EXECUTIVE SESSION: The Executive Session convened at 7:00 p.m.
ATTENDANCE: The following were present: Thomas Lioclardello, Chairman;James Xenakis;Daniel P.Lanen;
Mark J.T.Caggiano; Rosemary Connelly Smedile,Mark Rees,Town Manager; Ray Santilli,Assistant Town Manager,
Curt Bellavance,Thomas Urbelis and Carol McGrevey.
The Board of Selectmen was individually polled and each voted to move into Executive Session. Vote approved 5-0.

Pending Litioation
The Assistant Town Manager informed the Board on a serious mistake made by the Town's consulting engineer, SEA
Consultants,that may require the town to institute a lawsuit against the firm. At issue are erroneous field tests of soil
that could result in significant additional cost to the project. As a fall back,however,we received a letter from Mass
Highway saying that the$800,000 from the Federal government earmark can be used to'cover the cost of any
overruns or extra work related to the deficient sub-grade"and that remaining money would be split equally between
the town and the state.
The Town Manager recommends accepting an offer from Mass Highway and take legal action against SEA
Consultants.
Mark Caggiano made a MOTION,seconded by Rosemary Smedile,to accept Mass Highways offer and seek legal
action against SEA Consultants. Vote approved 5-0.
ADJOURNMENT:
James Xenakis made a MOTION, seconded by Daniel Lanen,to Adjourn at 10:10 PM. Vote approved 5-0.
