Pledge of Allegiance Acceptance of Minutes  A motion to accept the minutes of the June 12, 2019 as reviewed and amended is made by Mrs. Feltovic, seconded by Mr. Lynch.  Vote 5-0, Unanimous. Certificate of Compliance (COC) 242-1722, 173 Campbell Road (Prescott)  The Administrator reviews the project with the Commission. The Field Inspector visited the site and found stable conditions. The grass is growing and the addition was built in compliance with the approved plan. Confirmation of the installation of wetland markers needs to be completed.  A motion to issue a Full and Final Certificate of Compliance and hold until confirmation of installation of wetland markers is made by Mr. Manzi, seconded by Mr. Saal  Vote 5-0 Unanimous. Documents  COC Request Letter, dated March 13, 2019 prepared by LJR Engineering, Inc.  WPA Form 8A-Request for Certificate of Compliance  173 Campbell Road, NOI Plans 242-1675, 40 Hillside Road (Wallace)  Greg Hochmuth, Williams & Sparages, LLC states his firm got involved in the project after the permit was issued. An existing conditions plan was done showing the project was in substantial compliance. An amendment to the Order of Conditions was proposed for the construction of a paver patio, walkway, block retaining wall, fire pit and landscaping plantings. The following work was not completed: paver patio, retaining wall and walkway. The fallen trees in the pond were removed at the request of the NACC. A new As-Built has been completed. A letter was issued stating the project is in substantial compliance.  Mr. Lynch states once the COC has been issued the order will be closed and the As-Built Plan will serve as the record.  Mr. Hochmuth states the homeowner does not intend to pursue the other work at this time.  Mr. Manzi would like to know if the project is in compliance.  Mr. Hochmuth states the house is 1-foot to the left and the driveway is slightly different. The driveway was approved in the current location under an amendment request.  Mr. Napoli would like to know the width of the path leading to the pond on the original plan. He notes that the site photos show some tire marks were noticed on the path leading to the pond.  Mr. Hochmuth states they took the location for the path from the design plan. To their understanding, this was an existing path. He believes the marks are most likely from a Bobcat type machine that was used 07 10 19 NACC Meeting Minutes Page 2 of 9 during the tree removal. They discussed using a Bobcat with mats at the time of the pre construction meeting.  Mr. Napoli states the trail is only to be used as a walking trail and not intended to be used for vehicles.  Mr. Hochmuth states the trail is scaled 6-feet on the As-Built Plan.  Mr. Napoli states the main goal is to protect the pond and the wetlands surrounding it. He feels the placement of a boulder would prevent vehicle access.  Mrs. Feltovic states the wetland markers are on the trees vs. stonewall. The OOC requires the markers to be placed on the stonewall. It was also noted by the Field Inspector that the southeast corner of the property does not have any wetland markers.  Mr. Hochmuth states he will double check all the wetland markers are all in place and in the correct locations.  The Commission discusses placement of a 2-yd. boulder with a wetland marker at the entrance of the trail.  Mr. Hochmuth states he feels the applicant may want to forego the boulder and continue the wall to narrow the entrance.  A motion to issue a Full and Final Certificate of Compliance, hold until confirmation of installation of wetland markers, and address the width of the path opening is made by Mr. Manzi, seconded by Mrs. Feltovic.  Vote 5-0, Unanimous. Documents  Email from patrickgarner@me.com requesting a continuance until 7/24/19 Modification Request 242-1656, 95 Old Cart Way (Murtha)  Mr. Murtha the homeowner presents the Modification Request. Per the site monitor, the site is in full compliance with the original OOC. He has been asked to file for a modification but does not feel anything has changed.  Mr. Napoli states he was approached for relief and found the town had two sets of plans for the project.  Mr. Murtha states a pool permit triggered the issue. They are trying to get a good location for the pool/spa.  Mr. Napoli would like to know if the location of the bocce court and septic were changed.  Mr. Murtha states the Board of Health agent did not approve of the bocce court on top of the septic.  Mr. Manzi states the plan indicates the applicant is requesting 16 modifications to the record plan. Most of the requests are outside of the 100-foot Buffer Zone.  Mr. Murtha states with the exception of four items the other requests were reviewed and approved by the previous Administrator. He states he was accused of violating the OOC.  The Administrator states when the plan was received it appeared the site did not comply with the OOC.  The Commission discusses the deviations in the plans and the after-the-fact modification request. 07 10 19 NACC Meeting Minutes Page 3 of 9  Mr. Lynch states any/all changes if approved would have been indicated in the record.  Mr. Manzi would like to confirm the plan is accurate.  The Administrator states she has not been on site. She has reviewed the file vs. updated plans to see what was approved and documented.  Mr. Lynch states he has no reason to question the accuracy of the engineered plan. The new plan will serve as the new record plan to the OOC.  A motion to issue a Modification to the Order of Conditions as proposed is made by Mr. Lynch, seconded by Mrs. Feltovic.  Vote 4-1, Mr. Manzi: Opposed. The deck is on the rear of the house in the outer reaches of the buffer zone to BVW.  Kevin Sullivan, Prudential Remodeling is present on behalf of the homeowner. He states the deck and stairs will be replaced, the direction of the stairs will changed.  Mr. Lynch confirms the deck will stay in the existing footprint.  A motion to accept this as a Small Project B is made by Mr. Manzi, seconded by Mrs. Feltovic.  Vote 5-0 Unanimous.  A motion to approve the Small Project as proposed (post construction inspection required) is made by Mr. Manzi, seconded by Mr. Lynch.  Vote 5-0, Unanimous. The only ongoing condition relates to maintaining the chain link fence between WFA7&12. The existing conditions states snow shall not be stockpiled beyond the fencing.  Billy Sweet the property owner states he is seeking permission for a 4 yd. dumpster to be located next to the building as well as periodic replenishment of the gravel for the driveway in addition to the proposed 3 parking spaces.  Mr. Napoli states the NACC needs to be notified when the gravel is replenished.  Mr. Sweet would like to know if the parking spaces could be spread out to preserve an ornamental tree/shrub.  The Commission request the Administrator to help determine the spacing during the pre-construction meeting. A dumpster will be allowed on the property but must be placed as far away from the wetland as possible.  A motion to issue a Negative Determination #3 as amended (erosion controls, pre and post inspections, prior notice to the NACC when gravel is replenished, dumpster to be placed as far away from the wetland as possible) is made by Mr. Manzi, seconded by Mrs. Feltovic.  Vote 5-0, Unanimous. The proposal is for a new gas service connection to existing backup generators at Edgewood LifeCare Community. Mr. Altobello describes the existing conditions and presents the proposal to install the new gas service.  The Administrator states she walked the site, located a number of the wetland flags and the slope between the wetland and the road is well vegetated.  Mr. McDonough abstains from voting.  A motion to issue a Negative Determination #3 as amended (erosion controls, catch basin protection, no work during rain events, trenches backfilled same day, no stockpiling materials within jurisdiction and pre and post inspections) is made by Mr. Lynch, seconded by Mrs. Feltovic.  Vote 5-0, Unanimous, Abstained: Mr. McDonough. Documents  Email from norseenvironmental@verizon.net requesting a continuance until 7/24/19 660 Great Pond Road (Rolling Ridge)  Maureen Herald, Norse Environmental describes the existing conditions. They are proposing a Restoration Plan for seven shrub plantings. Approximately 90-feet of the trail is located in the wetland, no fill was brought in. The trail is approximately 20-24” wide. She would like to know if the NACC would consider allowing a trail/boardwalk through the wetland since the original trail access is steep.  Rev. Dr. Lawrence Jay, Executive Director, Rolling Ridge Retreat and Conference Center is present for questions.  Mr. Manzi states the request for a boardwalk would need to be requested through an RDA with alternative analysis and a waiver request.  Ms. Herald states some hemlock trees were removed and stockpiled along Carriage Drive. The trees will be removed by hand since they do not have access to small equipment immediately, but will explore contractors to assist with this. The tree piles are extensive and they are proposed to be removed.  The Commission discusses if the removal of the stockpiled trees should be part of the EO or the RDA.  Mr. Napoli would like to know if there is an open order for a parking lot.  Rev. Dr. Jay states the parking lot is a separate discussion with the Community Preservation Committee. The parking lot project has been placed on hold until the violation has been taken care of. Permitting for the parking lot was issued in the form of a RDA in 2015.  The Administrator states the RDA permit would need to be re-submitted.  Mr. Napoli requests the Administrator perform a site visit to indicate what should stay and what should go.  The Administrator states the property is in watershed and she is working with the Staff Planner.  Mr. Manzi states this is prime growing season for restoration and removal. He would like the soil stabilized with seed mix as as soon as possible.  Ms. Herald states if the NACC is open to the boardwalk proposal she would like to propose a seed mix to stabilize the area and incorporate plantings along the edges of the boardwalk. The proposed vegetation is comparable to what was removed.  Mrs. Feltovic states the parking lot has been an ongoing project that must be revisited and possibly re delineated.  Rev. Dr. Jay states the stockpiled trees were removed because they were dead/dying. They will be chipped and used on the other trails on the property. 07 10 19 NACC Meeting Minutes Page 6 of 9  The Commission discusses the original trail off Carriage Drive.  Mr. Lynch confirms the applicant is working with FONAT. He states FONAT knows what the Commission looks for and will be instrumental in helping to plan the boardwalk.  The Commission discusses the EO, which will require the blazed trail to be restored and reseeded. The trail must be seeded before the next rain event to prevent soil migration into the lake. The Commission directs the Administrator to accompany Ms. Herald to the site to provide direction regarding the restoration. The soil is to be raked, graded and stabilized with seed mix. It also requires removal of the piles of debris and stabilization.  Mr. Lynch would like to know if there is a need for erosion controls.  The Administrator recommends straw be placed over the seed and leaving the EO open in case more erosion controls need to be added.  The Commission would like the trail blocked off and signage posted stating “area under restoration, no admittance”. The Commission requests an update of the restoration work at the July 24, 2019 meeting.  A motion is made to amend and ratify the Enforcement Order as proposed is made by Mr. Lynch, seconded by Mr. Manzi  Vote 5-1, Mr. Napoli: Opposed. He states the conditions were similar to his prior visit one week ago; things are stable and improving. There are no new areas of calcite or vegetation stress. The calcite deposits continue to abate naturally. He no longer recommends the removal of the calcite crust with hand tools since a large degree of the calcite has abated. They will continue to monitor this and report to the NACC. The restoration plants are still recommended but are proposed to be planted in September 2019.  Mr. Manzi states they do not have any documentation showing the pH levels have gone down in the areas of observation.  Vern Kokosa, Sanborn Head & Associates, Inc. states they have evidence indicating the pH levels have gone down.  Mr. McManus states the new proposal before the NACC is to collect the data being requested.  Michael Sabulis, GEI Consultants agrees that the current system is operating successfully and taking care of the problem. He recommends the asphalt base be allowed to cut off stormwater infiltration. Subsequential final paving is okay with the understanding that if it has to be torn out, it will be torn out. The GEI team met with the NRP team to discuss the monitoring plans on June 28, 2019. At the meeting, they discussed the monitoring plan as well as an additional trench system put together by Paul Lockwood, LRT. They discussed the hydrogeological survey of the property and additional monitoring wells requested on June 11, 2019. Their intent is to use the existing wellpoint system to evaluate conditions at the site. This is an endpoint system that looks at flow, TSS and pH. GEI agrees they do not need additional hydrogeological information upgradient of the wellpoint system..  Mr. Sabulis states they will be able to capture the information as it comes through the rain store systems.  Mr. Lynch states the NACC is concerned with the areas upgradient that have yet to come online. 07 10 19 NACC Meeting Minutes Page 7 of 9  Mr. Kokosa states they are monitoring the pH level, flow rate and continue to measure turbidity of the treated water. They also measure the pH of the flow being collected at the downgradient property line and upgradient of the wetland areas. These readings are being taken hourly, giving them daily averages.  Mr. Lynch states he does not feel the method has been established to be certain that migration from other parts up gradient have been solved.  Mr. Kokosa states once the pH level of the untreated water being collected is below a pH level of 8.3 for one month they feel they will be able to turn off the collection system. With the collection, system off they will collect surface water samples in the wetland and check the pH levels. If the results come back good after two months, they will be at a point where the wetlands are being protected with the treatment system no longer needing to be run. If they receive high pH readings from the surface water in the wetlands, the treatment system can be turned back on.  Mr. Manzi states the ideal pH level is 8.3. Recent samples taken from test site SW4 has a pH level reading of 11.5. He states that 12.5 is considered hazmat and that the current pH levels are a direct result of the RCA used on site.  Mr. Kokosa states the data collected from the treatment system has encouraging pH trends from the untreated water coming into the treatment system. The pH levels started around 11.5 and after approximately six weeks, the pH levels are running around 10.2-9.8. He states they have a long way to go and will continue to run the system.  Mr. Sabulis states at the June 28th meeting it was confirmed the RCA has been fully reused onsite. Therefore, the influence is already there and the end point is the appropriate place to measure. The inundation rates have been reduced and what is being inundated should be showing up in the collection system.  Mr. McDonough would like to know what influence precipitation is having on current situation and some of the data being received.  Mr. Sabulis feels the original precipitation in resulting leachate was being driven by stormwater. The abatement of the rain, paving of the site along with wellpoint systems has helped to reduce and eliminate the migration to the wetland.  Mr. McDonough would like to know if the data received week to week is being driven by less precipitation.  Mr. Sabulis states it is a combination of less precipitation and the fact that the material there is slowly flushing out. There will be some natural attenuation occurring along with cut off from the paving and the reduction in rain.  Mr. McDonough states his concerns with the treatment system being turned off or removed prematurely.  Mr. Sabulis states there will be trial points for shutting the system down. This will be done in dry and wet weather events. He feels the plan is going in the right direction.  Mr. Lynch would like to know if Mr. Sabulis is looking to correlate the periodic shutdowns against rain to establish a measurement of the accuracy of the pH to make a sound decision.  Mr. Sabulis states part of the reason for the temporary shutdowns is to understand what will happen when the system is no longer operating. Construction dewatering is not to occur at the same time as the shutdowns, allowing a true test.  Mr. Kokosa feels that testing may need to go on during the construction phase. The temporary shutdown tests may still be able to be done during construction. He does not foresee permanent shut down of the system during construction.  Mr. Sabulis states the interceptor trench would work as a backup. It will cover a longer stretch of the wall and connect the sumps together.  Mr. Kokosa describes the interceptor trench. The interceptor trench is capable of capturing overland flow and groundwater and will be placed on the down gradient side of the retaining wall.  Mr. Sabulis would like to know what consideration would be made for the safety of future residents or trespassers. 07 10 19 NACC Meeting Minutes Page 8 of 9  Mr. Kokosa states they have considered relocating the treatment systems into the two garages on the plan. This will allow them to make treatment systems more secure. They feel they can prevent trespassing on the site with fencing and access.  Mr. Sabulis states items that need to be discussed tonight are the distances off the down gradient side, installation of the trench, tree cutting, equipment and hand digging.  The Administrator states the location chosen for the interceptor trench is tight in many spots. The onsite project manager told her this would mostly require handwork. The trench will be installed in the Buffer Zone with parts just inside the 50-foot NBZ. Digging and the trench may need to go beyond existing erosion control limits. The fence at the property line will control some of this. The trees they are proposing to be removed have a heavy lean and are almost touching the new building. She feels the root structures are likely already impacted. The stumps of these trees will need to be removed and that replanting is a viable option. There will be more than one pipe in the trench, a return pipe and electrical pipe for example. The arrow on the plan provides the direction of flow to the sump. The pipes will be angled to get the proper pitch. The site manager has confirmed the driveway from entrance to entrance has been paved along with the areas at the end of buildings B and C.  Mr. Lockwood states they are proposing additional pipes to house the electrical for the pumps, a control wire and in some areas a discharge line. He goes on to describe how the interceptor system will work with the current wellpoint system.  Mr. Kokosa states they would like to move forward with the installation of the interceptor trench. The team reviewed the monitoring plan. They feel they can address the comments in a resubmitted plan and have it approved administratively.  The Commission discusses the interceptor trench and decide to move forward with the proposal as an EO.  Mr. Manzi states the south pond has potentially the highest pH level reading onsite. He expresses his concerns that someone could be injured if exposed to the high pH levels.  Mr. Kokosa states the pond is surface water that was tested several weeks ago. The testing took place when the collection system was just being installed. The test results are outdated at this time. They propose to pump the surface water out of the pond to be treated and retested and to install temporary fencing.  Mr. McManus states they will continue to test the water in the pond.  Mr. Sabulis recommends the NACC authorize the infiltration trench.  Mr. Lynch states the Commission will not authorize any work done off property.  The Administrator requests a pre construction walkthrough with the construction manager.  The Commission allows the Administrator discretionary authority when it comes to the removal of any additional trees due to the depth of the trench and proximity to the wall.  Mr. Seuch would like to know if they have permission to remove the hay bales under the supervision of the environmental monitor.  Mr. Lynch states once the Administrator has agreed to the line they will allow the environmental monitor to use his discretion to move hay bales to accommodate the line.  The Commission discusses the use of machinery for the installation of the trench. If the equipment will have an adverse impact, they request to be notified.  The Commission discusses further retainment of the peer reviewer. The Commission would like to see how the installation of the interceptor trench goes before making a decision.  The Administrator requests they add a reference table of triggers.  A motion to ratify the Enforcement Order as proposed is made Mr. McDonough, seconded by Mrs. Feltovic.  Vote 5-0, Unanimous, Recused: Mr. Napoli.  A motion to adopt the proposal subject to GEI peer review approval is made by Mr. Lynch, seconded by Mrs. Feltovic.  Vote 5-0, Unanimous, Recused: Mr. Napoli. 07 10 19 NACC Meeting Minutes Page 9 of 9  Discussion ensues as to when the applicant should next appear before the Commission. Decisions 242-1755, Rea Street, Lots 4-7 (RDM, Inc.)  The Administrator reviews the drafted Order of Conditions with the Commission. The provision for dewatering will remain part of the OOC. Changes were made to condition #60. They discuss condition #44 regarding tree caliper size. The trees that need to be removed will be discussed at the pre construction meeting. The bond amounts have been set at $2,000.00 each.
