The closest proposed addition is 565 feet from Lake Cochichewick, as shown on the plan, and a careful inspection of the premises by me indicates that there is no wetlands located within 400 feet of the proposed activity. Therefore, it is my opinion that Section 4.135(2)(a) of the Town of North Andover Zoning By-Law do not apply to the construction of the proposed addition. I ask that you review the plan and forward to me correspondence that you concur with my interpretation of the By-Law and that construction of the addition can proceed without the benefit of a Special Permit by the North Andover Planning Board.
