ADJOURNMENT BOARD OF SELECTMEN MINUTES NOVEMBER 4, 2013 CALL TO ORDER: Chairman Rosemary Smedile called the meeting to order at 7:00 PM at Town Hall Meeting Room. ATTENDANCE: The following were present: Rosemary Smedile Chairman; Richard Vaillancourt, Clerk; Tracy Watson, Licensing Chairman; Donald Stewart, William Gordon, and Andrew Maylor, Town Manager and Ray Santilli, Assistant Town Manager. PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES: Richard Vaillancourt made a MOTION, seconded by William Gordon,'to approve the Open Session Minutes of October 7, 2013 as written. Vote approved 5-0. Richard Vaillancourt made a MOTION, seconded by William Gordon, to approve the Strategic Planning Session Minutes of October 21, 2013 as written. Vote approved 5-0. COMMUNICATIONS, ANNOUNCEMENTS,AND PUBLIC COMMENT: Veterans Day Veterans Day Parade and Ceremony will be held on Monday, November 11, 2013.' The parade will step- off at corner of Main and First Streets at 10:15 a.m. The parade will proceed up Main Street to Patriots' Memorial Park for the service. In the event of inclement weather, the services will be held in the Middle School Auditorium at 10:30 a.m. New Business Recognition The Board presented a Certificate of Appreciation,to Franks Barber Shop, 148 Main Street for locating his business in North Andover. Greater Lawrence Sanitary District Greater Lawrence Sanitary District Director Rick Hogan has announced his retirement on November 15, 2013. Mr. Hogan has done an outstanding job during his years of service. Adopt a Wreath Program Selectman Smedile announced that the Holiday Decorating Committee will kick off the 'Adopt a Wreath Program'. The cost of wreaths is$65 each and will be placed on the light poles on Main Street and at the Old Center. Please contact her and make out checks to 'Holiday Decorating Committee'. Questions from Citizens Selectmen Smedile and the Town Manager Andrew Maylor addressed various questions from citizens about funding, building projects, safe routes to school sidewalks and signage. Town Manager announcements Town Manager Andrew Maylor announced that the Town Farm Athletic Fields on Dale Street is progressing and on budget. Starting December 3rd the Kittredge School gym structure will start to be assembled on site. The DPW announced that leaf pickup is in full swing for 3 weeks in November taking Thanksgiving week off and then continuing for the first two weeks in December. Edmunds Road will be getting six new trees planted before winter sets in. Board of Selectmen Minutes November 4, 2013 2 CONSENT ITEMS: Acceptance of Donations from Joseph N. Herman Youth Center, Inc. The Joseph N. Herman Youth Center, Inc. has made two donations to the Youth & Recreation Services Department: $5,040 to provide scholarships to Youth Center members who cannot afford the annual fee, and $11,000 to fund a part-time Administrative Assistant. Tracy Watson made a MOTION, seconded by Donald Stewart, that the Board of Selectmen accepts the donation from the Joseph N. Herman Youth Center, Inc. in the amount of$5,040 to provide scholarships to Youth Center members who cannot afford the annual fee. Vote approved 5-0. Tracy Watson made a MOTION, seconded by Donald Stewart, that the Board of Selectmen accepts the donation from the Joseph N. Herman Youth Center, Inc. in the amount of$11,000 to fund a part-time Administrative Assistant at the Youth Center. Vote approved 5-0. Winter Parking Ban The Town Manager gave a draft copy of the 'All Night Winter Parking Ban' for 2013-2014. The parking ban will be in effect for the months of December, January and February. The language allows the Board at the end of February to determine if enforcement of the parking ban should be continued, Richard Vaillancourt made a MOTION, seconded by Tracy Watson, that the Board of Selectmen approve the proposed 'All Night Winter Parking Ban' as proposed, from December 1, 2013 through February 28, 2014'with the option of extending the ban if needed due to inclement weather. Vote approved 5-0. Request to Dispose of Surplus Equipment— Public Works Department Per the Town Policy regarding surplus material and equipment, Bruce Thibodeau, Director of Public Works is requesting to surplus a 1971 John Deere Loader with attachments. Tracy Watson made a MOTION, seconded by Donald Stewart, that the Board of Selectmen approves the request of Public Works Director Bruce Thibodeau to surplus the 1971 John Deere Loader with attachments per his memo to the Town Manager dated October 30, 2013. Vote approved 5-0. FY15 Budget Policy Statement In accordance with the Town Charter, Chapter 9-2-3, on or before the first day of November each year, the Board of Selectmen, after consulting with the Town Manager, shall issue a policy statement relating to the budget for the ensuing fiscal year. The statement shall establish the outer limits of possible budget growth for the town.' The Town Manager Andrew Maylor outlined the objectives and strategic goals for Financial Conditions; Economic Development; Neighborhood Enhancement; Community Development; Public Safety and Government Philosophy. Tracy Watson made a MOTION, seconded by William Gordon, that the Board of Selectmen approves the FY15 Budget Policy Statement as presented by the Town Manager. Vote approved 5-0. LICENSING COMMISSIONERS: Donald Stewart made a MOTION, seconded by Richard Vaillancourt, to open a meeting of the North Andover Licensing Commission. Vote approved 5-0. Bertucci's Restaurant Corporation (dba Bertucci's Brick Oven Ristorante) 435 Andover Street, request a Change of Manager Donald Stewart made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen, acting as Licensing Commissioners, approves the request of Bertucci's Restaurant Corporation (dba Bertucci's Brick Oven Ristorante) at 435 Andover Street, North Andover for a change of manager to Nicholas J. Joseph. Vote approved 5-0. Board of Selectmen Minutes November 4, 2013 3 Stewart made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen, acting as Licensing Commissioners, approve a Common Victualler License to Farnaro, LLC (dba Baked) at 1211 Osgood Street. Vote approved 5-0. Donald Stewart made a MOTION, seconded by Rosemary Smedile, to close a meeting of the North Andover Licensing Commission. Vote approved 5-0. Request by the Festival Committee and North Andover Police Association to use Town streets for the Annual Santa Parade on November 30, 2013 Lt. E.J Foulds on behalf of the Festival Committee and North Andover Police Association requests approval for the Santa parade route closing Main Street, Elm Street, Water Street, and Sutton Street on Saturday, November 30, 2013. The streets will have posted "No Parking" signs from 8:00 a.m. until the finish of the parade on those streets. Tracy Watson made a MOTION, seconded by William Gordon, to approve the requests for the Santa parade on November 30, 2013. Vote approved 5-0. TOWN MANAGER'S REPORT: Position/Vacancy Log Human Resources Director provided an update report outlining the status of various recruitments that are ongoing or recently completed. Next Meeting on November 18, 2013 Selectman Vaillancourt said that he would be traveling on business and would not be able to attend the meeting on November 18, 2013, The Board discussed whether there was a need to hold a meeting on that date or change it to another date. A Public Hearing for the Tax Classification will be held at the Board's meeting on December 2, 2013. We have discussed the event with Michael Smolak of Smolak farms who has agreed to host the event. As suggested by lieutenant Folds, this letter serves to provide details of the event and a formal request for approval by the Town of North Andover and the board of selectman for use of the public roadways in North Andover. We are also working with Chief Michael Murphy of the Boxford police and have submit ed a similar letter to the town of Boxford for the portion of the event that involves Boxford public roadways. The event will start with a road run, followed by road cycling and concluding with a trial run. The event will be professionally managed by Streamline Events LLC, or another qualified Triathlon and Duathlon event management company. The number of participants in the event is estimated to be approximately 300 athletes. The race will be capped at a number of participants that the Farm can accommodate or as otherwise limited by Smolak and/or town police. Distance of the running and cycling legs will be determined based on the course options as approved by the town selectmen and/or police departments. Our initial proposed cycling route will run through the towns of North Andover and Boxford. The proposed cycling route is 13.4 miles and is described in more detailed below. The running routes will be limited to the town of North Andover and will be a 5K (3.1 mile) road course and a 1.5 mile trial run on the Smolak property. DATE OF EVENT:This event will take place on Sunday, May 4th. The event will run from 7:00am to approximately 1 pm, including registration and post race activities. The event start time will be approximately 8:30am with the first run. DESCRIPTION OF PROPOSED ROAD RUNNING COURSE AND NORTH ANDOVER ROADS USED The proposed 1St leg of the running route will start at Smolak Farms on South Bradford in North Andover. Runners will start the 1St leg of the running course at approximately 8:30am. It is expected that all runners will complete the 1St running course within 1 hour and will be off all public roads by 9:30am. Andover REQUIRED NORTH ANDOVER POLICE DETAIL FOR ROAD RUN ROUTE: Based on our experience and discussions with other town police we would expect the town to require at least 2 police detail for the road run course. One police detail at the intersection of South Bradford and Great Pond Rd and a second police detail at the intersection of Great Pond and Bridle Path. We will also have a number of volunteers along the run route and propose using orange safety cones for a run lane on Great Pond Rd. It is our understanding that Breakaway will be responsible for the cost of police detail. We also understand that the town may require additional police detail. DESCRIPTION OF PROPOSED CYCLING COURSE AND NORTH ANDOVER AND BOXFORD ROADS USED The proposed cycling route will start at Smolak Farms on Dale street in North Andover. Racers will start the cycling portion of the event at approximately 9:00am after the initial run of approximately 3.1 miles. As such, cyclists will be entering all public road ways 1 cyclists at a time. Since this is a USAT sanctioned event cyclist are not allowed to draft and as such will not be riding in groups or in pace-lines. It is expected that cyclists will be on the course for approximately 1.5 hours and off all public roads by 10:30am. One police detail at the intersection of Main street and Middleton which is a 4 way stop and the other on Ipswich road where it intersects with Spofford and Herrick. It is understood that Breakaway will be responsible for the cost of police detail required. REQUIRED NORTH ANDOVER POLICE DETAIL: Based on our experience and discussions with other town police we would expect the town to require at least 1 police detail for the cycle portion of the event on North Andover roads. A police detail would be required on Dale street where it intersects with South Bradford. This is where cyclists would be entering and exiting Smolak farms for the cycling portion of the race. STAFF and VOLUNTEERS ON CYCLYING and RUNNING ROUTES: Breakaway staff or volunteers will be stationed along the bike and Running routes. Each staff&volunteer will have been instructed as to town requirements and cycling and running safety. Staff will help ensure running and cycling participants are adhering to race, safety and town requirements. In addition, staff will be responsible for clearing any trash left by races. CYCLING COURSE MARKINGS AND SAFETY: We understand and respect the fact that the Town of Boxford does not allow markings on its streets. As such no marking of roadways will be made. However to ensure safety, orange safety cones will be used at each turn to guide riders and will indicate course direction, turn number and mileage. All participants will be required to wear approved cycling helmets and ride single file on the course at all times in accordance with USAT rules. Race officials will be on course to monitor riders. INSURANCE: The Smolak Farms Duathlon will be a USA Triathlon sanctioned event, and, as such, a Certificate of Insurance will be provided to Smolak Farms and Towns as required. F NORTH ANDOVER POLICE ---Community Partnership--- The Office of CHIEF OF POLICE TO: Andrew Maylor,Town Manager FROM: Paul J. Gallagher, Chief of Police DATE: November 5,2013 RE: October 2013 Crime Statistics October was a transition month for the Police Department. The summer weather is ending and the fall in approaching. Our noise complaints and loud parties have dwindled and our late night foot traffic has slowed. This made it easier for one of our officers to apprehend two B&E suspects towards the end of the month. The officer observed two subjects walking along 114 near Waverley Road late at night. The officer conducted a filed interview and check on their well being. While speaking to there,a caller on Trinity Court reported their car broken into. After a thorough investigation,the two were arrested and charged with B&E to a motor vehicle. Officer Jason Wedge was commended for his proactive policing. In reading the local and national headlines,the North Andover School Department was placed into an uncomfortable situation. Although an incident occurred in Boxford,I assigned another School Resource Officer (SRO)to the high school.Threats,harassing emails and telephone calls were received by school administration, This incident and the tragedy at Danvers High School of a teacher heightened security awareness. I am also in contact with other law enforcement agencies relative to this. This month the Police Department conducted a staff meeting with command staff and supervisory staff members. The meeting was a team building experience and brought up many issues. Policies,protocols and next year's budget were discussed. The supervisors were commended for their proactive initiatives. I appreciate you,as Town Manager,participating at the staff meeting and giving your perspective of the next few years in North Andover. Another case,which we just went to trial,was"child abuse".An infant suffered serious life-changing injuries at the hands of its mother's boyfriend. Detective Cronin received a commendation for his investigation,testimony and subsequent convictions at this trial. Both mother and boyfriend were convicted on most of the charges.The infant will no longer be abused and is doing fine with other caretakers. It is these types of cases where police officers truly see the dark side of humanity and see sights and injuries that no person should have to suffer through. Our patrol force was supplemented by some of our Special Police Officers which increased our presence on the road. In late October a Black Light Run took place at Osgood landing. We have never experienced that type of event. The Command Staff not only help organize the event but worked the event to gauge how the community was affected. There were over nine thousand participants and attendees.Traffic was monitored and the participants, mostly college students and families,were able to participate and stay after for the music and a light show. There were no reportable incidents and the event went smoothly. I understand the organizers may have another event this summer. This month there were a few organized charity events that were held in town.The NAAA road race and the Tommy Strong event at the Steven's Estate were the two major ones. Many of your police officers volunteered their time to help regulate traffic,or conduct security evaluations to ensure that the events were safe and secure. Both events were successful and for great causes.. The North Andover Police Department received three grants from the Executive Office of Public Safety this month. They are a bicycle and pedestrian safety grant,alcohol enforcement and underage drinking grant,and a car seat grant for proper installation and inspection of infant and toddler car seats. Looking towards November,we will begin the holiday traffic enforcement as many commute to shop and visit relatives. The day after Thanksgiving we will begin our holiday directed patrols. These patrols are in their 5th year and the results have been outstanding. We look forward to working with the retail community to ensure a safe and sound holiday shopping experience for those in North Andover.
