ADJOURNMENT Approval of Minutes BOARD OF SELECTMEN MINUTES February 23, 2015 CALL TO ORDER: Chairman Richard Vaillancourt called the meeting to order at 7:00 PM at Town Hall Meeting Room. ATTENDANCE: The following were present: Chairman Richard Vaillancourt, Clerk William Gordon, Rosemary Smedile, Licensing Chairman Tracy Watson, Donald Stewart, Town Manager Andrew Maylor, Assistant Town Manager Ray Santilli and Executive Assistant, Laurie Burzlaff. Approximately 35 members of the public were present. The meeting was recorded. PLEDGE OF ALLEGIANCE Chairman Vaillancourt introduced Brendan "Trey" Sheehy to lead the group in the Pledge of Allegiance and presented Mr. Sheehy with a Certificate of Appreciation. APPROVAL OF MINUTES: William Gordon made a MOTION, seconded by Rosemary Smedile, to approve the Open Session Minutes of February 11, 2015. Vote approved 5-0. i COMMUNICATIONS AND ANNOUNCEMENTS: Recognition of 2014 Police Officers of the Year Police Chief Paul Gallagher described the event that led to the officers being nominated as the 2014 Police Officers of the Year and then introduced the officers: Lieutenant Charles Gray, Officer Jarrad Lawlor, Officer Jason Wedge, and Officer Robert Hillner. Recognition of 2014 Firefighters of the Year Fire Chief Andrew Melnikas read the speech he gave at the Public Safety Awards Banquet and then introduced the 2014 Firefighters of the Year: Lieutenant Mike Beirne, Lieutenant Graham Rowe, Firefighter John McClennan, Firefighter Matt Twiss, Firefighter Dan Pas, Firefighter Dan Ryan, Firefighter Steve Risacher, Firefighter Blake Zwinggi and Firefighter Neil'Patnaude. The Board thanked both departments for all they do for the Town. New Business Recognition-Cows Rock Ice Cream Cythia Sanborn and Corrine Willis were present to receive recognition from the Board. Ms. Sanborn distributed a map to the Board and asked the Board for permission to use Blacksmith Foundation which is behind their building. The Town Manager indicated he will look into it and contact Ms. Sanborn with a decision. Cheri Cousens,'Exective Director, Greater Lawrence Sanitary District Cheri Cousens, Executive Director of the Greater Lawrence Sanitary District, showed a power point presentation updating the Board on the Organics Energy Project that was first discussed at the Selectmen's Meeting on August 20, 2014. Ms. Cousens explained that last year Mass DEP banned commercial facilities from throwing out organic waste, so this new facility will address a need in the community. Ms. Cousens explained that they have received enough grant money to move forward with the design of the facility. In response to'a question from the Board, Ms. Cousens indicated there would be 4 additional trucks per day during the pilot phase of the program and 12 additional trucks per day when the project is completely up and running. The Board expressed their concerns about disrupting the neighborhood, the environmental impact of the project, and the wear and tear on the roads. The Board requested a site visit to be scheduled, a peer review to be completed at the cost of the GLSD, and a written agreement be drafted regarding the number of trucks and hours of operation. Update on snow and ice budget The Town Manager, Andrew Maylor, gave an update on the snow and ice budget. Mr. Maylor explained that to date, $1.7 million has been spent on snow and ice and the Town is approaching a $1 million deficit. Mr. Maylor indicated that as long as March is tame, we will be able to use balances in existing accounts to cover the deficit rather than carrying it over to the following year. Board of Selectmen Minutes February 23, 2015 2 Mr. Maylor acknowledged that the Town has struggled at times with trash pick-up and indicated the town will work with the vendor to do a better job when dealing with delays in trash pick-up. Mr. Maylor announced that he intends to keep the parking ban in place and a telephone notification will go out to residents. Additionally, due to all the snow and ice, there are going to be problems with the roads in the spring that will need to be addressed. Assistant Town Manager, Raymond Santilli, announced that the Youth Center ice rink is still available for use and they expect it to remain open for a couple more weeks. The Board congratulated NAHS wrestlers Fritz Hoehn and Steve Cincotti for winning states and also congratulated the High School wrestling team for winning 2"d place in the Division 2 State tournament. Chairman Vaillancourt announced that the New England Runners Calendar lists North Andover's 4'h of July Road Race as the first race. CONSENT ITEMS: Keith D'Entremont of Angel Flight NE requests to use streets in North Andover on Sunday, September 13, 2015 from 7:00 a.m. to 2:30 p.m. for the 5th Annual Ride for Angels (taken out of order) Keith D'Entremont of Angel Flight NE was present to request to use the streets in North Andover on Sunday, September 13, 2015 from 7:00 a.m. to 2:30 p.m. for the 5th Annual Ride for Angels charity cycling event. The four routes (20, 40, 65 and 100 miles)will start and finish at Lawrence Municipal Airport. All relevant departments recommended approval. Tracy Watson made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen approve the request of Angel Flight Northeast to hold the `5th Annual Ride for Angels'charity cycling event on Sunday, September 13, 2015 from 7:00 a.m. to 2:30 p.m. Vote approved 5-0. Accept and sign "Grant of Easement"to Massachusetts Electric Company for 795 Chickering Road The Board was provided with a copy of an Easement from Massachusetts Electric Company for installation of an "Underground Electric Distribution System" at 795 Chickering Road (the new fire station). Tracy Watson made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen accept and sign the Grant of Easement to Massachusetts Electric Company for 795 Chickering Road. Vote approved 5-0. Request to dispose of surplus vehicle-Water Treatment Plant Included in the Board's agenda packet was a Memorandum from Public Works Director, Bruce Thibodeau, requesting to dispose of a surplus vehicle. William Gordon made a MOTION, seconded by Tracy Watson, that the Board of Selectmen approve the request of Public Works Director Bruce Thibodeau to dispose of a surplus vehicle per his memorandum to the Town Manager dated January 22, 2015. Vote approved 5-0. Request to dispose of surplus vehicle-Emergency Management Included in Board's agenda packet was a "Fixed Asset Control Card" from Emergency Management Director, Jeffrey Coco, requesting to dispose of a surplus vehicle. William Gordon made a MOTION, seconded by Rosemary Smedile, that the Board of Selectmen approve the request of Emergency Management Director Jeffrey Coco to dispose of a surplus vehicle as described in the Fixed Asset Control Card dated February 18, 2015. Vote approved 5-0. LICENSING: Rosemary Smedile made a MOTION, seconded by Donald Stewart, to open a meeting of the North Andover Licensing Commission. Vote approved 5-0. Mukta Shah of Merrimack College requests a One Day Wine & Malt license for a "St. Germain Memorial Lecture" on Thursday, March 5, 2015 at the Rogers Center from 5:00 p.m. to 10:00 p.m. Donald Stewart made a MOTION, seconded by William Gordon, that the Board of Selectmen, acting as Licensing Commissioners, approve a One-Day Wine & Malt License for Merrimack Board of Selectmen Minutes February 23, 2015 3 College for a "St. Germain Memorial Lecture"on Thursday, March 5, 2015 at the Rogers Center from 5:00 p.m. to 10:00 p.m. Vote approved 5-0. PUBLIC HEARING: None I OLD BUSINESS: None I NEW BUSINESS: Town Manager's FY16 Recommended Budget The Board was provided with copies of the Town Manager's FY16 Recommended Budget. The Town Manager read the Executive Summary that was included in the budget book. Rosemary Smedile made a MOTION, seconded by Donald Stewart that the Board of Selectmen approve the Town Manager's FY16 Recommended Budget reserving the ability to make amendments as additional information comes forward and to forward the budget to the Finance Committee. Vote approved 5-0. PUBLIC COMMENT: Stan Limpert of 43 Stonecleave Road, thanked Public Works Director Bruce Thibodeau and his crew for helping to keep the schools open and the roofs from collapsing. The Town Manager announced the playground assessment is complete and there was a meeting with various stakeholders to discuss the plan. Mr. Maylor indicated that the final, comprehensive plan should be completed soon and an application for funds will be submitted to the Community Preservation Committee. I'm still scouting for some locations so I'm definitely interested in also attending the March 23rd meeting just so I can give you the finalized schedule/locations. 1.Weir Hill(Friday,April I Oth specifically the very top of the hill and the underpass brill e. 1) -": •We will be using a film camera,a tripod,and a bounce board(a 6'x6',reflective square of foam.)The rest of our film equipment will be off-set--We do not need to set up lights for an outdoor scene. •The scene has 2 actors and an estimated 10 crew. •Just a quick inquiry in regards to shooting here in early April-how much snow do you think would be here around this time of the year? Would it make it difficult to travel up and down the hill? The rest of the locations will all be filmed on Sunday,April 12th. 2. 1 initially expressed interest in shooting a driving scene on a street but I've since cut that out.However, I am still interested in shooting on a street surrounded by trees,with at least one utility pole in view. Based on the information given in the proposal, it is apparent that this will be a very dynamic situation. Having reviewed the details of the plan, it is apparent that there will be road closures and detours for approximately two hour blocks in various areas of town. The Police Department would require the hiring of two (2) detail officers with marked police cruisers for the entire time the movie will be filming on public roadways where pedestrian and/or motor vehicle traffic will be affected. This is based on the Manual of Uniform Traffic Control Devices, specifically, Temporary Traffic Controls, The Detail Officers will be responsible for establishing temporary work zones, directing traffic through the zone, or around the work zone, depending on the needs of the person in charge of the set and maintaining overall safety within the work zone. Following a successful event in 2014, we are excited to bring back this race. If you recall, last year we had both a half and a full marathon attached to this event. This year, we are looking at only keeping the half marathon option available. The first year, though proving successful with an overall turnout of about 700 participants, we still experienced a loss in revenue mainly due to the additional costs needed for the full marathon. Also, our overall turnout was less than 25% for the full marathon, thus making it more cost efficient to produce only the half marathon. Nonetheless, with our growing network of runners, we anticipate a higher turnout of participants and look forward to keeping this great event in North Andover for years to come. Last year, though experiencing a financial loss, Green Stride still donated approximately $1,000 dollars to the Merrimack Valley Strider Scholarship Fund as well as the Lazarus House in Lawrence. For 2015, we plan to donate a larger sum to the same beneficiaries assuming our anticipated growth in the event. By way of background,the applicant received the Planning Board's approval of a 5-lot definitive subdivision located at real property known and numbered as 288 Sutton Street in July,2011,and Conservation Commission approval of a Wetlands Order of Conditions in November, 2013. Zoning Board of Appeals Special Permits were also issued for the project in August,3013. In connection with the Planning Board's approval of the subdivision,the applicant is required to plant a total of nineteen(19) trees as a part of the project. In connection with preliminary site work involved with the subdivision project in the fall,2014,the subject tree was removed both because the tree obstructed site distance along Sutton Street, and because the tree was in late stages of decline. Thereafter,the Department of Public Works informed the applicant of the need for the tree removal to undergo Public Shade Tree Act review before the Board of Selectmen in connection with the removal of the sugar maple tree. As noted in the attached report entitled "Evaluation of Sugar Maple,288 Sutton Street,North Andover,MA," dated December 23,2014,prepared by John DelRosso, Massachusetts Certified Arborist, an inspection of the subject sugar maple tree revealed that it"...was,in a state of decline when it was felled." Assignment After talking with Mr.Smolak,it was agreed that I would: ® Inspect the remains of the tree for signs of health and structural integrity. Present my opinion as to the health and condition the tree was in at the time it was removed. ® Provide a written report of my findings. Limitations As I was not able to inspect the tree before it was felled,a visual assessment of the tree parts was performed on the ground.Available to me were;several large sections of root,the stump and root buttresses,four 8.10'sections of the trunk,and a large pile of brush that contained branches with stem diameters ranging from 6-8"down to small twigs. Evaluating the health of a tree is sometimes a subjective process.Photos included in this report and others available on the internet are used to support my findings. Purpose and Use The purpose of this report is to provide objective information regarding the health and condition of the tree at the time it was removed.The information is provided to Steve Smolak to help resolve a dispute regarding the health of the tree at the time of removal. Observations On Saturday,December 20th,2014,I met Steve Smolak at a construction site located at 288 Sutton Street in North Andover.The site consisted of a vacant lot with disturbed soil and woody debris.The tree in question had been felled from its original location, dismantled,and sorted into three piles consisting of roots and stump,large trunks boles,and a pile of brush. Prior to being felled the tree had been growing at the front left(southwest)corner of the lot,in the grass median between the sidewalk and Sutton Street. This large Sugar Maple had a dbh(diameter at breast height)of approximately 36 inches,a height of 55 feet and an average crown spread of about 50 feet.These are approximate measurements based on scale comparisons of photos taken from Google Earth on 8/24/13. The area of the root zone was limited due to more than 50%of it being comprised of asphalt. Three large roots that had been unearthed and removed with the stump were largely decayed. The stump,which consists of the root flare and approximately 2 1/2 feet of the trunk had a considerable amount of decay as seen in photo#1.In some areas of the stump the bark has sloughed off to expose a mycelium.fungal mat of decayed wood as seen in photo#2. -2- "far :# -` r iYL 4 r F r I - rr rf Photo 1 Photo 2 The stump lso had a large wound with characteristic traits similar to those of mechanical p g damage,suggesting that at some time the tree may have been stuck by an automobile or snow plow. Examination of the cross sections of the trunk sections revealed a considerable amount of decay present in the tree's heartwood. Photos 3-9 show the areas of decay,sometimes outlined with a permanent marker to accentuate the demarcation between healthy and rotten wood.I also found a moderate amount of dead branches scattered throughout the brush pile,suggesting that perhaps as much as 15%of the crown had died back.This conjecture is further supported by photographs available on the internet on Google Earth.An aerial view of 288 Sutton Street was taken on August 24th,2013.In this image the structure of large branches is evident through the crown of the tree.In comparison to many of the nearby trees this trait would suggest that the crown was thinning and that the tree was in a state of decline.This hypothesis is further supported in a"street view"image on Google Earth taken in October of 2012.The image dearly shows that over 50%of the crown had already dropped its leaves when many of the nearby Maple trees had not even started to turn.This symptom is very'common in Sugar Maples as they start to become senescent,lose their vigor,and start to decline.One other characteristic of -3- the tree worth noting;before the tree was felled,the crown of the tree was heavily unbalanced with considerable weight over the southern,or street side. ny MEW a i n Photo 3 Photo 4 yy" �- V" 7 SA € .. �4 I ft � Photo 5 Photo 6 -4- Y �j t Ana Y � f Photo 7 Photo 8 UP o t" t teW, AX cam" ry a . S r f Photo 9 Photo 10 Discussions Sugar Maple is a picturesque native tree.In ideal growing conditions it can reach heights of up to 75 feet and has the potential to live more than one hundred years.Because of its upright growing habit,adaptability to various soil types,and hardwood,it was often used in street tree plantings throughout New England,However;as those trees matured and were subjected to adverse conditions such as road salts,limited root zones,mechanical damage to their trunks, and attack of defoliating caterpillars,it soon became apparent that a tree of this size,when -5- planted in this type of location and subjected to such conditions,could quite conceivably be considered a hazard to many of its potential targets. i With regard to the tree that formerly stood at 288 Sutton Street,the decay noted in my observations is significant.The cross sectional photographs above show that 20%to 80%of the heartwood has been eroded.It should be noted that much of the decay found in my inspection of the tree was located in parts that are considered critical to the tree's structural integrity. Conclusions i Although not all of the tree was available to me for this assessment,the parts that were,together with the images available on Google Earth lead me to believe that the health of the Sugar Maple at 288 Sutton Street was in a state of decline when it was felled. Given the location of the tree, the amount of decay present, the size and amount of deadwood in the crown,and the bulk of the load of the tree over the roadside,it is conceivable that this tree had the potential to be considered hazardous to motorists and pedestrians. i i �I i -6- I I,John DelRosso,certify that I have personally inspected the tree on the property referred to in this report and have stated my findings accurately.The extent of the evaluation and/or appraisal is in the attached report.
