HomeMy WebLinkAbout1965-12-20145 Monday, December 20, 1965 Special Meeting The Board of Appeals held a special meeting on Monday evening, December 20, 1966 at 7:30 P.M. in the Town Building. The following me~bers were present and vot~8: Daniel T. O'Leary, Chairm~_; Will, mm ~k~ton, Secretary; Jmm~s Deyo, Arthur Dru~ and John J. Shields. This meeting was called to act on the petition of John Caron. Caron and Dosald Brasseur, the S~-v.yor, ~ere also present. ware presented to the Board. John Caron arrived later. Atty. Finck, George New corrected plans ~ir. Shields questioned the feasibility of the plan as presented. He looked at the property on Tuesday after the last meeting and observed activity in the b~ilding. There were various types of workmen, incl~,a~-g personnel of the Buila~ Inspector on Wednesday, Thursday and Friday. Be is concerned because he received a phone call fr~n a leading citizen of the town ~o questioned the work that was being done on the house. No building permit was issued yet a letter wes received from the Buil~ Inspector saying a permit wes denied for 4 apartments. The petitioner fails to qualify under the sub-paragraphs of the Zoning By-Law. Where is the off- street parking going to be provided? The father's lot wes mentioned, but what if something happens betwees them? Atty. Finek was perturbed at what Mr. Shields said. He said there is no park*-g problem and that the Building Inspector was not present to defend himself. Parking was further discussed. Atty. Finck explained that parking lies witb~ the province of the Selectmen - they can force the people to find parking space if it is a problem. George Catch explained that the people living in the house now ,m~ have been using the park~ area right along. The biggest percentage of apartments in to~m don~t have parking facilities. M~. Shields explained that no member on the Board voted adversely on the petition last week - 2 abst_~_ned. He said this petition f~s in almost every requirement of conversion. This is not a ~dship. Atty. Finek explained that this conversion is in conformity with the area. John Caron said that this is a business area and a business could come in and wouldn't have to cc~e before this Board at ~ and it might create a worse proble~ tha~ what these apartments would. Mr. Morton said that the area is business and that there is a distinct difference between this petition and others that have come_ in before the Board. John Catch explained that he has plans to put a third apartment in any way. He is replacing the walls and taking off wallpaper. If the permit for 4 apart~ente is not granted, they are going to have a 3-room apar+.w~nt any~. The other part of the building could be used for the business. Mr. Shields made a suggestion that there be some form of right of way created to provide parking, where it is in the family. 146 December 20, 1965 - cont. Atty. Finck said he doesn't th4.~ it can be legally imposed. Mr. Shields said he is in disagreement with converting to x 4-apartments. This is an extremely small lot. It is the responsibility of this Board to see that pro- ~ision is made for perking. Mr. O'Leary said he th~ka this petition has perfect parking facilities, better than others that have been granted in the past. Mr. Shields said that since he has been on the Board they have provided for parking. Atty. Finck said that the decision should spell out that adequate parking be supplied by the petitiQner. The Board then went into E~e~ative session and thoroughly discussed the petition. Mr. Deyo said that the petitioner doesnlt suffer any hardship if it is denied. Mr. Shields said he. thinks there is a need for this type of apartment. Mr. Morton made a motion to grant the special permit. Mr. Shields seconded the motion and the vote was It is to be included in the decision that not less t~a~ four unobstructed parking spaces be provided. AD Clerk
