EXECUTIVE SESSION: The Executive Session convened at 7:30 p.m.
ATTENDANCE: The following were present: Wendy D. Wakeman, Chairman; James Xenakis;
Donald Stewart; Mark J.T. Caggiano; Mark Rees, Town Manager; Ray Santilli, Assistant Town
Manager.
Rosemary Smedile was absent.
The Board of Selectmen was individually polled and each voted unanimously to move into
Executive Session. Vote approved 4-0.
Pending Litigation— Beads Oil Superfund Site.
The Town has been extended a settlement offer from the EPA regarding our involvement in the
Beads Waste Oil Superfund Site. This settlement offer is in the amount of$132,000 and is
being recommended by counsel. The Town had previously appropriated $125,000 under Article
17 of May 2002 Annual Town Meeting for possible settlement of this matter. Counsel's
recommendation is that the Town does not have to respond until August 9, 2004, if the Board
wishes to accept the settlement. The Town Manager suggested doing it after July 1, 2004 and
to take the balance necessary to settle of$7,502 from the FY05 legal budget.
Mark Caggiano made a MOTION, seconded by Donald Stewart, to approve the Beadle Oil
Superfund Site settlement as presented by the Town Manager. Vote approved 4-0.
ADJOURNMENT:
Mark Caggiano made a MOTION, seconded by Donald Stewart, to move out of Executive
Session. Vote approved 4-0.
