HomeMy WebLinkAbout2004-10-12 Board of Selectmen Executive Minutes BOARD OF SELECTMEN EXECUTIVE MINUTES OCTOBER 12, 2004 EXECUTIVE SESSION: The Executive Session convened at 7 :00 p.m. ATTENDANCE: The following were present: Rosemary Connelly Smedile, Chairman; Wendy Wakeman;James Xenakis; Donald Stewart; Mark J.T. Caggiano; Mark Rees, Town Manager; Ray Santilli, Assistant Town Manager and Town Counsel Thomas Urbelis. The Board of Selectmen was individually polled and each voted unanimously to move into Executive Session. Vote approved 5-0. Pending Litigation Special Counsel Kenneth Kimmell recommended that the Town dismiss an ongoing GLSD's case regarding the sludge dry facility due to lack of activity and prosecution. Wendy Wakeman made a MOTION, seconded by Donald Stewart, to dismiss GLSD case per Attorney Kimmell's recommendation. Vote approved 4-0. Mark Caggiano arrived at 7:06 PM Collective Bargaining Police Officer Ronald Reid has requested a six-month leave of absence to allow him to attend a state police academy. Labor Counsel recommends only to grant a three-month leave and not to grant a six-month leave without permission from the state personnel administrator. Donald Stewart made a MOTION, seconded by James Xenakis, to grant and approve a six-week leave of absence for Officer Ronald Reid. Vote approved 4-1. Wendy Wakeman opposed. Officer Chad Lawlor requests a lateral transfer to the Lawrence, MA Police Department. James Xenakis made a MOTION, seconded by Wendy Wakeman, to grant the request by Officer Chad Lawlor for a lateral transfer to the Lawrence, MA effective November 2, 2004. Vote approved 5-0. Real Estate Matters The Town Manager gave an update of the progress regarding an agreement between the Town and the owners of Oz y Properties. The Town Manager requested the Board meet on Thursday, October 14, 2004, at 4:00 PM for discussion and a full account of the result of these meetings. The Town Manager informed the Board that of a court action against the Police Department for improper behavior in an arrest of a former Merrimack Student. Wendy Wakeman made a MOTION, seconded by James Xenakis, to release from Executive Session the contents of this meeting as regards Chad Lawlor. Vote approved 5-0.
