HomeMy WebLinkAbout1965-10-13Wednesday - October 13, 1965 Special Meet~n~ The Board of Appeals held a special ~eeting. on Wednesday evening,. October 13, 1966 in the To~n Building. Members present and voting were= Daniel T. O'~.eary,' Oke~rm~; William Morton, SecretaryI Arthur Dr-~mond, John J. Shields and Jamos Dey~. This meeting was called after cons~tation with Town Counsel and after the meeting with the Board of Selectmen on Mcsday evening. Mr. O'Leary explained that he w~ld like to see the Housing Authority get per~ission for their development. Under the ~ay it was presented to us, we had no alternative but to act on it the way we did. The Se~lectman asked the Board if they would go along with it if there wes a way out* They shouldntt have come in under a special permit - they didn't need it. Al~ they had to come in for was a side line variance. That is the interpretation of'Town Ooumsel. Mrs. Donahue, the 01erk, went to the Town Counsel's office and sh~ Mm all of the necessary ~B~ormation. ~e will back up our Board 100%. Town Counsel said this is different frc~ an outsider, a developer comes under Apartment developments. When it is the To~n it c~aes under Section ~15. Mr. Shields said that since it is Federally financed~ it would also come u~er Federal regulation. Their requirements are alot stiffer than ours. Some members of the Board felt they needed mere t~.m* to maMe a decision and that it should he thrashed out mere o~mpletely with the Housing Authority, counsel, etc. At 8:10 P.M. Atty. Finck was contacted by telephone and said he would c~s to the meeting. At 8:20 Atty. Finck a~-A-ive~. A lengthy discussion was held Atty. Finck explained that the Housing Authority has until Friday to make a decision to the State an~ if it isn't done by that time then the Town wi~_l lose out for this y~a~. After thorough discussion in Executive session, Mr. M~rton made the follc~rlng metion~ That the Hoard GRANT a variance in conformity with plans filed under Section 7.23 with the provision that Section 4.1~5 he strictly adhered to and under advisement, find Section Z. 7 not applicable. Mr. Deyo seconded thee motion and the vote was unanimous. This would be in the best interest of the public and the To~n. The meeting adjourned at 10~30 P.~ ~~ ~~ ~ Clerk
