Application for a Site Plan 29 Review Special Permit under Article 8,Part 3 and Article 10 § 195-10.7 of the North Andover Zoning Bylaw. The 30 Applicant proposes the creative reuse and conversion of the Grange Hall in the Old Center to three residential 31 units, cojrstruction of retaining walls, storinwater management, and creation of associated parking spaces. No 32 exterior alterations are proposed. The parcel is located within the Residential 3 zoning district. 33 A. Caffrey, Requested a Continuance; Applicant is working on parking and circulation design. Appears 34 before Zoning 219121 and would like to meet with Planning Board after that. 35 [No Evidence Heard-Continued to the Februaiy 23, 2021 Planning Board meeting] 36 37 419 & 435 Andover Street, Crosspn nit Associates,Inc.: (Read the Governor's Order into the record). 38 Application for a Site Plan Review Special Permit under Article 8, Part 3, including Parking Special Permit under 39 Article 8 Part 1, and Article 10 § 195-10.7 of the North Andover Zoning Bylaw. The Applicant proposes to 40 redevelop the properties located at 419 and 435 Andover Street by demolishing the existing Ethan Allen and the 41 Bliss Spa and Salon building and constructing two smaller buildings with a total square footage of 10,852 SF to 42 house new commercial tenants. Four businesses are proposed on the property: the existing Bertucci's Restaurant, a 43 coffee shop, a medical office, and a bank. Both the coffee shop and bank are proposed to have drive-thru 44 operations. The parcels are located in the General Business Zone. 47 J. Enright: Draft decision has been updated to reflect the Board's discussion. Applicant has requested project 48 engineer perform construction monitoring services and has provided suggested language for a revised Independent 49 Monitor Form. Building Commissioner confirmed he has not rec'd complaints related to Bertucei's in the past, 50 that the existing ADA spaces comply and the new construction will not create a traffic/safety issue with 51 implementation of proper barriers and signage. Since the last meeting,the Applicant has asked for flexibility in 52 terms of whether combining the lots would be required. To date, it has been understood that the lots would be 53 combined. The draft decision includes a condition related to an ANR Plan. If the lots are to remain under separate 54 ownership a Common Driveway special permit would be required. The applicant now prefers to allow for the two 55 separate lots to remain thus not requiring an ANR 56 Board: Discussed original application calling for lot consolidation of two lots. An agreement would need to be put 57 in place to address an operations and maintenance plan, shared parking, easements,etc. Applicant needs to return 58 to Board with all required documentation related to separate ownership, Common Driveway SP, including solid 59 agreements on all cross easements. Board questioned how two lots owned by different entities might successfully 60 resolve issues such as queueing, drainage, parking, maintenance issues, as they arise if they are not in common 61 ownership?Board wondered if a Common Driveway SP suffices with three access points to the parcel. Will both 62 parties have full access between lots or do lots entertain limited access? Board discussed Independent Monitor 63 Form edits and precedent this sets for other fixture projects. 64 J. Enright: Read abutter comment from Seth Bedard, 14 Highland Terrace,NA,received @ 7:13 p.m.: Concerns 65 for safe access to Route 125 exiting Highland Terrace. Seeks clear signage marker in street. 66 E. Goldberg: Applicant may return to the Board with all concerns addressed; concise plan,agreements regarding 67 two lots with access easement agreement, maintenance concerns identified, O&M Plan agreement signed by both 68 parties, all access and parking requirements addressed appropriately and a Common Driveway Special Permit 69 application. Enright: Retail is allowed as an accessory use in B4; GB entertains broader uses. 83 Alex Loth: Presented suggestions to the CDD2 District removing restrictions to allow for more flexibility and 84 include drive-through operations, stating that post-Pandemic this will be an evolving trend. This project will likely require a Special Town Meeting as zoning changes required are 100 unlikely to be resolved and ready to be presented prior to May 18.
