Admin. Marie Boudrot, Sec. The following minutes were approved December 7, 1988 - December 10, 1986 March 9, 1988 - May 18, 1988 and April 20, 1988 Paul Tariot motioned we accept the above minutes as amended. B. Sousa seconded, motion carried. Marco Rubber - Reg. for Cert. of Compliance A. Resca. stated that the lot is on hold dur to the fact that the grass is not grown, therefore, the Certificate of Compliance is on hold. No vote taken. Hawkins Lane - Siaxuaaion on Proposed Addendum P. Tariot motioned they adopt the addendum to Hawkins Lane covering the road crossing culvert design on 242-388 Salem Forest III. Bill Sousa seconded, motion carried. Lot 1 Essex Street Discussion of Planning Boards concerns of Order of Conditions (#242-259) This project has been in litigation with the Planning Board for quite some time. P. Tariot motioned to issue a one year extension to the Order of Conditions for Lot 1 Essex Street. Extended until April 1, 1990. B. Sousa seconded, motion carried. Lot BB Middleton Street - Certificate of Compliance P. Tariot motioned we issue a Certificate of Compliance on Lot BB Middleton Street Bill Sousa seconded, motion carried. Lot 1 Berry Street/Lot 2 Turnpike - Discussion of Proposed Revisions Bill Bergeron from Hayes Engineering attended the meeting. The reason for this meeting was for the NACC to give their opinion on the proposed revisions as this project is presently in Planning. It was decided that Lois Bruinooge would review the file and a letter would be written. No vote taken. 1 Long Pasture This meeting is in response to Phil Christiansen's letter. An abutter namely Paul Plazinski of 505 Salem Street attended the meeting and presented information to the Commission regarding this project. P. Tariot motioned to indicate to Phil Christiansen r Page -2- Approved minutes of January 18, 1989 that this area is a resource area under the Town Bylaw and therefore protectable under the Town Bylaw. C. Schoene abstained. A. Resca seconded, motion carried. Tro iano Building - Reg. for Determination This area is at the town line of North Andover and Haverhill. The project is to add a bay to an already existing building. A request was made for the staking of the building and the Commission would make a site visit. Tim Tanner explained to the Commission what they were planning to do. P. Tariot motioned to close the public hearing conditioned upon the evidence and authorize the site team to make a decision on the site. Bill Sousa seconded, motion carried. (The site team consisted of Deborah Moore, Carl Schoene, Bill Sousa and Paul Tariot) . It was unanimously voted a Positive Determination on this submission under State Law and Town Bylaw at the site visit on January 28, 1989. Route 114 - Public Hearing Continued from Jan. 4, 1989 It was decided at this meeting that the State Forest Realty Trust would hire a consultant to review the flaggin. Paul Tariot motioned that the Chairman be authorized the expert to be chosen by the applicant and to continue the public hearing. A. Resca seconded, motion carried. Lawrence Municipal Airport - Continued Public Hearing from January 4, 198 (#242-491) Maureen W. Sakakeeny, a project engineer of Edwards & Kelcey Inc. , and Richard D'Agostino attended the meeting with their plans. (Work had already been done) . It was requested by the Commission that 1. A plan merging the general plans presented be prepared to provide a clearer more precise representation of the work. And 2 a discussion of plans for the parking lot gas traps be prepared. P. Tariot motioned we close the public hearing and issue a decision upon receipt of the referenced pland and discussion addressing contaminates from the apron, twenty-one (21) days after receipt of the information. Wintergreen Estates/Rocky Brook Estates - Public Hearing - Req. for Determination This Determination was presented by Vincent Grasso, Peter Breen and Tyler Munrow. The purpose of the analysis was to determine whether or not a small depression vegeted with wetland species meets the requirements necessary to be classified as an Isolated Land Subject to Flooding as defined in the Wetlands Proteciton Act. P. Tariot motioned we close the public hearing and authorize a site visit team to make a Determination after walking the site. D. Moore seconded, motion carried. The site-visit team (D. Moore, C. Schoene, B. Sousa and P. Tariot) , unanimously; voted a Negative Determination under both the State Law and Town Bylaw at the site visit on January 28, 1989. Leland Properties This was to review a drafted letter by Loise Bruinooge of the NACC's concerns after a hearing had been held in Boston with DEQE. A copy of this letter would be sent to all i concerned. It was decided by the Commission at this time not to hire an outside consultant. P. Tariot motioned not to hire an outside consultant at this time. D. Moore seconded, motion carried. Page -3- Approved minutes of January 18, 1989 Lot 64 Haymeadow Road - Discussion of Order of Conditions Jack McQuillkin of Yankee Engineers in Methuen attended the meeting. He propsed putting a pier into the middle of the stream as opposed to a clear span crossing of the bordering vegetated wetland and stream. P. Tariot motined that the Commission reject the proposal which involved putting a pier into a resource area. D. Moore seconded, motion carried. North Andover Business Park - Willow Street - Extension Tom Neve of Neve Associates and James Bourgeois of Bayfield Co. attended the meeting to present alternatives for the crossing in this lot. Alternatives A, 9 and 10 were the most promising of all the plans presented. It was decided to schedule another site visit and invite Ogan Foods prior to our having to make a decision two weeks from tonight. Lots 37 & 38 Sawmill Road - Follow-up It was decided that Willie would write a letter to the owner discussing the Commission's site visit decision against an additional driveway wetland crossing. P. Tariot motioned to pay the Pickett & Miyares Bill of $135,50. L. Bruinooge seconded, motion carried. i Meeting adjourned at 11:20 P.M.
