The 11 remaining Portion of Lot A will be conveyed to the owners of Lot 8B and the remaining portion of Lot 8A will be 12 conveyed to the Owners of Lot 8B. 13 Peter Barbieri,Fletcher Tilton PC: A one acre lot is being created for the existing house; two parcels will be 14 marked unbuildable with the remaining acreage(4 acres)going to the farm parcel. Frontage meets zoning. 15 MOTION: J. Simons made a motion to direct the Staff Planner to sign the mylar on behalf of the Board for the 16 Form A for 115 & 125 Windkist Farm Road,North Andover, MA. A. Preston seconded. The vote was 5-0, 17 unanimous in favor. 18 19 4 High Street—AvalonBav Communities,Inc.: Application for Subdistrict A Definitive Master Plan Special 20 Permit in accordance with The Town of North Andover Zoning bylaw Section 195-18.20. The Applicant proposes 21 construction of a inarket-rate rental multifamily residential community to be known as Avalon North Andover, 22 consisting of a total of 200 studio, one, two and three-bedroom units to be contained within three(3) separate 4 23 four&five(5)story buildings and clubhouse comprised of approximately 111,221 sq.ft., approximately 113,603 24 sq.ft. and 5,142 sq. ft. along with an outdoor pool,parking, stormwater management facilities, landscaping, 25 signage and other improvements to be located on approximately 9.44 acres of land. This project is located within 26 the Downtown Overlay District A: Historic Mill Area(underlying Industrial—S (I-S)and Residential 4 (R-4) 27 Zoning Districts, with all buildings proposed within the boundaries of the underlying I-S District). 28 David Gillespie,AvalonBay& Steve Schwarz: Addressed items from last meeting. Architecturals were submitted 29 showing four stories and 170 units;civil is updated, landscape plan has been provided, peer reviews are complete. 30 Several balconies were removed from the buildings, i.e. near the Granite Building and clubhouse overlooking 31 abutters. Avalon met with Sutton Pond to review gas and water lines noted on the plans and submitted a WB50 32 truck turning analysis. Unit totals have been reduced to: (15) studios,(65) I-bedroom, (82)2-bedroom and(8) 3- 33 bedroom units; resulting in (31) school aged children. Avalon reviewed screening to neighbors' yards and Sutton 34 Pond; open to discussion regarding fences or trees. Assured abutters that based upon geotechnical review there 35 will be no need for blasting on site. 36 Ed Bradford,AIA, TAT: Reviewed architectural drawings and proposed materials. 37 Sally Fimrimore,90 High Street: Prefers walkability be improved in the area, i.e. sidewalks to high school along 38 Prescott St. Inquired about runoff; it was noted that specific fill is outlined in the Decision. Fence discussion was 39 height specific; six ft, or less requires building permit. 40 Barbara Suhr, 148 Main Street: Asked who will pay for building damage if incurred, i.e. cracks in the Sutton Pond 41 Building foundation?It was explained that if that were to occur it would be resolved between building owners. 42 Bob Dufault, 148 Main Street: Questioned validity of geotechnical engineer. Access to the site will be via a temporary roadway 47 as outlined in the Conditions of the permit. 48 Kim Pass, 110 High Street: Concern for excess material hauling to and from site on congested High Street. 49 Requested clarification of five foot retaining wall on site facing abutters. 50 Jill Barker, 181 High Street: Concern for size and scale of project. Wondered what happened to the discussion 51 amongst the Board limiting the building height to three stories and 150 units. 52 Betsy Cote 116 High Street: High Street needs to be repaved. Questioned whether it can be widened and with 53 curbs?Inquired how Town will get to its 10% quota on Affordable Housing recognizing this project is not 54 contributing? 55 B. Dufault, 148 Main Street: Believes project is too big for this area. 56 Margorie MacLean, Stack: Project is too large,traffic is terrible, it's much too dense of all area to build this. 57 MOTION: J. Simons made a motion to close the public hearing for 4 High Street,AvalonBay Communities,Inc. 58 A. Preston seconded the motion.The vote was 5-0,unanimous in favor. 59 MOTION: I Simons made a motion to approve the Subdistrict-A Definitive Master Plan Special Permit for 4 60 High Street-AvalonBay Communities Inc., as amended. The vote was 4-1, in favor. 61 (K Bargnesi opposed) 62 63 NEW PUBLIC HEARINGS 64 505 Sutton Street Modification: Application for Special Permit Modifications—Site Plan Review Multifamily 65 Housing,Height Waiver, and Common Driveway, under Sections 195 -4.8.0, 195 2.2, 195 7.4, 195-8.8, Section 66 195-8.10 of the North Andover Zoning Bylaw and MGL c. 40A, Sec 9, to revise the Notice of Decisions and site 67 development plans to reflect the proposed 3-story building to the rear of the parcel (Building 3)and a 4/3-story 68 building to be situated along Sutton Street(Building 1). The Applicant proposes to convert the existing building into a four(4) unit 89 multifamily structure with parking for 8 cars at the rear and north sides of the property. This project is located 90 within the Residence 4 (R-4)Zoning District 91 Rick Byers,Attorney: Provided an overview of the history of the project. Approval from the ZBA for four 92 residential units has been obtained. The parking triggered Site Plan Review. Reviewed parking plan; seven spaces 93 are required-eight are shown on the plan;tandem style.There are two one-bedroom units and two three-bedrooms. 94 M. Gregoire: Planning has not received the stormwater report;there is an increase in impervious surface, 95 Conservation has concern regarding roof drain locations and pitch of the site. Town Engineer has concern for 96 driveway width; standard is 25 ft.; applicant is asking for 27 ft. (A variance was obtained for the 25 ft.) Sidewalk 97 improvements were discussed. 98 T. J. Melvin, Morin Cameron:No increase to the footprint of the building. Mentioned pervious pavement as an 99 option. Pence screening and plantings could be entertained alongside the parking areas. 100 D. Schei ers 266 Middlesex Street: Spoke in favor of the project; prefers no street parking near the stop sign. 101 Parking shown is safer than what is existing. 102 John Camozzi, 283 Middlesex Street: Complained about the pitch of the site and water issues. I have water in my 103 basement and am afraid I will just get more. Inquired about odd/even parking-no sign posted. 104 Louis Capobianco,280 Middlesex Street: Parking is problematic; requested a"no parking"sign to the corner of 105 the street. Visitors will be parking on the street in front of my house. I have four cars in my driveway and a trailer 106 home to get in and out.The gas line will be on the sidewalk and they need to study that intersection. 107 Joseph Stewart, 281 Middlesex Street: Spoke in support of project. Enright: Requested the Chair take the item as a discussion item. This is a 3 lot Land Disturbance Permit. The lot 115 we are referencing tonight is 1995. Limit of work was violated. Trees were removed in the riverfront and some 116 clearing occurred up the hill to the rear of the Iot. Conservation Commission has left it up to the administrator to 117 implement a restoration planting plan for the riverfront and I would imagine Planning would request a planting 118 plan for the hill area. A Certificate of Occupancy is being held rip pending the Board's review. 119 M. Gregoire: Reviewed the restoration plan for replanting. 120 T.J. Melvin,Morin Cameron: Reviewed the replanting plan and caliper of trees. Site is currently stabilized. 121 J. Enright: Project is currently bonded for$1 OK. An additional $1 OK should be sufficient to cover the driveway 122 paving and additional planting required. Conservation has an additional bond for$7,500. 123 MOTION: P. Boynton motioned to approve the Insubstantial Change to the Land Disturbance Special Permit for 124 1995 Salem Street with the requirement that the planting plan and installation be approved by Conservation and 125 Planting by May 15,2020 and a$10K bond be established for the project in addition to the original bond. No changes are proposed to the property 132 for structures. This project allows us to move ahead with East Mill 135 Pond Building project and eventually Phase 3 (89 units over the existing parking garage). Gregoire: The application has gone out for department review. The fire department requested that a new fire hydrant be located 158 on site due to that fire; The Applicant and Fire Chief visited the site and a hydrant location has been determined. 159 No other modifications are required.
