HomeMy WebLinkAbout2002-08-14 Conservation Commission Minutes 1 Conservation Commission Meeting August 14,2002 Board Members Present: Scott Masse, Chairman Albert Manzi Jr., Vice Chairman Robert Mansour John Mabon Absent Board Members: Joseph Lynch Jr. Deborah F'eltovic Beth Wescott Staff Present: Julie Parrino, Conservation Administrator Alison McKay, Conservation Associate Donna Wedge, Conservation Secretary Meeting came to order at 7:00 PM Quorum Met General Business DEP#242-784 Lot 26 Thistle Road Ben Osgood present at meeting for the modification request. Ms Parrino stated siltation beyond hay bale and recommended all erosion controls be replaced. Ben Osgood stated all wetland flags have been replaced in the plan. Recommendation to grant Lot 26 modification with conditions to replace EC and remove silt from breach area. Modification motioned by Albert Manzi, seconded by John J. Mabon. Vote: Unanimous. DEP9242-784 Lot 40C Thistle Road Ben Osgood present at meeting for modification request. Ms Parrino stated all erosion controls should replaced, wetland flags were reviewed in the field. Modification motioned by Albert Manzi, seconded by John J. Mabon Vote: Unanimous. DEP#242-784 Lot 28 Thistle Road Ben Osgood present at meeting for modification request. The deck was originally inside the 50' no build zone and is now proposed outside of the 50' no build area. Ms Parrino stated all the erosion controls must be re-established. Modification motioned by John J. Mabon, seconded by Albert Manzi. Vote: Unanimous. 2 DEP#242-784 Lot 33 Thistle Road Ben Osgood was present at meeting for modification request. Ms Parrino stated breach in erosion controls, siltation must be removed immediately and erosion controls re- established. Modification motioned by John J. Mabon, seconded by Albert Manzi. Vote: Unanimous. DEP#242-441 Lot 2 Long Pasture Steven Crowley was present at meeting for COC. Ms. Parrino stated house construction outside of the buffer zone. A portion of the driveway is in the buffer zone. Original approved plan has a different driveway configuration outside of the buffer zone. Work in the buffer zone is minor. Ms. Parrino stated site is stable. Scott Masse stated applicant should request a modification for driveway re-configuration. Motion by Albert Manzi to issue a PCOC upon written request of a modification seconded by Jack Mabon. Vote: Unanimous, DEP#242-441 LOT-5 Long Pasture Ms. Parrino explained work on lot 5 includes a driveway which is not located in the buffer zone. Work on lot 6 is located is located in lot 5 has received a PCOC. Ms. Parrino stated this is an administrative approval. Motion to grant PCOC by Albert Manzi, seconded by Robert Mansour. Vote: Unanimous. DEP#242-1045 North Andover High School Nick Reitzel present at the meeting for request of a modification. Ms. Parrino presented an overview of the consultants review letter. Lisa Eggleston staffed the stormceptor unit is an equivalent technology, Ms. Eggleston noted stormceptor smaller may require more frequent cleaning. Al Manzi stated concerns with the need for more frequent cleaning. Nick Reitzel stated he can enlarge the unit to provide the same volume as the approved unit. Upon completion of 8 nap drawings he will submit a copy to Lisa Eggleston for review. Albert Manzi motion to grant modification provided equal volume storage be provided and reviewed, seconded by Jack Mabon.-Vote: Unanimous. DEP4242-1107 269 Barlceiā€¢Street Ben Osgood was present at the meeting for a request for a COC. Alison McKay an overview project and stated that the site is stable recommended to issue COC.Motion by Albert Manzi to issue COC. Seconded by Jack Mabon. Vote: Unanimous. Recess for 15 mins Public Hearing 8:00 PM RDA Waverly Road (Barrett)(Epsilon) Mike Howard present at meeting for William Barrett for the request for determination of applicability to determine the presence or lack thereof wetland resource areas. Ms. 3 Parrino did two inspection of the property with Mike Howard from Epsilon Associates. Ms. Parrino stated extensive soil plots were conducted on site to determine the presence of hydrie soils, there is flow from the up gradient property, a ditch is located on the property up gradient which discharges to the project site. Water collects in a small area on the property, however hydrology is not strong enough to form hydric soil a culvert from Waverley Road also deposits water into the property. The questionable area would not qualify as a resource area under the Wetland Protection Act or Bylaw. Albert Manzi motioned to issue a negative determination of applicability stated no areas subject to jurisdiction exist on site seconded by Jack Mabon. Vote: Unanimous. DEP#242-1158 100 Andover By Pass Paul Marchionda was present at meeting. Ms. Parrino told the board members that the applicant filed all necessary NOI paper work recommends closing the public hearing, Motioned to close hearing and issue decision in 21 days by Albert Manzi seconded by Jack Mabon. Vote: Unanimous. DEP#242-1164 193 Gray Street Applicant submitted a written request to continue to 8/28/2002. Motioned by Albert Manzi seconded by Jack Mabon. Vote: Unanimous. DEP#242-1156 129 Forest Street Peter Flink from Griffin Engineering was present at meeting. Peter Flink presented and overview the proposed garage, front entry and the replacement of the mudroom and revised deck. Installing 2 dry well units to handle the roof runoff. Ms. Parrino stated a COC and as-built plan submitted in 1993. Since then appears vegetation removed and dog pen construction has taken place in the 75' no-disturbance zone. Mr. Tricket stating his dog has passed away and the dog pen will be removed. Continued to 8/28/2002 for acceptance of stamped plans Motioned by Albert Manzi seconded by Jack Mabon. Vote: Unanimous. DEP#242-1157 Eastside Interceptor High Street Relief Sewer Ms. Parrino has concerns because they will be crossing the brook by the High School. Ms. Parrino wants on site monitoring with the 25' no disturbance area of the brook Some Flag's were disturbed Flags 16 and 17 must be replaced. Motioned by Albert Manzi seconded by John J. Mabon. Vote: Unanimous. DTP#242-1157 Phase 3 Sewer, Dale Street & Glencrest Drive Lou Mammolette was present at the meeting. Lou Mammolette per series of Flags H-Z are located on S. Bradford Street and Smolocks Farm.. Work will be done all on the road with fence and hay bales. Ms. Parrino wants filter system to have environmental monitoring on all the work being done on the road. John Mabon asked what is being done here. They will be using PCP pipe to save the town gravity on the sewage line to two houses and also 1 house up on top. Mr. Larry Small address is 807 Dale Street he asked information on where is the pumping station going to be. Lou Mammolette said the pumping station will be on the other side of Meeting Commons where the Christmas Tree 4 Farm and Coventry Lane are located. Mr. Joseph Piturio address 815 Dale Street said that the road was just paved and they will be digging the road up again after it was just paved. John Mabon suggested this be continued pipe and wetland area should be included in the plans. Motioned by Albert Manzi seconded by John J. Mabon. Vote: Unanimous. DEP9242-1160 Phase 4 Sewer Osgood Street, Great Pond Road,Marbleridge Road, Abbott Street Lou Mammolette present at meeting. Ms. Parrino has limits on the roadway in the center of the road must have erosion controls this must be done. Albert Manzi and John Mabon this is adjacent to wetland area trust be double piping here all the time if gravity feed. John Mabon said if PCP pipe being used here must have double capped in crossing and 25' Ft plus in the crossing. Robert Mansour said he did not like concrete. Albert Manzi stated modification request needed. Continued to 8/28/2002 Motioned by Robert Mansour seconded by Albert Manzi. Vote: Unanimous. DEP#242-1159 383 Johnson Street Mike Howard was present at the meeting representing William Barrett. Mr. & Mrs. Sparks who are abutters to the property were also present at the meeting. All the work being done here is outside of the Wetland area it is 150' from the Wetlands. Notice of Intent by the property within the buffer zone violations corrected vegetated and replanting has been done. Ms. Parrino has no problem with planting plans further planting for the neighbors in the fixture Ms. Parrino can do a site visit to check on planting. Ms. Parrino complying an order of condition of enforcement. Mr. David Rand was present at meeting lie manages the cemetery they have had flooding and he does not want any more flooding. Issue decision in 21 days Motioned by Robert Mansour seconded by Albert Manzi. Vote: Unanimous. DEP#242-116210 Cominerce Way Richard Grasso was present at meeting. Scott Masse said Ms. Parrino has to leave the room because she was working on the project when she was working for Hancock Engineering. Scott Masse said this would be a conflict of interest Ms. Parrino will not take any part in this project. Alison McKay will be taking over she needs to review the Plans because she has not worked on this project yet. DEP requires storm water management. Albert Manzi recommends to contact Natural Heritage Pat Hickory. This site had partial building back in March all was confrrtned was in buffer zone. The car wash needs a parking lot which is near a pond which supports rare turtles. The parking lot will have no run off the water is recycled water in car wash. Scott Masse wants Alison McKay to review escrow account. Robert Mansour building line to wetland line note has no change Flags are marked. Ms McKay said has been existing building approved by the Commission in March. Continued to 8/28/2002 Motioned by Robert Mansour seconded by Albert Manzi. Vote: Unanimous. DEP#242-1163 173 Campbell Road John Moran and Gary Adams present at tnecting. Ms. Parrino stated that the detached garage in the buffer zone. The wetland line reviewed and has been approved. A very large slash pile observed just up gradient of flags 114 and 113, should be removed. 5 Disturbance in the vicinity of the proposed garage has occurred, including clearing. A hay bale silt fence line should be installed along the front of the property to prevent erosion into the road. Issue decision within 21 days. Motioned by Albert Manzi seconded by John J. Mabon, Vote: Unanimous. DEP#242-? 170-172 Sutton Street Ray Sanatilli was present at meeting. Ms Parrino stated NOI for construction of addition to an existing building located in the riverfront and the buffer zone on bank. The Town of North Andover owners the building town is exempt from filing fees. The Iine must be fully re-established in the field by a survey. The addition of a variance with ZBA in order to comply with state and local setbacks. The building is 50 feet from the mean annual high water mark. Ms. Parrino suggested erosion controls be proposed. Decisions DEP9242-1151 429 Marble ridge Road Ms Parrino discussed conditions she said site is disturbed suggested to issue OOC. Motioned by Albert Manzi seconded by John,I. Mabon. Vote: Unanimous.
