Appeals Court No. 2011-P-1873
Dear Members:
The appeal in this case is to overturn the Superior Court ruling vacating the renewal of a
special permit for wireless facilities which you granted to T-Mobile Northeast.
On,Jamlary 13 T-Mobile Northeast and I, on behalf of the Planning Board,filed briefs
with the Massachusetts Appeals Court.
The Plaintiffs had until February 13 to file their brief in response.
I spoke with the Appeals Court clerk's office today and the clerk said that no such
responsive brief had been filed by the Plaintiffs. Accordingly, the clerk informed me that if the
Appeals Court schedules an oral argument,then the Plaintiffs would be precluded from making
any oral argument.
