ADJOURNMENT Not A @ tAf ;iL, 0-AMent BOARD OF SELECTMEN EXECUTIVE MINUTES NOVEMBER 7, 2011 EXECUTIVE SESSION: The Executive Session convened at 7:00 p.m. ATTENDANCE: The following were present: Chairman Tracy Watson; Clerk William F. Gordon; Rosemary Smedile, Licensing Chairman; Donald Stewart; Interim Town Manager James Purcell and Assistant Town Manager Ray Santilli. William Gordon made a MOTION, seconded by Donald Stewart, to move into Executive Session to discuss Non-Union contract Negotiations. Roll Call vote: William Gordon yes, Rosemary Smedile yes, Donald Stewart yes, Tracy Watson yes. Vote approved 4-0, Chairman Tracy Watson declared that an open meeting may have a detrimental effect on the bargaining position of the Selectmen. Note: Rosemary Smedile recused Contract Police Chief Paul Gallagher Interim Town Manager James Purcell informed the Board that the Town had an agreement with Police Chief Paul Gallagher regarding his contract. Base pay effective July 26, 2011 shall be $100,000; effective December 1, 2011 it may increase to $103,000 based on successful completion of agreed upon goals and objectives; effective July 1, 2012 the salary may increase based on successful completion of agreed upon goals and objectives. Changes to the benefits package were that the Town will pay the chief 20% of annual base salary per year for having attained a Bachelor's of Law Enforcement degree. The chief shall be entitled to compensation for accumulated sick leave for up to 90 days of said sick leave at time of separation. As soon as the Board votes on this contract, the chief will resign from Civil Service. William Gordon made a MOTION, seconded by Donald Stewart, to accept the provisions of the contract between the Town of North Andover and Police Chief Paul Gallagher. Roll Call vote: William Gordon yes, Donald Stewart yes, Tracy Watson yes. Vote approved 3-0. ADJOURMENT: Donald Stewart made a MOTION, seconded by William Gordon, to move out of Executive Session. ATTENDANCE: The following were present: William F. Gordon, Clerk; Rosemary Smedile, Licensing Chairman; Donald Stewart, Raymond Santilli, Assistant Town Manager; and James Purcell, Interim Town Manager. COMMUNICATIONS ANNOUNCEMENTS ANDPUBLIC COMMENT: New Business Recognition The Board presented a'06 rtificate of Appreciation to Van Otis Truffles, 27 Main Street for locating their business in North Andover:', CONSENT, ITEMS VFW Donation to Fire bbe artment The Fire Department has received a donation in the amount of$2,500 from the VFW to be used for upgrades toithe Fire Station located at 9`8alem Street. The Board is asked to accept the donation. Rosemary Smedile made a MOTION, seconded by Donald Stewart, to accept the donation of$2,500 from the VFW to be used for upgrades to the Fire Station located at 9 Salem Street. Vote approved 3-0. Historical Drinking Trough TABLED LICENSING COMMISSIONERS': Donald Stewart made a MOTION, seconded by Rosemary Smedile, to move into Licensing. Vote approved 3-0. PUBLIC HEARING: Application for Livery License—Timothy Eatman, 77 Beverly Street Timothy Eatman is applying for a Livery License to transport customers to Airports and requesting permission to store his vehicle at 77 Beverly Street. Resident John McCarron of 75 Sterling Lane owns property on 122 Union Street and questioned the license due to limited parking on Beverly Street and asked the Board to check into a few things that the builder did at 114/116 Union Street; such as installing a fence on town property, a torn away sidewalk and occupancy permits for condos. Board of Selectmen Minutes November 28, 2011 2 Interim Town Manager James Purcell and Selectman Stewart are going to check on the Mr. McCarron's request and get back to him. Selectmen determined that this would not have any effect on the livery license at 77 Beverly Street. Donald Stewart made a MOTION, seconded by William Gordon, to approve the Livery License for one vehicle parked on the property and contingent on providing a copy of new driver's license to the Town Clerk by December 31, 2011. Vote approved 3-0. Donald Stewart made a MOTION, seconded by William Gordon, to move out of Licensing. Vote approved 3-0. NEW BUSINESS: Preliminary Discussion: FY12 Tax Classification Chief Assessor Garrett Boles provided the Board with spreadsheets calculating preliminary information regarding tax values, tax levy and estimated FY2012 tax rate for residential and commercial properties. The Board was asked to review this for a scheduled Tax Classification Public Hearing on December 5, 2011. Selectman Smedile requested a figure on the Debt Exclusion for the next meeting. Interim Town Manager Selectman Gordon announced that Interim Town Manager James Purcell's last day would be December 1, 2011 and new Town Manager Andrew Maylor would officially start full-time on December 16, 2011. Assistant Town Manager Ray Santilli will continue to function as Assistant Town Manager and any related duties until Mr. Maylor officially starts on December 16, 2011. Chairman Tracy Watson and Town Manager Andrew Maylor will decide if he wants to appoint Ray Santilli as an Interim Town Manager for two weeks prior to his arrival. Goodbye to Interim Town Manager James Purcell Selectmen thanked Mr. Purcell for coming to North Andover and for helping the Town during the transition and search for a new Town Manager. Town Employees are invited to stop by the Town Manager's office to say goodbye to James Purcell on Thursday, December 1, 2011, between 12:00-2:00 p.m. TOWN MANAGER'S REPORT: The sale of Surplus Vehicles/Items took place on Saturday, November 5th. A total of$40,572.19 was received for the vehicles/items in a sealed bid format. In accordance with the vote by the Board, the bids received for the Catch Basin Truck were rejected as they did not exceed the trade-in value previously obtained. House 1972 which is pending in the Joint Committee'on Election Laws. This bill would combine the presidential and state primaries to June 5, 2012. Currently, the State Primary date has been changed from September 18, 2011 to Thursday September 6, 2012. There is serious discussion to changing that date because of convention conflicts and other issues. I bring this forward for discussion with the Board. Mr. Campbell requests that"at this point, it could be something as simple as voting to support passage of H1972 and directing that a letter communicating the support be sent to the Joint Committee on Election Laws and to your State Representatives and State Senators." I and my Board of Registrars concur that this is worthy of consideration. We share the concern that proper time be allowed to send proper absentee ballots to our military and their families as well as other overseas voters. Patrick State House—Room 280 Boston,MA 02133 Re: 2012 State Primary Dear Governor Patrick: This is to bring to your attention H1972"An Act Regulating State Primaries"that is pending in the Joint Committee on Election Laws. The bill has the support of communities by affirmative votes of Boards of Selectmen and City Councils across the Commonwealth—from Mount Washington to Amesbury and from Cheshire to Provincetown,Northampton,Amherst,Fall River and Gloucester,to name a few. H1972 would combine the presidential and state primaries to.June 5,2012. The bill will increase voter turnout,reduce costs of elections by at least$8 million,reduce voter fatigue,reduce security issues in schools by using the buildings less for elections, ensure that Massachusetts residents including military personnel residing overseas`receive a ballot and the ballot is counted, and eliminate any voter being required to waive their right to a secret ballot. Both California and New Jersey recently took the same action, combining their presidential primary and state primary to June 5, 2012. There is no question that the proposal is bold. However,these times call for bold action and new solutions to problems facing the residents and businesses of the Commonwealth. Rather than tinker at the edges and move the state primary forward or back a few days, with.all due respect for your office,I urge that you call for the adoption of H1972 swiftly so that communities can take action to implement the bill. The one objection that will be offered is that it is too late to act. In 2008,the Presidential Primary was moved forward from March 4, 2008 to February 5,2008. The act that allowed that change was approved on November 26,2007—just 71 days before the February 2008 primary. H1972 is pushing the election further out and therefore gives election officials more time to prepare than in 2008 where the calendar was shortened. It is never too late to act. Patrick Re: 2012 State Primary November 30,2011 Page Two Finally, it is clear that due to a number of Massachusetts statutory provisions which impact the printing of ballots, any date later than August will place Massachusetts out of compliance with the federal MOVE Act. The New York state primary is currently scheduled for September 11, 2012, The Department of Justice asked a federal judge to issue an order compelling the state of New York to hold the state primary no later than August 2012 as the state will not be in compliance with the MOVE Act.
