannounced North.Andover Restaurant Week starting Sunday, September 29 through
October 5, 2013 with 28 restaurants participating.
Richard Vaillancourt announced the North Andover Merchants Association is holding their Festival
Fundraiser on Sunday, September 29, 2013 at the Knights of Columbus grounds from 10:00 AM—4:00
PM.

William Gordon made a MOTION, seconded by Tracy Watson, that the Board of Selectmen appoints

June 30, 2016. Vote approved 5-0.

Carol Bradstreet on behalf of the Cystic Fibrosis Foundation requests permission to hold "Great Strides: A
Walk to Cure Cystic Fibrosis" at Drummond Park on Saturday, May 17, 2014.
Tracy Watson made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen approve
the request of Carol Bradstreet on behalf of the Cystic Fibrosis Foundation requests permission to hold
"Great Strides: A Walk to Cure Cystic Fibrosis" at Drummond Park on Saturday, May 17, 2014. Vote
approved 5-0.
Rabbi Zalman Borenstein of Chabad of North Andover requests to use the Town Common for the lighting
of the Chanukah Menorah from November 26-December 5, 2013.
The request also included using Town Common on Tuesday, December 3rd for a ceremony on the Town
Common from 5:30—7:00 PM,
Tracy Watson made a MOTION, seconded by William Gordon, that the Board of Selectmen approves the
request of Rabbi Zalman Borenstein of Chabad of North Andover to use Town Common for the lighting of
the Chanukah Menorah from November 26-December 5, 2013 and for a ceremony on December 3, 2013
from 5:30—7:00 PM. Vote approved 5-0.
Affordable Housing Unit Resale—210 Chickerinq Road, Unit 304A(Kittredge Crossing)
The Citizens' Housing and Planning Association (CHAPA) has notified the Town that the affordable
housing unit at 210 Chickering Road, Unit 304A(Kittredge Crossing is up for sale. It is recommended the
Board not exercise its right of first refusal.
Richard Vaillancourt made a MOTION, seconded by Tracy Watson, that the Board of Selectmen decline
the right of first refusal to purchase the affordable housing unit at 210 Chickering Road, Unit 304A
(Kittredge Crossing). Vote approved 5-0.
Affordable Housing Unit Resale—2 Harvest Drive, Unit 203 (Oakridge Village/Maplewood Reserve)
The Citizens' Housing and Planning Association (CHAPA) has notified the Town that the affordable
housing unit at 2 Harvest Drive, Unit 203 (Oakridge Village/Maplewood Reserve) is up for sale. It is
recommended the Board not exercise its right of first refusal.
Richard Vaillancourt made a MOTION, seconded by Tracy Watson, that the Board of Selectmen decline
the right of first refusal to purchase the affordable housing unit at 2 Harvest Drive, Unit 203 (Oakridge
Village/Maplewood Reserve) Vote approved 5-0.
Endorsement of"North Andover Middle School— North Andover MA—Safe Routes to School
Infrastructure Program— Preliminary Assessment
At the Board's meeting of June 24, a preliminary assessment prepared by MassDOT for a 'Safe Routes to
School Infrastructure Program' for the North Andover Middle School. Two Public Hearings have been
held to review the assessment. The Board was given a neighborhood petition in support of'sidewalk
installation from Parker Street to Greene Street to Massachusetts Avenue. The Town Manager wrote a
draft letter to the Massachusetts Department of Transportation as a result of the Board's anticipated vote.
Tracy Watson made a MOTION, seconded by Donald Stewart that the Board of Selectmen endorses the
'North Andover Middle School—North Andover, Massachusetts—Safe Routes to School Infrastructure
Program— Preliminary Assessment'. Vote approved 5-0.
Approve Ten (10)Year Contract between town of North Andover and JRM Hauling & Recycling Services
Inc. for October 1, 2013 through September 30, 2023
In May, the Town issued a Request for Proposals for the 'Acceptance & Processing of Recyclable
Material.' The selected company would process and market recyclable material collected from North
Andover's curbside recycling program (including eligible residential units and businesses, municipal

buildings and schools). The Town generates approximately 2,500 (single stream) tons of recyclable
material annually. The Town currently offers weekly curbside single stream recycling collection to
approximately 11,000 residential units and approximately 200 businesses and municipal locations. Five
proposals were received and evaluated. The proposal from JRM was the only proposal that guarantees
to pay the Town ($20) per ton) over any designed period. Bruce Thibodeau, Public Works Director,
recommends the ten year contract be awarded to JRM Hauling & Recycling Services Inc. for these
services.
Selectman Smedile stated that Northside Carting will continue to pick up all recyclables throughout the
Town and this will not change.
Donald Stewart made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen
approves the ten year contract for acceptance and processing of recyclable material between the Town of
North Andover and JRM Hauling & Recycling Services Inc. for October 1, 2013 through September 30,
2023. Vote approved 5-0.
LICENSING COMMISSIONERS:
Donald Stewart made a MOTION, seconded by Richard Vaillancourt, to open a meeting of the North
Andover Licensing Commission. Vote approved 5-0.
Pamela Devoid, Merrimack Donuts LLC requests a Common Victualler License at 315 Turnpike Street
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen,
acting as Licensing Commissioners, approves the Common Victualler License for Merrimack Donuts LLC.
Vote approved 5-0.
Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt, to close a meeting of the North
Andover Licensing Commission. Vote approved 5-0.
NEW BUSINESS:
Request for a Bonfire Permit
Richard Vaillancourt requests permission to have a Bonfire on the grounds of the Knights of Columbus at
505 Sutton Street on the evening of Sunday, September 29, 2013.

The Police Department recommends that we continue to follow the same pattern as past years and
designate the hours of 5PM to 7PM on Thursday October 31St for town-wide trick or treating,weather
permitting. I will assign our volunteer Special Officers on duty during that period in directed patrol
assignments. We will deploy the message boards on the days prior to help notify motorists and residents.

I am requesting approval to hold the 25th annual Cambridge Sports Union rollerski race in N.
Andover again this year. I would like to hold the race on Sunday November 3,2013. The race
would start at 9:30 am at the playground on Milk Street. The race is a 2 loop race which
,P generally has between 20 and 30 rollerskiers.
The race starts on Milk St.,turns right onto Johnson St. and proceeds up and then down Johnson
to Rea St.,up to Chestnut St. and follows Chestnut back to Milk St. The race finishes on Milk
St. at the playground. The race takes approximately 1 hour for the slower skiers to complete.
We have had no problems holding the race over the years, although it is very helpful if a police
cruiser is at the corner of Johnson and Milk St. at the start to slow any drivers down for the start
of the race. After that the skiers get strung out. I put up arrows for the skiers and have
volunteers to stand and direct skiers at the four major corners. In addition I put out a number of
sandwich board type signs to warn drivers that a race is in progress.
I appreciate the Town of North Andover's willingness to let the Cambridge Sports Union hold
this annual ski season tune-up race. If you have any questions please let me know. I can be

Dear Sir/Madam:
My name is Paul Fluckiger and I have been operating under license an"Internet Only"
Class II used car business—Silverstone Motorcars—out of 2350 Turnpike Street North
Andover since the end of 2010. I sell owned and consigned classic cars—European and
American—as well as some exotics (Ferraris and Lamborghinis etc.) and a few"regular"
cars when asked by a client.
This business has grown significantly over the past 3 years and now I have an option to
lease space that is coming available in the summer of 2014, in the same building at 2350
Turnpike Street(approximately 11,000 sq ft currently occupied by CWT transport and
previously occupied by American Sweeps). I would like to sign a lease on this space but
not until you have approved my plan. Jerry Brown the North Andover Building Inspector
has no issue with the intended use from his perspective as the building has already been
set up for working on motor vehicles etc .
This letter and associated documents are being provided for your consideration as I am
applying to upgrade my Internet Only Class I1 License to a full and regular Class II used
car license. As you will see from the attached building plan, clients will have access to
the building - along with parking - from Turnpike Street. Almost all cars however will be
kept indoors and are under lock and key and there will be no "outdoor lot" as such.
There is a private lot fenced in and not visible from Turnpike Street. I will use this for
additional parking and to store trailers, Boats or RV's from time to time.
As a legal requirement regarding the upgraded Class II license, I will be installing one or
two lifts in the premises to fix cars that we buy before selling and to perform warranty
work on cars that we sell as required by law. We will not be operating a public repair
shop. This area is noted on the plan.
