ADJOURNMENT i Approval of Minutes BOARD OF SELECTMEN MINUTES DECEMBER 16, 2013 CALL TO ORDER: Chairman Rosemary Smedile called the meeting to order at 7:00 PM at Town Hall Meeting Room. ATTENDANCE: The following were present: Rosemary Smedile Chairman; Richard Vaillancourt, Clerk; Tracy Watson, Licensing Chairman; Donald Stewart, William Gordon, and Andrew Maylor, Town Manager and Ray Santilli, Assistant Town Manager. PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES: Richard Vaillancourt made a MOTION, seconded by Tracy Watson, to;,,approve the Open Session Minutes of December 2, 2013, as written. Vote approved 5-0. COMMUNICATIONS ANNOUNCEMENTS AND PUBLIC COMMENT: Presentation to Kenneth Wedge The Board of Selectmen, the North Andover Booster's Club, Football Coach John Rafferty and Terry Holland of the Field's Committee honored Kenneth Wedge for his dedicated`35 years of service in the Town of North Andover upon his retirement. Update on ESCO Proiect The Town Manager gave a brief update on the ESCO project.'The contracts have been executed and the work will begin on all municipal and school buildings. The energy improvements will be implemented over the next 12 months. CONSENT ITEMS: Financial Reserve Policies The Town Manager presented "Financial Reserve Policies"to be established to protect the Town from unforeseen increases in expenditures, reduction in revenues, or a combination of both, or any other extraordinary events, He explained that fund balance and reserve policies also serve to provide an additional,source of funding for capital construction and replacement projects. Reserves should normally average 5% to 15% of the town's General Fund 'Budget; Andrew Maylor gave a brief summary of the following: Operating Reserves, Stabilization Fund, Capital j Stabilization Fund, Other Post-Retirement Benefits (OPEB), Overlay Reserve, and the Enterprise Fund Retained Earnings Reserve. He requested the Board vote to approve the Financial Reserve Policies as presented. Tracy atson made a MOTION seconded b Donald Stewart that the Board of Selectmen approves the Y Y pp Financial Reserve Policies as presented. Vote approved 5-0. Item B Town Manager's Recommended FY2015-2019 Capital Improvement Plan will be moved to the Town Manager's Report. Acceptance of donation ($12,822)from Joseph N. Hermann Youth Center, Inc. to Youth & Recreation Services to refinish Youth Center gymnasium floor Tracy Watson made a MOTION, seconded by Donald Stewart, that the Board of Selectmen accepts the donation from the Joseph N. Herman Youth Center, Inc. in the amount of$12,822 to Youth & Recreation Services to refinish the Youth Center gymnasium floor. Vote approved 5-0. Affordable Unit Resale—2202 Dogwood Circle (Oakridge Village/Maplewood Reserve) The Citizens' Housing and Planning Association (CHAPA) has notified the Town that the affordable housing unit at 202 Dogwood Circle (Oakridge Village/Maplewood Reserve) is up for sale. It is recommended the Board not exercise its right of first refusal. Board of Selectmen Minutes December 16, 2013 2 Donald Stewart made a MOTION, seconded by Tracy Watson, that the Board of Selectmen declines the right of first refusal to purchase the affordable housing unit at 2002 Dogwood Circle (Oakridge Village/Maplewood Reserve). Vote approved 5-0. Waiver of Building Fees for School Administration Building project The Board is asked to approve waiving any and all building fees for the School Administration Building project. The project is scheduled to go out to bid the first week of January. Richard Vaillancourt made a MOTION, seconded by Tracy Watson, that the Board of Selectmen waives any and all building fees for the School Administration Building project. Vote approved 5-0. LICENSING COMMISSIONERS: Donald Stewart made a MOTION, seconded by Richard Vaillancourt, to open a meeting of the North Andover Licensing Commission. Vote approved 5-0. Extended Hours for New Year's Eve The following alcohol establishments have requested extended hours and remain open until 2:00 a.m. with service of alcohol to end at 1:00 a.m. on New Year's Eve. Orzo Restaurant, 1170 Osgood Street, China Blossom, 946 Osgood Street, Chama Grill, 115 Main Street, and Hokkaido, 1250 Osgood Street. William Gordon made a MOTION, seconded by Donald Stewart, that the Board of Selectmen, acting as Licensing Commissioners, approve the following license holders to stay open until 2:00 a.m. on New Year's Eve, with alcohol service to end at 1:00 a.m.: Orzo Restaurant, 1170 Osgood Street, China Blossom, 946 Osgood Street, Chama Grill, 115 Main Street, and Hokkaido, 1250 Osgood Street. Vote approved 5-0. License Renewals for Calendar Year 2014 Public Comment—A group of residents that are abutters to Smolak Farms, hired Attorney Timothy Schiavoni to represent them stating that the loud music that projects from the farm during functions at night infringes on their peace and quiet. The amplification of the music is so loud that it rattles their windows and interferes with their children's sleep. They are not trying to take away the Entertainment License but would like to work out a solution that would work for all parties involved. Town Manager Andrew Maylor said he would set up a meeting with Attorney Schiavoni, Michael Smolak, and residents within the next couple of weeks to try and work out an acceptable solution. Selectmen decided to vote on approval of all renewal licenses except Smolak Farms Entertainment License. If and when the parties have agreed on a solution, it will be brought to the Selectmen at their next meeting. William Gordon made a MOTION, seconded by Donald Stewart, that the Board of Selectmen, acting as Licensing Commissioners, approve and renew the licenses for all establishments listed in the Assistant Town Clerk's memorandum dated December 11, 2013, except for the Entertainment License for Smolak Farms, 315 South Bradford Street. Vote approved 5-0. i Board of Selectmen Minutes December 16, 2013 16 TOWN MANAGER'S REPORT: Town Manager Recommended FY2015-2019 Capital Improvement Plan Andrew Maylor submitted his recommended Capital Improvement Plan (CIP). The common goal continues to be to implement practices which will result in establishing a sustainable municipality and ensure the stewardship of town assets. This plan requests funding for annual building maintenance, roadway improvements, the adopted Facilities Master Plan and information technology enhancements. For the for seeable future we will continue the practice of reducing debt service as a percentage of revenues to below 5%. The General Fund CIP for FY15 achieves the lowest percentage of debt service to revenues in memory at 4.31%. Per Chapter 9, Section 5-1 of the Town's Charter, the Board has 30 days to act on the CIP and forward to the Finance Committee once approved. It is recommended that the Board accept the CIP as submitted reserving the right to make any changes at future meetings. William Gordon made a MOTION, seconded by Tracy Watson, that the Board of Selectmen accepts the FY2015-2019 Capital Improvement Plan reserving the right to make changes as additional information becomes available and forwarding the document to the Finance Committee for their review.
