HomeMy WebLinkAbout2022-04-27 Board of Selectmen Minutes SELECT BOARD MINUTES April 27, 2022 Call To Order: Chair Laura Bates called the meeting to order at 7:02PM in the Town Hall Select Board Meeting Room. Attendance: Chair Laura Bates, Janice Phillips, Clerk Rosemary Smedile, Richard Vaillancourt, Town Manager- Melissa Murphy Rodrigues, Director of Administrative Services- Laurie Burzlaff and Deputy Town Manger- Denise Casey were present. EXECUTIVE SESSION Chair Bates stated the Board will enter Executive Session to conduct strategy with respect to collective bargaining, to consider purchase or value of real estate, approve executive session minutes and declared that an open meeting will have a detrimental effect on the litigating position of the Board. MOTION: Ms. Phillips motioned the Select Board enter into Executive Session pursuant to Massachusetts General Laws, Chapter 30A, Section 21(a)(3) and Section 21(a)(6) to discuss strategy with respect to collective bargaining and considering the purchase or value of real estate. Ms. Smedile seconded. Motion approved 5-0. The Board returned to Open Session at 7:02PM. The open session meeting was recorded. PUBLIC COMMENT None. Request of Mark Bohrer and Karen Kline of the Poet Laureate Committee to use the Town Common on May 21, 2022 (rain date May 28, 2022) from 12:00PM to 5:00PM for the Anne Bradstreet Poetry Contest Awards Celebration (out of order) Mark Bohrer was present at the meeting and explained the upcoming Anne Bradstreet Poetry Contest Awards Celebration. Karen Kline was present at the meeting. MOTION: Mr. Vaillancourt motioned to approve the request of Mark Bohrer and Karen Kline of the Poet Laureate Committee to use the Town Common on May 21, 2022 (rain date May 28, 2022) from 12:00PM to 5:00PM for the Anne Bradstreet Poetry Contest Awards Celebration. Ms. Phillips seconded. Motion approved 5-0. Request from Mayara Reis of Merrimack Valley Black & Brown Voices, Inc. to use the Town Common on May 22, 2022 from 11:00AM to 3:00PM for a Black & Brown-Owned Outdoor Business Market and Request of the Festival Committee to use the Town Common on May 22, 2022 from 7:00AM to 7:00PM for the annual Sheep Shearing Festival and to close Mass Ave from Osgood Street to Academy Road MOTION: Ms. Phillips motioned to approve the request of the Festival Committee to use the Town Common on May 22, 2022 from 7:00AM to 7:00PM for the annual Sheep Shearing Festival and to close Mass Ave from Osgood Street to Academy Road and Merrimack Valley Black & Brown Voices, Inc. to use the Town Common on May 22, 2022 from 11:00AM to 3:00PM for a Black & Brown-Owned Outdoor Business Market. Mr. Vaillancourt seconded. Motion approved 5-0. Request of Al Apperti of the North Andover Athletic Association to use Osgood Street, Stevens Street, Great Pond Road, Pleasant Street and Harkaway Road for the Knights on the Run road race on October 8, 2022 starting at 9:00AM MOTION: Mr. Vaillancourt motioned to approve the request of the North Andover Athletic Association to use Osgood Street, Stevens Street, Great Pond Road, Pleasant Street and Harkaway Road for the Knights on the Run road race on October 8, 2022 starting at 9:00AM. Mr. Nobile seconded. Motion approved 5-0. Letter of support for Congressional Funding application of Merrimack College for a pedestrian footbridge over Route 114 1 SELECT BOARD MINUTES April 27, 2022 Ms. Rodrigues stated Merrimack College contacted North Andover to partner with them in requesting funding. Ms. Rodrigues suggested the Select Board write a letter to support the application. Ms. Phillips stated she would like to mention the need to make safe crossing and provide a bridge for those who want to use it. Mr. Vaillancourt mentioned putting a fence down the middle of the median to deter the students from going that way. Ms. Smedile suggested Merrimack College run a fence along Route 114 which will help the students on campus and elevate the look of the campus. Mr. Nobile asked Ms. Rodrigues what the timeline is. Ms. Rodrigues stated they may need to apply for the second time if it doesn't get funded this year. Mr. Nobile asked if anyone from the Senators’ offices went to Merrimack College or lived in North Andover that they may be able to speak about it. Ms. Bates asked to have the senators come to a meeting. MOTION: Mr.Nobile motioned provide a letter of support for the Congressional Funding application of Merrimack College for a pedestrian footbridge over Route 114. Ms. Phillips seconded. Motion approved 5-0. LICENSING MOTION: Mr. Nobile motioned to open a meeting of the North Andover Licensing Commission. Ms. Phillips seconded. Motion approved 5-0. Application from Deborah Ingalls of Butlers and Bars for two one day all alcohol liquor licenses for wedding receptions on May 14, 2022 and June 11, 2022 from 5:00PM to 10:00PM and request for a waiver of the police detail Mr. Nobile stated Lt. Lanen suggested a police detail. Ms. Phillips asked why it was not under their catering license. Ms. Rodrigues stated it was booked before their catering license went into effect. MOTION: Ms. Phillips motioned to approve the application from Deborah Ingalls of Butlers and Bars for two one day all alcohol liquor licenses for wedding receptions on May 14, 2022 and June 11, 2022 from 5:00PM to 10:00PM and approve the request for waiver of the police detail. Ms. Bates seconded. Motion approved 5-0. Application from Ashley Piazza of Smolak Farms to extend their entertainment license hours on Thursday, September 1, 2022 until 10:00PM Ashley Piazza was present at the meeting. Mr. Vaillancourt suggested to notify neighbors of the extended hours. Ms. Piazza stated she would notify neighbors. MOTION: Mr. Vaillancourt motioned to approve the application of Ashley Piazza of Smolak Farms to extend their entertainment license hours on Thursday, September 1, 2022 until 10:00PM with notice to neighbors. Ms. Smedile seconded. Motion approved 5-0. Application from Robert Holland for renewal of a junk dealer/collector license for 114 Jewelry and Antiques located at 2350 Turnpike Street MOTION: Mr. Vaillancourt motioned to approve the application from Robert Holland for renewal of a junk dealer/collector license for 114 Jewelry and Antiques located at 2350 Turnpike Street. Ms. Smedile seconded. Motion approved 5-0. MOTION: Ms. Bates motioned to close a meeting of the North Andover Licensing Commission. Ms. Phillips seconded. Motion approved 5-0. CONSENT ITEMS Accept donation in the amount of $17,935.00 from Joseph N. Hermann Youth Center, Inc. to the Youth Center for program and membership scholarships MOTION: Mr. Vaillancourt motioned to accept consent item. Mr. Nobile seconded. Motion approved 5-0. 2 SELECT BOARD MINUTES April 27, 2022 APPROVAL OF OPEN SESSION MINUTES OF APRIL 11, 2022 MOTION: Mr. Nobile motioned to approve the Open Session minutes of April 11, 2022. Ms. Phillips seconded. Motion approved 5-0. OLD BUSINESS Ms. Rodrigues discussed who will make presentations at Town Meeting. Mr. Nobile asked Ms. Rodrigues to speak with the Town Moderator and confirm time limit. Ms. Bates asked if questions are being taken yet. Ms. Rodrigues stated questions will be able to be emailed ahead of time and during the meeting. All questions not completed will be put in an FAQ. Town Manager’s Report - National Take Back Prescription Day is Saturday 4/30 - Town Meeting start time is 6:30PM - Warrant Article of the Day are being done daily on social media - COVID cases are on the rise Select Board Update th - Ms. Smedile reminded that the upcoming 375 Anniversary Gala is on 5/13 - Ms. Phillips mentioned the Town Wide Cleanup on Sunday 5/1 ADJOURNMENT MOTION: Mr. Vaillancourt made a MOTION, seconded by Mr. Nobile to adjourn the Select Board meeting at 7:49PM.
