Scott Masse, Chairman, Albert Manzi Jr., Vice Chairman, Joseph W. Lynch, and Robert L. Mansour Board Members Absent: John J. Mabon, Beth Wescott, and Deborah Eeltovic Staff Present: Alison McKay, Associate, and .Donna Wedge, Secretary Staff Absent:. Julie Parrino, Administrator Meeting came to order at 7:00 pm General Business 242-964 C®C &Bond Release 345 Berry Street Goudreault (Cont. from 9/12 The applicant was not present at meeting. Ms. McKay stated that an appropriately sized riprap had been installed at both pipe locations as noted on her inspection, Mr. Mansour questioned the size of the rocks. Ms. McVay indicated the size of the rocks used. Joseph Lynch motioned to issue COC, seconded by Albert Manzi Voter Unanimous. 242-894— C+OC Lot 13 36 Beaverbrook Road Mahalati Hancock Environmental The applicant, Mr. Mahalati, was present for the hearing. He said he had been referred by the Conservation Department to hire Hancock Engineering. Mr. Manzi noted that Ms. Parrino would not be involved with the project due to a conflict of interest. Ms. McKay would act on behalf of Ms. Parrino. Ms. Parrino was absent. The original filing was for the construction of a single family home, septic, driveway and utilities in the buffer zone to a vernal pool resource area. A certified plot plan was previously submitted and an As-built Plan stamped by an engineer was submitted certifying the location of the septic system. Upon completion of the As-built plan, the location of the deck was determined to be in the No-Build Zone, Ms. McKay stated the site was stable and the 25-foot No Disturbance area behind the fence was vegetated. Mr. Mansour stated there were inconsistencies on the plan as to the location of the approved wetland line and that shown on the as-built plan. He also mentioned that the As-built Plan needed to be stamped by a registered P.E and needed at least spot topography shots. Mr. Mahalati asked that he be informed of the actions needed for compliance. Mr. Manzi said that Ms. McKay would write a letter indicating the additional information needed for compliance. Mr. Lynch moved to deny the request due to the lack of information presented and plan inaccuracies and delinquencies, seconded by Albert Manzi. Vote: Unanimous. 242-1091- Modification & C+OC 980 Winter Street Bill Barrett Bill Barrett of William Barrett HoYnes was present for the hearing. Ms. McVay said the original project filing was for the replacement of a failed septic system at the front of the existing house, t 2 the connection to an existing water main and the reconstruction of the existing house foundation. Two modifications were requested and were approved in house. New plans had been submitted to reflect these changes. The second modification was for the construction of a paved driveway and the reconstruction of a previously approved retaining wall to include a set of stairs to facilitate access from the driveway to the front entrance to the dwelling. The proposed driveway adhered to the 25-foot No-Disturbance Zone. A revised plan was submitted with a request showing all modifications since the original filing. The work has been completed in accordance with the approved Order and the modifications with the exception of a stone retaining wall constructed along the southerly side of the driveway, and a driveway extension approximately seven feet further easterly, parallel to the wetlands, The applicant has submitted a modification letter to accompany these minor changes. The site is stable and appears to be in conformance with the proposed and the as-built plan. Joseph Lynch motioned to issue a modification, seconded by Robert Mansour. Albert Manzi moved to issue a COC, seconded by Joseph Lynch, Vote: Unanimous. The Commission took a 15-minute recess. 8:00 p.m. - Public Hearings Re uest for Determination of Applicabilt 350 Summer Street (AIibrandi) (Hancock Environmental) John Dick from Hancock Environmental was present along with the applicant, Ms. Alibrandi. Mr. Dick said that minimal disturbance was proposed. He explained that proposed work included the replacement of the existing deck with an addition. The addition would have a full foundation and would be approximately 81 feet from the wetlands. Scott Masse indicated that Ms. Parrino would not be involved with the project because of a conflict of interest. Ms. McKay would act on her behalf. Ms. Parrino was absent. Ms. McKay said that the applicant had submitted a RDA for the project because there was still an open Order of Conditions for other work being performed on the site. The Order was issued on August 1, 2001 for the construction of an inground swimming pool, a concrete retaining wall, a timber retaining wall, associated grading, a pool shed, a drainage swale, a boulder retaining wall along the 25 foot No-Disturbance Zone and complete restoration and revegetation of a previously disturbed area within the 25 foot No Disturbance area. A swing set and associated play area was approved in-house to accompany the work. The entire play area was proposed outside the 50-foot no-build zone with no significant grade changes. Ms. McKay recommended adding a second row of hay bales at the top of the slope around the work area or stockpiling material in a location away from the proposed work outside the buffer zone. Ms. McKay discussed these options with the applicant and either option was agreeable. Mr. Mansour questioned the stockpiling area on the plan. Joseph Lynch moved to issue a Negative Determination with the conditions to add erosion controls in a location approved by the Conservation Department and to require an as-built plan for all the work completed under this filing as well as under the Notice of Intent filing, seconded by Albert Manzi. Vote: Unanimous. 242-1162- 10 Commerce Wa Grasso Hancock Environmental 3 The applicant had requested, in writing, to continue to the October 9, 2002 meeting. The Commission questioned if applicant had set up the Escrow Account. The applicant had not yet posted the escrow account. Joseph Lynch motioned to continue to the October 9, 2002 meeting, seconded by Albert Manzi. Vote: Unanimous. 242-1165- 117 Milk Street (Galaher) The applicant, Mr. Galaher was present at the hearing. Ms. McKay said that the applicant had sent out the abutter notification letters by certified mail, as required. Incorrect notification was the reason for the hearing continuance. Albert Manzi motioned to close the hearing and issue a decision in 21 days, seconded by Robert Mansour. Vote: Unanimous. 242-1170- 215 Old Cart Way (Checkowav) (New England Engineering) Mrs. Checkoway, the applicant, was present at meeting. Upon her inspection, Ms. McKay indicated that her only concern would be the stabilization of the proposed slope. She recommended the installation of a jute mat to provide additional stabilization of the slope. The DEP had issued a file number. This was the only reason for the continuance. Ms. McKay recommended a$1000 bond for this project. Mr. Lynch moved to close the hearing and issue a decision within 21 days with the condition to install a jute mat on the slope, seconded by Albert Manzi. Vote: Unanimous. Decisions 350 Summer Street Alibrandi Hancock Environmental Close and issue a negative determination with conditions to add erosion controls, require a designated stockpiling area outside of the buffer zone, hold a pre-construction meeting and require an as--built plan of all work included in both filings. Joseph Lynch moved to issue a Negative Determination, seconded by Albert Manzi. Vote: Unanimous. 242-1165 - 117 Milk Street (Galaher) Albert Manzi moved to close and issue a decision within 21 days, seconded by Robert Mansour. Vote: Unanimous. 242-1170 -215 Old Cart Way (Checkowav) (New England Engineering) Joseph Lynch moved to require a jute mat for the slope and to post a bond for the amount of $1,000 seconded by Albert Manzi.
