Faigen Staff Present: Gavel given to: D. Paul Koch, Jr. Pledge of Allegiance 2. Acceptance of Minutes Allan Cuscia made a motion to approve the minutes and Alexandria A. Jacobs seconded the motion. Vote was unanimous in approving the minutes. 3. New Public Hearing re: 62 Saile Way The petition of Maria and Anthony DeMarco for property at 62 Saile Way (Map 062.0, Parcel 0046), North Andover, MA 01845 in the R-1 Zoning District. The Applicant is requesting a Variance pursuant to Town of North Andover Zoning Bylaws, Section 195-4.19(B)(3)(a) for construction of an in-ground pool in the R-1 Zoning District. Allan Cuscia read the legal notice. Gregory Hocmouth is at the table representing the applicants Maria and Anthony DeMarco. They are in front of the board because there is no place on the property they can construct the pool that will allow for no variances. They will need a watershed special permit from the Planning Board. The pool will be kidney shape and a fence will surround the pool. They will need a temporary road and access area for pool excavation. A 2 foot trench is being proposed. Notices and agendas are to be posted 48 hours in advance of a meeting excluding Saturdays, Sundays, and legal holidays. Please keep in mind the Town Clerk's hours of operation and make necessary arrangements to be sure that posting is made in an adequate amount of time. A listing of topics the Chair reasonably anticipates will be discussed at a meeting are to be listed on the Agenda. Note: Matters may be called out of order and not as they appear in the Agenda. Page 1 of 2 There is discussion on discharge of the pool water and whether or not the water will be salt or chlorine. It would be safe to pump it into the infiltration system. The hardship for the applicant is there is no place on the property to construct the pool without variances. It should have zero impact to the surrounding area. The pool will be gunite with bluestone pavers. Paul Koch would like to discuss the conditions in further detail. The conditions will need to be cohesive with the Planning Board. It is on the outskirts of the non- discharge zone and it would be hard for the water to go uphill. The town is very conservative due to the fact it is the drinking water. The Board attaches the following conditions to the findings: (1) prior to any major discharge of the pool, the contents shall sit for seventy-two (72) hours to ensure dissipation of chemicals (2) any minor discharge of the pool shall be directed to the existing subsurface infiltration or a dry well to be installed by Applicant (3) Applicant shall implement and follow the Operation & Maintenance Plan submitted with the Application A motion was made by Ellen P. Mcintyre and seconded by Allan Cuscia to grant the variance requested under Section 195-4.19(B)(3)(a) of the Zoning Bylaws to allow a variance from Section 195-4.19(B)(3)(a) (Watershed Protection District Non-Discharge Buffer Zone) of the Zoning Bylaws for the construction of an in-ground pool in accordance with (a) the following plans and other materials: (1) Letter of Authority dated May 16, 2019 (2) Correspondence from Greg J. Hochmuth, RS, CWS, PWS, Project Manager at Williams & Sparages LLC dated May 16, 2019 (3) Proposed Operation & Maintenance Plan with Inspection and Maintenance Form (4) Site Plan #12515 by Williams & Sparages dated May 14, 2019 (5) Plan by Pools by Andrews dated April1, 2019 7.
