CALL TO ORDER: Chairman Regina Kean called the meeting to order at 7:OOPM in the Town Hall
Meeting Room. The open session meeting was recorded.
ATTENDANCE: The following were present: Chairman Regina Kean, Clerk Phil DeCologero, Licensing
Chairman, Chris Nobile, Richard Vaillancourt, Town Manager Andrew Maylor, Deputy Town Manager,
Meghan Jop, Assistant Town Manager, Denise Casey and Executive Assistant, Laurie Burzlaff.

PUBLIC COMMENT
None
APPROVAL OF MINUTES:
Chris Nobile made a MOTION, seconded by Phil DeCologero, to approve the Open Session
Minutes of October 22, 2018 and October 25, 2018, as presented. Motion approved 4-0.
Chris Nobile made a MOTION, seconded by Richard Vaillancourt to approved the Executive
Session minutes of February 12, 2018, March 26, 2018 and October 9, 2018, as presented. Motion
approved 4-0.
ACCEPTANCE OF DONATIONS
Donation of a bedroom set from David Donnan to the Stevens Estate
David Donnan, a member of the Stevens family, is donating a bedroom set that was originally purchased
for Moses Stevens' bedroom at the Stevens Estate.
Phil DeCologero made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen
accept the donation from David Donnan of Moses Stevens'original bedroom set to be used at the
Stevens Estate. Motion approved 4-0.
LICENSING COMMISSIONERS:
Chris Nobile made a MOTION, seconded by Richard Vaillancourt to open a meeting of the North
Andover Licensing Commission. Motion approved 4-0.
Request of the North Andover Foundation for Education for a one day wine and malt license for a
fundraiser at Brooks School on November 17, 2018 from 6:OOPM-10:30PM and for a waiver of the fee
Regina Kean made a MOTION, seconded by Phil DeCologero that the Board of Selectmen, acting
as Licensing Commissioners, approve the request of Kristi Hale on behalf of the North Andover
Foundation for Education for a one day wine and malt license for a fundraiser at Brooks School
on November 17, 2018 from 6:OOPM-10:30PM and to waive the fee. Motion approved 4-0.
Request of Stevens-Coolidge Place for a one day wine and malt license for an indoor cocktail party on
November 16, 2018 from 6:OOPM to 8:OOPM
Phil DeCologero made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen,
acting as Licensing Commissioners, approve the request of Katherine Bibeau on behalf of the
Stevens-Coolidge Place for a one day wine and malt license for a cocktail party on November 16,
2018 from 6:OOPM-8:OOPM. Motion approved 4-0.
Request of Merrimack College for two one day wine and malt licenses for receptions at Cascia Hall on
November 15, 2018 from 6:OOPM to 8:30PM and December 28, 2018 from 4:OOPM to 8:OOPM
Regina Kean made a MOTION, seconded by Phil DeCologero that the Board of Selectmen, acting
as Licensing Commissioners, approve the request of Paul Gallant of Merrimack College for two
one day wine and malt licenses for receptions at Cascia Hall on November 15, 2018 from 6:OOPM-
8:30PM and December 28, 2018 from 4:OOPM-8:OOPM. Motion approved 4-0.
Regina Kean made a MOTION, seconded by Richard Vaillancourt to close a meeting of the North
Andover Licensing Commission. Motion approved 4-0.

CONSENT ITEMS
Accept grant from the MA Department of Children and Family Services in the amount of$25,000 for a
youth mentoring/recreation program
The Youth Center has received a grant from the Department of Children and Family Services in the
amount of$25,000. The grant will be used for a youth mentoring/recreation program.
Richard Vaillancourt made a MOTION seconded by Phil DeCologero that the Board of Selectmen
accept the grant in the amount of$25,000 from the Mass Dept, of Children and Family Services to
be used for a youth mentoring/recreation program. Motion approved 4-0.
Request of James Mealey, Assistant Superintendent, for a 15 MPH speed limit on Cypress Terrace
Included in your packets is a request from James Mealey for approval of a 15MPH speed limit on Cypress
Terrace. The NAPD supports the request. Mr. Mealey was present to answer any questions.
Phil DeCologero made a MOTION, seconded by Chris Nobile that the Board of Selectmen approve
the request of Assistant Superintendent, James Mealey, for a 15MPH speed limit on Cypress
Terrace. Motion approved 4-0.
Affordable Unit resale-210 Chickering Road-Unit 107D (Kittredge Crossing)
The Town has been notified by CHAPA that an affordable unit at Kittredge Crossing is being listed for
sale. The Town has the right of first refusal to purchase the property. It is recommended the Board waive
the right of first refusal on this property.
Richard Vaillancourt made a MOTION, seconded by Phil DeCologero that the Board of Selectmen
waive their right of first refusal for 210 Chickering Road, Unit 107D (Kittredge Crossing). Motion
approved 4-0.
Appointments:
The appointment subcommittee recommended Seema Sanjeev Gupte be appointed to the Sustainability
Committee and Lauren Younes to the Festival Committee.
Chris Nobile made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen
appoint Seema Sanjeev Gupte to the Sustainability Committee for a term ending June 30, 2020
and Lauren Younes to the Festival Committee for a term ending June 30, 2019. Motion approved 4-
0.
Submission of written comments to the Federal Communications Commission regarding proposed rules
on cable franchise
Brian Fraser, Executive Director of North Andover Cable Access Media was present to explain the issue.
The FCC is proposing a rule change that would allow cable companies to count in kind contributions as
part of their franchise fees which would have a negative impact on services NACAM provides. The Board
asked for a copy of the comments to be sent to North Andover's Federal delegation.
Phil DeCologero made a MOTION, seconded by Chris Nobile, that the Board of Selectmen approve
and sign the comments to be submitted to the FCC regarding implementation of Section 621(a)(1)
of the Cable Communications Policy Act of 1984. Motion approved 4-0.
Rosemary Smedile arrived at 7:35.
GOVERNMENTAL REPORTS
Update on Electrical Aggregation
The Town Manager explained that the town was able to obtain favorable rates for supply of electricity
through the municipal aggregation program that was approved at the 2016 Town Meeting. Residents will
be automatically enrolled if National Grid is their current electric supplier. A notice will be sent in the
January bill and new rates will appear on the February bill.
Update on gas restoration
The Town Manager gave an update on the gas restoration process. Columbia Gas will be responsible for
repairing Grogan's Field. The Town has formally filed a claim with Columbia Gas. Many residents are self-
mitigating. Wellness checks were done over the weekend for residents age 70 or over in the impacted
area.

TOWN MANAGER'S REPORT:
Job posting/vacancy log
Included in the packets was the job posting/vacancy log provided by the Human Resources Department.
Seth Moulton will be having office hours at Town Hall on Thursday from 3-6PM.
The Town Manager received a letter from a resident asking if the Town will be asking Columbia Gas to
repair the roads. Mr. Maylor stated that he is in the process of preparing a cost estimate for repaving of all
thirteen miles of road disturbed by Columbia Gas work.
The resident also asked about the tax rate not appearing on the tax bill. The tax rate is not on the second
quarter bill because it is an estimated bill. The Board will vote on the rate at the next meeting and the rate
will be shown on the February bill.
SELECTMAN'S UPDATES/COMMENTS
Chairman Kean stated that she was asked to support a bill that will require sewer operators to notify
towns of overflow. The Massachusetts Municipal Association is opposing the bill and she is not sure why.
She is waiting to hear back from them and will report back to the Board.

BOARD OF SELECTMEN EXECUTIVE SESSION MINUTES February 12, 2018
EXECUTIVE SESSION: The Executive Session convened at 6:30 p.m.
ATTENDANCE: The following were present: Chairman Phil DeCologero, Clerk Regina Kean, Rosemary
Smedile, Richard Vaillancourt, Chris Nobile, Town Manager Andrew Maylor, Assistant Town Manager
Ray Santilli and Executive Assistant Laurie Burzlaff.
Executive session-M.G.L. Chapter 30A. §21(a) reason#3-to discuss strategy with respect to collective
bargaining with Police and Firefighter Unions
Town Manager, Andrew Maylor, indicated that they have just begun negotiations and the predominant
issue is compensation. Firefighters are asking to work details; however this may need to be approved by
the Police Union and would require significant hours of training which the firefighter would have to
personally pay for. The Board discussed whether the contract would address firefighter overtime.

BOARD OF SELECTMEN EXECUTIVE SESSION MINUTES March 26, 2018
EXECUTIVE SESSION: The Executive Session convened at 6:30 p.m.
ATTENDANCE: The following were present: Chairman Phil DeCologero, Clerk Regina Kean, Rosemary
Smedile, Richard Vaillancourt, Chris Nobile, Town Manager Andrew Maylor, Assistant Town Manager
Ray Santilli and Executive Assistant Laurie Burzlaff.
Executive session-M.G.L. Chapter 30A, �21(a) reason#3-to discuss strategy with respect to collective
bargaining with Police and Firefighter Unions
Town Manager, Andrew Maylor, indicated that they have come to an agreement with the Police union
(patrolmen and sergeants) and provided a copy of the Memorandum of Understanding. Mr. Maylor
reviewed the terms of the MOU with the Board.
Mr. Maylor indicated that they are still negotiating with the Firefighters. The union is seeking higher
percentage increases than the police and have rejected most proposals by the Town.

EXECUTIVE SESSION: The Executive Session convened at 6:30 p.m.
ATTENDANCE: The following were present: Chairman Regina Kean, Clerk Phil DeCologero, Rosemary
Smedile, Chris Nobile, Town Manager Andrew Maylor and Executive Assistant Laurie Burzlaff.
Executive session-M.G.L. Chapter 30A, §21(a) reason#3-To discuss strategy with respect to collective
bargaining with the Firefighter Union
Town Manager, Andrew Maylor stated that they have come to an agreement with the Firefighter Union
and provided a copy of the Memorandum of Understanding. Mr. Maylor reviewed the terms of the MOU
with the Board. The compensation aligns with the Police contract, more detailed language was added
regarding leave and they settled the outstanding grievances.

CONSENT ITEMS:
Vote to accept the provisions of Chapter 59, 42D
At their meeting on June 7, 2004, the Board rejected the provisions of Massachusetts General Laws
Chapter 59, Section 2D, which requires the town to abate taxes if the assessed value of the real estate is
decreased by more than fifty percent due to fire or natural disaster. Given that the impact of the gas fires
to certain properties was significant, the Town Manager recommended the Board rescind its vote to reject
the provisions of General Laws Chapter 59, section 2D. The provisions will apply for fiscal years that
begin on or after July 1, 2018.

Phil DeCo/ogero made a MOTION, seconded by Chris Nobile that the Board of Selectmen rescind
its vote on June 7, 2004 to reject the provisions of General Laws Chapter 59, section 2D. Motion
approved 5-0.
Ratification of contract between the Town of North Andover and the International Association of
Firefighters. Local 2035 for the period of July 1, 2018 through June 30, 2021
The Firefighters Union President informed the Town Manager that the membership approved the
Memorandum of Agreement and ratified the contract.
Phil DeCologero made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen
approve the Collective Bargaining Agreement between the Town and the International Association
of Firefighters, Local 2035 for the period July 1, 2018-June 30, 2021. Motion approved 5-0.
Request of the Affordable Housing Trust to approve funding $40.000 fr;
om the trust for a MassSave
Program for seniors
The Affordable Housing Trust asked the Board to approved using $40,000 of trust funds to provide grants
to qualified seniors to make energy saving improvements to their I ,fg�applicants would need to have
a MassSave energy assessment done prior to applying for the gr

FY20 Budget Policy Statement
In accordance with the Town Charter 9-2-3, "on or before the fire day of November of each year, the
Board of Selectmen, after consulting with the Town Manat, shaiisue a policy statement relating to the
budget for the ensuing fiscal year. The statement shall estabtr " outer limits of possible budget growth
for the town." Ms. Smedile asked for a sent a-to be added dWng that a cost analysis will be done for
new hires.

Request ffi ;a,:DCR to reduce 120 day notice period for purchase of land near Harold Parker
Included in ,,e,packet was a request from DCR to reduce the 120 day notice period for the purchase of
land off of Carn"popll Road. Conservation Administrator, Jennifer Hughes, has been working with DCR on
acquiring this land and is in favQT of the purchase.
Chris Nobile made-a MOTION, seconded by Rosemary Smedile that the Board of Selectmen
approve the request 6fA to reduce the 120 day notice period for the purchase of property off of
Campbell Road as presented. Motion approved 5-0.
Winter parking ban
Included in the packet was the proposed winter parking ban. After discussions with the Police Chief and
Department of Public Works, the Town Manager recommend the ban begin on January 2, 2019 and end
on March 1, 2019. Decisions of whether to institute a parking ban after March 1s' will be made by the
Town Manager in consultation with the Police Chief.
Rosemary Smedile made a MOTION, seconded by Phil DeCo/ogero that the Board of Selectmen
adopt the Winter Parking Ban effective January 2, 2019 at 12:01AM through March 1, 2019 and to
allow the Town Manager, in consultation with the Police Chief, to extend the dates. Motion
approved 5-0.

The Board was given the monthly reports for the Police Department, Fire Department, Opioid Overdose,

Chris Nobile mentioned leaf pick up will be October 29th, November 5th and,November 12th. The Town
Manager stated that on November 26th, the town will be picking up, ndt anches.

David.Donrd.an is a member of the Stevens Family living in Chatham, MA. He reached out to the
Stevens Estate with the offer of a donation of a bedroom set which was originally purchased for Doses
Stevens' bedroom here at the Stevens Estate. The set comprises of a marble-topped dresser with mirror,
night strand, four caned side chairs and one single sleigh bed. All pieces are hand painted with various
nature scenes on the large pieces.
The bedroom set,being Moses Stevens' original. set, would find a home in its' original setting in the
Green Bedroom on the second floor of the mansion., where currently we do not have matching
funifture. 1 would like to request that the donation be accepted by the 'Town.of North.Andover.

Dear Members of the Board,
We are writing to request consideration of a fee waiver for the one-day liquor license application
submitted by North Andover Foundation for Education for this year's Live Your Learning Education Fund
(LYLEF)fundraising dinner scheduled for November 17,2018.
The North Andover Public Schools and the North Andover Foundation for Education believe that all
students should have access to learning experiences outside of the traditional classroom that foster
critical 21st century skills. LYLEF supports students who lack financial means to take advantage of these
opportunities,both domestic and international.LYLEF opens doors to students, many of whom have not
had experiences outside of their own community,who would not be able to participate in these rich
educational experiences without financial aid.
With more than $8,500 raised from last year's fundraising dinner, the LYLEF Committee was able to
award 7 scholarships. The scholarship funds provided an opportunity for five students to participate in
the science course at the Teton School in Wyoming this past summer,one student to participate in the
service-leaming trip to Nicaragua last April,and one student to take part in chorus trip to Quebec.

Special One Day License Request for The Stevens-Coolidge Place
1) TIPS Certification will be renewed prior to the Friday, Nov. 16`h event. Our credit card was
compromised last month and once a new once is received this week,we will pay for an updated
TIPS training asap.
2) We spoke with Ralph Scaramone of the Alcoholic Beverages Control Commission and was given
verbal approval to use the remaining alcohol from last year's party for this year's,as it was
legally purchased through a distributer.

Members of the North Andover Board of Selectmen:
I respectfully request approval to post 15 MPH Speed Limit signs along Cypress Terrace,the road in and
out of the Franklin Elementary School. This request comes as a result of reports from a neighbor and
parent of a child who attends Franklin Elementary School that cars are driving too fast on this roadway,
making it unsafe for pedestrians.
A posted limit of 15 MPH would be consistent with the posted speed limit at the high school. We believe
this action would have a positive impact on student and pedestrian safety at the Franklin Elementary
School, so we are officially making this request.

Our office has been notified by the Citizens' Housing and Planning Association (CHAPA) that the owners
of an affordable housing unit at Kittredge Crossing wish to put their unit up for sale. The Town of North
Andover has the right of first refusal for this property. Specifically, the unit and the resale price as
determined by CHAPA are:
210 Chickering Road—Unit 107D—Kittredge Crossing=Sale Price of$168,000
If the Town wishes to exercise its right of first refusal for this property, it would then either purchase the
unit directly from the owners at the determined resale price(s)or locate an eligible buyer to purchase the
unit. If the Town elects to not exercise the right of first refusal,CHAPA will work with the property owner
to locate eligible buyers. If after 120 days an eligible buyer is not found, the owner would be able to sell
their unit at market value with any net gain funds above the resale price given to the Town for affordable
housing activities.
This office recommends that the Board of Selectmen not exercise the Town's right of first refusal for this
affordable housing unit. This will allow CHAPA, which is better suited to do so than the Town, to find
eligible buyers and thereby preserve the unit as affordable and keeping it on the Town's subsidized
housing inventory(SHI).

Dear Members of the Board of Selectmen,
North Andover Community Access & Media, Inc. ("NACAM"),through its executive
director Brian Fraser, has asked that the Board of Selectmen submit comments to the Federal
Communications Commission(the"FCC") concerning proposed rules on cable franchise
agreements and local regulation of the cable networks. The Town of Northdove as cable
franchise agreements with Comcast of Massachusetts and Verizon New England. FCC
regulations limit the franchise fees to five percent of the cable companies gross cable services
revenues. Within the agreements,the cable companies also agree to give NACAM free public
education and government channel access known as in kind contributions. The FCC proposes to
adopt rules that would treat the in kind contributions as a part of the franchise fees for the
purpose of calculating the five percent cap. Since NACAM receives a substantial amount of the
cable franchise fee and the in kind contribution,NACAM may be financially impacted by the
rules which may in turn impact the services it provides to the Town. I have drafted comments
for the Board that address those concerns.

COMMENTS OF TOWN OF NORTH ANDOVER
The Town of North Andover, Essex County, Massachusetts appreciates the opportunity to
file comments on the Second Further Notice of Proposed Rulemaking ("FNPRM") in the above-
referenced docket. We oppose the tentative conclusions in the FNPRM that cable-related in-kind
contributions should be treated as franchise fees and that local government authority regarding
cable operators' use of the rights of way to provide non-cable services will be curtailed.
The Town of North Andover has franchise agreements with two companies that provide
for franchise fees for capital expenses to be paid to the Town of North Andover and fees for
operating and capital expenses to North Andover Community Access & Media, Inc. The Town of
North Andover benefits from the services provided by North Andover Community Access &
Media, Inc. as it provides programming for all of the Town of North Andover public meetings free
of charge. North Andover Community Access & Media, Inc. filming and televising of all public
hearing and meetings promotes public transparency and provides access to all residents who would
not otherwise be able to attend public meetings and hearings. The Town recently negotiated and
entered into a cable renewal license agreement with Verizon New England for a term of five years
ending on June 1, 2023 and is mid agreement with Comcast of Massachusetts. The Town looks

for stability in its agreements and therefore any changes to the regulations which would impact
these agreements would be disruptive to the operation and ability of the Town to plan for the
future.

The Town of North Andover is pleased to announce that Constellation NewEnergy,Inc.("Constellation")has been selected
as the supplier for its Community Choice Power Supply Program ("Program"). This Program is a municipal aggregation
which enables local government to combine the purchasing power of its residents and businesses to provide them with an
alternative to National Grid Basic Service (M.G.L. c. 164, § 134). This Program only affects the supply portion of your
monthly bill.It will not affect the delivery portion of your monthly bill.National Grid will continue to deliver your electricity
but North Andover has chosen the supplier for the Program. Constellation will provide electric power supply for all
consumers currently on Basic Service in North Andover.This letter is intended to tell you about this Program for electric
power supply.In accordance with state law,it also informs you of your rights and options if you choose not to participate in
the Program.
