HomeMy WebLinkAbout2012-04-03 Planning Board Supplemental Materials (55) BreakAway Realty Trust 28 Main Street North Andover, MA 01845 April 3, 2012 North Andover Planning Board 1600 Osgood Street North Andover, MA 01845 Main Street Rear Lot Dear Planning Board: My sincerest apologies that I will not be able to personally attend tonight’s planning board meeting which will discuss the proposed 8 unit subdivision behind my building at 28-30 Main Street, North Andover, MA. I do have a myriad of serious concerns relating to the number of units proposed in the new overlay zoning district which the applicant is intending to use to justify a subdivision of such massive scale on the rear parcel lot. I have engaged the services of an attorney to clarify and challenge the validity and legality of the supposed ingress and egress easement that was referenced at the planning board meeting which I attended on March 20, 2012 and how the “quiet statute of enjoyment” referred to in said easement is being utilized in the applicants’ proposal before the planning board. I have placed two telephone calls with messages left to the applicant (Jeffco) today in hopes of meeting with them prior to the next scheduled meeting on April 17, 2012 to discuss a number of serious concerns which I have with their current proposal. I also placed a call today and spoke at length with Mr. Al Manzi, current owner of the property, to discuss my concerns with the proposal before the planning board and asked Mr. Manzi that he call the applicant and have him return my call as soon as possible. As of this afternoon, I have yet to receive a return call from the applicant. Again, my respectful apologies to the board that I will be unable to attend tonight’s meeting and assure you that I will be present at the planning board meeting scheduled for April 17, 2012 to discuss my concerns as a direct abutter.
