She has generated another round of comments based on the revised plans. • Ben Osgood,Ranger Engineering presents the proposal for the construction of a single family dwelling with associated driveway. The driveway will cross the wetland using an arch culvert. A temporary disturbance is required for the installation of the utilities under the arch culvert. Approximately 450-s.f of alteration is proposed with 950-s.f of replication . More than a 2:1 ratio of wetland replacement is proposed. A retaining wall is proposed along the edge of the 25-foot NDZ. A detailed plan of the wetland replication area and a plan depicting the construction sequence for the construction of the crossing is presented. The construction of the replication area will be done in conjunction with the utility sleeves. 2021-10-27 Conservation Commission Minutes Page 2 of 9 Approved 1112212021 • Mr. Lynch questions if test pits have been conducted. It was confirmed that the roads in this area did not receive street acceptance. A letter was received from the Director of Public Works stating the DPW does not have any jurisdiction with regards to the roadway standards. They recommended this question be directed to Planning/Zoning. The Commission needs to know what standard improvement to the roadways is going to be done. • Mr. Osgood states test pits should be performed within the next few weeks. • Mr. Mabon questions if they propose to leave the tree line intact other than for the access way. • Mr. Osgood states some clearing of vegetation will be required for access to the lot. Additional canopy and shrub clearing will be required along the existing tree line which is outside of the 25-foot NDZ. • Mr. Lynch states stream stats were calculated, and the stream was confirmed as an intermittent stream. • Mr. Manzi questions if the Administrator agrees with the measurement for the span to width ratio. • The Administrator states she agrees with the measurement but requires accurate numbers • Mr. Osgood explains how he calculated the openness/span ratio. • Mr. Capachietti believes the numbers presented exceed the openness area. • The Commission discusses the private way/paper street and the history behind the request for street acceptance,the area in question was never accepted by the town. • Mr. Lynch states if there is a requirement to change the roadway curvature,this will change the way the project is carried out. The area of roadway improvement is within the Buffer Zone. • Mr. Capachietti requests the consultant speak with the Fire Department regarding clear space. He believes based on the calculations of bank disturbance a wildlife study is required to determine if the project meets the standard. • Mr.Napoli requests documentation be provided from the Planning Department regarding the street opening. • Patty Aloisi, 10 Kingston Street expresses concerns with the tree removal, questions what the wildlife study entails and questions how the stream was determined as interinittent. • Mr. Capachietti explains the wildlife study and states the stream status is determined by an analysis. • Mr. Lynch states the stream analysis was reviewed by the Commission and they agree it is accurate. • Mr. Manzi states the trees are not within the Commission 25-foot NDZ, which therefore does not preclude them from being removed. • Andrea,Village Green Board Chairman and abutter questions whether the project needs to be reviewed by the Planning Board. She questions if more than one driveway is proposed for access. • Mr. Osgood states only one driveway is proposed. • Erich O'Neil, 8 Kingston Street, questions if markers are required to mark the 25-foot NDZ and restoration area. He would like to know if a fence has been proposed and what type of plantings will be used for the restoration plantings. He states has a sump pump for his basement that empties out onto the subject parcel. • The Administrator states that a stone wall is proposed at the edge of the 25-foot NDZ,which will be monumented with wetland markers. A planting plan for the restoration area has been proposed. • Mr. Osgood states a landscape wall will be located around the restoration area and a stockade fence is proposed along the property line. • Mr. Manzi states the sump pump must daylight on the abutter's own property and suggests speaking with the project engineer. • Ted Beagen, 10 Kingston Street questions whether the parcel has the required amount of frontage. • Mr. Osgood states a land usage table was provided on the plan;it is a conforming lot. • The Administrator reviews the additional information (wildlife study,test pits, check with Planning/Zoning, consult with the Fire Dept. and ensure all numbers are accurate and respond to Administrator's recent round of comments)requested by the Commission. • Mr. Manzi requests the project engineer to add additional restoration area to the proposal. • Mr. Osgood requests to continue to the December 8th meeting. • A motion to continue to December 8, 2021,is made by Mr. Manzi, seconded by Mr. Mabon. • Vote 5-0,Unanimous. As requested,the Applicant secured the services of an attorney to determine if they have the authority to construct within the easement. The easement was never recorded, they believe they have the right to construct in this area. • Mr. Capachietti questions if the reference to the plan creates an easement. • Pushpak Patel,the homeowner is present. • Don Bornstein, Johnson&Bornstein is present on behalf of the Applicant. He explains that a reference to an easement on the plan does not create an easement,there is no separate recorded instrument for an easement. There is additional access to the state land as well as significant public way frontage. • Mr. Manzi questions if there was a reference to the easement on any of the deeds for the preceding owners daring back to 1987. • Mr. Bornstein states there has been no grant of this easement throughout the title change. He reads from a letter from Atty. Timothy Doyle dated October 8, 2021. • The Commission discusses the easement and agrees to accept the evidence provided by the title attorney. They request the information be submitted and annexed to the application. • Mr. Lynch requests that any evidence of the easement be removed from the proposed plan. • Mr. Cowell presents full size plans for the Commission review. A cross section of the retaining wall was provided,the maximum height of the wall is less than 4-feet. The grading contours were revised to accommodate for the wall.A larger stockpile area has been shown on the plan per the request of the NACC. The primary construction access will be the driveway. • Mr.Napoli questions if there is still an outstanding OOC for the subdivision. • The Administrator states there were no subsequent applications for the house lots. The Administrator has drafted an Enforcement Order allowing the Applicant to start work on restoring the slope. A revised plan with enhanced Buffer Zone plantings on the slope was submitted. The Field Inspector has provided recommendations for seed mixes to be used. A post and rail fence has been proposed as a physical barrier. • The Commission discusses the barrier and agrees a steel fence or stone wall is required. • Thorsen Akerley,Williams& Sparages states the homeowner has expressed concerns with the cost associated with a stone wall. • Tate Sahagian agrees to install a stone wall as requested by the Commission. • The Administrator states plant survivorship must be added to the Enforcement Order. • The Commission agrees the slopes must be stabilized and maintained through the winter. The closest point of work is approximately 55-feet from the BVW. The building is proposed to be supported by 24 4x4 footings, which will be sawcut into the pavement. The interior of the pole barn will remain paved. Staff visited the site and agreed with the delineation. She projects a plan/photos depicting the location of the boardwalk and construction sequence. • Mr. Lynch requests vertical posts be installed at the end of the trail to prevent access by ATVs. • The Commission discusses the proposal and agrees it is a good project. • Dave Rand,280 Dale Street expresses concerns with work being performed until the flooding situation due to beaver activity is resolved. He met with the Conservation Administrator,Director of the Board of Health and the Town Manager regarding his concerns. • The Administrator states the Town Manager asked that the Commission continue the hearing to November 17th to allow time for her to conduct a site visit. • Mr. Rand states the Town Manager has an appointment to visit his property on November 3rd. He has expressed concerns to the Health Department regarding the high water table and the increased risk for West Nile virus. He would like the water level back to where they were 100-years ago. He explains to the Commission the reason he believes the water level has risen. It is his belief that if the beaver dams are removed the boardwalk might not be needed. • Dan Mancini, 12 Carriage Chase agrees the water levels have increased in the past three years and expresses concerns with trespassing on his property due to the location of the trail. • 9:04 p.m. Mr. Manzi leaves the meeting. • Mr. Lynch states the flooding is an important issue but does not believe it is related to the trail network or boardwalk improvement. He offers to walk the area over the weekend. • 9:06p.m. Mr. Manzi rejoins the meeting. • 9:06 p.m. Mr. Napoli leaves the meeting. • Rob Jones,FONAT states the project location is downstream of the beaver dam. He believes the area would still be wet due to the perennial stream. • 9:09 p.m. Mr. Napoli rejoins the meeting. • Mr. Capachietti questions if it is possible to work with the Water Department to get a permit for a beaver deceiver. • Mr. Manzi is in favor of the installation of a beaver deceiver. • Glen Aspeslagh, FONAT states there is a pedestrian easement on the 12 Carriage Chase driveway to access the Town Farm property however it has never been shown on any of the FONAT trail guides. He believes the Glennie Woodlot Boardwalk will work in favor of preventing people from accessing the trail via the abutting property. • John Schroeder, 9 Village Way states he is in favor of the proposal. He questions how many people they anticipate will use the boardwalk and how close the trail will be to his property. • Mr. Aspeslagh states he believes the trail will attract a handful of people each day. • Mr. Jones states the trail will be located approximately 15 to 20-feet from the current stone wall. • A motion to continue to November 17,2021,is made by Mr. Lynch, seconded by Mr. Mabon. • Vote 5-0,Unanimous. During a recent site visit Conservation Staff observed turbid water being pumped into the town's catch basin, operations were shut down until the monitoring could resume. A Notice of Intent is expected to be filed for the November 17th meeting. • 9:31 p.m. Mr. Lynch rejoins the meeting. • The Commission discusses the discharge of turbid water and agrees to issue a$100.00 fine for violating the Enforcement Order. The Applicant must maintain discharge control at all times while pumping and a monitor must be on site. Conservation Staff is concerned about the tree and would like them to reestablish the root zone by removing the loam from the trunk and drip edge. The site is stable, and the homeowner needs to apply for a COC. • The Commission discusses the violation and agrees the soil must be removed from around the tree and upon completion of work file for a COC within 30-days. • Mr. Manzi confirms there is no activity taking place within the hatched area shown on the plan. • The Administrator confirms there is no activity taking place in the hatched area. • A motion to amend the Violation letter as discussed is made by Mr. Manzi, seconded by Mr. Lynch. • Vote 5-0,Unanimous.
