CALL TO ORDER: Chairman Regina Kean called the meeting to order at 7:09PM in the Town Hall
Meeting Room. The open session meeting was recorded.
ATTENDANCE: The following were present: Chairman Regina Kean, Clerk Phil DeCologero, Licensing
Chairman, Chris Nobile, Richard Vaillancourt, Rosemary Smedile, Town Manager Andrew Maylor,
Assistant Town Manager, Ray Santilli and Executive Assistant, Laurie Burzlaff. Approximately 15
members of the public were present.
PLEDGE OF ALLEGIANCE
PUBLIC COMMENT
Helen Pickard of 447 Waverly Road thanked the Board for their responsiveness to the gas crisis and for
the proclamation of Indigenous Peoples' Day.
Mark Bohrer of 10 Heath Circle, read a poem for Indigenous Peoples' Day.
APPROVAL OF MINUTES
Richard Vaillancourt made a MOTION, seconded by Phil DeCologero, to approve the Open
Session Minutes of September 10, 2018. Motion approved 5-0.
GOVERNMENTAL REPORTS
Update on Gas Incident
The Town Manager presented a slide show of the information regarding the gas incident which occurred
on September 13tn
Donald Stewart of 52 Prospect Street, thanked the first responders.
Anna Choi of 70 Maple Avenue suggested a list be created with names of contractors that can do the
repair work.
Halloween Hours
Police Chief, Charles Gray, provided a memorandum to the Board recommending trick or treat hours on
October 31 st be from 5:30PM to 7:30PM.
The Board took at twenty minute recess.
CONSENT ITEMS (taken out of order)
Request of Dan Pas to hold the MDA Fill the Boot Drive on Saturday, October 13, 2018 at the roundabout
at the Town Common from 9:OOAM to 2:OOPM
Dan Pas of the North Andover Firefighters Union is asking permission to hold their annual Muscular
Dystrophy Association Boot drive on Saturday, October 13, 2018 9:OOAM-2:OOPM. All relevant
departments have reviewed the request and have no issues.
Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt that the Board of
Selectmen approve the request of Dan Pas to use the roundabout at the Town Common for the
Muscular Dystrophy Association Boot Drive from 9AM-2PM on October 13, 2018. Motion approved
5-0.
Proclamation of Indigenous Peoples' Day
On July 16, 2018, the Board voted to issue a proclamation declaring the second Monday in October as
Indigenous Peoples' Day along with Columbus Day. Chairman Regina Kean read the proclamation.
Waiver of permit fees for residents and businesses impacted by the gas incident
Phil DeCologero made a MOTION, seconded by Chris Nobile that the Board of Selectman waive all
permit fees for residents and businesses impacted by the gas incident of September 13, 2018.
Motion approved 4-0-1. Selectwoman Smedile abstained.
Grant Town Manager authority to approve gas petitions for repair work
In an effort to expedite repair work that Columbia Gas needs to complete, the Town Manager suggested
the Board grant him the authority to approve the gas petitions for repair work.

Phil DeCologero made a MOTION, seconded by Richard Vaillancourt that the Board of Selectman
grant the Town Manager authority to approve gas petitions for repair work. Motion approved 4-0-1.
Selectwoman Smedile abstained.
Approve letter to Division of Local Services to deficit spend under M.G.L. Chapter 44, §31
The Department of Revenue requires the Board submit a letter to them in order to deficit spend. Since it
is the beginning of the Fiscal Year, the town is currently not in the situation where deficit spending is
necessary; however, by the end of the fiscal year, it may be because of the costs associated with the gas
disaster.
Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectman
approve the letter to the Department of Revenue requesting permission to deficit spend. Motion
approved 5-0.

Chris Nobile made a MOTION, seconded by Richard Vaillancourt that the Board of Selectman
approve the appointment of Kevin Craig and Jessica Pimentel to the Sustainability Committee for
a term ending June 30, 2020;Alvin Pimentel to the Sustainability Committee for a term ending
June 30, 2019;Jeffrey Clark to the Patriotic Observance Committee for a term ending June 30,
2021; Vishvesh Dhar to the Sustainability Committee for a term ending June 30, 2021, Frank
Killilea as an associate member to the Zoning Board of Appeals for a term ending June 30, 2021;
Jennifer Abou-Ezzi to the Council on Aging for a term ending June 30, 2021;and Ellen Moshier to
the Stevens Estate Advisory Committee for term ending June 30, 2020. Motion approved 5-0.
LICENSING COMMISSIONERS
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile to open a meeting of the
North Andover Licensing Commission. Motion approved 5-0.
Request of Ashley Piazza of Smolak Farms for a one day wine and malt license for a dinner in the tent on
Thursday, October 11, 2018 from 5:OOPM to 9:OOPM
Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen,
acting as Licensing Commissioners, approve the request of Ashley Piazza of Smolak Farms for a
one day wine and malt license for a dinner in the tent on October 11, 2018 from 5:OOPM-9:OOPM, as
presented with the notice that no music may be played during clean up and workers must be quiet
during clean up. Motion approved 5-0.
Request of Paul Gallant of Merrimack College for ten one day wine and malt licenses for the concessions
at the Athletic Center on:

Richard Vaillancourt made a MOTION, seconded by Phil DeCologero to table numbers 1-10 until
the next meeting. Motion approved 5-0.
Regina Kean made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen,
acting as Licensing Commissioners, approve the request of Paul Gallant of Merrimack College for
a one day wine and malt licenses for concessions at the Rogers Center on December 28, 2018
from 5:OOPM to 10:OOPM as presented. Motion approved 5-0.
Request of Deborah Ingalls for two one day all alcohol liquor licenses for events in the tent at Smolak
Farms:
1. Corporate dinner on Thursday, October 4, 2018 from 4:OOPM to 8:OOPM
2. Wedding on Saturday, October 6, 2018 from 4:OOPM to 10:OOPM
Regina Kean made a MOTION, seconded by Phil DeCologero that the Board of Selectmen, acting
as Licensing Commissioners, approve the request of Deborah Ingalls for two one day all alcohol
licenses for events at Smolak Farms as presented with the notice that no music may be played
during clean up and workers must be quiet during clean up.
Richard Vaillancourt made a MOTION, seconded by Regina Kean to close a meeting of the North
Andover Licensing Commission. Motion approved 5-0.

NEW BUSINESS
Dedication of benches in front of Town Hall
At the suggestion of Chairman Kean, the Board agreed to dedicate a bench in front of Town Hall to
Kenneth and Carrie Crouch and a bench to Charlie and Martha Salisbury.
TOWN MANAGER'S REPORT
Reports
The Board was provided with the Police Department report, Fire Department report, Opioid overdose
report, Building department report and the Job posting/vacancy log.
Town Manager, Andrew Maylor, explained that the Housing Production Plan has been approved, the
Capital Improvement Plan process has begun, the Owner's Project Manager has been chosen for the
Senior Center and the architect for the Senior Center will be chosen shortly.
SELECTMAN'S UPDATES/COMMENTS
The Board thanked Assistant Town Manager, Ray Santilli, for his many years of service.

CALL TO ORDER: Chairman Regina Kean called the meeting to order at 7:OOPM in the Town Hall
Meeting Room. The open session meeting was recorded.

APPROVAL OF MINUTES:
Richard Vaillancourt made a MOTION, seconded by Phil DeCologero, to approve the Open
Session Minutes of August 13, 2018 and August 27, 2018, as presented. Motion approved 5-0.
INTRODUCTION OF NEW STAFF MEMBERS
Town Manager, Andrew Maylor, introduced Diamanthina 'Deanna" Cruz who was appointed the town's
first Community Support Coordinator. Ms. Cruz gave a grief description of her background and answered
questions from the Board.
ACCEPTANCE OF DONATIONS
Donation from the Groveland Firefighters Association in the amount of;$200 to be used for operating
expenses for Fire Safety Trailer
The Groveland Firefighters Association has donated $200 to the Fire Department as a thank you for
letting them use North Andover's fire safety trailer.
Richard Vaillancourt made it MOTION, seconded by Chris Nobtle that that the Board of Selectmen
accept the donation of$200 from the Groveland Firefighters Association to be used for operating
expenses for the fire safety trailer. Motion approved 5-0.
Donation from the Atkinson School PTO in the amount of$9,937.70 to be used for the Atkinson School
Playground
The Atkinson School PTO donated funds to be used for the new Atkinson School playground.
RosemaryS►tredfle made a MOTION, seconded by Phil DeCologero that the Board of Selectmen
accept the donation of9,937.70,from the Atkinson School PTO to be used toward the cost of the
new Atkinson School playground: Motion approved 5-0.
LICENSING COMMISSIONERS:
Rosemary`S►rredile made a MOTION, seconded by Phil DeCologero to open a meeting of the North
Andover Licensing Commission. Motion approved 5-0.
Request for Change of Manager at the North Andover Country Club from Stephen J. Kohr to Jeff S. Isbell
Jeff Isbell was present to answer questions from the Board.
Rosemary Smedile made a MOTION, seconded by Regina Kean that the Board of Selectmen,
acting as Licensing Commissioners, approve the change of manager request for North Andover
Country Club as presented. Motion approved 5-0.

Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen,
acting as Licensing Commissioners, approve the request of Paul Gallant of Merrimack College for
eighteen one day wine and malt licenses, as presented. Motion approved 5-0.
Rosemary Smedile made a MOTION, seconded by Regina Kean to close a meeting of the North
Andover Licensing Commission. Motion approved 5-0.
CONSENT ITEMS
Accept and sign Municipal Certification for Conservation Restriction from.Edgewood to tho Trustees of
Reservations
Included in the packet was a memorandum from Jennifer Hughes regarding the Conservation Restriction
from Edgewood to the Trustees of Reservations. The Board is Ming asked to approve the restriction. The
Conservation Commission has unanimously voted to approve and recommended the Board of Selectmen
approve it as well.
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of
Selectmen approve the Conservation Restriction from Edgewood Retirement Community, Inc. to
the Trustees of Reservations. Motion approved 5-0.
Appointment of Paul Hutchins as ADA Coordinator
The Board was asked to appoint a new ADA Coordinator. The position was previously held by Donald
Belanger who no longer works for the town.
Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt that the Board of
Selectmen appoint Paul Hutchins as the ADA Coordinator. Motion approved 5-0.
Vote on comments to send to Planning Board regarding draft Master Plan
The Town Manager stated that the final Master Plan document will be approved by the Planning Board in
two weeks and he doesn't expect any major changes to the draft document between now and then. The
Board discussed working toward creating a;priority plan but did not have any comments of substance that
they wanted to send to the Planning Board;therefore no vote was taken.

TOWN MANAGER'S REPORT
Job posting/vacancy log
Included in the packets was the latest job posting/vacancy log provided by Human Resources.
Town Manager, Andrew Maylor explained that the Finance Director, Lyne Savage, has developed the
budget calendar and the Finance Committee has been given a copy.

Mr. Maylor also stated that they are in the process of hiring an Assistant Town Manager to replace Ray
Santilli when he retires at the end of the month. Mr. Maylor thanked Mr. Santilli for his efforts over the last
seventeen years and expressed his appreciation for all he has done.
SELECTMAN'S UPDATES/COMMENTS
Rosemary Smedile asked about the Greater Lawrence Sanitary District's response to the recent
combined sewer overflow. Mr. Maylor explained that they had some issues during the process of
repairing a pipe but now that the repair is done it should reduce the likelihood of a combined sewer
overflow during a power outage.
Rosemary Smedile asked about the surcharge on resident's electric bills. The Town Manager stated the
surcharge is for the undergrounding of the wires on Main Street, similar to what was done around the
common. The process could take up to ten years to complete.
Richard Vaillancourt stated there will be a 9/11 ceremony at Town Hall at 9;00AM.
Phil DeCologero stated his appreciation for Carrie Crouch and her forty years of volunteer service that
helped change the direction of the community.

The Event
■ At approximately 4pm on Thursday Sept 13t" a series of fires broke out and explosions
occurred in South Lawrence, Andover and North Andover related to the delivery of
natural gas as a result of high pressure in a low pressure system.
■ The fires tragically killed one individual, caused dozens of injuries, destroyed homes and
led to the evacuation of significant portions of each municipality.
■ A mobile command center was stood up in Lawrence and supported by first responders,
utility companies, federal officials and members of state and local government.
■ 32 Properties were impacted by gas related fires of some sort.

and community volunteers
■ The shelter provided:
- Cots for sleeping - provided by red cross
- Hot Showers in NAHS locker rooms; toiletries and towels donated by Target
- Food - donated by business (LIST) and residents
- Several hudred people were served
■ After closing the shelter:
- YMCA opened to all resident for showers - remains open to all residents
- Food donated to residents/ local pantries

The Restoration - Overview
■ Navy Captain Joe Albanese, Ret., Founder and CEO of Commodore Builders, a construction
management firm, will serve as the Chief Recovery Officer.
■ Starting today (9/24) Columbia Gas and contracted construction teams will begin the massive
replacement program in all three communities.
- The effort will ultimately replace the 48-mile, cast iron and bare steel distribution
system with state-of-the-art infrastructure and safety features such as excess flow
valves that automatically shut off gas flow if a service line is damaged or broken.
- Columbia Gas is working closely with industry and regional partners, including local fire
and police departments, elected officials and the Department of Public Works, which is
reviewing all engineering and construction plans.
■ Teams will visit every impacted residence/business to do a full assessment and determine
what appliances need to be replaced or repaired. Each assessment may take several hours.
- Residents will receive a communication from Columbia Gas to confirm the assessment
so they can plan to be home.
- It will take several weeks for all assessments to be completed.
■ Restoration is expected by Nov 19th

Dear Ms. Hardy:
I am writing to request permission for the Town of North Andover to deficit spend under Chapter 44,
Section 31 due to the gas explosions and fires that occurred on September 13, 2018 in the Merrimack
Valley. Governor Charlie Baker declared a state of emergency on September 14, 2018 for North Andover,
Andover and Lawrence. A brief explanation of the situation is as follows:
On September 13,2018, the North Andover Fire Department responded to 31 fires of various magnitudes.
At the time, all fire engines (pumps and the ladder) along with two fire vehicles (Deputy Chief and FPO)
were dispatched. Since the number of calls was far too many for North Andover equipment to handle,the
Communication Center called for mutual aid support. It was at this time that we became aware of similar
occurrences in Lawrence and Andover. All North Police Department staff were held over to assist the Fire
Department and in many cases police officers were responding to alarms sounding to assess and report
back what was happening. Electricity was shut off to the impacted area and crews from Columbia Gas
working with public safety personnel began the process of turning off the gas to the impacted area at
around 2am on September 14a'. By the end of the day on September 16', electricity was restored;
however, at this time approximately 1600 residents of North Andover are still without gas.Public safety
personnel and several town staff members have been working overtime during this crisis and will
continue to do so until it is over.
Because of the extent of the disaster and the ongoing state of emergency,we are uncertain as to what the
amount of deficit spending will be. At this time our best estimate is $500,000.

EXPLAINATION OF TERMS
Cardiac Arrest: Sudden cardiac arrest is the sudden, unexpected loss of heart function,
breathing and consciousness. Sudden cardiac arrest usually results from an electrical disturbance
in your heart that disrupts its pumping action, stopping blood flow to the rest of your body.
These patients are provided resuscitation efforts with cardiopulmonary resuscitation, airway
management and automatic external defibrillator.

disease.
Dead on Arrival(DOA): Is a term used to indicate that a patient was found to be already
clinically dead upon the arrival of professional medical assistance. Examples of Dead on Arrival
according to the Massachusetts Department of Public Health are as follows:
Date of Service (DOS): The date in which the fire department responded to a call for assistance.
Fentanyl: Is a potent, synthetic opioid analgesic with a rapid onset and short duration of action.
Opiate: Opiates are a group of drugs that are used for treating pain. They are derived from opium
which comes from the poppy plant. Opiates go by a variety of names including opiates, opioids,
and narcotics. The term opiates is sometimes used for close relatives of opium such as codeine,
morphine and heroin, while the term opioids is used for the entire class of drugs including
synthetic opiates such as Oxycontin. Some of the more common opiates are Codeine, Vicodin,
Hycodan, Morphine, Oxycontin, Percoset, Dilaudid, and Fentanyl.
Polysubstance Overdose: A polysubstance overdose is when a person is in an intoxicated state
without a preference for one particular substance as several substances have been mixed
together. Although any combination of three drugs can be used, more likely alcohol is commonly
used with other substances such as cocaine and heroin. In the substance abuse context, it usually
refers to the use of multiple illicit drugs, however, it can also apply to prescription medications
used for nonmedical purposes. People often use multiple substances in an attempt to enhance the
effect of a single drug to create a more intense high.
NOTES.-
On July 12, 2016 (Polysubstance Overdose): A person with polysubstance overdose is when a
person is in an intoxicated state without a preference for one particular substance as several
substance have been mixed together for the ultimate effect. Although any combination of three
drugs can be used, more likely alcohol is commonly used with other substances such as cocaine
and heroin.

keeping with the trend that is being seen across the Merrimack Valley.
On July 30, 2016 (Cocaine Overdose): Cocaine is a strong stimulant mostly used as a
recreational drug. Cocaine has powerful negative effects on the heart and brain. Occasional
users run the risk of sudden death with cocaine use. Cocaine use is bad for the heart. Cocaine
increases heart rate and blood pressure while constricting the arteries supplying blood to the
heart. The result interrupts blood flow to the heart muscle itself, which can cause a heart
attack even in young people without heart disease.
On August 8, 2016 (Ingested Percocets): The drug Percocet contains a combination of
acetaminophen and oxycodone. Oxycodone is an opioid pain medication. An opioid is
sometimes called a narcotic. Oxycodone is used to treat moderate to severe pain.
On October 30, 2017: The patient accidently overdosed on prescription pain medication.
On December 26, 2017: (Oxycodone Overdose) Patient accidently overdosed on prescription
pain medication.
On February 25, 2018 (Cocaine Overdose): Cocaine is a strong stimulant mostly used as a

users run the risk of sudden death with cocaine use. Cocaine use is bad for the heart. Cocaine

PROCLAMATION
Whereas,the Town of North.Andover recognizes that the indigenous peoples of the land that would later
become known as the,Americas have occupied these lands since time immemorial and values the progress
our society has accomplished through.American Indian technology,thought, and culture; and
Whereas,the Town of North Andover understands that government entities, organizations and other
public institutions should update their policies and practices to better reflect the experiences of American
Indian people and uplift our country's indigenous roots,history, and contributions; and
Whereas, Indigenous Peoples' Day was first proposed in 1977 by a delegation of Native Nations to the
United Nations sponsored International Conference on Discrimination Against Indigenous Populations in
theAmericas; and
Whereas, in 1990 representatives from 120 native nations at the First Continental Conference on 500
Years of Indian Resistance unanimously passed a resolution to transform Columbus Day into an occasion
to strengthen the process of continental unity and struggle towards liberation, and thereby use the
occasion to reveal a more accurate historical record; and
Whereas,the United States federal government,the State of Massachusetts and the Town of North
Andover recognize Columbus Day on the second Monday of October, in accordance with the federal
holiday established in 1937;
Now Therefore,Be it Resolved by the Board of Selectmen that the Town of North Andover shall
also recognize Indigenous Peoples' Day on the second Monday in October.
Be It Further Resolved that the Town of North Andover shall continue its efforts to promote the well-
being and growth of the American Indian and indigenous community.
Be It Further Resolved that Indigenous Peoples' Day shall be used to reflect upon the ongoing struggles
of indigenous people on this land and to celebrate the thriving culture and value that indigenous nations
add to our Town.
Be It Further Resolved,the Town of North Andover encourages other businesses, organizations and
public entities to recognize Indigenous Peoples' Day in conjunction with Columbus Day.
IN WITNESS WHEREOF, I have hereunto set my hand and caused the Seal of the Town of North
