Attendance: The following were present: Rosemary Connelly Smedile,Chairman;James Xenakis,Donald Stewart, Mark J.T.Caggiano,Thomas Liodardello,Mark Rees,Town Manager;Ray Santilli,Assistant Town Manger and Town Counsel Thomas Urbelis. The Board of Selectmen were individually polled and each voted to move into Executive Session. Vote approved 5-0. Pending Litigation Town Counsel Tom Urbelis gave an update on the Plisinski case. Scott Masse,Chair of the Conservation Commission said he would modify the settlement terms regarding the Plisinski case and have the Conservation Commission vote to accept a settlement along the terms of the 25'no disturb zone if the Selectmen agree to withdraw Warrant Article 17 Wetlands Protection Exemptions. Selectmen said that the Conservation Commission should settle this case on its own merits not to play politics with the Town. This would save the town about$400,000. The Conservation Board should look at what is best for the Town and not just their narrow view of their charge. The Selectmen don't want to play politics with this Board. Mark Caggiano made a MOTION,seconded by Thomas Licciardello,to reject the Conservation Commission's suggestion of settlement of the Plisinski case and not bargain with them on completely unrelated items and to reconsider their vote on the Plisinski matter for the best interest of the Town. Vote approved 5.0. Old Salem Village ^ Town Counsel Thomas Urbelis met with the Planning Board and explained that the applicants want assurance that the zoning density would not be the reason for denial and an analysis done of sight plan review for a special permit. Town Counsel pointed out an error on March 28,2005,Executive Minutes,last paragraph of first page. Add the word did not write. Minutes can be adopted as Amended in Open Session. Civil Service Lists Assistant Town Manager Ray Santilli said that he spoke to a woman at Civil Service and reported that his letters and reasons for bypass was accepted and neither of the two people has contacted Civil Service to appeal. The Town will withdraw the paperwork that was submitted. Interviews will be held in Open Session and the Board would give conditional offers of employment,with psychological and medical testing. Confidentiality The Town Manger said that there was an article in the local newspaper,the Valley Patriot with a very explicit piece on the Building Inspector case and said the source came from Town Hall. This is a remender that all Executive Session conversations should be kept confidential. Adiournment: James Xenakis made a MOTION,seconded by Thomas Licciardello,to move out of Executive Session.
