EXECUTIVE SESSION: The Executive Session convened at 7:02 p.m.
ATTENDANCE: The following were present: Rosemary Connelly Smedile, Chairman; James Xenakis;
Daniel P. Lanen; Mark J.T. Caggiano; Thomas Licciardello, Mark Rees, Town Manager; Ray Santilli,
Assistant Town Manager.
The Board of Selectmen was individually polled and each voted to move into Executive Session. Vote
approved 5-0.
Pending Litigation
Town Counsel Thomas Urbelis gave the Selectmen an update on the pending Cingular
Telecommunications tower litigation. Counsel Urbelis has worked out an arrangement with the Planning
Board and the Zoning Board of Appeals that would allow the antenna to be placed on the tower, since in
his opinion, the town would mostly certainly lose in Federal court on this matter.
Real Estate Matter
Town Manager Mark Rees told the board that the bids for the town owned land on Pine Ridge Road were
rejected by Finance Director Linda Casey for not coming up to the fair market value. The Board
discussed various ways to better advertise the auction for the future, including advertising in the Boston
Globe and having the Building Inspector and Conservation Commission certify that it is a buildable lot.
ADJOURNMENT:
Thomas Licciardello made a MOTION, seconded by James Xenakis, to move out of Executive Session.
