EXECUTIVE SESSION: The Executive Session convened at 7:05 P.M.
ATTENDANCE: The following were present: Thomas Licciardello, Chairman; James Xenakis; Daniel P.
Lanen; Mark J.T. Caggiano; Rosemary Connelly Smedile, Mark Rees, Town Manager, Town Counsel
Thomas Urbelis and Lt. Paul Gallagher.
The Board of Selectmen was individually polled and each voted to move into Executive Session. Vote
approved 5-0.
Deployment of Security Personnel or Devices
Licensing Chairman Mark Caggiano informed the Board of two incidents of violence that recently happened at
the China Blossom Restaurant. He has asked the Board to consider sending the China Blossom a notice and
invite them to come to a future Board of Selectmen meeting.
The purpose of the meeting is to discuss with them the circumstances of the following two incidents and to
explore ways to prevent re-occurrence in the future:
Incident 1): April 29, 2006, 12:55 A.M: Responding to reports of a fight on the premises, North Andover
police officers were initially told not to enter the building. Three individuals were injured in the fight.
Incident 2): September 9, 2006, 11:50 P.M.: North Andover Police officers responded to reports of a fight on
the premises. Two individuals were stabbed with a knife during this incident.
In the past the China Blossom has not been very compliant with the rules and regulations of the Town. They
^ focus on a specific entertainment on Friday and Saturday nights that bring in a rowdy crowd and their lack of
security has caused multiple problems with crowd control.
Rosemary Smedile did not want the Board of Selectmen to overstep their authority, she suggested sending a
letter of warning rather than bringing them before the Board.
Town Counsel Thomas Urbelis said that the Board is permitted to send notice to the China Blossom that an
informal informational meeting would be held to listen to their side of the story.
Mark Caggiano said that the Police Department should continue to do their rounds of in and out checks on
establishments serving liquor just to show their presence.
James Xenakis made a MOTION, seconded by Thomas Licciardello, to send a notice to the China Blossom
asking them to attend an informational meeting with the Board of Selectmen with an explanation of the above
specific dates and incidents. Vote approved 4-1. Rosemary Smedile opposed.
James Xenakis suggested the Police do some undercover work this weekend at the China Blossom and the
Beijing Restaurants.
Real Estate Matters. Stevens Estate Cell Tower
The Town was approached several months ago by T-Mobile/Omnipoint regarding the possibility of adding a
third antenna to the Stevens Estate monopole cell tower. In discussions with T-Mobile, the Town was
informed that because the new antenna would be lower then tree line thus providing them with less coverage
than the other two antennas. With that fact along with potential legal problems with our lease with the existing
carriers, has resulted in our recommendation that we accept their offer of half the rent currently being paid by
the established carriers.
/1 James Xenakis made a MOTION, seconded by Rosemary Smedile,to accept the T-Mobile/Omnipoint offer of
half the rent currently being paid by the other established carriers. Vote approved 5-0.

^ Sunnyridce Property Purchase and Sale.
Nellie Aikenhead of the Trust for Public Land requested to come before the Board to discuss possible
changes to the purchase and sale agreement between the Trust and the Town. As the Board may recall,
under the terms of the original P&S, any profits from the sale of the Cullen property beyond the estimated
$1.2 million would be shared between the Town and the Trust. Because of expenditures that are necessary
to bring the property up to"Saleable"condition are extensive,the Trust is requesting that those expenditures
be deducted before any profit sharing occurs. The repairs include driveway re-grading and re-paving, exterior
painting and minor carpentry work, repairs to the slate roof,and electrical system stabilization. Written quotes
and/or contracts for all work have been submitted.
After advice from Town Counsel Thomas Urbelis, the Board agreed to have the added improvements done to
the property at a cost up to$75,000 before splitting the profits.
Mark Caggiano made a MOTION, seconded by James Xenakis, to approve the added expenses at a cost of
up to$75,000 before splitting the profits between the Town and TPL. Vote approved 5-0.
ADJOURNMENT:
Rosemary Smedile made a MOTION, seconded by James Xenakis,to move out of Executive Session. Vote
approved 5-0.
