HomeMy WebLinkAbout2004-07-26 Board of Selectmen Executive Minutes BOARD OF SELECTMEN EXECUTIVE MINUTES JULY 26, 2004 EXECUTIVE SESSION: The Executive Session convened at 6 :00 p.m. ATTENDANCE: The following were present: Rosemary Connelly Smedile, Chairman;Wendy Wakeman; James Xenakis; Donald Stewart; Mark J.T. Caggiano; Mark Rees, Town Manager; Ray Santilli, Assistant Town Manager and Town Counsel Thomas Urbelis. The Board of Selectmen was individually polled and each voted unanimously to move into Executive Session. Vote approved 5-0. Audit Report on Police Grants. Several months ago the Board requested the Town Manager to conduct a forensic investigation into grants received by the Police Department through NEMLEC and Crest Associates. Karen Roberts, Forensic Investigator for Melanson Heath &Company, PC presented her findings for the Town of North Andover regarding the possible fraudulent invoice used by Crest Associates to obtain reimbursement with federally provided Byrne grant funds. In her report, Ms. Roberts made recommendations on Expenditure Procedures, Timing of Procurement Procedures, Documentation of Procurement Procedures and Subcontracting Procedures. In summary the report states,we did not find that grant funds were used for goods or services not received by the Town, or for goods and services that were otherwise ineligible as grant expenditures. However, sub-recipient expenditures were not adequately monitored and appropriate procurement practices were not followed in some instances." The Board agreed that after hearing the report that if North Andover received grant money, it paid for something for the program and the Town has a piece of equipment that corresponds to every dollar spent. Wendy Wakeman made a MOTION, seconded by Donald Stewart, to release the Audit Report and all minutes of Executive Session regarding the audit to the public and the FBI at the beginning of tonight's Open Session. Vole approved 5-0. Pending Litigation-Technical Training Foundation-(Campion Hall) The Town Manager said that the Technical Training Foundation has declined our offer to settle with our legal costs being reimbursed. The Town Manager requested the Board's approval to see if they would settle for half of our legal costs of$1,200. James Xenakis made a MOTION, seconded by Wendy Wakeman, to request a settlement from the Technical Training Foundation for half of our legal costs of$1,200. Vote approved 5-0. ADJOURNMENT: Wendy Wakeman made a MOTION, seconded by Mark Caggiano,to move out of Executive Session. Vote approved 5-0. ^ Respectfully submitted, Adele J. Johnson, Administrative Secretary
