The Planning Board herein approves an eleven (11) lot Preliminary Subdivision located on Berry Street in the R-3 Zoning District. The application was submitted by applicant Cal Goldsmith of Goldsmith, Prest and Ringwall, Inc, for the owner of the property Margaret Fiore, prepared by Goldsmith, Prest and Ringwall, dated April 2011. Findings of Fact The Planning Board makes the following findings as required by Section 5B Review Standards for Preliminary Plans as set forth in the Rules and Regulations Governing the Subdivision of Land, North Andover, Massachusetts, Revised February 1989: A. The applicant submitted a complete application for a Preliminary Subdivision, on April 20, 2011, according to the Town of North Andover’s Rules and Regulations Governing PROCEDURE FOR the Subdivision of Land in North Andover, section IV, SUBMISSION AND APPROVAL OF A PRELIMINARY SUBDIVISION. B. The applicant submitted a preliminary plan on April 20, 2011, showing conformance with design criteria for the street plan and profile, as set out in section 5.2.5.4 and section 6.8 in the town of North Andover Subdivision Regulations, but with waivers for street width (22 feet proposed, 26 feet required), minimum corner curb radius (28 feet proposed, 40 feet required) and a waiver for sidewalks. C. The proposed development includes an open space area, containing endangered species habitat as well as wetlands, with a potential for walking trails. Access to the cemetery will be provided through this open space area. D. The applicant has done a flood study of the area and has received a Letter of Map Amendment (LOMA) from FEMA, which resolves issues with regard to flood plain areas. E. The applicant will provide sewer infrastructure along Berry St. thus allowing the town to extend its capacity in the future. F. The Preliminary Plan adheres to the requirements of section 4.1, and in particular section 4.3.12, in that they have provided information regarding drainage systems, sewer and water pipes and other utilities. The drainage system will be reviewed by our outside consultant, when the Definitive Subdivision is filed to determine if the plan meets the stormwater requirements for subdivisions. Any decisions made by the Planning Board regarding this Preliminary Subdivision Application are not binding upon the Planning Board and are not to be considered as an approval or denial of any future Definitive Subdivision filing. Any Definitive Plan filed at a future date may contain more detailed information than that provided with this Preliminary Plan. This information will be presented and discussed at a formal Public Hearing. Upon a motion made by T. Seibert and a second by C. LaVolpicelo, the Planning Board herein APPROVES this application for a Preliminary Subdivision Plan. The vote was 3 – 0 in favor of the application.
