Lynch, Jr., Deborah A. Feltovic and Douglas W. Saal Members Absent: Albert P. Manzi, Jr., Vice Chairman, John T. Mabon and Sean F. McDonough Staff Member Present: Jennifer A. Hughes, Conservation Administrator Meeting came to Order at: 7:05 Quorum Present. Pledge of Allegiance Acceptance of Minutes  A motion to accept the minutes of September 12, 2018 as reviewed and amended is made by Ms. Feltovic, seconded by Mr. Lynch.  Vote 4-0 Unanimous. Agricultural Lease Agreement (Rogers) (Carter Hill and Mazurenko)  The discussion for the Agricultural Lease Agreement is tabled. Small Project 374 Osgood Street (North Andover Auto Body)  Mr. Napoli states this project is for a temporary propane tank due to the Columbia Gas outages.  The Administrator states project is outside the 50 foot no build zone.  Mr. Lynch asks about fees and states future filings related to the outage should request a waiver.  A motion to accept this as a Small Project L is made by Ms. Feltovic, seconded by Mr. Saal.  Vote 4-0 Unanimous.  A motion to approve the small project permit as proposed with post construction inspection is made by Ms. Feltovic and seconded by Mr. Saal.  Vote 4-0 Unanimous. Documents  Application Check List  Plot Plan dated 7/10/15 with hand edits Request for Determination of Applicability 200 Vest Way (Dale Lewis)  The Administrator reviews the proposal to install a 10’ x 16’ shed on blocks. She states flags placed in the field were found to be 45’ from the wetland and the shed will need to be re-flagged farther away and the location approved.  A motion is made to issue a Negative Determination #3 with conditions for pre and post construction inspection as well as wetland markers in the vicinity of the shed is made by Ms. Feltovic, and seconded by Mr. Saal.  Vote 4-0 Unanimous. Documents  Email from TJ@csi-engr.com requesting a continuance until 10/10/2018 General Business 242-1045, COC Request 675 Chickering Road (430 Osgood Street) (NA High School) (DGT Assoc.)  The Administrator confirms that the commission wants the school department to do a full ground survey of the high school. She states the town engineer is in favor of the on the ground survey as well.  Commission confirms the request and asks Administrator to confirm bond amount available. 242-1631, COC Request, 294 Chestnut Street (William & Sparages) (Request to cont. to 10/10/2018)  A motion to continue until October 10, 2018 is made by Ms. Feltovic, seconded by Mr. Saal.  Vote 4-0 Unanimous. Documents  Email from ghochmuth@wsengineers.com requesting a continuance until 10/10/2018 242-1717, COC Request, 2198 Turnpike Street (Jorge Solano)  The Administrator reviews the project history with the Commission and states that the structure in the backyard has yet to be removed.  A motion to continue until October 10, 2018 is made by Ms. Feltovic, seconded by Mr. Lynch.  Vote 4-0 Unanimous. Documents  WPA Form 8A Request for Certificate of Compliance  As-Built Septic System Repair Plan, dated June 20, 2017 242-1682, COC Request, 56 Candlestick Road (Sullivan Engineering)  The Administrator gives the Commission background on the request for Certificate of Compliance and states a few minor project discrepancies including extended pavement and unconstructed proposed sunroom. The only outstanding item is the placement of wetland markers. The Administrator states the Certificate of Compliance could be held until the wetland markers have been placed.  Mr. Lynch questions if the applicant understands once the Commission has issued the compliance the order will be terminated and no additions can be made.  The applicant, Ms. Martin states this is understood.  A motion to issue a Certificate of Compliance and hold for placement of wetland markers is made by Mr. Saal, seconded by Ms. Feltovic.  Vote 4-0 Unanimous. Documents 3  Compliance Letter, dated September 18, 2018 prepared by Sullivan Engineering Group  As-Built Plan, dated September 18, 2018 prepared by Sullivan Engineering Group  WPA Form 8A Request for Certificate of Compliance  Progress Photos 242-1734, Modification Request, 980 Forest Street (Norse Environmental)  Maureen Herald, Norse Environmental is requesting a modification to the original proposal which a 10x20 foot deck which is outside the 50 foot no build zone. Other changes include eliminating the wall directly behind the dwelling by approximately 25 ½ feet and relocating to the back corner of the house. New plans show the elimination of a 10x14 foot shed and 10 foot section of the wall at the far end of the pool. She requests that the existing stairs off the porch be replaced due to rot, the stairs will have a slightly different footprint.  Mr. Lynch requests a new record plan with correct 10x20 foot deck dimensions (plan was in error and showed smaller deck).  Ms. Herald will supply the Commission with the requested plans.  Mr. Lynch questions if the staircase will be replaced in-kind.  Ms. Herald states the new staircase will have a slightly different configuration and will be outside of the 50 foot no build zone.  A motion to issue a modification request as proposed is made by Ms. Feltovic, seconded by Mr. Saal.  Vote 4-0 Unanimous. Documents  Notice of Intent Site Plan, dated September 18, 2018 prepared by Dresser, Williams & Way, Inc.  Modification Request Letter, dated September 25, 2018 prepared by Norse Environmental 242-1714, Modification Request, 865 Johnson Street (185 Mill Road) (Tom Zahoruiko)  The Administrator gives the Commission background on the project, and states restoration and plantings have been done. The Administrator states the modification request is for a larger deck and refers the Commission to the foundation as-built for proposed deck plans. Applicant provided accurate foundation as-build with proposed deck modification since approved plan did not show home in the same location.  The Commission discusses the foundation as-built and existing foot print certifications.  A motion to issue a modification request as proposed is made by Mr. Lynch, seconded by Ms. Feltovic.  Vote 4-0 Unanimous. Documents  Foundation As-Built, dated June 27, 2018 prepared by Sullivan Engineering Group, LLC  Modification Request, dated September 17, 2018 Enforcement Order/Violation 46 Hollow Tree Lane (Lally)  The Administrator states the property owner is out of town for work and that Hancock Survey Associates has yet to complete the plan. The property owner assured the Administrator that he would be present for the October 10, 2018 meeting.  The Commission discusses the enforcement order, fines will be issued if property owner is not in attendance on October 10, 2018 meeting.  A motion to continue until October 10, 2018 is made by Ms. Feltovic, seconded by Mr. Saal.  Vote 4-0 Unanimous. Documents 4  Email from james.r.lally@gmail.com requesting a continuance until 10/10/2018 141 Carlton Lane (Boyle)  The Administrator gives the Commission background on the Enforcement Order and provides the Commission with photos of the area.  The Commission discusses the proposal of installing a fence and restoration plantings.  The Enforcement order is to be amended, allowing the installation of the fence and restoration plantings. The property owners are to provide a planting plan by October 15, 2018 and by June 1, 2019 the plantings should be in place.  A motion to amend the Enforcement Order as proposed is made by Mr. Lynch, seconded by Ms. Feltovic.  Vote 4-0 Unanimous. Documents  Site photos dated September 19, 2018 Emergency Certificate Emergency Ratification (Columbia Gas)  The Commission discusses the Emergency Certificate issued to Columbia Gas regarding the response to the gas issues that took place on September 13, 2018.  Mr. Lynch states the Commission doesn't want to slow the project down but inspectors need to be on site when working near stream carrying culverts to avoid after the fact filings.  The Administrator states the Emergency Certificate will require no pre-construction inspections, crews may work in the rain, material is to be tarped and erosion controls to be placed.  Mr. Lynch states more information needs to be provided when crews are crossing a major structure and that it needs to be on record. The repair work can be done now with a paperwork filing deadline of May 19, 2019.  The Commission discusses the process of how gas services will be brought to homes in the impacted area.  The Administrator states Columbia Gas has hired an environmental monitoring company and she has requested weekly monitoring reports when they are working on jurisdictional areas.  Mr. Lynch states his concerns with the quality of the work that Columbia Gas will be doing under the emergency circumstances and the amount of environmental monitors on-site.  The Administrator states that each zone will be assigned its own environmental monitor.  A motion to ratify the Emergency Certificate as proposed is made by Mr. Lynch, seconded by Ms. Feltovic. Decision 242-1720, Amended OOC, 33 Regency Place  The Commission discusses the amended Order of Conditions.  A motion to adopt the Order of Conditions as drafted and amended is made by Mr. Lynch, seconded by Ms. Feltovic.  Vote 4-0 Unanimous. Adjournment  A motion is adjourn at 7:52 is made by Ms. Feltovic, and seconded by Mr. Lynch.  Vote 4-0 Unanimous.
