CALL TO ORDER: Chairman Rosemary Smedile called the meeting to order at 7:00 PM at Town Hall
Meeting Room.
ATTENDANCE: The following were present: Rosemary Smedile Chairman; Richard Vaillancourt, Clerk;
Tracy Watson, Licensing Chairman; Donald Stewart, William Gordon, Andrew Maylor, Town Manager and
Ray Santilli, Assistant Town Manager.
PLEDGE OF ALLEGIANCE
APPROVAL OF MINUTES:
Richard Vaillancourt made a MOTION, seconded by Tracy Watson, to approve the Open Session Minutes
of November 18, 2013, as written. Vote approved 5-0.
COMMUNICATIONS ANNOUNCEMENTS, AND PUBLIC COMMENT:
Selectmen's Meeting Schedule for first-Half of 2014
The Town Manager provided the Board with dates for the Selectmen's meetings for the first six months of
calendar year 2014. The proposed meeting dates are as follows: January 6, 27, February 10, 24, March
10, 31, April 14, 28, May 12, 20, June 9, 23. Meeting dates may be added, deleted, and/or changed as
the need arises or as circumstances dictate.
Five Year Financial Forecast Presentation
The Town Manager Andrew Maylor gave a presentation of his Five Year Financial Forecast for FY15-
FY19. Members of the School Committee and Finance Committee were present. Maylor started with the
Town's Mission Statement and briefly went over the Budget Development process. He spoke about the
Budget Pressures and on the Pro Forma Assumptions-General Fund Revenues Fixed Costs and
General Fund Expenses. He projected percentages of Health!Insurance from Self-Insured vs. GIC and
estimated Retirement Appropriation for FY15-FY24. An Summary the;goal is "Plan the Work,Work the
Plan....Our Path to Fiscal Stability".
CONSENT ITEMS
Acceptance of Donation($9,688.78)from Joseph N Hermann Youth Center Inc. to Youth & Recreation
Services for Stake Park equipment
The Joseph N. Hermann Youth Center, Inc. continues its practice of making generous donations to the
operations of Youth & Recreation Services. The group is donating $9,688.78 of new equipment to the
Skate Park located at the Youth Center,
Tracy Watson made a MOTION, seconded by William Gordon, that the Board of Selectmen accepts the
donation from the Joseph N. Hermann Youth Center, Inc. in the amount of$9,688.78 to Youth &
Recreation Services for Skate Park equipment. Vote approved 5-0.
Acceptance of Donation ($10',000):from Brooks School for the Kittredqe Gym Addition Project
With the additional component of installing a wood floor as part of the Kittredge School Gym Addition
project, Mr. John Packard of the Brooks School graciously donated $10,000 towards this endeavor with a
commitment of donating another$20,000 in the next two years for a total of$30,000,
Richard Vaillancourt made a MOTION, seconded by Tracy Watson, that the Board of Selectmen accepts
the donation from the Brooks School in the amount of$10,000 for the Kittredge School Gym Addition
project. Vote approved 5-0.
Request to Dispose of Surplus Vehicles— Police Department
Per the Town Policy regarding surplus vehicles, please see the memorandum in your packets from Police
Chief Paul Gallagher.

Tracy Watson made a MOTION, seconded by Donald Stewart, that the Board of Selectmen approves the
request of Police Chief Paul Gallagher to surplus two (2) police vehicles per his memo to the Town
Manager dated November 5, 2013. Vote approved 5-0.
Request by Bay State Gas Company, d/b/a Columbia Gas of Massachusetts to excavate Russell Street
for the purpose of installing a new main
In accordance with M.G.L. c164 §70, the Board must give consent to the gas company'to dig up and
open the ground in any of the street, lanes and highways of a town.'
Tracy Watson made a MOTION, seconded by William Gordon, that the Board of Selectmen approves the
request of By State Gas Company, d/b/a Columbia Gas of Massachusetts, to excavate Russell Street for
the purpose of installing a new main. Vote approved 5-0.
Request by Stephen DiPietro Breakaway Computraining LLC, to use public roadways for a
Breakaway/Smolak Farms Duathlon Event on May 4 2014 from 7:00 a.m. to 1:00 p.m.
In conjunction with Smolak Farms, Breakaway Computraining is asking to use public roadways to hold a
Duathlon Event on Sunday, May 4, 2014 from 7:00 a.m. to 1:00 p.m. The Duathlon Event is a running
and cycling race starting and finishing at Smolak Farms. The event will start with a road run, followed by
road cycling, and concluding with a trial run. All relevant Town Department recommend approval.
William Gordon made a MOTION, seconded by Tracy Watson, that the Board of Selectmen approves the
request of Breakaway Computraining LLC to use public roadways for a Breakaway/Smolak Farms
Duathlon Event on May 4, 2014 from 7:00 a.m. to 1:00 p.m. Vote approved 5-0.
Ratification of Collective Bargaining Agreement between the Town and AFMCE Local 2978 (Public Works
Group) for the period July 1, 2013—June 30, 2016,
The Board was given a Memorandum of Agreement between the Town of North Andover and AFSCME
Local 2978 (Public Works Group) for a new collective bargaining agreement for the period July 1, 2013—
June 30, 2016. The agreement has been formally ratified by the Union. The Board was asked to ratify.
Richard Vaillancourt made a MOTION, seconded by Tracy Watson, that the Board of Selectmen ratify the
collective bargaining agreement between the Town of North Andover and AFSCME Local 2978 (Public
Works Group) for the period July 1, 2013—June 30, 2016. Vote approved 5-0.
LICENSING COMMISSIONERS:
Donald Stewart made a MOTION, seconded by Richard Vaillancourt, to open a meeting of the North
Andover Licensing Commission. Vote approved 5-0.
Jennifer Konopisos on behalf of Merrimack College requests a One Day Wine & Malt License for a
Student Holiday Party on December 6 2013 from 10:00 p.m. to 1:00 a.m.
Rosemary Smedile made a MOTION, seconded by William Gordon, that the Board of Selectmen, acting
as Licensing Commissioners, approves a One Day Wine & Malt License to Merrimack College for a
Student Holiday Party on December 6, 2013 from 10:00 p.m. to 1:00 a.m. Vote approved 5-0.
Transfer of Package Store All Alcohol License at 23 Peters Street from Den Rock Liquor Mart Inc. to Jai
Om Sai Inc.
Donald Stewart made a MOTION, seconded by William Gordon, that the Board of Selectmen, acting as
Licensing Commissioners, approves the transfer of Package Store All Alcohol License at 23 Peters Street
from Den Rock Liquor Mart Inc. to Jai Om Sai Inc. Vote approved 5-0.
William Gordon made a MOTION, seconded by Donald Stewart, to close a meeting of the North Andover
Licensing Commission. Vote approved 5-0.
PUBLIC HEARING:
Tracy Watson made a MOTION, seconded by Donald Stewart, to enter a Public Hearing on Property Tax
Classification.

Roll Call vote: William Gordon yes, Donald Stewart yes, Rosemary Smedile yes, Richard Vaillancourt,
and Tracy Watson yes. Vote approved 5-0.
Chief Assessor Garrett Boles provided spreadsheets with tax values, quartile factor, and tax levy and
estimated the FY14 tax rate for residential and commercial properties. He provided new estimated values
with a shift percentage change of 1.29 and 1.30.
Selectmen Smedile said that she and her colleagues want the impact of higher taxes to fall equally on
businesses and homeowners, so they could "share the pain".
On behalf of the Merrimack Valley Chamber of Commerce Vice President Will Carpenter requested that
the Board consider not raising the tax rate on local businesses.
William Gordon made a MOTION, seconded by Tracy Watson, to close the Public Hearing on Property
Tax Classification.
Tracy Watson made a MOTION, seconded by Donald Stewart, that the Board of Selectmen adopts a
residential factor of 0.955886 for the purpose of classifying the FY2014 North Andover property tax rate.
Vote approved 5-0.
TOWN MANAGER'S REPORT:
Town Manager said that through the work of the legislature and the governor, the matching contribution to
about$400,000. The State is matching the Community Preservation contribution up to $800,000 this is
double what it has been and the state has increased commitment and North Andover will get the full
allotment.

RE: Affordable Unit Resale

CHAPA (Citizens' Housing and Planning Association), has notified the Town that the following affordable
units are up for sale. CHAPA manages the resale of affordable units at the Oakridge Village/Maplewood
Reserve development.
2002 Dogwood Circle—Oakridge Village/Maplewood Reserve
The Board of Selectmen has to determine if they want to exercise their right of first refusal. Our office
would recommend that the Board of Selectmen should not exercise their right of first refusal for the
affordable housing units. If the Town chooses to exercise its right,then it would be the responsibility of
the Town to purchase the properties or locate an individual to purchase the properties.
CHAPA, which is the monitoring agent for the Town and several other communities, has better
resources to preserve the units as affordable and has recently hired new staff to manage the marketing
of the unit. The timeframe is 120 days to find an applicant that meets the affordable criteria.
Our office continues to work with the North Andover Housing Trust to ensure that the units stay
affordable.
The deadline to act is January 2 2014 for the Oakridge Village unit. If the Board does not act the right of
first refusal is deemed authorized. It is recommended that the Board of Selectmen not exercise their
right of first refusal.

RESERVE POLICIES
As of December 10, 2013
Fund balance and reserve policies should be established to protect the Town from
unforeseen increases in expenditures, reduction in revenues, or a combination of both, or
any other extraordinary events. Fund balance and reserve policies also serve to provide an
additional source of funding for capital construction and replacement projects. Reserves
should normally average 5%to 15% of the Town's General Fund budget.
There are two classes of reserves: 1) restricted reserves which'are to be utilized only for
the purpose designated, 2)unrestricted reserves which can be utilized at the discretion of
the authorized personnel.
Reserve policies cover; Operating Reserves,which provide for",unanticipated
expenditures or unexpected revenue losses during the year; Capital deserves, which
provide for normal replacement of existing capital plan and the financing,of capital
improvements; OPEB Reserves provide for funding of other.post employment benefit
liability; Cash Flow Reserves, which provide sufficient cash flow for daily financial
needs; and Contingency Reserves provide for unanticipated expenditures.
The Town shall maintain the following general,_special and strategic reserve funds:
Operating Reserves-The maintenance of adequate operating reserves is essential
to the financial strength and flexibility 6f the Town as a whole. Adequate
operating reserves are integral parts of the financial"structure of the Town and
help make if possible forthe Town to.'issue debt, among many other functions.
l:f Undesignated Bund Balance-.Operating fund balance shall be maintained
at suff cient levels:to absorb unpredictable revenue shortfalls and to insure
desired cash flow levels. With 'regard to the General fund, cash balances
available at year end shall, in combination with the new revenues be
sufficient to''' any requirement for short-term debt to sustain Town
;operations. Should this fund balance fall below 5% of the "Fund Balance
Floor," defined as General Fund revenue less state aid and appropriations
to reserve accounts, a plan for expenditure reductions and/or revenue
increases.shall be submitted to the Board of Selectmen during the next
budget cycle.
2. Free Cash—This reserve provides for the temporary financing of
unforeseen opportunities or needs of an emergency nature including
increases in service delivery cost. This is the portion of undesignated fund
balance certified by the Department of Revenue, Division of Local
Services, as "Free Cash". Monies held in this reserve may be appropriated
during the current budget year and may also be used as a source of
revenue for the ensuing budget year. Of all general fund reserves this is
the most flexible.

• Stabilization Fund—a Stabilization Fund shall be maintained, under the
provisions of MGL Chapter 40, Section 5B.
1. The target funding level (TFL) for the Fund shall be an amount equivalent to
5% of the Town's prior year's Total General Fund Revenue less
appropriations to reserve accounts. A Stabilization Fund Floor shall be
established at 1.5% of the Town's prior year's Total General Fund Revenue
less appropriations to reserve accounts. The Fund shall be funded only with
Free Cash or one-time revenues.
2. The Stabilization Fund may only be used., the following circumstances:
a. To support the operating budget4hen General Fund Net Revenue, as
defined as Total Revenue less-;debt exclusions-<and state school
building reimbursements,increases less than'2;5°/n from the prior fiscal
year.
b. To fund capital projects oii,,a pay-as-you-go basis, when available
Free Cash drops below$2 million in atiy year and only',,, the Capital
Stabilization Fund has reached its floor as defined in the`Capital
Stabilization Fund section of this'policy.
3. The level of use of the Siabilizatinn°Fund shall be:limited to the following:
a. When supporting the`operating budget under``2a" above,the amount
drawn,dovvn from the fund shall be- pa I to the amount necessary to
bring the year over-yearincrease in the Town's prior year Net
Revenue by"2`5%, or$1 million, whichever is less. The draw down
shall not occu,in more than,.three consecutive fiscal years and the
maximum shall not exceed$2:S,million.
b When funding capital pojects, on apay-as-you-go basis under"2b"
above;,no niore;than$1 million may be drawn down from the fund in
any fiscal year the draw down shall not occur in more than three
consecutive fscd-years and the maximum shall not exceed$2.5
million.
4. In order to replenish the Stabilization Fund if used, in the year immediately
following dhy i raw down, the Town shall formulate a plan to restore the Fund
to the previously identified TFL. Said funding shall come from Free Cash.
• Capital Stabilization Fund a Stabilization Fund shall be maintained,under the
provisions of MGL Chapter 40, Section 5B.
1. The TFL for the Fund shall be an amount equivalent to 1% of the Town's
prior year Total General Fund Revenues. A Capital Stabilization Fund
Floor shall be established at $25,000. The Fund shall be funded only with
Free Cash or one-time revenues.
2. The Capital Stabilization Fund may only be used under the following
circumstances:

a. To fund projects which have been approved as part of the Town's
Capital Improvement Plan (CIP).
+ Other Post-Retirement Benefits (OPEB)——a Stabilization Fund shall be
maintained,under the provisions of MGL Chapter 40, Section 5B.
1. The target funding level (TFL) for the Fund shall be an amount equivalent to
5% of the OPEB unfunded actuarial liability.
a. An amount equal to 1% of the OPEB unfunded actuarial liability shall
be transferred to the OPEB Fund from the Town's Health Insurance
Trust Fund at the time the OPEB Fund is,established.
b. Annually, an amount equal to a minimum of 2.5% of the OPEB Fund
balance shall be appropriated to the OPiJB:Fund either from the
operating budget or Free Cash.; ,
c. From time to time the To,
wn"sfidll analyze the'balance in the Health
Insurance Trust Fund to,determine if additional funds can be
transferred into the OPEA fund.
2. In order to replenish,the;.OPEB Fund if used,'in the year immediately
following any draw down �°lhe Town shall f6hnulate a plan to restore the Fund
to the previously identified "FL<`Said fund'in' hall come from Free Cash.
Note: The Annual=Town Meeting of 2010;establishedsi.OPEB trust fund to
offset the anticipated cost of other;post empoyindrit benefits (OPEB) of retired
employees To date, no appropriation has been made to that fund. This fund
should be eliminated
• . Overlay:Reserve>estabhshed;per_the requirements of MGL Chapter 59, Section
25; the Overlay is used,as a reserve,;unde'r the direction of the Board of Assessors,
to fund properky tax exemptions and abatements resulting from adjustments in
valuation. The Board of Selectmen shall, at the conclusion of each fiscal year,
require the Board I fAssessors jo submit an update of the Overlay reserve for
each fiscal year, including, but 'not limited to,the current balances, amounts of
potenfial�abatements; ar�d any transfers between accounts. If the balance of any
fiscal year,overlay exceeds the amount of potential abatements, the Board of
Selectmen may regtest the Board of Assessors to declare those balances surplus,
for use in the Town's Capital Improvement Plan (CIP) or for any other one-time
expense.
• Enterprise Fund Retained Earning Reserve—to provide rate stability in the
Water and Sewer Enterprise Funds, the funds will maintain retained earnings
equivalent to a minimum of three months of appropriated expenses. Retained
earnings in excess of four months will be appropriated to offset user fees directly
or indirectly through capital project pay-as-you-go funding of enterprise fund
proj ects.

SUBJECT: Licensing Renewals for 2014
DATE: December 11, 2013
I respectfully submit the attached list of establishments for your review in approving their
license renewals for the calendar year 2014. Attached is a memo from the Police Department
recommending favorable action on the renewals. The following are changes for 2014:
• Jasmine's Famous Roast Beef, 1060 Osgood Street, (Common Victualler) closed
2/2013
• Ray Finocchiaro, I1 Riverview Street, (Class II) per phone call, not renewing for
2013
• One Stop Transportation, Timothy Eatman, 77 Beverly Street, (Livery/Limo) did
not reply to renewal package mailed to him. Followed up with phone call, left
message, no reply back.
• Camelot Sports Pub has regretfully closed their doors as of 11/30/2013 (see attached
letter).
In regards to the Section 12 (alcohol licenses), the Building Inspector and Fire Chief have
signed off on most of the establishments regarding the Certificates of Inspection. Valid copies
of the signed certificates are in the Town Clerk's Office files. All appropriate paperwork
regarding Worker's Compensation Insurance and Alcohol Liability Insurance is likewise in the
office files. As of this date, the businesses without signed Certificates of Inspection are: Rolf s
and the North Andover Country Club. The Fire Chief and Building Inspector continue to work
with them to achieve compliance.
Please see the attached memo from Treasurer/Collector Jennifer Yarid regarding outstanding
taxes owed to the Town of North Andover.

Gentlemen it is with deep regret to inform you that Camelot
Association Inc will not be re-hewing its Alcohol and Beverage License for the year
2014. Camelot has closed its doors and are no longer in business as of November
30th 2013. If in the future we do open a business again that the Town of North
Andover would give us consideration for a new license. The Knights of Columbus
will be resuming its meetings at St.Michaels Church in the convent.

SUBJECT: Extended hours New Year's Eve
It has been past practice for the Licensing Commission to allow alcohol establishments to
remain open until 2:00 am, with service of alcohol to end at 1:00 am, on New Year's Eve. As
of this date,the following businesses have asked to remain open late:
Orzo Restaurant, 1170 Osgood Street
China Blossom, 946 Osgood Street
Chama Grill, 115 Main Street
Hokkaido, 1250 Osgood Street
Included is a favorable recommendation from the Police Department.
Should the Commission vote to allow this, I will notify the businesses by mail.

Re: Extended Hours on New Year's Eve
The Police Department recommends favorable action on the requests from Orzo, China Blossom,
Chama Grill and Hokkaido restaurants to extend their hours of operation on New Year's Eve, 2013.
These establishments can remain open until 2:00am on January 1, 2014 and will need to stop service
of alcoholic beverages at 1:00am on January 1, 2014.
The Police Department will conduct additional liquor checks of these establishments, as well as
others,to ensure that all are in compliance with all regulations set forth by the Town of North
Andover and the Commonwealth of Massachusetts.

RE: November 2013 Crime Statistics
November brought the beginning of the holidays. Over the last 6 years,the police department has implemented
"Directed Patrols"along the Route 114 shopping corridor. The purpose is to have a visible presence in the
retail areas to give the shoppers a sense of security while letting potential shoplifters and car breakers know that
there is a police patrol nearby.Also,to let the store employees and management know that the police are
available for a quick response if need be. On our second day of implementation we received a 911 call for a
choking child inside Market Basket. While the fire department ambulance was being dispatched our
Communication Center called the officer on directed patrol. The officer answered the radio transmission and
said that he was at Kohl's and on the way. This quick response had nothing to do with any criminal act or
investigation but the response time was what every parent of a choking child would hope for,seconds.
Although the numbers are still relatively low,the amount of B&E's and motor vehicle B&E's, continues to
affect the town. Our residents continue to call for suspicious activity that has resulted in arrests.We place the
unmanned cruisers in strategic and predetermined locations around town in an attempt to show more of a police
presence. This tactic has worked in the past and our hope is that it continues. While statistics can never report
how many crimes we actually prevent,we firmly believe that it makes a big difference.
Often during the holiday period we have persons that are in emotional distress. This month such an incident
occurred. Sergeant Stephen Diminico and Officer Katherine Gehrke were assigned a call for service of a
resident that could not be located by the family.The family had serious concerns of his well being. The
investigation also used technology to"ping"the person's telephone.Due to the diligence of these two officers
that resident was found in a nearby community and was in"distress". Assistance was rendered and the family
expressed their appreciation.
We are currently interviewing applicants for communication officer positions for both full and part time. We
have a lot of interest in the position and our hopes after to have the positions filled in the next few weeks.

I and the command staff have met with the new managers of Royal Crest Estates in my office. Several
meetings with past mangers were not very productive. The new managers were very receptive to our discussion
and concerns. I have already seen a dramatic increase in our working relationship. Incidents on their property
are reported to management per our notification process of landlords/owners of properties. Management has
taken the appropriate measures to persons causing problems at the complex. This notification process was
enacted by the Board of Selectmen several years ago and has been a tremendous tool for the police department.
I look forward to working with Royal Crest Estates
At the end of the month the annual Santa parade took place. The North Andover Police Association is the proud
sponsor of this event. Officers and supervisors donated their time to assist with the set-up, closing of streets and
moving cars. Others volunteered to direct traffic around the parade and the Honor Guard marched in the parade
itself. As our community events become more frequent and larger our Officers and Special Officers have come
forward to have a successful event. Lieutenant Eric Foulds did a tremendous job of coordinating the parade and
working with the Festival Committee.
The North Andover Garden Club, once again, decorated the police headquarters with wreaths for the holiday
season. The department is grateful for their continued support.
The Massachusetts Chiefs of Police and the Massachusetts Police Accreditation Commission recognized the
department with a plaque at their annual meeting for our Re-Accreditation for the next three years.The officers
are to be credited for their professionalism in attaining this distinction.
