HomeMy WebLinkAbout2019-11-12 Board of Selectmen Minutes BOARD OF SELECTMEN MINUTES November 12, 2019 CALL TO ORDER: Chairman Richard Vaillancourt called the meeting to order at 7:02PM in Meeting Room at Town Hall. ATTENDANCE: The following were present: Chairman Richard Vaillancourt, Clerk Rosemary Smedile, Licensing Chairman, Regina Kean, Chris Nobile, Phil DeCologero, Town Manager, Melissa Murphy Rodrigues and Executive Assistant, Laurie Burzlaff. PLEDGE OF ALLEGIANCE PUBLIC COMMENT Ellen Mosier of 137 Kara Drive, asked the Board to table the discussion about the Stevens Estate financials. APPROVAL OF MINUTES Rosemary Smedile made a MOTION, seconded by Regina Kean to approve the Open Session Minutes of October 15, 2019. Motion approved 5-0. Rosemary Smedile made a MOTION, seconded by Regina Kean to approve the Open Session Minutes of October 21, 2019. Motion approved 5-0. GOVERNMENTAL REPORTS Opioid Presentation- Deanna Cruz and Jeff Deschenes Community Support Coordinator, Deanna Cruz, spoke about her work related to opioid issues. Five percent of her work is related to addiction while the other ninety-five percent is mental health issues and resources for the elderly. She is trying to reduce the stigma of asking for help. Firefighter, Jeff Deschenes, presented the report on the Opioid overdoses over the last couple of years. Mr. Deschenes explained that they don’t always know about overdoses because of the program that allows family members to obtain Narcan. Police Chief, Charles Gray, commended Ms. Cruz for her work and stated that it is an excellent resource for the Town. Board of Selectmen meeting schedule The Board agreed to move the meeting on January 6, 2020 to January 13, 2020 and the meeting on April 21, 2020 to April 27, 2020. FY20 first quarter financials Lyne Savage, Finance Director, presented the FY20 first quarter financials. Ms. Savage indicated that compared to last year, meals tax is up, excise tax is down and inspection fees are down. All other revenue and expenses are on track. Financial update on Stevens Estate Finance Director, Lyne Savage, gave the Board an update on the financials for the Stevens Estate. Ms. Savage is projecting a loss at the end of the year. Ms. Kean asked the Town Manager to provide at a future meeting the fee schedule and an explanation of when we deviate from it. Winter parking ban Town Manager, Melissa Rodrigues, spoke with the Police Chief and Director of Public Works about the parking ban, and she is suggesting a snow emergency be called on an as needed basis rather than every day from January through March. Ms. Rodrigues will present the proposal at the next meeting. CONSENT ITEMS Confirm Town Manager appointment of Marielle Conte to the position of Treasurer/Collector Town Manager, Melissa Rodrigues, has promoted Marielle Conte to the position of Treasurer/Collector subject to the Board’s approval. Per the Town Charter, the Board of Selectmen must confirm the appointment. Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen confirm the Town Manager’s appointment of Marielle Conte as the Treasurer/Collector. Motion approved 5-0. Board of Selectmen Minutes November 12, 2019 2 Accept grant from the MA Executive Office of Elder Affairs in the amount of $3,800 Irene O’Brien submitted a letter asking for the Board to accept the grant to be used for marketing, supplies and programming. Phil DeCologero made a MOTION, seconded by Regina Kean that the Board of Selectmen accept the grant from MA Executive Office of Elder Affairs in the amount of $3800.00. Motion approved 5- 0. Accept grant from Lawrence Partnership in the amount of $133,250 to support business recovery in Columbia Gas impacted area th The Town will be offering the gift card promotion again this year on the weekend of November 16 and th 17. This grant will pay for the promotion. Ms. Burzlaff explained that customers that shop at the listed businesses can obtain a gift card back from the town. The amount of the gift card is based on the dollar amount spent. Regina Kean made a MOTION, seconded by Phil DeCologero that the Board of Selectmen accept the grant in the amount of $133,250.00 from the Lawrence Partnership. Motion approved 5-0. Accept grant from DOER in the amount of $12,500 to fund assistance with a commissioning study Steve Foster, Facilities Director, received a grant to study the HVAC controls for efficacy at the schools. Regina Kean made a MOTION, seconded by Chris Nobile that the Board of Selectmen accept the grant from the Department of Energy Resources in the amount of $12,500. Motion approved 5-0. Approval of Fire Chief trip to Oklahoma City for Amazon site visit Included in the packet is a disclosure form from Fire Chief, William McCarthy, for travel to Oklahoma to visit a building similar to the building proposed by Amazon. As his appointing authority, the Board would need to approve the travel expense as serving a legitimate public purpose. Regina Kean made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen approve the travel expenses disclosed by Fire Chief William McCarthy as serving a legitimate public purpose and declare that such public purpose outweighs any special non-work related benefit to the employee or the person providing the payment. Motion approved 5-0. Accept donation in the amount of $100 to the Fire Department from Smart Start, LLC The Board is being asked to accept a donation in the amount of $100 to the Fire Department from Smart Start, LLC to be used for public education materials on fire safety. Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen accept the donation of $100 from Smart Start, LLC to be used for public education material on fire safety. Motion approved 5-0. Appointment of one member to join negotiations with Amazon regarding economic development incentives and any potential development agreement Town Manager, Melissa Rodrigues, stated that at this point there has been no request by Amazon for any economic development incentives; however, to be prepared she suggests that one member of the Board of Selectmen be appointed to join her and Town Counsel for negotiations regarding any potential development agreement. Regina Kean made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen appoint Richard Vaillancourt as the Board’s representative for negotiations with Amazon regarding economic development incentives and any potential development agreement. Motion approved 5-0. Approve and sign amendment to development agreement for 1600 Osgood Street and authorize Town Counsel to work with counsel for 1600 Osgood to draft the residential covenant as required The Board took no action on this item and there was no discussion. Appoint members to Stevens Estate Long Term Advisory Committee The Board must appoint four members to the Stevens Estate Long Term Advisory Committee. Each Board member provided to Deputy Town Manager, Denise Casey, the names of five applicants they would choose to be on the committee. Ms. Casey provide the top five applicants chosen by the Board as a whole for appointment to the Stevens Estate Long Term Advisory Committee. The top five were: James Lafond, Joseph Pelich, Kathleen Stagno, Kevin Driscoll and David Stroh. Board of Selectmen Minutes November 12, 2019 3 Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen appoint James Lafond to the Stevens Estate Long Term Advisory Committee for a term ending June 30, 2021. Motion approved 5-0. Phil DeCologero made a MOTION, seconded by Rosemary Smedile that Joseph Pelich be appointed to the Stevens Estate Long Term Advisory Committee for a term ending June 30, 2021. Motion approved 5-0. Rosemary Smedile made a MOTION, to appoint David Stroh to the Stevens Estate Long Term Advisory Committee for a term ending June 30, 2021. There was no second. Phil DeCologero made a MOTION, seconded by Regina Kean to appoint Kathleen Stagno to the Stevens Estate Long Term Advisory Committee for a term ending June 30, 2021. Motion approved 5-0. Phil DeCologero made a MOTION, seconded by Chris Nobile to appoint Kevin Driscoll to the Stevens Estate Long Term Advisory Committee for a term ending June 30, 2021. Motion approved 4-0. Ms. Smedile abstained. LICENSING COMMISSIONERS Chris Nobile made a MOTION, seconded by Regina Kean to open a meeting of the North Andover Licensing Commission. Motion approved 5-0. Request for a one day wine and malt license from Paul Gallant of Merrimack College for a donor dinner at Cascia Hall on November 18, 2019 from 5:00PM to 10:00PM Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectmen, acting as Licensing Commissioners, approve the request of Merrimack College for a one day wine and malt license for a donor dinner at Cascia Hall on November 18, 2019 from 5:00PM to 10:00PM. Motion approved 5-0. Change of officer and change of ownership interest application for an annual restaurant all alcohol beverages license for the 99 Restaurant of Boston, LLC d/b/a 99 Restaurant & Pub This request has already been approved by the state. Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectmen, acting as Licensing Commissioners, approve the request of 99 Restaurant of Boston, LLC d/b/a 99 Restaurant & Pub for a change of officer and change of ownership interest. Motion approved 5-0. Request for eleven one day wine and malt licenses and waiver of the police detail from Tricia Dunphy of Smolak Farms for the following events: 1. Wine and centerpiece making night in the barn on November 15, 2019 from 6:00PM to 8:00PM 2. Wine and centerpiece making night in the barn on November 20, 2019 from 6:00PM to 8:00PM 3. Christmas festival in the tent on November 29, 30 and December 1, 2019 from 11:00AM to 5:00PM 4. Winter festival in the tent on December 7, 8, 14, 15, 2019 from 11:00AM-5:00PM 5. Wine and wreath making in the barn on December 13 and 17, 2019 from 6:00PM-7:30PM Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen, acting as Licensing Commissioners, approve the request of Tricia Dunphy of Smolak Farms for eleven one day wine and malt licenses for events on November 15, 20, 29, 30, December 1, 7, 8, 13, 14, 15, and 17, as presented and waive the police detail. Motion approved 5-0. Request of Elizabeth Santana for a fortune teller license at 75 Park Street, Unit 316 Ms. Santana explained that she is working out of her home and will be scheduling readings in the common room at Stevens Corner. Chris Nobile made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen, acting as Licensing Commissioners, approve the request Elizabeth Santana for a fortune teller license at 75 Park Street, Unit 316. Motion approved 5-0. Chris Nobile made a MOTION, seconded by Phil DeCologero to close the meeting of the North Andover Licensing Commission. Motion approved 5-0. Board of Selectmen Minutes November 12, 2019 4 OLD BUSINESS Assignments for Board liaisons Included in the packet was the list of Town Boards and Committees. The Board reviewed the list and pick which boards each would like to be the liaison for. Assignments for FY21 goals Included in the packet was the list of the Board’s goals as decided at their strategic planning meeting. The Board reviewed the list and decided which member will be the lead for each goal. NEW BUSINESS None TOWN MANAGERS REPORT The Board was provided with the job posting/vacancy log. SELECTMEN’S UPDATES/COMMENTS Ms. Smedile asked the public for help in assembling the wreaths for the light posts. They will be th assembling them on Sunday, November 17 at 1:00pm at the old museum of printing. ADJOURNMENT Chris Nobile made a MOTION, seconded by Phil DeCologero to adjourn the meeting at 8:30PM.
