HISTORY AND BACKGROUND On September 20, 2011, the applicant requested a waiver of the Watershed Protection District Special Permit, in accordance with the North Andover Zoning Bylaw section 4.136.8, so as to allow the construction of a 4’ X 22 ft. extension to the western side of an existing dwelling unit and a 35’ X 18.5’ addition on the southern side of the same dwelling unit. The new construction is located more than 100’ from a delineated wetland resource area within the Non-Disturbance buffer zone of the Watershed Protection District. DECISION nd After a Planning Board meeting on the above date, and upon a motion by X and 2 by X a vote unanimousin was taken with regard to a waiver of the Watershed Special Permit. The vote was favor of the waiver. John Simons recused himself from the discussion and the vote. FINDING OF FACT The Planning Board has made its decision based on the following findings:  The extension and the addition are located within the non-disturbance zone and are more than 100 ft. from a delineated wetland.  The grading on the existing lot is such that stormwater runoff drains to an existing swale on the property and does not drain to the closest wetland area, located on the opposite side of Dale Street. CONDITIONS  The applicant will install underground stormwater structures to capture runoff from the extension and addition.  The applicant will install the appropriate erosion control prior to construction, which will be inspected by the Town Planner prior to the start of construction. _______ North Andover Planning Board Richard Rowen Tim Seibert Michael Colantoni Rickey Glover 2
