EXECUTIVE SESSION: The Executive Session convened at 7:20 p.m.
ATTENDANCE: The following were present: Thomas Licciardello, Chairman; James Xenakis; Daniel P.
Lanen; Mark J.T. Caggiano; Rosemary Connelly Smedile, Mark Rees,Town Manager; Ray Santilli,
Assistant Town Manager.
The Board of Selectmen was individually polled and each voted to move into Executive Session. Vote
approved 5-0.
Selectman Lanen recused himself from the meeting.

VFW Post 2104
Licensing Chairman Mark Caggiano said that the North Andover VFW is in violation of state and national
member policy. This situation could potentially affect the North Andover VFW liquor license, which is
premised upon the VFW's existence as a private club. The Licensing Commission has also received two
verbal complaints, from Mr.Alan Breen and Mr. Kevin Hayes, on the same subject. The complainants
have suggested that the North Andover VFW Post 2104 is permitting non-members to access the club
inappropriately. As a Licensing Board it is our obligation to make sure that the state laws are being
upheld, not the VFW regulations. Let the state determine what a private club is that is not under the
Board of Selectmen's purview.
Selectman Smedile suggested that the Board do a general letter putting them on notice that the Board of
Selectmen are aware of complaints with membership policies and other interpersonal disputes at the
club. The Board would like the VFW to address any issues among its members and the state wide
organization so that it will not be necessary for the Licensing Commission to adjudicate the matter.
ADJOURNMENT:
Rosemary Smedile made a MOTION, seconded by James Xenakis, to move out of Executive Session.
Vote approved 5-0.
