HomeMy WebLinkAbout2019-05-14 Board of Selectmen Minutes BOARD OF SELECTMEN MINUTES May 14, 2019 CALL TO ORDER: Chairman Regina Kean called the meeting to order at 5:00PM in Room 1064 of the North Andover High School. The open session meeting was recorded. ATTENDANCE: The following were present: Chairman Regina Kean, Clerk Phil DeCologero, Licensing Chairman, Chris Nobile, Richard Vaillancourt, Rosemary Smedile, Acting Town Manager Lyne Savage, Deputy Town Manager, Denise Casey and Executive Assistant, Laurie Burzlaff. EXECUTIVE SESSION: Richard Vaillancourt made a MOTION, seconded by Phil DeCologero that the Board of Selectmen enter into Executive Session pursuant to Massachusetts General Laws, Chapter 30A, Section 21(a)(6) to consider the purchase, exchange, lease or value of real property (Stevens Estate) and to return to Open Session at the conclusion of Executive Session. Chairwoman Kean declared an open meeting may have a detrimental effect on the Board’s negotiating position. Roll call vote: Vaillancourt-yes; DeCologero-yes; Kean-yes; Nobile-yes and Smedile-yes. The Board returned to open session at 5:30PM. PLEDGE OF ALLEGIANCE PUBLIC COMMENT None APPROVAL OF MINUTES Phil DeCologero made a MOTION, seconded by Richard Vaillancourt to approve the Open Session Minutes of May 6, 2019. Motion approved 5-0. LICENSING COMMISSIONERS Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile to open a meeting of the North Andover Licensing Commission. Motion approved 5-0. Chris Buco requests a one day entertainment license for a beer festival on May 18, 2019 from 12:00PM- 4:00PM at 505 Sutton Street Regina Kean made a MOTION, seconded by Phil DeCologero that the Board of Selectmen, acting as Licensing Commissioners, approve the request of Chris Buco for a one day entertainment license for a beer festival on May 18, 2019 from noon until 4:00PM. Motion approved 5-0. Phil DeCologero made a MOTION, seconded by Rosemary Smedile to close a meeting of the North Andover Licensing Commission. Motion approved 5-0. CONSENT ITEMS Vote to withdraw Article 7 from Town Meeting As discussed at the last meeting, the Board agreed they should withdraw Warrant Article 7. Phil DeCologero made a MOTION, seconded by Chris Nobile that the Board of Selectmen make a motion on the floor of Town Meeting to withdraw Warrant Article 7. Motion approved 5-0. Vote to appoint associate members to the Council on Aging Two of the members appointed at the last meeting must be moved to associate positions since the Board cannot increase the membership of the Council on Aging without Town Meeting approval. Chris Nobile made a MOTION seconded by Richard Vaillancourt that the Board of Selectmen appoint Lawrence Smith and David VanArsdale as associate members to the Council on Aging for a terms ending June 30, 2022. Motion approved 5-0. Board of Selectmen Minutes May 14, 2019 2 Renew Appointment of Acting Town Manager Town Charter requires the Board to vote to either renew the appointment of the Acting Town Manager or appoint someone else as Acting Town Manager, should the new Town Manager not be hired within 90 days of vacating the position. Rosemary Smedile made a MOTION, seconded by Chris Nobile that the Board of Selectmen appoint Lyne Savage as Acting Town Manager for an additional 90 days. Motion approved 5-0. Vote to approve Town Manager appointment of Kate Bargnesi as an associate member to the Planning Board Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectmen approve the appointment of Kate Bargnesi as an associate member to the Planning Board for a term ending June 30, 2020. Motion approved 5-0. OLD BUSINESS Stevens Estate discussion The Board continued the discussion regarding the Stevens Estate proposal and next steps. At the next meeting they will consider lifting the moratorium on bookings until September 1, 2020 and whether to renew the liquor license. PUBLIC HEARING (continued from last meeting) Layout of Wellington Way Included in the packets were the street layout plans and recommendations from Town Counsel and relevant departments for Wellington Way. Once the Board accepts the street layout, the street must then be accepted as a public way at Town Meeting. Stephanie Keifer from Smolak and Vaughn, attorney for the applicant, provided an update on the conditions. Phil DeCologero made a MOTION seconded by Chris Nobile to close the public hearing for the layout of Wellington Way. Motion approved 5-0. Vote on whether to accept layout of Wellington Way Chris Nobile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen recommend acceptance of Wellington Way, as a public way, and declare that public necessity and convenience require the aforesaid way to be laid out and do hereby order and direct that said way be laid out as shown on Plan of Land entitled “Street As Built Plan for Wellington Way in North Andover, Mass. Date: 2/11/19, revised 04/11/19, Professional Engineers and Land Surveyors Christiansen & Sergi, a division of the Morin-Cameron Group, Inc., 160 Summer Street, Haverhill, Massachusetts 01830” and upon acceptance by Town Meeting, to accept deeds to the street and all related restrictions and easements shown on said Street Layout Plan and the plan entitled “Street Layout Plan of Wellington Woods, located in North Andover, MA” prepared by Christiansen & Sergi dated 1/28/2019 and recorded as Plan No. 17354 at the North Essex Registry of Deeds. Motion approved 5-0. Recommendation for Article 24-Acceptance of Public Way-Wellington Way The Planning Board recommended favorable action. Richard Vaillancourt made a MOTION seconded by Phil DeCologero that the Board of Selectmen recommend Favorable Action on Article 24. Motion approved 5-0. Phil DeCologero made MOTION seconded by Chris Nobile, to recess the meeting and move into the auditorium for Town Meeting.
