EXECUTIVE SESSION: The Executive Session convened at 7:05 p.m.
ATTENDANCE: The following were present: Thomas Licciardello, Chairman; James Xenakis; Daniel P.
Laren; Mark J.T. Caggiano; Rosemary Connelly Smedile, Mark Rees,Town Manager; Ray Santilli,
Assistant Town Manager.
The Board of Selectmen was individually polled and each voted to move into Executive Session. Vote
approved 5-0.
Collective Bargaining
Pendina Litigation
On December 29", the Retirement Board voted to accept the medical panel's finding and forwarded their
approval to PERAC. PERAC has up to 30 days to approve the Retirement Board's vote. Pending any
unforeseen circumstances, Firefighter Ford's should finally receive his accidental disability retirement by
the end of January 2007.
The Town continues to pursue separate litigation against the driver and the company involved in the
August 2003 accident in an attempt to recoup all expended monies including salary, shift replacement
overtime costs and medical expenses.
Note: Daniel Lanen recused

ADJOURNMENT:
Rosemary Smedile made a MOTION, seconded by Mark Caggiano, to move out of Executive Session.
Vote approved 4-0.
