HomeMy WebLinkAbout2006-10-24 Board of Selectmen Executive Minutes BOARD OF SELECTMEN EXECUTIVE MINUTES OCTOBER 24,2006 EXECUTIVE SESSION: The Executive Session convened at 7:00 p.m. ATTENDANCE: The following were present: Thomas Licciardello,Chairman;James Xenakis;Daniel P. Lanen;Mark J.T. Caggiano;Rosemary Connelly Smedile,Mark Rees,Town Manager, The Board of Selectmen was individually polled and each voted to move into Executive Session. Vote approved 5-0. Real Estate Matters Fire Chief Dolan notified the Board about a parcel of land on the corner of Salem and Boxford Streets that might be for sale in the out country. This is a primary location for a Fire Station;the assessed value building and land is$575,600. The Chief would like the Board's permission to explore this possibility and approach the owner to see if the town could purchase property for the use of a Fire Station. T-Mobile Cell Tower T-Mobil is requesting to see if the town would be interested in leasing them land at the Sharpner's Pond fields for the location of a cell tower. The Board should consider leasing the land to at least three cell tower providers. ABCC—Informal Hearing China Blossom A representative from the ABCC,Caroline Wilichoski was present to answer questions about the incidents that happened at the China Blossom Restaurant,which involved a fight,a stabbing of a patron and security guards that were employed at the times of these incidents. The Board of Selectmen and Chief Richard Stanley gave the ABCC representative a thorough report of the two incidents ^ that happened at the China Blossom on April 29,and September 9,2006. They asked what the Licensing Board could do to avoid problems in the future. Caroline suggested that all Police Officers be made agents of the Licensing Board and at anytime they can conduct an inspection of the liquor license of an establishment. Worded as"They are conducting an investigation of the business operation". This does not need a search warrant. You can also call the owner of an establishment and ask them questions such as: "Can you prove that you knew or should have known under our regulations ABCC 204cmr.2.052 permitting the legality of a license on the premises this disorder. Chairman Licciardello suggested that the Licensing Commission send out a letter to all establishments notifying them of a new Licensing Policy. Licensing Chairman Caggiano says with the help of ABCC he is pooling together all of our licensing documents into one consolidate policy document about licensing,working with Town Counsel Thomas Urbelis,which will be self explanatory to license holders. ABCC representative Caroline Wilichoski said that if the Town continues to have problems with any establishment late at night,you as a licensing board can roll back their hours until only 11:00 PM. you only have to give licenses from 11:00 AM to 11:00 PM. They can get an injunction but they have no right of appeal. This is only done under a severe case of continuing to have Police Officers at the establishment after 11:00 PM for one incident or another and people leaving intoxicated and driving under the Influence. The Board thanked Caroline Wilichoski for attending and for her professional opinions and help. ADJOURNMENT: Mark Caggiano made a MOTION,seconded by lames Xenakis,to move out of Executive Session.
