EXECUTIVE SESSION: The Executive Session convened at 6:30 P.M.
ATTENDANCE: The following were present: Chairman Rosemary Connelly Smedile, Clerk Mark J.T.
Caggiano; Daniel P. Lanen; Richard A. Nardella; Tracy M. Watson; Mark Rees, Town Manager; Ray
Santilli, Assistant Town Manager.
The Board of Selectmen was individually polled and each voted to move into Executive Session. Vote
approved 5-0.
Pending Legal Matters
ABCC Appeal Hearing RE suspending of license of Millennium Eatery Inc D.B.A. Bel Ing Restaurant
Town Counsel Thomas Urbelis was present and participated in this discussion.
Town Counsel Thomas Urbelis reviewed the Beijing Restaurant incident of September 30, 2007 and the
decision by the Licensing Board to suspend the license for three consecutive days. He told the Board
that it is a possibility the Town will lose this case.
The ABCC has determined that in order to show negligence the Town needed to show that the bar knew
that there was going to be a fight and that they did not take proper action when the fight broke out.
Proper action merely includes calling the police; this is the standard regulation.

ADJOURNMENT:
Daniel Lanen made a MOTION, seconded by Tracy Watson, to move out of Executive Session. Vote
approved 5-0.
